    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Al no haberse presentado reclamaciones durante el plazo de exposición al público, queda automáticamente elevado a definitivo el Acuerdo plenario inicial aprobatorio de la aprobación de la Ordenanza reguladora de la prestación patrimonial de carácter no tributario del servicio de parking subterráneo, cuyo texto íntegro se hace público, para su general conocimiento y en cumplimiento de lo dispuesto en el artículo 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;“ORDENANZA REGULADORA DE LA PRESTACIÓN PATRIMONIAL DE CARÁCTER PÚBLICO NO TRIBUTARIO DEL SERVICIO DE PARKING SUBTERRÁNEO&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 1. Fundamento y Régimen Jurídico&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;En uso de las facultades contenidas por los artículos 133.2 y 142 de la Constitución, el artículo 84.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y de conformidad con lo dispuesto en el artículo 20.6 en relación con los artículos 15 a 19 del Texto Refundido de la Ley Reguladora de las Haciendas Locales aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, y la disposición adicional primera de la Ley 58/2003, de 17 de diciembre, General Tributaria, este Ayuntamiento establece la prestación patrimonial no tributaria por la prestación de servicios en el parking subterráneo.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTÍCULO 2.&lt;strong&gt; &lt;/strong&gt;Presupuesto de hecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Constituye el presupuesto de hecho de la prestación patrimonial de carácter público no tributario, del que surge la obligación de pago, la prestación de los siguientes servicios:&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;-&amp;nbsp;Estancia horaria para coches y motocicletas tarificada por minuto: es la denominada estancia&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;por rotación. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Estancias de duración determinada: son servicios de aparcamiento, denominados comercialmente como bonos de rotación que permiten el uso sin limitaciones del parking en el periodo que establezca el tipo de bono.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Estacionamiento de vehículos para estancias de corto/medio plazo.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Servicio de lavadero.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Servicio de aspirado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Servicio de verificación de presión de neumáticos e inflado.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Servicio de carga de vehículos eléctricos.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Equipo arrancador de baterías para coches.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;-&amp;nbsp;Servicio de alquiler de trasteros.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Otros servicios. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 3. Obligados al pago&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Son obligados al pago, las personas físicas y jurídicas así como las entidades a que se refiere el artículo 35.4 de la L.G.T. que soliciten o resulten beneficiados o afectados por los servicios o utilicen las instalaciones citadas.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 4. Responsables&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;En relación con la responsabilidad solidaria y subsidiaria de las prestaciones patrimoniales, se estará a lo establecido en los artículos 41, 42 y 43 de la Ley 58/2003, de 17 de diciembre, General Tributaria, de acuerdo con la remisión a esta norma efectuada por el artículo 10 de la Ley 47/2003, de 26 de noviembre, General Presupuestaria.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 5. Tarifas&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La presente Ordenanza se regirá por las siguientes tarifas:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;La obligación de pagar las tarifas nace desde el momento en que se inicie la prestación del correspondiente servicio, sin perjuicio de que según el tipo de tarifa pudiera exigirse un depósito al solicitarse el servicio.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 7. Administración y cobranza&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;La administración y cobranza de las tarifas se realizará por la empresa concesionaria/contratista o encargada de la gestión de los servicios de gestión y explotación del aparcamiento.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 8. Normas de gestión&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La prestación del servicio, así como los derechos y obligaciones básicas entre la entidad prestadora del servicio y los usuarios del aparcamiento subterráneo y en general todas las normas de gestión de las prestaciones patrimoniales de carácter público no tributario del aparcamiento, se ajustará a lo que establezca el correspondiente &lt;span style="background-color:white"&gt;reglamento del servicio y los pliegos de condiciones del contrato o el encargo de gestión.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 9. Recaudación en período ejecutivo&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Finalizado el plazo de pago de las tarifas en voluntaria, sin que hayan sido abonadas, se iniciará el período ejecutivo, siendo exigidas por procedimiento de apremio, declaración para la que se formalizará el oportuno expediente de acuerdo con lo que prevé el vigente Reglamento General de Recaudación.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;ARTÍCULO 10. Infracciones y sanciones&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;En todo lo relativo a la calificación de infraccions tributaries, así como las sanciones que correspondan en cada caso se estará a lo dispuesto en los artículo 181 y siguientes de la Ley General Tributaria.&lt;/em&gt;&lt;/p&gt;
