    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Junta de Gobierno del Consell Insular de Formentera, en sesión ordinaria celebrada el 12 de mayo de 2023, y en ejercicio de sus competencias, sobre la base de lo propuesto (conforme a la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas), de los artículos 132 y 28 de la Ley 4/2022, de 28 de junio,&amp;nbsp; de consejos insulares, y en virtud del Decreto de Presidencia de fecha 15 de octubre de 2021, aprobado por BOIB número 146, de 26 de octubre de 2021, mediante el cual se delegan competencias en la Junta de Gobierno, y del resto de atribuciones que le otorga la legislación vigente, adoptó, por unanimidad, el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;PRIMERO&lt;/strong&gt;. - APROBAR las bases que deben regir la convocatoria de concesión de ayudas económicas para compensar la doble/tripla insularidad para los estudiantes que cursen estudios fuera de la isla, siempre que éstos no se puedan hacer en Formentera y enseñanzas de Régimen especial, para el curso 2022-2023, que figura en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;. - APROBAR la convocatoria pública para la concesión de las subvenciones a que hace referencia el punto anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;. - APROBAR un gasto por un importe de 38.000 € (treinta y ocho mil euros), con cargo a la partida 2023/1/334/48000/01 de los presupuestos generales del Consell Insular de Formentera, para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;CUARTO&lt;/strong&gt;. - PUBLICAR las mismas en el Boletín Oficial de las Islas Baleares, en el Tablón de anuncios, en la página web de la corporación y en la Base de Datos Nacional de Subvenciones, a los efectos legales oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;“ANEXO&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Bases que deben regir la convocatoria de ayudas para compensar la doble/ triple insularidad para los estudiantes que cursen estudios fuera de la isla de Formentera para el curso 2022-2023&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto de la convocatoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Formentera cuenta con unas medidas de ayudas económicas para estudiantes que cursan estudios fuera de la isla de Formentera. Estas ayudas quieren corregir las desigualdades o los desequilibrios entre los estudiantes de la isla con los del resto de la comunidad autónoma y el Estado español, sobre todo teniendo en cuenta que en nuestra isla todavía no hay una oferta formativa al alcance de todas las inquietudes estudiantiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Desde el área de Educación del Consell Insular de Formentera, mediante convocatoria pública, se quieren otorgar unas ayudas que contribuyan a paliar la doble/triple insularidad de los gastos de estudiar fuera de la isla de Formentera. La voluntad es contribuir con esta ayuda en el coste económico que supone cursar estudios fuera del lugar de residencia habitual (manutención, material, libros, transporte en el lugar de estudio...), así como cualquier otro gasto complementario tanto para los estudiantes residentes de Formentera, y que viven fuera del lugar residencia habitual, como para los estudiantes que tengan que efectuar desplazamientos periódicos durante el curso académico y que residen en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Importe y crédito presupuestario&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a)&amp;nbsp; El importe que se destina a la ayuda tiene un crédito máximo de 38.000 € (treinta y ocho mil euros) habilitado con cargo a la partida presupuestaria 2023 / 1 / 334 / 48000 / 01 del presupuesto anual del Consell Insular de Formentera, para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) En el caso de que el importe de las ayudas aprobadas exceda el crédito del punto a), éste se podrá ampliar según las disponibilidades presupuestarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) En el caso de que el importe de las ayudas exceda la disponibilidad presupuestaria, todas ellas se reducirán de manera proporcional, en función del número de solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Importe de las subvenciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. MODALIDAD A – Ayudas a estudiantes que cursen sus estudios en Ibiza y en Universidades a distancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;La cuantía individual máxima de esta ayuda es de ciento cincuenta euros (150€)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. MODALIDAD B- Ayudas a estudiantes que cursen sus estudios fuera de las islas Pitiusas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;La cuantía individual máxima de esta ayuda es de quinientos euros (500€)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. MODALIDAD C – Ayudas a estudiantes que cursen estudios de las enseñanzas elementales o profesionales reglados de música o danza, fuera de la isla, siempre que éstos no se puedan hacer en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;La cuantía individual máxima de esta ayuda es de cien euros (100€)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Personas beneficiarias y requisitos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas que