    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Habiendo transcurrido el plazo de treinta días de exposición pública de la aprobación inicial de la Ordenanza fiscal reguladora de la tasa por expedición de documentos administrativos y utilización de fotocopiadora, sin presentación de alegaciones, se ha aprobado definitivamente el reglamento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por tal motivo y, en cumplimiento de lo dispuesto en los artículos 102 y 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, junto con lo establecido en los artículos 49 y 70.2 de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, a continuación, se publica el texto íntegro de la mencionada Ordenanza:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA FISCAL REGULADORA DE LA TASA POR EXPEDICIÓN DE DOCUMENTOS ADMINISTRATIVOS Y UTILIZACIÓN DE FOTOCOPIADORA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;FUNDAMENTO LEGAL&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Artículo 1.º&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En conformidad con el art. 20 de la Ley 39/1988, de 28 de diciembre, se establece la tasa en forma de sello municipal, que grabará todos los documentos que a instancia de parte se expidan o se entreguen a la Administración o Autoridades Municipales.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;OBLIGACIÓN DE CONTRIBUIR&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Artículo 2.º&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Hecho imponible. La actividad municipal llevada a cabo con motivo de la tramitación, a instancia de parte, de los documentos que se expidan o que se libren a la Administración o a las Autoridades municipales, así como la utilización de fotocopiadora.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La obligación de contribuir se originará en el momento de presentación de la solicitud que inicie el expediente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Sujeto pasivo. Las personas naturales o jurídicas que soliciten, provoquen o en interés de las cuales se efectúe la tramitación de un expediente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las cuales se refieren los art. 38 y 39 de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Serán responsables subsidiarios los administradores de las sociedades o los síndicos, interventores o liquidadores de deudas, concursos, sociedades y entidades en general, en los supuestos y con la extensión que señala el arte. 40 de la Ley General Tributaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;BASES Y TARIFAS&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Artículo 3.º&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Constituirá la base de la presente exacción la naturaleza de los expedientes a tramitar y documentos a expedir.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Artículo 4.º&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el proceso de renovación de los “Libros de derechos funerarios”, a aquellas personas que aporten el libro antiguo se les expedirá el nuevo sin ningún coste; las personas que no puedan aportar el libro antiguo, pagarán la tarifa correspondiente a la primera copia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;DISPOSICIÓN DEROGATORIA&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda derogada cualquier previsión normativa que entre en contradicción con este articulado, siempre que sea de rango igual e inferior, y de forma exprés la Ordenanza fiscal reguladora de la tasa por expedición de documentos administrativos y utilización de fotocopiadora y fax publicada en el BOIB 54 de 3 de mayo de 2018.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;DISPOSICIÓN FINAL&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta Ordenanza entrará en vigor a partir de su publicación en el Boletín Oficial de las Islas Baleares, permaneciendo en vigor hasta su modificación o derogación expresa.&lt;/span&gt;&lt;/p&gt;
