&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El 17 de diciembre de 2022, en el BOIB n.º. 164, se publicó la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022 por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2023, para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El técnico de la Dirección General de Energía y Cambio Climático, en aplicación del procedimiento de concesión que establece el apartado séptimo de la Resolución mencionada, informaron desfavorablemente sobre la concesión de las subvenciones descritas en el anexo, con la motivación que también figura en él.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 17 de abril de 2023,&amp;nbsp; se emitió una Propuesta de resolución denegatoria del director general de Energía y Cambio Climático (BOIB nº.51, de 22 de abril de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 27 de abril de 2023 se publicó en el BOIB nº.54, una corrección de errores de la Propuesta de resolución denegatoria del director general de Energía y Cambio Climático de 17 de abril de 2023 .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Se ha agotado el plazo de diez días hábiles que se concedía para hacer alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022 por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2023, para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (BOIB n.º 164, de 17 de diciembre de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Denegar la concesión de una subvención a los beneficiaros que figuran en el anexo, de acuerdo con la motivación que también figura en él.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar la presente resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