pueden beneficiarse de estas ayudas económicas deben cumplir los siguientes requisitos:&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El alumnado debe tener su domicilio familiar (empadronado) en la isla de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La unidad familiar debe estar empadronada en Formentera como mínimo los 12 meses anteriores a la presentación de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los estudios para los que se pueden solicitar las ayudas son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Estudios superiores en centros públicos o privados o en centros adscritos a ellos, fuera de la isla. Teniendo en cuenta que las enseñanzas de estudios superiores comprenden los: universitarios (grados, primer y segundo ciclo, posgrados y másteres), enseñanzas artísticas superiores y enseñanzas de formación profesional de grado superior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Enseñanzas de formación profesional o educación postobligatoria reglada, fuera de la isla, siempre que estos no se puedan hacer en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Enseñanzas de Régimen especial: Estudios de Artes Plásticas y Diseño y Estudios Deportivos (CF Grado Medio y CF Grado Superior).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Enseñanzas elementales o profesionales regladas de música o danza, fuera de la isla, siempre que estos no se puedan hacer en Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Los estudios deben realizarse fuera de la isla de Formentera de forma presencial o estar matriculado en estudios a distancia (modalidad A). Deben ser estudios en centros oficiales reconocidos por la Administración educativa y que se encaminen a la obtención de un título oficial con validez académica o profesional. Quedan excluidos los estudios que se puedan realizar presencialmente en Formentera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Estar matriculado/a, durante el curso 2022-2023, de los estudios establecidos en el punto 3 y 4 de este, y con los mínimos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Estudiantes universitarios y de enseñanzas artísticas superiores: al menos del 65 % de los créditos de este año previstos en el plan de estudios para un curso académico. No será motivo de denegación o desestimación la matriculación de menos del 65 % de los créditos establecidos para un curso académico cuando sean el resto de créditos a superar para obtener la titulación, lo cual se tendrá que hacer constar en la solicitud (Anexo 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Estudiantes de ciclos formativos (tanto de grado superior como de grado medio): el curso completo. No será motivo de denegación o desestimación no matricularse del curso completo cuando la matrícula sea de los últimos módulos necesarios para obtener la titulación, lo cual se tendrá que hacer constar en la solicitud (Anexo 1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Estudiantes de enseñanzas elementales o profesionales regladas de música o danza, fuera de la isla, siempre que estas no se puedan hacer en Formentera: el curso completo. No será motivo de denegación o desestimación cuando la matrícula sea en el Aula de Extensión del Conservatorio en Formentera del Conservatorio Profesional de Ibiza y Formentera y se tengan que cursar asignaturas en Ibiza que no se imparten en Formentera, lo que se tendrá que hacer constar en la solicitud (Anexo 1)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. No podrán obtener la condición de persona beneficiaria, las personas en las cuales concurran en alguna de las circunstancias previstas en el artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la Ley de subvenciones de las Islas Baleares, y en el artículo 13.2 de la Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Plazo de presentación de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo para presentar las solicitudes será de treinta días hábiles a partir del día siguiente de la fecha de publicación de estas bases en el Boletín Oficial de las Islas Baleares (BOIB), en cualquiera de las formas establecidas en el art. 30 de la ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, a partir de ahora (ley 39/2015 de 1 de octubre del PACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se aceptará ninguna solicitud fuera de este plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria también se hará pública en el tablón de anuncios y en la web del consell:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;www.consellinsulardeformentera.cat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Presentación de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las solicitudes deben formalizarse mediante los modelos normalizados que se adjuntan a estas bases como anexo I, anexo II, anexo III, correctamente cumplimentados y con la documentación original adecuada objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Se podrán presentar los documentos en la forma establecida según el art. 16 de la Ley 39/2015 de 1 de octubre del PACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;– De forma presencial mediante registro general electrónico de la Oficina de Atención Ciudadana (OAC), en la calle de Ramon Llull, 6, CP 07860 Sant Francesc