&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mediante Resoluciones de la consejera de Presidencia, Función Pública e igualdad de 9 de marzo de 2023 se aprobaron los contenidos, el desarrollo, la metodología, la duración, la evaluación y el régimen interno de los cursos de capacitación para el acceso a las categorías de mayor y comisario de policía local para el año 2023 (BOIB núm.31, de 11 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Mediante Resoluciones de la Dirección gerencia de la Escuela Balear de Administración Pública de 16 de marzo de 2022 se aprobaron las convocatorias de las promociones de los cursos de capacitación para acceder a las categorías de mayor y de comisario del cuerpo de policía local para el año 2023( BOIB n.º 36, de 21 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este sentido y de acuerdo con la base primera de ambas convocatorias, la EBAP inscribió de oficio, atendidas las solicitudes del Ayuntamiento de Palma, al sr. Guillermo Mascaró Ferrer (curso de capacitación categoría de mayor) y a la sra. Antonia Barceló Estelrich (curso de capacitación categoría de comisario). Por cuestiones de cariz organizativo, los mencionados cursos se han duit a término en el Instituto Valenciano de Seguridad Pública y Emergencias (IVASPE).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En fecha 27 de febrero de 2023 empezaron ambos cursos y en fecha 24 de marzo finalizaron.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En fecha 27 de abril de 2023 el Instituto Valenciano de Seguridad Pública y Emergencias (IVASPE) ha emitido los diplomas acreditativos de la superación, por parte del Sr.Mascaró Ferrer y de la Sra. Barceló Estelrich, de los cursos de capacitación para el acceso a la categorías de mayor y comisario, respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En fecha 11 de mayo la Comisión de Evaluación y Actualización de los Cursos de Capacitación de las Diferentes Categorías de Policía Local acordó elevar a la consejera de Presidencia, Función pública e igualdad la propuesta definitiva de la persona que ha superado el curso de capacitación para el acceso a la categoría de mayor y de la persona que ha superado el curso de capacitación para el acceso a la categoría de comisario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de Derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los artículos 34.3 y 28.3 de la Ley 4/2013, de 17 de julio, de coordinación de las policías locales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 159 del Reglamento marco de coordinación de las policías locales de las Illes Balears, aprobado por el Decreto 40/2019, de 24 de mayo, por el cual se aprueba el Reglamento marco de coordinación de las policías locales de las Illes Balears y se modifica el Decreto 55/2017, de 15 de diciembre, del Fondo de Seguridad Pública de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los artículos 177 y siguientes del Reglamento marco de coordinación de las policías locales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La resolución de la consejera de Presidencia, Función Pública e igualdad, de 9 de marzo de 2023, por la cual se aprueba el contenido, el desarrollo, la metodología, la duración, la evaluación y el régimen interno del curso de capacitación para el acceso a la categoría de mayor de policía local (BOIB n.º 31, de 11 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La resolución de la consejera de Presidencia, Función Pública e igualdad, de 9 de marzo de 2023, por la que se aprueba el contenido, el desarrollo, la metodología, la duración, la evaluación y el régimen interno del curso de capacitación para el acceso a la categoría de comisario de policía local (BOIB n.º 31, de 11 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Los artículos 4.1 y 5.9 de los Estatutos de la Escuela Balear de Administración Pública, aprobados por el Decreto 31/2012, de 13 de abril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar la lista definitiva con la persona que ha superado el curso de capacitación para acceder a la categoría de mayor del cuerpo de policía local para el año 2023 que figura relacionada en el anexo 1 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprobar la lista definitiva con la persona que ha superado el curso de capacitación para acceder a la categoría de comisario del cuerpo de policía local para el año 2023 que figura relacionada en el anexo 2 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; y en la sede electrónica de la EBAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Presidencia, Función Pública e igualdad en el plazo de un mes a contar desde el día siguiente a la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante el Juzgado de lo contencioso-administrativo de Palma en el plazo de dos meses contadores desde el día siguiente a la publicación, de acuerdo con los artículos 8 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
