    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De conformidad con lo establecido en el artículo 9.3 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y en el artículo 45 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, a continuación se hacen públicas las bases reguladoras de la convocatoria de subvención para el fomento de la prevención, la reutilización, la preparación para la reutilización y el reciclaje de residuos dirigida a entidades sin ánimo de lucro, para año 2023, aprobada por acuerdo del Consejo Ejecutivo del Consejo Insular de Eivissa, en fecha 27 de abril de 2023, siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Justificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La actividad subvencional es una de las formas más importantes de fomento que desarrollan las administraciones públicas, ya que las subvenciones representan la herramienta con la que se canaliza una parte importante de la actividad financiera del sector público, con el objetivo de dar respuesta a demandas sociales y económicas de personas y entidades públicas o privadas, así se recoge en la exposición de motivos de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tanto la Ley 7/2022, de 8 de abril, de Residuos y Suelos Contaminados para una Economía Circular, en el artículo 16, como la Ley 8/2019, de 19 de febrero, de Residuos y Suelos Contaminados de las Islas Baleares, en el artículo 22.1.h) atribuyen a las administraciones públicas, dentro del marco de sus competencias, la función de fomento en la prevención de la generación de residuos, la reutilización y reparación, la implantación de la recogida selectiva, la mejora de la gestión de los residuos y el impulso y refuerzo del mercado de productos procedentes de la preparación para la reutilización y del reciclado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Plan Director Sectorial de Prevención y Gestión de Residuos no Peligrosos de la isla de Eivissa (PDSPIGRE), aprobado por el Pleno del Consell Insular de Eivissa en sesión extraordinaria y urgente, de día 22 de junio de 2020, y publicado en el BOIB núm. 116, de 30 de junio de 2020, tiene como máxima prioridad la prevención de los residuos, seguida de su reutilización, preparación para su reutilización y reciclaje.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por su parte el PDSPIGRE en el artículo 6.3.d) atribuye al Consell Insular de Eivissa la actividad de fomento de las actividades públicas y privadas de prevención, reutilización, preparación para la reutilización y recogida separada de residuos en el ámbito territorial de la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En los últimos años se han llevado a cabo varios cambios que suponen una mejora importante en el modelo de gestión de los residuos de Eivissa, como es la puesta en funcionamiento de la Planta de Triaje y Tratamiento de Residuos y la implantación de la recogida de la fracción orgánica en la mayor parte de los municipios de la isla. Ahora bien, con el fin de alcanzar los objetivos fijados por la ley, es necesario llevar a cabo actuaciones específicas para prevenir la cantidad de residuos producidos, incrementar el porcentaje y la calidad de la recogida selectiva y disminuir la fracción rechazo depositada en el vertedero, alargando así su tiempo de vida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así, se desprende desde el Departamento de Gestión Ambiental del Consejo Insular de Eivissa la necesidad y la voluntad de fomentar proyectos y acciones llevados a cabo por parte de las entidades sin ánimo de lucro, enfocados a la prevención, la reutilización, la preparación por a la reutilización y reciclaje de residuos no peligrosos en la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Objecto &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de la convocatoria es fomentar la implantación de proyectos de prevención, reutilización, preparación para la reutilización y reciclaje de los residuos generados en la isla de Eivissa, para todos los flujos de residuos no peligrosos generados en la isla, mediante proyectos o actuaciones llevadas a cabo por las entidades sin ánimo de lucro, a fin de alcanzar los objetivos establecidos en la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Régimen jurídico&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria se regirá por las disposiciones contenidas en sus bases, y por la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante LPAC), por la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, por la Ley 38/2003, de 17 de noviembre, General de Subvenciones (LGS en adelante) y su Reglamento de desarrollo, aprobado por Real Decreto 887/2006, de 21 de julio (en adelante RLGS), y serán de aplicación el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones de las Illes Balears (TRLS en adelante) y el Real decreto 130/2019, de 8 de marzo, por el que se regula la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y otras ayudas públicas, y demás normativa aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, es de aplicación la Ley orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los Derechos Digitales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Dotación económica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. En el presupuesto del Consejo Insular de Eivissa aprobado para el ejercicio 2023 así como en el Plan estratégico de subvenciones, publicado en el BOIB núm. 12, de 26 de enero de 2023 (que tiene una vigencia de tres años), se prevé una convocatoria de subvención para el fomento de la prevención, la reutilización, la preparación para la reutilización y el reciclaje de residuos dirigida a entidades sin ánimo de lucro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. La cantidad máxima que se destina a la presente convocatoria para el año 2023 es de sesenta y cinco mil euros (65.000 €) del vigente presupuesto del Consell Insular de Eivissa, de los que 40.000 € son aportaciones para gasto corriente con cargo a la aplicación presupuestaria 1700 4890000 y 25.000 € son aportaciones para bienes inventariables con cargo a la aplicación presupuestaria 1700 78900. En caso de que no se agote la cantidad consignada en una de aplicaciones presupuestarias, el importe remanente puede transferirse en la otra aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.3. La cuantía máxima total a la que podrá aspirar cada entidad es de 10.000€, distribuidos en 6.000€ para gasto corriente y 4.000€ para bienes inventariables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.4. Una vez dictada la resolución definitiva de concesión de las ayudas, la cantidad sobrante, en su caso, podrá sumarse a cualquier otra convocatoria del Departamento de Gestión Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Actuaciones subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1. Serán objeto de subvención las actividades llevadas a cabo entre el día 1 de enero de 2023 y la fecha límite de justificación, ambos inclusive, y que se correspondan con el objeto de la convocatoria dentro de las líneas de actuación descritas en el apartado siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2. Actuaciones subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Acciones de sensibilización, información y/o formación para fomentar medidas de prevención y preparación para la reutilización de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Creación y fomento de espacios, actividades o redes que permitan promocionar la reutilización o preparación para la reutilización de productos o alquiler de materiales compartidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Campañas educativas para el fomento del consumo responsable (fomento de consumo de bienes y servicios inmateriales, mercados y tiendas de segunda mano, compra de bienes y servicios duraderos, uso de productos reparables y reciclables, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Medidas para el uso responsable del papel, desmaterialización de la información y reutilización de libros de texto y lectura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Actuaciones dirigidas a la prevención y reciclaje de la materia orgánica, como el compostaje doméstico y comunitario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f. Campañas de concienciación para un consumo responsable y reducir el desperdicio alimentario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g. Fomento y mejora de los circuitos de aprovechamiento de excedentes alimenticios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h. Acciones encaminadas a la preparación para la reutilización y reciclaje de residuos voluminosos (incluidos muebles y colchones).