    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aprobadas en Junta de Gobierno Local de día 12 de mayo de 2023, la Bases reguladoras de las subvenciones de las Áreas de Cultura y Juventud para el año 2023, se hace pública la presente convocatoria:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;"BASES REGULADORAS DE LAS SUBVENCIONES DE LAS ÁREAS DE CULTURA Y JUVENTUD PARA EL AÑO 2023&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PRIMERA.- COMPETENCIA Y MOTIVACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las subvenciones dirigidas a las entidades culturales y de juventud tienen como objetivo apoyar las iniciativas culturales y juveniles de las asociaciones inscritas en el registro municipal de entidades del Ayuntamiento de Andratx, fomentar y dinamizar los diferentes núcleos de nuestro municipio, potenciar la relación con los diversos públicos culturales e impulsar proyectos sociales que utilicen el arte y la cultura como herramienta de transformación social, así como empoderar a los jóvenes como futuro transformador de nuestro municipio, promover el ocio y dinamizar la gente joven de nuestro municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las subvenciones dirigidas a las entidades culturales y de juventud de nuestro municipio guardan relación directa con las competencias municipales fijadas en el artículo 25.1 y 25.2 letra m) de la ley 7/1985 reguladora de las bases de régimen local de promoción de actividades o instalaciones culturales y deportivas; ocupación del tiempo libre; turismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGUNDA.- OBJETO Y FINALIDAD DE LA CONVOCATORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presente convocatoria de subvenciones dirigida a las entidades culturales y juveniles del municipio de Andratx para el ejercicio 2023 tiene por objeto:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Fomentar las actividades culturales, juveniles, lúdicas y sociales, de las asociaciones inscritas en el registro municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Fomentar la participación ciudadana en el municipio de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Fomentar el tejido asociativo en el municipio de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Fomentar la igualdad de género a las actividades de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.- Fomentar proyectos sociales que utilicen el arte y la cultura como herramienta de transformación social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCERA.- BENEFICIARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Pueden solicitar las subvenciones objeto de esta convocatoria las asociaciones o entidades culturales o juveniles del municipio de Andratx legalmente constituidas, sin ánimo de lucro, e inscritas en el Registro Municipal de Asociaciones del Ayuntamiento, y que tengan su domicilio social situado en el municipio de Andratx y que proyecten realizar actividades, proyectos o programas objeto de la presente convocatoria de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CUARTA.- REQUISITOS DE LOS BENEFICIARIOS DE LAS SUBVENCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para poder ser beneficiario de las subvenciones, las entidades beneficiarias deben cumplir los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- No estar afectadas por ninguna de las prohibiciones del art. 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Estar al corriente en cuanto a las obligaciones tributarias y económicas, con la Seguridad Social, la Agencia Tributaria y con el ayuntamiento de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con respecto al Ayuntamiento de Andratx, una vez finalizado el plazo para la presentación de las solicitudes, el Tesorero del Ayuntamiento expedirá de oficio certificación acreditativa de si los peticionarios están al corriente de sus obligaciones fiscales con este Ayuntamiento y no son deudores al mismo por cualquier otro concepto no tributario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los peticionarios que no estuvieran al corriente de sus obligaciones, tendrán 5 hábiles para enmendar la deficiencia detectada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El cumplimiento de los requisitos anteriores se acreditará en la forma prevista en el apartado noveno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;QUINTA.- ACTIVIDADES Y GASTOS OBJETO DE SUBVENCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el objeto y la finalidad de esta convocatoria, son gastos subvencionarles:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Gastos derivados de la realización de actividades culturales, juveniles, o sociales dentro del término de Andratx, o fuera de Andratx en caso de representación del municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Gastos derivados de la adquisición y mejora de bienes muebles e inmuebles inventariables y en locales donde se desarrolle la actividad, necesarios para la ejecución de las actividades descritas, debidamente justificadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Gastos derivados del pago de monitores y profesionales necesarios para el desarrollo de las actividades descritas al proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Los gastos subvencionarles se tendrán que haber efectuado en el periodo comprendido entre el día 1 de octubre del año anterior al de la convocatoria, y el día 1 de octubre del año en curso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;En cuanto a los proyectos Culturales:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.-&lt;strong&gt; &lt;/strong&gt;Favorecer actividades complementarias a la oferta municipal: Actividades con un programa cultural de cualquier ámbito artístico que den respuesta a una demanda social que complementen la oferta cultural municipal y que, por lo tanto, cubran actividades con poca oferta o inexistente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Favorecer actividades culturales con finalidad inclusiva y de acción social. Actividades culturales o artísticas que fomenten la atención a las diversidades, el desarrollo personal, la accesibilidad y los proyectos comunitarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Favorecer actividades que incentiven el desarrollo social sostenible resaltando la diferencia como valor, riqueza, oportunidad y descubrimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Favorecer acciones artísticas y culturales enfocadas a la innovación social y la creatividad como herramienta de apoderamiento de la ciudadanía y de transformación social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.