Xavier, Formentera, del Consell Insular de Formentera, y en los restantes registros electrónicos de cualquier órgano administrativo público. Los documentos presentados de manera presencial ante las Administraciones Públicas serán digitalizados de acuerdo con el art. 27 y demás normativa aplicable de la Ley 39/2015 de 1 de octubre del PACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;– De forma telemática a través de la Oficina Virtual de Atención Ciudadana (OVAC), a la que se puede acceder desde la página web del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Documentación a presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.1 Documentación general obligatoria de las modalidades:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se tendrán que presentar debidamente cumplimentados los siguientes documentos preceptivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) &amp;nbsp;Modelo de solicitud, Anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) &amp;nbsp;Modelo de declaración responsable, Anexo II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Modelo de solicitud de transferencia bancaria, Anexo III, en el cual el estudiante debe figurar necesariamente como titular o cotitular de la cuenta bancaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) &amp;nbsp;Documento de la matriculación formalizada del curso 2022-2023, donde consten los datos del solicitante, y nombre de las asignaturas. &amp;nbsp;Se tendrá que cumplir el requisito académico de mínimo de matriculación indicado en el apartado 4.5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) &amp;nbsp;Documento realizado por el centro, si procede, en el caso de estudiantes que realicen la matricula del curso por menos del requisito académico de mínimo de matriculación indicado en el apartado 4 punto 5. &amp;nbsp;El centro deberá justificar el motivo por el que la matricula tiene un número de asignaturas inferior, y si se ha formalizado por un máximo del total del curso, de acuerdo con la organización administrativa del centro o del expediente académico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) &amp;nbsp;Documento del plan de estudios completo de la especialidad que se cursa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) DNI. En el caso de alumno/a extranjero: NIE o tarjeta de residencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) En el supuesto de que en el DNI/NIE no figure como localidad el domicilio del municipio de Formentera, certificado de convivencia que acredite la vecindad administrativa de la persona solicitante y el número de personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) En el caso de que en el DNI/NIE no conste la antigüedad de residencia que debe tener un mínimo de un año, se justificará mediante un certificado de empadronamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Requerimientos de la solicitud&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si los anexos o documentación requerida fueran incorrectos o incompletas, se requerirá al interesado para que, en un plazo de diez días, enmiende la falta o acompañe los documentos preceptivos, con indicación de que, si así no lo hace, se considerará que desiste de su petición, de acuerdo con el art. 68 y otros exigidos por la legislación específica aplicable de la Ley 39/2015 de 1 de octubre del PACAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Instrucción, resolución y publicidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor del procedimiento es el área de Educación del Consell Insular de Formentera, que debe llevar a cabo las actuaciones necesarias para la determinación, el conocimiento y la comprobación de los datos en virtud de los cuales debe dictarse resolución, en el marco del artículo 16 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez realizados los actos de instrucción que resulten oportunos, por parte de la Conselleria de Cultura y Educación, como área competente, con fundamento en el informe del técnico/jurídico, según corresponda, se redactarán las correspondientes propuestas de concesión de las ayudas que se elevarán a la Junta de Gobierno, como órgano competente para la concesión. En las propuestas se expresará la identificación de las personas beneficiarias y la cuantía, así como las solicitudes excluidas, con indicación de la causa de exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas se harán públicas en el tablón de anuncios de esta corporación, y en la página web del consell.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Casos especiales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes de casos especiales o excepcionales no previstos en estas bases serán objeto de resolución puntual por la Junta de Gobierno, con informe previo de los Servicios Técnicos/Jurídicos de este Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolución de concesión de las ayudas agota la vía administrativa y ante ésta se puede interponer, o bien, recurso potestativo de reposición ante el mismo órgano que la ha dictado, es decir, ante la Junta de Gobierno del Consell Insular de Formentera, en el plazo de un mes desde la notificación de la denegación o exclusión y en el tablón de anuncios,&amp;nbsp; o bien, recurso contencioso administrativo ante los juzgados de lo contencioso administrativo de Palma (Mallorca), en el plazo de dos meses desde la notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas que otorgue el Consell Insular de Formentera se harán efectivas mediante transferencia bancaria indicado por el adjudicado en el Anexo III.