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Actuaciones dirigidas al fomento de la reutilización y reciclaje de determinadas fracciones de residuos (textiles, aceites de cocina, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j. Medidas para prevenir el consumo de envases y fomentar el uso de envases reutilizables (venta y consumo de productos a granel, venta y uso de envases o dispositivos reutilizables, u otras medidas, a fin de reducir la generación de residuos de envases).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k. Medidas dirigidas a sustituir productos plásticos desechables por productos reutilizables alternativos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l. Acciones encaminadas a frenar la generación de estiércol en el medio marino con el objeto de prevenir la contaminación marina por plásticos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;m. Elaboración de materiales didácticos (talleres, vídeos, audiovisuales, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;n. Talleres de reparación de productos o para reciclar residuos y convertirlos en nuevos objetos útiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;o. Otras actuaciones relacionadas con el objeto de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3. Características de las actuaciones objecto de subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Deben estar exclusivamente centradas en prevención, reutilización, preparación para la reutilización y reciclaje de los residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Deben estar claramente definidas, tanto desde el punto de vista técnico como económico, deben presentar un presupuesto justificado y deben ser perfectamente cuantificables, evaluables y controlables tanto en la fase de valoración como en la de seguimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Los mensajes que se difundirán deben incluir los beneficios ambientales y la forma de realizar las acciones de prevención, reutilización, preparación para la reutilización, reciclaje y mejora de la recogida selectiva de los residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Los elementos de difusión y materiales que se realicen en el marco del proyecto llevarán el distintivo del beneficiario de la subvención y el del Consejo Insular de Eivissa, que se puede consultar en la página web del Consejo Insular de Eivissa www.conselldeivissa. se.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Deben ser proyectos ejecutados entre el 1 de enero de 2023 y la fecha de justificación determinada en el artículo 17 de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f. El ámbito territorial de las actuaciones será la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g. Serán subvencionables el personal ajeno, el material y otros gastos necesarios para realizar las actuaciones de prevención, reutilización, preparación para la reutilización y reciclaje de los residuos, incluidas las campañas de difusión y de información del proyecto y adquisición de bienes inventariables necesarios para llevar a cabo el proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h. Quedan excluidos los vasos, platos, cubiertos y tazas compostables, premios y regalos no relacionados con la prevención, la reutilización, la preparación para la reutilización, el reciclaje y la mejora de la recogida selectiva de los residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Las actuaciones de limpieza de espacios por sí solas o que no formen parte de un proyecto más amplio de prevención, reutilización, preparación para la reutilización, reciclaje y mejora de la recogida selectiva de los residuos tampoco están incluidas en el ámbito de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j. Las actuaciones o proyectos subvencionados, de conformidad con el artículo 35 de la Ley orgánica 3/2007, de 22 de marzo, de igualdad, deberán hacer efectiva la consecución de la igualdad entre mujeres y hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Beneficiarios. Requisitos i obligaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. Beneficiarios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Podrán ser beneficiarias de esta subvención las entidades y las asociaciones sin ánimo de lucro que quieran llevar a cabo un proyecto en el ámbito territorial de la isla de Eivissa de prevención, preparación para la reutilización, reutilización y/o reciclaje de residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pueden ser asociaciones ecologistas, asociaciones de vecinos, comunidades de propietarios, asociaciones de madres y padres de alumnos, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La solicitud de subvención puede presentarse individual o conjuntamente con otras entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. Requisitos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para ser beneficiario de las subvenciones, será necesario no incurrir en ninguna de las prohibiciones establecidas en el artículo 13 de la LGS y en el artículo 10 del TRLS, o en otra normativa sectorial que así lo establezca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No pueden ser beneficiarias de las subvenciones las entidades que no se encuentren al corriente en el cumplimiento de sus obligaciones tributarias con la hacienda estatal, con la Seguridad Social y con el Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.3. Obligaciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades beneficiarias de las subvenciones tendrán que cumplir las obligaciones previstas en el artículo 14 de la LGS y en el artículo 11 del TRLS, entre las que hay las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Comunicar al órgano competente la aceptación de la propuesta de resolución definitiva en los casos y términos que, en su caso, establezcan las bases reguladoras de la subvención. En cualquier caso, esta comunicación se entiende producida automáticamente si en el plazo de diez días hábiles, desde la notificación de la propuesta de resolución definitiva, no se hace constar lo contrario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Cumplir el objetivo, ejecutar el proyecto, realizar la actividad o adoptar el comportamiento que fundamenta la concesión de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Justificar debidamente la realización de la actividad, así como el cumplimiento de los requisitos y condiciones que determinen la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Someterse