- Favorecer programas de actividades culturales innovadores y que comporten la relación entre colectivos y/o entidades de la población.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.- Potenciar actividades de recuperación y mantenimiento de aspectos vinculados a la cultura popular y tradicional de la población.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.- Potenciar actividades de recuperación y/o conservación de aspectos del patrimonio cultural local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;En cuanto a los proyectos de Juventud: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Promover el ocio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Fomentar las actividades encaminadas al conocimiento y la integración en el medio natural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Creación de las nuevas entidades y/o propuestas de dinamización de la gente joven del municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4.- Propuestas de actividades y/o actuaciones conjuntas entre varias entidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5.- Favorecer las propuestas que complementen los proyectos y las actividades que se llevan a cabo desde el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.- Favorecer las propuestas que avancen en la implantación de las TIC (tecnologías, información y comunicación) como herramientas de relación y comunicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.- Favorecer propuestas y actividades que avancen en la formación con el objetivo de mejorar y promocionar el asociacionismo la participación ciudadana en la vida de la población o del barrio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;8.- Favorecer las propuestas que avancen en la publicación, elaboración de materiales para la divulgación de los diferentes proyectos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;9.- Promocionar la integración de jóvenes en actividades culturales, deportivas y de tiempo libre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Consideraciones a tener presente para todos los proyectos:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Si durante la ejecución del Proyecto o actividad financiado por la presente convocatoria de subvenciones, a causa de fuerza mayor o por motivos ajenos a la entidad o asociación, se produjera la imposibilidad de ejecutar la actividad o proyecto, se tendrá que comunicar inmediatamente al Ayuntamiento, a efectos de aprobación por parte de la Junta de Gobierno, si se tercia, el cambio de actividad propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Serán gastos subvencionables los &lt;/span&gt;&lt;span style="color:#000000"&gt;establecidos&lt;/span&gt;&lt;span style="color:#000000"&gt; en el articulo 31 de la ley 38/2003 de 17 de noviembre General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEXTA.- CUANTÍA Y CRÉDITO PRESUPUESTARIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El importe de la presente convocatoria de subvenciones está financiada por la aplicación presupuestaria &lt;span style="color:#000000"&gt;330.48920 del Presupuesto para el año 2023, con un importe máximo de 60.000€. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atendidas las disponibilidades presupuestarias, el importe máximo de la subvención a conceder a las entidades o asociaciones objeto de la presente convocatoria no podrá ser superior a los 6.500.- euros, por entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les entitats podran subcontractar l'activitat objecte de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La actividad subvencionada, que el beneficiario subcontrate con terceros, no podrá exceder el 90% del total de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las entidades podrán concertar con personas o entidades vinculadas con el beneficiario siempre y cuando el importe subvencionable no exceda del coste concertado con la entidad o persona vinculada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SÉPTIMA.- RÉGIMEN DE CONCESIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las subvenciones objeto de esta convocatoria se otorgarán en régimen de concurrencia competitiva, mediante la comparación y puntuación de las solicitudes presentadas por los interesados de acuerdo con los criterios establecidos al apartado décimo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;OCTAVA.- PLAZO PARA PRESENTACIÓN DE LAS SOLICITUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El plazo de presentación de solicitudes será de 20 días hábiles contados a partir del día siguiente de haber publicado el extracto de esta convocatoria en el Boletín Oficial de las Islas Baleares. Si el último día es inhábil, se entiende prorrogado hasta el primer día hábil siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;NOVENA.- LUGAR Y FORMAS DE PRESENTACIÓN DE LAS SOLICITUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las solicitudes se deben presentar de acuerdo con lo que establece el articulo 16.4 de la Ley 39/2015 del 1 de octubre, del procedimiento administrativo común de las administraciones públicas. TELEMATICAMENTE: a través de la sede electrónica del ayuntamiento de Andratx (&lt;/span&gt;&lt;/span&gt;https://andratx.sedelectronica.es/)&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt; según su trámite especifico establecido. Para poder llevar a cabo un registro telemático hay que disponer de un certificado electrónico o DNI electrónico i &lt;/span&gt;&lt;/span&gt;Cl@ave&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt; pin. (obligatorio para los sujetos obligados a relacionarse electrónicamente con las administraciones por el artículo 14.2 y 3 de la ley 39/2015 del 1 de octubre, del procedimiento administrativo común de las Islas Baleares)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las