    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En fecha&lt;span style="background-color:white"&gt; 5 de mayo de 2023&lt;/span&gt;, el jefe del Servicio de la UDIT, ITV y Registro Industrial ha formulado la propuesta de resolución siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Las tarifas vigentes en 2022 que percibieron los laboratorios autorizados y el laboratorio oficial de las Illes Balears para el análisis y el contraste de objetos fabricados con metales preciosos son las aprobadas mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática publicada en el BOIB número 24, de fecha 18 de febrero de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El artículo 8 del Decreto 86/2009, de 1 de julio, que desarrolla el Reglamento de la Ley de objetos fabricados con metales preciosos, establece que es necesario actualizar anualmente estas tarifas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El artículo 39 de la Ley 11/2022, de 28 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2023, establece que las cuotas fijas de las tasas de la Comunidad Autónoma de las Illes Balears establecidas por normas de rango legal se tienen que mantener en la misma cuantía vigente en 2022. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. En fecha 01/12/2022 el Servicio de Registro Industrial solicitó al laboratorio oficial de las Illes Balears para el análisis y el contraste de objetos fabricados con metales preciosos, ITEB, y al Gremio de Joyeros y Relojeros, representados por Quimiotest, un informe sobre las tarifas vigentes que perciben los laboratorios de metales preciosos en otras comunidades autónomas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. En fecha 10/01/2023 la ITEB aportó el informe solicitado, número de registro de entrada GOIBE25267/2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. En fecha 30/03/2023, QUIMIOTEST, en nombre del Gremio de Joyeros y Relojeros, aportó su informe, en mano, a la jefa de sección III del Registro Industrial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. La Ley 17/1985, de 1 de julio, sobre objetos fabricados con metales preciosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El Real Decreto 197/1988, de 22 de febrero, por el que se aprueba el Reglamento de la Ley de objetos fabricados con metales preciosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El Decreto 86/2009, de 27 de noviembre, que desarrolla el Reglamento de la Ley de objetos fabricados con metales preciosos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. La Ley 11/2022, de 28 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Los laboratorios autorizados y el laboratorio oficial de las Illes Balears para el contraste y el marcaje de objetos fabricados con metales preciosos (en adelante, los laboratorios) han reivindicado en varias ocasiones un incremento del importe en las tarifas a percibir por su trabajo y que la Administración tiene que autorizar anualmente, en aplicación del Decreto 86/2009, de 27 de noviembre, de desarrollo de la Ley 17/1985, de 1 de julio, sobre objetos fabricados con metales preciosos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. En su momento, la Ley 5/2021, de 28 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2022, expuso en el artículo 39 que las tarifas se tenían que mantener en la misma cuantía que en 2022, y la Dirección General de Política Industrial resolvió no incrementar las tarifas de los laboratorios. Anteriormente, la Ley 3/2020, de 29 de diciembre, de presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2021, también había establecido en el artículo 39 que las tarifas se tenían que mantener en la misma cuantía que en 2021, y esta dirección general resolvió el mantenimiento de los precios para análisis. Este año, por tercera vez consecutiva, la Ley de aprobación de los presupuestos para el año 2023, congela las tasas y, ante esto, los laboratorios han trasladado al Servicio de Registro Industrial su dificultad para llevar a cabo su trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. En este sentido, los laboratorios señalan que todos los costes relacionados con los procesos del análisis de las piezas de oro, plata y platino se han modificado al alza: precio de la energía y de los equipos requeridos, así como su mantenimiento dentro de las exigencias de la normativa de metrología y calibración vigentes, personal calificado con titulación académica específica para las tareas de laboratorios, reactivos y material de referencia para pruebas y valoraciones, etc. Dado lo anterior, el importe a percibir por el laboratorio por la realización de sus tareas es muy inferior al coste que estas tareas originan y las tasas congeladas les obligan a trabajar en una situación de pérdida. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8. Hay que añadir que los precios por los análisis en los laboratorios de las Illes Balears son inferiores a los del resto de las comunidades autónomas, tal y como se muestra en la tabla siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En fecha 01/12/2022, el Servicio de Registro Industrial requirió de los laboratorios un informe relativo a los costes relacionados con el análisis y el contraste de objetos fabricados con metales preciosos. El informe presentado por el ITEB en relación con estas cuestiones propone un incremento de tarifas para hacer sostenible su actividad y para equipararla con otras comunidades autónomas. Igualmente, Quimiotest, en nombre del Gremio de Joyeros y Relojeros, aportó un informe con sus propuestas que se resume en la tabla siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se considera, por lo tanto, oportuno y necesario el incremento de los precios de las tarifas que han de percibir los laboratorios de las Illes Balears en relación con sus tareas de análisis de piezas de oro y plata en la manera que se indica en el anexo I de esta propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11. En cuanto al platino y a los servicios de asistencia a laboratorios y empresas y de asistencia a la intervención, no está prevista ninguna modificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12. Así, con la información y la documentación recibidas, se propone el incremento de tarifas a percibir por los laboratorios en sus tareas de análisis y contraste según queda indicado en el anexo I de esta propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Propuesta de Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Propongo al director general de Política Industrial que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Aprobar las tarifas que constan en el anexo I como tarifas a percibir por los laboratorios autorizados y el laboratorio oficial de las Illes Balears por el análisis y el contraste de objetos fabricados con metales preciosos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Incluir en la resolución la lista de laboratorios autorizados para el análisis y el contraste de objetos fabricados con metales preciosos, así como el laboratorio oficial de las Illes Balears, para cumplir el artículo 21 del Decreto 86/2009, según el anexo II de esta propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Publicar la Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