a las actuaciones de comprobación, seguimiento, inspección y control financiero que pueda efectuar el Consell Insular de Eivissa y aportar toda la información y documentación que se les requiera en el ejercicio de estas actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Comunicar al Consell Insular de Eivissa la obtención de otras subvenciones, ayudas, ingresos o recursos que financien las actividades subvencionadas, procedentes de cualquier administración o entidad pública o privada, nacional o internacional. Esta comunicación debe efectuarse tan pronto como se conozca y, en todo caso, con anterioridad a la justificación de la aplicación dada a los fondos percibidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f. Acreditar, con anterioridad a dictarse la propuesta de resolución de concesión, que se encuentra al corriente en el cumplimiento de sus obligaciones tributarias y frente a la Seguridad Social, salvo si la entidad ha autorizado expresamente al Consejo a solicitar esta documentación a los órganos competentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g. Disponer de los libros contables, registros diligenciados y otros documentos debidamente auditados en los términos exigidos por la legislación mercantil y sectorial aplicable a la persona o entidad beneficiaria en cada caso, así como de todos los estados contables y registros específicos exigidos por estas bases reguladoras, con el fin de garantizar el adecuado ejercicio de las facultades de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h. Conservar los documentos justificativos de la aplicación de los fondos percibidos, incluidos los documentos electrónicos, mientras puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Adoptar las medidas de difusión haciendo constar expresamente y de forma visible en cualquiera de los medios y materiales que se utilicen para difundir las actividades subvencionadas que éstas se realizan con la financiación del Consell Insular de Eivissa, en los términos que se establezcan en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j. En caso de subvenciones a bienes inventariables, mantener el destino de los bienes a la finalidad concreta de la subvención por un período de cinco años en cuanto a bienes inscribibles en registro público y de dos años para el resto de bienes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k. Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 del TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l. Cumplir con los compromisos y obligaciones que establezcan las bases reguladoras de esta convocatoria y la legislación aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquiera de las alteraciones tenidas en cuenta para conceder la ayuda y, en cualquier caso, la obtención de subvenciones incompatibles pueden dar lugar a la modificación de la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que las entidades beneficiarias incumplan las obligaciones previstas en el artículo 14 de la LGS, se aplicará lo que establecen los artículos 22 y 23 de las bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Importe de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La cantidad máxima que se destina a la presente convocatoria es de sesenta y cinco mil euros (65.000 €) del vigente presupuesto del Consell Insular de Eivissa, distribuida en 40.000 € de aportaciones para gasto corriente con cargo a la aplicación presupuestaria 1700 4890000 y 25.000€ de aportaciones para bienes inventariables con cargo a la aplicación presupuestaria 1700 78900.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La cuantía máxima a obtener por cada entidad será de 10.000€, de los cuales cada entidad podrá disponer de 6.000€ para gasto corriente y 4.000€ para material inventariable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada entidad puede solicitar más de una ayuda, pero en ningún caso podrá recibir más de la cantidad máxima estipulada, teniendo en cuenta todos los proyectos para los que solicite subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los beneficiarios no podrán recibir ninguna ayuda que sea superior al coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago de la subvención concedida quedará condicionado a la implantación del proyecto presentado y aprobado por el que se haya concedido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso, la ayuda efectivamente pagada podrá ser superior a la cuantía debidamente justificada; en tal supuesto, la cantidad de la ayuda se reducirá en la misma proporción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones que se otorguen tienen carácter ocasional y no generan ningún derecho a la continuidad en la asignación de financiación para ejercicios posteriores y no pueden alegarse como precedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Procedimiento de concesión y compatibilidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.1. Procedimiento de concesión de las ayudas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procedimiento de concesión de estas ayudas debe tramitarse de acuerdo con los principios de publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación, eficacia en el cumplimiento de los objetivos fijados, eficiencia en la asignación y utilización de los recursos públicos, y para concurrir en el solicitante los requisitos para su beneficiario, en el marco de lo previsto en el artículo 13 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El procedimiento de las ayudas se tramitará en régimen de concurrencia competitiva, en la modalidad de procedimiento selectivo único.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tiene consideración de concurrencia competitiva el procedimiento por el que la concesión de la subvención se realiza mediante la comparación de las solicitudes presentadas, a fin de establecer una prelación entre éstas, de acuerdo con los criterios de valoración fijados en la convocatoria, y adjudicar, con el límite fijado en la convocatoria dentro del crédito disponible, las que obtengan una mayor valoración de acuerdo con los criterios mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.2. Compatibilidad&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones que se otorguen de acuerdo a esta convocatoria son compatibles con las que puedan otorgar otras entidades públicas o privadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe de las subvenciones en ningún caso puede ser de tal cuantía que aisladamente o en concurrencia con otras subvenciones, ayudas, ingresos o recursos supere el coste de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La entidad beneficiaria debe comunicar al Consell Insular de Eivissa la obtención de otras subvenciones, ayudas, ingresos o recursos para la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Solicitudes. Plazo y documentación a presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1. Forma y lugar de presentación de solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes de subvención se formalizarán mediante instancia, según modelo normalizado que figura como Anexo I de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes se dirigirán a la presidencia del Consell Insular de Eivissa, de conformidad con lo previsto en el artículo 14.2 de la LPAC. Las solicitudes y demás documentación, así como cualquier otra relación con el Consejo Insular de Eivissa, se presentarán por medios electrónicos en la sede electrónica del Consejo Insular de Eivissa (http://seu.conselldeivissa.es).