solicitudes se tendrán que presentar de acuerdo con el modelo establecido para esta convocatoria, junto con los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Instancia, firmada por el peticionario o representante legal de la entidad, en la cual se hará constar el proyecto, programa o actividad para la cual se solicita la subvención. (Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Programa detallado del proyecto, actividad o servicio, con expresión de la finalidad que se persigue, el número de personas a quienes se dirige y los medios humanos y materiales, y subvención solicitada. (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Presupuesto total de ingresos y gastos, y desglosado por partidas de la actividad a realizar e indicación del importe de la subvención solicitada. (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) CIF de la entidad solicitante, y de la persona que firma la misma como representante de la entidad representada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Acreditación del representante de la entidad o asociación (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Declaración jurada de las subvenciones o ayudas que se vayan a obtener para la misma finalidad, procedentes de cualquier administración o entidad pública o privada, o bien de la no obtención de ninguna ayuda con la misma finalidad. (Anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;g) Acreditar que se encuentra al corriente en el cumplimiento de sus obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;h) Declaración responsable de no incurrir en ninguno de las prohibiciones para obtener la condición de beneficiaria de una subvención. (Anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;i) SEPA, Certificado de la entidad bancaria en el que se hará constar el número de cuenta y su titular. (Anexo VI).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DÉCIMA.- CRITERIOS DE VALORACIÓN DE LAS SOLICITUDES &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para la concesión de subvenciones se tendrán en cuenta los siguientes criterios hasta obtener un máximo de 100 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Se valorará de 0 a 100 puntos la adecuación a las finalidades de la convocatoria del proyecto presentado, la amplitud de la población destinataria y el número de actividades propuestas, los proyectos que fomenten la participación ciudadana y de las asociaciones, la colaboración con el Ayuntamiento para promover actividades que repercutan en el beneficio del municipio, la originalidad y la novedad del proyecto, las actividades que fomenten de la igualdad de género y las actividades que fomenten la integración social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;UNDÉCIMA.- DETERMINACIÓN DEL IMPORTE INDIVIDUAL DE LAS SUBVENCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El total de la subvención resultará de la aplicación de los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1,- Se valorará cada proyecto presentado de acuerdo con los criterios establecidos en el apartado décimo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2,- De acuerdo con los puntos obtenidos con el proyecto presentado, este mismo % será el que se recibirá de la subvención solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3,- La subvención obtenida nunca puede ser superior a los 6.500.-€, en caso de no existir crédito presupuestario suficiente, todas las subvenciones se prorratearán para poder dar el máximo de cobertura a todas, según el % obtenido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4,- En ningún caso, el importe de las subvenciones podrá ser de tal cuantía que, aislada o en concurrencia con subvenciones o ayudas otras Administraciones Públicas, u otros entes públicos o privados, supere el coste de la actividad a desarrollar por el beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DÉCIMO SEGUNDA.- OBLIGACIONES DE LOS BENEFICIARIOS.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Son obligaciones de los beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Cumplir el objetivo, ejecutar la totalidad del proyecto, realizar la actividad o adoptar el comportamiento que fundamenta la concesión de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Justificar ante el Ayuntamiento de Andratx el cumplimiento de los requisitos y condiciones, la realización de la actividad y el cumplimiento de la finalidad que determinen la concesión o disfrutar de la subvención mediante la documentación establecida en su punto 14 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Someterse a las actuaciones de comprobación, a efectuar por el Ayuntamiento de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) En el caso de adquisición de material inventariable incluido en el proyecto subvencionado, el periodo durante el cual el beneficiario tiene que destinarlo al fin concreto por el al cual se concedió la subvención, no podrá ser inferior a dos años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Comunicar en el Ayuntamiento de Andratx la obtención otras subvenciones, ayudas, ingresos o recursos que financien las actividades subvencionadas. Esta comunicación deberá de efectuarse tan pronto como se conozca y, en todo caso, con anterioridad a la justificación de la aplicación dada a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Acreditar con anterioridad a dictarse la propuesta de resolución de concesión que se encuentra al corriente en el cumplimiento de sus obligaciones tributarías y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;g) Disponer de los libros contables, registras diligencias y otros documentos debidamente auditivos en los términos exigidos por la legislación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;h) Conservar los documentos justificativos de la aplicación de los fondos recibidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;i) Hacer el reintegro de los fondos percibidos en los supuestos contemplados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;j) Las actividades o servicios subvencionados tendrán que estar realizados antes del el 1 de octubre del año de su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;k) El beneficiario está obligado a hacer constar en la documentación y propaganda impresa, radiofónica o audiovisual que la actividad comporte, la expresión «con la colaboración del Ayuntamiento de Andratx». Los carteles, dípticos o anuncios se tendrán que editar, al menos, en lengua catalana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El hecho de rendir cuentas al Tribunal de Cuentas, de los preceptores de subvenciones, se instrumentará mediante el cumplimiento de la obligación de justificación al órgano que ha concedido o entidad colaboradora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DÉCIMO TERCERA.