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Compatibilidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas ayudas serán compatibles con otras que se puedan recibir las personas beneficiarias, de otras administraciones o entidades, públicas o privadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Verificación y control&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas beneficiarias de las ayudas quedarán sometidas al régimen de obligaciones, intervenciones y sanciones que establecen el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, la Ley estatal 38/2003, de 17 de noviembre, general de subvenciones, el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el reglamento de la Ley 38/2003, y otra normativa que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son obligaciones, entre otras, de las personas beneficiarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.- Someterse a las actuaciones de comprobación de la entidad que concede la ayuda y las de control financiero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.- Acreditar la realización de la actividad al Consell Insular, así como el cumplimiento de los requisitos y las condiciones que determinen la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquier alteración de las condiciones tenidas en cuenta para conceder la ayuda podrá dar lugar a la modificación de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de estas obligaciones por parte de las personas beneficiarias, o la alteración sustancial de las condiciones determinantes del otorgamiento de la ayuda o la concurrencia de las causas de reintegro previstas en el artículo 11 del Decreto legislativo 2/2005, de 28 de diciembre, y en el artículo 37 de la Ley 38/2003, podrá dar lugar al reintegro de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Causas de reintegro&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se revocará la ayuda y se tendrá que reintegrar total o parcialmente el importe recibido por las personas beneficiarias y, en su caso, el interés de demora, en los siguientes casos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.- El incumplimiento de la finalidad para la que se conceda la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.- La obtención de la ayuda sin que se cumplan las condiciones requeridas o cuando se alteren las condiciones tenidas en cuenta para concederla, siempre que sea por causas imputables a la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.- La negativa de someterse a las actuaciones de control previstas o la obstrucción injustificada de estas actuaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para el reintegro se aplicarán los procedimientos previstos al efecto en la legislación de las finanzas, en los que se garantizará la audiencia a las entidades interesadas. Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigibles por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de la obligación de justificar la finalidad de ayuda económica recibida en la forma y los plazos establecidos supondrá, además del reintegro mencionado, la imposibilidad de participar en próximas convocatorias de ayudas mientras no se haga la devolución del importe reclamado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Régimen jurídico&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria se rige por estas bases y, en lo no previsto, por el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones de las Islas Baleares, por la Ley estatal 38/2003, de 17 de noviembre, general de subvenciones, el Real Decreto 887/2006, de 21 de julio,&amp;nbsp; por el que se aprueba el Reglamento de la Ley 38/2003, la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, Ley 40/2015, de 1 de octubre, de régimen del sector público, y toda la normativa vigente que sea de aplicación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Ley orgánica 3/2018, de 5 diciembre, de protección de datos de carácter personal y de garantía de los derechos digitales. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con la Ley orgánica 3/2018, de 5 diciembre, de protección de datos de carácter personal y de garantía de los derechos digitales, se pone de manifiesto que la información facilitada por los peticionarios de estas becas será tratada en un fichero debidamente protegido para la gestión de este programa. Las personas interesadas podrán solicitar a la administración el ejercicio de sus derechos de acceso, rectificación, cancelación y oposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con la presentación de la solicitud y el resto de la documentación requerida para participar en este programa, la persona interesada autoriza al Consell Insular de Formentera a facilitar los datos aportados a cualquier otra administración u organismo siempre que así lo requiera expresamente para el cumplimiento de sus obligaciones específicas y garantice, igualmente, la confidencialidad de la información.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