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La firma y presentación de la solicitud comporta la plena aceptación de estas bases reguladoras y lleva implícita la autorización al órgano gestor para comprobar, de oficio, todos los datos que contienen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2. Plazo de presentación de las solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se establece un plazo de presentación de las solicitudes de quince días hábiles a contar desde el día siguiente de la publicación del extracto de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes presentadas fuera del plazo establecido no se admitirán a trámite y se dictará la correspondiente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.3. Documentación a presentar&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Impreso de solicitud de la subvención (Anexo I), debidamente cumplimentado y firmado por el representante legal de la entidad, en el que se incluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;a.1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaración responsable firmada por la persona solicitante de no estar sometida a ninguna de las circunstancias que determinan la imposibilidad de obtener la condición de beneficiario/a de las subvenciones públicas recogidas en el artículo 13 de la LGS y en el artículo 10 del TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;a.2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Declaración responsable en la que se hagan constar todas las subvenciones o ayudas obtenidas o solicitadas en cualquier ente público o privado, haciendo constar la relación detallada con la entidad concedente y la cuantía solicitada y/u obtenida, si procede, o una declaración expresa de no haber solicitado u obtenido ninguna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes de subvención tendrán que incluir los conceptos para los que se concurre a la convocatoria y que, en todo caso, tendrán que ser coherentes con el objeto de la convocatoria, hecho que se justificará adecuadamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, se indicará la dirección electrónica a la que el Consell Insular de Eivissa enviará los avisos de las notificaciones telemáticas referentes a esta subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;NIF de la entidad. Si el certificado digital con el que se firma la solicitud es del representante legal de la entidad, sólo será necesario presentar copia de su DNI y el NIF de la entidad solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si el certificado digital con el que se firma la solicitud (Anexo I) pertenece a una persona física sin ningún tipo de representación, deberá aportarse el documento acreditativo del poder con el que actúa, además de la copia del su DNI y el NIF de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Certificados de estar al corriente con las obligaciones tributarias con la hacienda estatal (AEAT) y con la seguridad social (TGSS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La entidad solicitante puede autorizar al Consell Insular de Eivissa para que lleve a cabo la comprobación de estos datos y pueda obtener los certificados (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin embargo, según el artículo 22.4 del RLGS, el solicitante podrá denegar expresamente el consentimiento para la comprobación de certificados (mediante el Anexo III); en tal caso, deberá aportar los certificados correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se podrá simplificar la acreditación de este cumplimiento mediante la presentación de declaración responsable (modelo normalizado en el Anexo IV) en los casos descritos en el artículo 24 del RLGS, y siempre que la ayuda solicitada sea como máximo de 3.000€.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, el Consell Insular de Eivissa comprobará de oficio si la entidad está al corriente de las obligaciones económicas ante la propia administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los certificados tendrán que estar vigentes no sólo en el momento de la concesión de la ayuda, sino también en el momento anterior a su pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;d)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Impreso de transferencia bancaria, sellado por la entidad bancaria (modelo normalizado en el Anexo V). La entidad solicitante debe figurar necesariamente como titular de la cuenta bancaria en la que, en su caso, se realizará el ingreso. Este impreso no deberá presentarse en caso de que se haya presentado anteriormente al Consell Insular de Eivissa y no se haya producido ningún cambio en los datos aportados con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;e)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En caso de que la entidad que presenta la solicitud represente a varios asociados, será necesario adjuntar una lista de las entidades a las que representa, para cada proyecto, y acreditar que actúa en su nombre y representación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Documentación acreditativa de su inscripción en el registro competente y escritura de constitución y de sus estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Memoria técnica en la que se expliquen las características técnicas y económicas del proyecto, que deberán ajustarse a los datos exigidos en el Anexo II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Cualquier otra documentación que la entidad solicitante considere conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Firmar y presentar la solicitud comporta la plena aceptación de estas bases reguladoras y lleva implícita la autorización al Consell Insular de Eivissa para comprobar, de oficio, todos los datos que contienen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No será necesario aportar la documentación que ya conste en poder del Consell Insular de Eivissa siempre que se encuentre vigente y no hayan transcurrido más de cinco años desde que se presentó la documentación; a tal efecto, el solicitante deberá indicar la fecha y el órgano ante el que se presentó (en la tabla de documentación adjunta del Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades que lo deseen podrán presentar de forma conjunta la solicitud y la justificación de la subvención, hasta la fecha límite de presentación de solicitudes. En este caso, tendrán que presentar toda la documentación exigida en los apartados correspondientes de solicitudes y de justificación, con excepción de las memorias, que se podrán simplificar con la presentación de una sola memoria descriptiva con las orientaciones técnicas descritas en el Anexo VII.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Cualquier otra documentación que la entidad solicitante considere conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Firmar y presentar la solicitud comporta la plena aceptación de estas bases reguladoras y lleva implícita la autorización al Consell Insular de Eivissa para comprobar, de oficio, todos los datos que contienen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No será necesario aportar la documentación que ya conste en poder del Consell Insular de Eivissa siempre que se encuentre vigente y no hayan transcurrido más de cinco años desde que se presentó la documentación; a tal efecto, el solicitante deberá indicar la fecha y el órgano ante el que se presentó (en la tabla de documentación adjunta del Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades que lo deseen podrán presentar de forma conjunta la solicitud y la justificación de la subvención, hasta la fecha límite de presentación de solicitudes. En este caso, tendrán que presentar toda la documentación exigida en los apartados correspondientes de solicitudes y de justificación, con excepción de las memorias, que se podrán simplificar con la presentación de una sola memoria descriptiva con las orientaciones técnicas descritas en el Anexo VII.