- ÓRGANOS COMPETENTES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las Áreas competentes emitirán una de evaluación técnica, y emitirán un informe, mediante el cual, la regidora delegada, emitirá propuesta provisional de concesión de subvenciones que será trasladada a las entidades para que puedan formular alegaciones en el plazo de diez días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En caso de que haya alegaciones, el departamento competente las estudiará y emitirá un nuevo informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El órgano competente para dictar resolución de concesión es la Junta de Gobierno Local, que resuelve a partir de la propuesta definitiva de la regidora de Cultura.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DÉCIMO CUARTA.- FORMA DE JUSTIFICACIÓN DE LAS SUBVENCIONES -&lt;/strong&gt; &lt;strong&gt;LA CUENTA JUSTIFICATIVA DEL GASTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.- Aportaciones de financiación del proyecto subvencionado.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El presupuesto de la actividad presentado por el solicitante, sirve de referencia para la determinación final del importe de la subvención, que se calcula como un porcentaje del coste final de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.- Forma y plazo de justificación.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Toda la documentación relativa a la justificación debe presentarse de acuerdo con lo que establece el articulo 16.4 de la Ley 39/2015 del 1 de octubre, del procedimiento administrativo común de las administraciones públicas. TELEMATICAMENTE: a través de la sede electrónica del ayuntamiento de Andratx &lt;/span&gt;&lt;/span&gt;https://andratx.sedelectronica.es/)&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt; según su trámite especifico establecido. Para poder llevar a cabo un registro telemático hay que disponer de un certificado electrónico o DNI electrónico i &lt;span style="color:#000080"&gt;Cl@ave&lt;/span&gt; pin. (obligatorio para los sujetos obligados a relacionarse electrónicamente con las administraciones por el artículo 14.2 y 3 de la ley 39/2015 del 1 de octubre , del procedimiento administrativo común de las Islas Baleares)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con anterioridad al 31 de octubre del año en curso, hay que presentar en el SAC mediante instancia de justificación, según modelo, adjuntando a la misma la cuenta justificativa del gasto efectuado (Anexo 7), que contendrá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A) MEMORIA detallada de la actividad realizada y declaración que no han percibido ni se ha solicitado ninguna otra subvención pública o privada por la actividad objeto de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;B) JUSTIFICANTES DEL GASTO.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Facturas u otros documentos de valor probatorio equivalente con validez en el tráfico jurídico mercantil o con eficacia administrativa. La fecha de las facturas puede ir de octubre del 2022 a octubre del 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Requisitos que deben que reunir las facturas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Ser originales o fotocopias compulsadas por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Tener el concepto del gasto relacionado con el presupuesto presentado en base al cual la Junta de Gobierno concede la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Estar datadas entre octubre de 2022 y octubre del 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Contener el código o número de identificación fiscal del preceptor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Presentar justificando de pago donde quede claramente especificado o demostrado que las facturas están pagadas, mediante transferencia o ticket que especifique claramente que está debidamente pagado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el supuesto de que el total de los documentos justificativos presentados fuera inferior al Proyecto presentado por el solicitante, de forma que se dedujera que la cuantía de la subvención concedida fuera superior al gasto real del proyecto, el Ayuntamiento podrá reducir proporcionalmente el importe de la subvención concedida conforme a los justificantes presentados y al porcentaje concedido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;C) DECLARACIÓN RESPONSABLE DE LA REALIZACIÓN DEL PROYECTO SUBVENCIONADO Y Otras SUBVENCIONES RECIBIDAS (Anexo 8).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DECIMOQUINTA.- INFRACCIONES Y SANCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El incumplimiento de los requisitos establecidos en estas bases o en la normativa de aplicación da lugar a la aplicación del régimen de infracciones y sanciones establecido a los capítulos noveno y décimo de la ordenanza municipal reguladora de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DECIMOSEXTA.- RÉGIMEN JURÍDICO APLICABLE.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En todo lo no previsto en las presentes Bases, será de aplicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;• La Ley 38/2003 de 17 de noviembre, General de Subvenciones. (BOE núm.276 de 18-11-2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;• El Real Decreto 887/2006, de 21 de julio por el cual se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (BORO núm.176, de 25-07-2006). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;• Ley 39/2015, de fecha 1 de octubre 2015 del Procedimiento Administrativo Común de las Administraciones Públicas."&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