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.Órganos competentes para la ordenación, la instrucción y la resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.1. El Departamento de Gestión Ambiental es el competente para instruir el procedimiento de tramitación de los expedientes de solicitud de las ayudas reguladas en esta convocatoria, de conformidad con lo establecido en el artículo tercero, apartado 2.a), del Decreto de Presidencia núm. 2019000471, de fecha 10 de julio de 2019, de Estructura del Gobierno del Consell Insular de Ibiza y Creación de Departamentos (modificaciones en el BOIB núm. 175, de 31-12-2019; BOIB núm. 101, de 4-06- 2020, BOIB nº 153, de 5-09-2020, y BOIB nº 119, de 2-09-2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.2. Corresponde al consejero ejecutivo del Departamento de Gestión Ambiental, la ordenación del procedimiento, en virtud del artículo primero, apartado i) del Decreto de Presidencia núm. 2019000484, de fecha 16-07-2019, de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular de Eivissa (BOIB núm. 98 EXT., de 17-07-2019; modificaciones en el BOIB núm. 175, de 31- 12-2019, en el BOIB núm. 101, de 4-06-2020, y en el BOIB núm. 153, de 5-09-2020) y el artículo 72.a) y e) del Reglamento orgánico de esta Corporación, de 25 de junio de 2010 (BOIB núm. 136, de 18-09-2010, corrección en el BOIB núm. 148, de 14-10-2010, y modificación en el BOIB núm. 48, de 16-04-2016).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.3. Aprobar estas bases y la convocatoria corresponde al Consejo Ejecutivo, de conformidad con lo establecido en el artículo tercero, apartado e), del Decreto de Presidencia núm. 2019000484, de fecha 16-07-2019, de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular de Eivissa (BOIB núm. 98 EXT., de 17-07-2019; modificaciones en el BOIB núm. 175, de 31- 12-2019, BOIB núm. 101, de 4-06-2020, y BOIB núm. 153, de 5-09-2020), dado que su importe total supera los 15.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.4. Estas ayudas se concederán y se pagarán, por delegación del Consejo Ejecutivo, mediante resolución del consejero ejecutivo del Departamento de Gestión Ambiental, de la que se dará cuenta al Consejo Ejecutivo de este Consejo de Eivissa en la próxima sesión que se celebre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Instrucción de los expedientes. Enmienda y mejora de las solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.1. El Departamento de Gestión Ambiental del Consell Insular de Eivissa es el competente para instruir el procedimiento de tramitación de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.2. Enmienda y mejora de la solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Después de evaluar las solicitudes, en caso de que éstas no reúnan los requisitos establecidos en estas bases, se requerirá y se notificará a las entidades interesadas para que la subsanen, de acuerdo con lo que dispone el artículo 68.1 de la LPAC. Las entidades interesadas dispondrán de diez días hábiles para subsanar su solicitud, a contar a partir del día siguiente de su notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la presentación de enmiendas no se aceptarán cambios significativos ni conceptos nuevos en el proyecto o en el presupuesto, que representen una modificación sustancial del proyecto, si no responden a lo que estrictamente se ha solicitado en el requerimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la entidad interesada no realiza la rectificación reclamada o no presenta la complementación requerida, dentro del plazo establecido, el Consell Insular de Eivissa considerará que la entidad interesada desiste de su petición y dictará la resolución pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor podrá requerir, en cualquier momento de la tramitación del expediente, los documentos complementarios que considere necesarios, a efectos de garantizar la correcta inversión de los recursos presupuestarios destinados a las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.3. Informe técnico&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los resultados de esta fase se recogerán en un informe técnico que debe emitir el instructor o la instructora, de acuerdo con lo establecido en el último párrafo del artículo 24.4 de la LGS, y que deberá servir de referencia a la Comisión Evaluadora para llevar a cabo su valoración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Comisión evaluadora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comisión evaluadora es el órgano colegiado al que le corresponden las funciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Examinar y evaluar las solicitudes presentadas, de acuerdo con los criterios establecidos en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Emitir un acta con un informe en el que se concretará el resultado de la evaluación y se establecerá una prelación de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comisión evaluadora estará integrada por:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13.Criterios de valoración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.1. La selección de los beneficiarios por el procedimiento de concurrencia competitiva se llevará a cabo mediante la comparación de las solicitudes presentadas, de acuerdo con los criterios de valoración establecidos a continuación, a fin de establecer una prelación entre éstas, y adjudicar subvención hasta la totalidad del importe solicitado (IVA incluido), dentro del límite fijado para cada entidad, y hasta agotar las partidas presupuestarias destinadas a esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.2. La comisión evaluadora puntuará cada proyecto de acuerdo con los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La prioridad de las actuaciones propuestas y el interés del proyecto. Se valorará de conformidad con la jerarquía de residuos, especialmente las actuaciones relacionadas con la prevención, preparación para la reutilización y reciclaje de los residuos. Se valorará el interés de la fracción de residuos objeto del proyecto, priorizando la fracción orgánica (incluidas las acciones para reducir el desperdicio alimentario), además de los voluminosos, los envases y la fracción de textiles. Asimismo, se valorará la innovación, el alcance y la repercusión de la acción proyectada. Se adjudicarán hasta un máximo de 40 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La calidad del proyecto presentado en el apartado técnico inicial. Se valorará esta calidad en función de la concreción de sus objetivos, la justificación de la adaptación del proyecto al objeto de la convocatoria, la explicación detallada de las actuaciones, el desarrollo de la metodología, la idoneidad de los materiales y recursos humanos y la presentación de los soportes documentales en los que se basará el trabajo. También se valorará la presentación del proyecto. Se adjudicarán hasta un máximo de 30 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. La relación del coste del proyecto con el trabajo presentado y desarrollado. Se valorará la eficiencia de las actuaciones. Se adjudicaran hasta un máximo de 30 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por cada punto obtenido, se contará un punto porcentual (es decir, si se le otorgan 75 puntos, equivaldrá a un 75% del importe solicitado) y la cuantía de la subvención concedida se establece en un porcentaje del importe de los gastos subvencionables proporcional al número de puntos obtenidos en la valoración, según los criterios expuestos, sin que se pueda superar el límite máximo por entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones se otorgarán siguiendo el orden de prelación establecido, teniendo en cuenta la cuantía máxima disponible para la convocatoria. Para los casos de proyectos que obtengan idéntica puntuación, para determinar el orden de prelación se tendrán en cuenta las fechas de registro de entrada de solicitudes, dando prioridad a las presentadas con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de no llegar la cantidad total para pagar todos los importes solicitados, se tendrán en cuenta las puntuaciones para pagar en primer lugar los proyectos con mayor puntuación en el orden resultante, y hasta que se agoten las cantidades disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.3. Determinación de la cuantía a conceder&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para determinar el coste total financiable de las actuaciones o proyectos subvencionables, se partirá del coste que solicita la entidad y se deducirán aquellas partidas que no se ajusten a las condiciones de la convocatoria o que no se consideren necesarias, y se descontará, en su caso, el importe correspondiente a otras subvenciones o ayudas que puedan quedar incluidas dentro del total solicitado. A la cantidad resultante, se le aplicará el porcentaje correspondiente obtenido en la valoración, al objeto de obtener el importe financiable, que en ningún caso podrá superar la cantidad máxima que puede recibir cada entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. Propuesta de resolución provisional y alegaciones. Reformulación de las solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14.1. Con fundamento del informe de la comisión evaluadora, el órgano instructor formulará la propuesta de resolución provisional, debidamente motivada, que expresará la lista de entidades propuestas por ser beneficiarias de la ayuda, debidamente priorizada en función de la puntuación obtenida y la cuantía que se propone conceder y, en su caso, las entidades que forman parte de la lista de reserva y, en su caso, las solicitudes inadmitidas o desistidas y la causa de inadmisión o desistimiento, y se abrirá un plazo de diez días hábiles, a contar a partir del día siguiente de su notificación, para que los interesados ​​formulen las alegaciones que estimen oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14.2. Reformulación de las solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 27 de la LGS, en caso de que el importe de la subvención que se determine en la propuesta de resolución provisional sea inferior al importe solicitado, las entidades interesadas podrán presentar reformulación del proyecto y del presupuesto para adaptarlos a la subvención que se propone. En todo caso, se tendrán que respetar el objeto, las condiciones y la finalidad de la subvención, así como los criterios de valoración establecidos respecto de las solicitudes y en ningún caso pueden comportar una modificación sustancial del proyecto. La subvención se otorga sobre el presupuesto aceptado y la justificación deberá ser respecto a ese presupuesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Propuesta de resolución definitiva. Aceptación y renuncia de la subvención concedida&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.1. Finalizado el trámite de audiencia y examinadas las alegaciones presentadas por las entidades interesadas, el órgano instructor formulará la propuesta de resolución definitiva, que se notificará a las entidades interesadas, las cuales dispondrán de un plazo de diez días hábiles, a a partir del día siguiente de la notificación, para comunicar al órgano gestor de las subvenciones la aceptación de la ayuda. Sin embargo, la aceptación se entenderá producida automáticamente si en ese plazo no se hace constar lo contrario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.2. En caso de que quiera renunciar a la ayuda, la entidad beneficiaria lo deberá comunicar por escrito al órgano gestor de la subvención, también dentro del plazo de diez días hábiles a contar a partir del día siguiente a la notificación de la propuesta de resolución definitiva, y el órgano instructor debe aceptarla. Una vez finalizado este plazo, no se aceptará renuncia alguna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que alguna de las entidades propuestas como beneficiarias de la subvención no acepte o desista de la solicitud, se puede otorgar la subvención a las siguientes entidades de la lista de reserva por orden de prioridad siempre que se haya liberado lo suficiente crédito para atender las siguientes solicitudes con la misma puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.3. Las propuestas de resolución provisional y definitiva no crean derecho alguno a favor de la persona beneficiaria propuesta, ante la Administración, mientras no se le haya notificado la resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Resolución de concesión y notificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolución de concesión de las ayudas, la dictará el consejero ejecutivo del Departamento de Gestión Ambiental, que es el órgano competente por delegación del Consejo Ejecutivo, y debe darse cuenta al órgano delegante. Igualmente, en su caso, se dictará resolución de la no concesión, con indicación de la causa de exclusión, desistimiento o denegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La resolución de concesión determinará la lista de entidades beneficiarias y la cuantía concedida a cada una de ellas y, en su caso, las entidades que forman parte de la lista de reserva, incorporando, en su caso, las condiciones y obligaciones que deben cumplir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor notificará la resolución correspondiente a cada entidad interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 25.4 y 25.5 de la LGS, el plazo máximo para resolver el procedimiento y notificarlo es de seis meses a contar desde la fecha de publicación del extracto de la convocatoria en el BOIB. Transcurrido este plazo sin que se haya dictado resolución expresa, la solicitud deberá entenderse desestimada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Justificación de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.1. La justificación del proyecto se llevará a cabo mediante la cuenta justificativa simplificada (artículo 30 de la LGS y artículo 75 del RLGS), que tendrá carácter de documento con validez jurídica para justificar la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificación de la subvención se realizará en una sola vez. Existen dos opciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Durante el plazo de presentación de solicitudes, conjuntamente con la solicitud. En este caso, se considera que el plazo de justificación coincide con el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Una vez finalizado el plazo de presentación de solicitudes y, como máximo, hasta la fecha límite de justificación. En este caso, se considera que el plazo de justificación se inicia a la finalización del plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se considerarán gastos justificables los que sean efectivamente realizados y pagados entre el 1 de enero de 2023 y hasta la fecha límite de presentación de la justificación que en ningún caso podrá exceder del 20 de septiembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Transcurrido el plazo establecido de justificación sin que ésta se haya presentado ante el órgano competente, éste requerirá a la persona o entidad beneficiaria que en el plazo improrrogable de quince días la presente. El transcurso de este plazo sin que se haya presentado la justificación comporta la exigencia de responsabilidades establecidas en la LGS. Sin embargo, presentar la justificación en este plazo adicional no eximirá a la persona o entidad beneficiaria de las sanciones que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.2. Subcontratación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las entidades beneficiarias podrán subcontratar con terceros, totalmente (hasta el 100%) o parcialmente, las actividades objeto de estas ayudas, siempre que se cumplan las prescripciones contenidas en el artículo 29.7 de la LGS y en el artículo 68 del RLGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Cuenta justificativa simplificada y documentación a presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;18.1. Para justificar debidamente los gastos subvencionables se deberá aportar la siguiente documentación, siendo obligatorio presentar el Anexo VI debidamente cumplimentado:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Modelo de &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;cuenta justificativa simplificado (&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;modelo normalizado Anexo VI), firmado por el representante de la entidad, que contiene:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.a)&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Datos del proyecto y de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Relación de documentacinó presentada y que integra la cuenta justificada simplificado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Una memoria técnica de actuación justificativa del cumplimiento de las condiciones impuestas en la concesión de la subvención, con indicación de las actividades realizadas y de los resultados obtenidos (según el Anexo VII que determina el contenido mínimo). La memoria se puede incluir en el modelo de cuenta justificativa simplificado o anexar como documentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la memoria deberá justificarse debidamente la publicidad llevada a cabo y deberá aportar bien un ejemplar de la publicidad escrita y gráfica de las publicaciones, o bien capturas de pantalla de la publicidad relativa a la actividad subvencionada, en la que debe constar expresamente el patrocinio del Consejo Insular de Eivissa y debe incluir el logotipo de la institución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que la subvención se otorgue de acuerdo con un presupuesto estimado, en la memoria se indicarán las desviaciones acaecidas en los apartados correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.d)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Declaración responsable en la que conste que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los datos incluidos son ciertos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los ingresos de la actividad subvencionada, incluida esta subvención y/u otras subvenciones e ingresos concurrentes, en su caso, no superan su coste.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los gastos subvencionados han sido efectivamente pagados antes de la fecha límite de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se recuperará ni compensará el IVA, y en su caso, el importe imputado a la justificación únicamente incluye la parte de IVA no deducible por el beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se han ejecutado y abonado las actuaciones objeto de subvención, se cumple con el objetivo y finalidad subvencionada y los fondos obtenidos se han destinado a financiar el objeto de la subvención otorgada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los gastos realizados por ejecutar el proyecto subvencionado no superan el valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La subvención otorgada por el Consell Insular de Eivissa se ha destinado íntegramente a financiar la actuación para la que fue concedida la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El compromiso de comunicar al Consell Insular de Eivissa cualquier modificación que se produzca respecto a los datos de financiación que constan en este documento y que impliquen un aumento de los ingresos recibidos o una disminución de los gastos incluidos en el coste del proyecto o actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subcontrataciones que se han hecho con terceros, para llevar a cabo las actividades objeto de esta ayuda, cumplen las prescripcions contengudes a l'article 29.7 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2) Certificados de estar al corriente con las obligaciones tributarias con la AEAT y con la Seguridad Social. Los certificados tendrán una validez de seis meses desde la fecha de su expedición y tendrán que estar vigentes a la hora de realizar el pago; en caso contrario, se tendrán que presentar certificados actualizados, o bien autorizar al Consell Insular de Eivissa para su comprobación mediante el Anexo III.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3) En su caso, carta de pago de reintegro en el supuesto de remanentes no aplicados así como de los intereses que se deriven.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4) Cualquier otra documentación que se considere de interés por justificar el proyecto, o bien que se derive de las bases o sea requerida a la entidad beneficiaria a fin de comprobar la justificación económica del proyecto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de entidades que hayan presentado más de un proyecto, tendrán que presentar una cuenta justificativa por proyecto, correspondiente a cada solicitud presentada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;18.2. Técnicas de muestreo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Eivissa, mediante técnicas de muestreo aleatorio simple, seleccionará una muestra de un 25% sobre el total de las solicitudes aprobadas. A tal fin podrá realizar las comprobaciones que estime oportunas, a los beneficiarios de las solicitudes seleccionadas, que permitan obtener evidencia razonable sobre la adecuada aplicación de la subvención y requerir la remisión de la totalidad de los justificantes de gasto. La comprobación puede ser exhaustiva cuando se aprecien irregularidades significativas en la muestra examinada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;18.3 Justificantes de gasto&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que la solicitud forme parte del muestreo y el Consell Insular de Eivissa requiera justificantes de pago, o bien para que los considere de interés para justificar el proyecto, se tendrá que tener en cuenta:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los gastos se justificarán mediante las facturas originales u otros documentos con valor probatorio equivalente con validez en el tráfico jurídico mercantil o con eficacia administrativa, que deben estar expedidos a nombre de la entidad subvencionada y deben reunir todos los requisitos que exige la normativa reguladora de las obligaciones de facturación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Deberán concretar suficientemente los conceptos incluidos y sus características, a fin de comprobar que se ajustan a los requisitos de la convocatoria ya los conceptos subvencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de exención del IVA, se acreditará suficientemente la concesión de esta exención. De igual forma se procederá en caso de que no se practique la retención del IRPF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, para justificar las actuaciones realizadas con personal propio, será necesario adjuntar originales de los TC1 y TC2 del personal dedicado a las tareas detalladas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La entidad beneficiaria será la responsable de estampillar las facturas y demás documentos indicando las cantidades imputables a cada una de las subvenciones recibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Comprobación documental de la justificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.1. El Consejo Insular de Eivissa comprobará la justificación documental de la subvención, así como la realización de la actividad y el cumplimiento de la finalidad que determinan la concesión de la subvención, por lo que revisará la documentación obligatoria que tenga que aportar entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.2. Si con la documentación presentada no se llega a justificar el 100% del gasto previsto para la actividad objeto de la subvención, la ayuda se reducirá de forma que cubra sólo los gastos correctamente justificados. Sin embargo, en caso de que el coste final de la actividad subvencionada sea inferior al coste inicialmente presupuestado y esta reducción no suponga un incumplimiento del objetivo por el que se concedió la ayuda, ni afecte a la adecuada realización de la actividad subvencionada, el Consejo hará efectivo el importe máximo concedido siempre que la persona beneficiaria haya efectuado gastos, como mínimo, por ese importe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.3. El Consejo Insular de Eivissa tiene la facultad de revisar las ayudas concedidas y modificar la resolución de concesión en caso de que las condiciones que se han tenido en cuenta para conceder la subvención se alteren o en el caso concurrente de otras ayudas o subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.4. El órgano instructor podrá realizar los controles necesarios para verificar el cumplimiento de los términos establecidos en la presente convocatoria, posteriormente emitirá informe técnico sobre la documentación justificativa presentada por las diferentes entidades, el cumplimiento de las bases y del objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;20. Pago de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;20.1. El pago de la subvención se tramitará una vez que la actividad subvencionada se haya justificado debidamente y se haya cumplido la finalidad que motivó su concesión, de acuerdo con los términos establecidos en estas bases y la normativa vigente, y órgano instructor haya emitido el correspondiente informe favorable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con esta documentación y con el informe técnico, la jefa de Sección del Departamento de Gestión Ambiental emitirá informe propuesta para hacer efectivo el pago de los importes finalmente subvencionados, mediante resolución de pago del consejero ejecutivo del Departamento de Gestión Ambiental. Igualmente, en caso de que finalmente no sea procedente efectuar el pago por alguna o algunas de las causas establecidas en la normativa, se dictará la oportuna resolución debidamente motivada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;20.2. Los importes de las ayudas que otorgue el Consell Insular de Eivissa se harán efectivos una sola vez mediante transferencia bancaria, después de que se dicte la resolución de pago y se notifique a cada entidad interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;20.3. Para efectuar el pago los beneficiarios deben encontrarse al corriente de las obligaciones tributarias (AEAT) y con la Seguridad Social (TGSS), así como con las obligaciones económicas con el Consell Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;21. Revocación y reintegro de las ayudas concedidas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;21.1. De acuerdo con lo que dispone el artículo 43 del TRLS, debe revocarse la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. En tal caso, quedará sin efecto el acto de concesión y en su caso se reintegrarán, total o parcialmente, las cantidades indebidamente percibidas además del interés de demora correspondiente en los términos establecidos en el artículo 44 del TRLS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y plazos establecidos supondrá, además de la revocación, la imposibilidad de participar en próximas convocatorias de ayudas del Consell Insular de Eivissa, mientras no se realice la devolución del importe reclamado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La revocación de la ayuda puede afectar al total o parte de la ayuda concedida por razón del incumplimiento total o parcial de las obligaciones de la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;21.2. Criterios de graduación de los incumplimientos materiales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si con posterioridad a la concesión de las subvenciones se observan incumplimientos parciales o totales de los proyectos o actividades objeto de las ayudas (incumplimiento material), la cantidad concedida puede ser objeto de disminución o reintegro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este sentido, y de conformidad con el artículo 17.3.n de la LGS, y en relación con el artículo 37.2 de la misma ley, se establecen los siguientes criterios de graduación de los posibles incumplimientos materiales del proyecto o la actividad objeto de subvención, y siempre que los beneficiarios acrediten una actuación inequívoca tendente a la satisfacción de sus compromisos, y que responden al principio de proporcionalidad:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Para el caso de bienes inventariables, incluye la obligación de mantenimiento de su destino en los términos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor aplicará estos criterios para determinar la cantidad que finalmente tendrá que percibir la entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por debajo del 10% de cumplimiento, se considerará que no queda acreditada una actuación inequívoca de la persona beneficiaria en la realización de la actividad subvencionada y el órgano competente acordará la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;21.3. El reintegro se realizará por el procedimiento establecido en el Título II de la LGS, en el que debe garantizarse la audiencia de las entidades interesadas. Las cantidades reintegrables tendrán la consideración de ingresos de derecho público y podrán ser exigidas por vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;22. Régimen de infracciones y sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de incumplimientos formales, el régimen de infracciones y sanciones administrativas aplicables será el que establecen el título IV de la LGS y el título V del *TRLS, de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por incumplimiento formal se entiende todo aquel que implique un incumplimiento de la normativa de subvenciones, como por ejemplo el incumplimiento de presentar la justificación en el plazo establecido, la justificación deficiente, la deficiencia en la publicidad del Consejo Insular de Ibiza como entidad *subvencionadora, el incumplimiento en la acreditación de este hecho, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Todo esto sin perjuicio de las responsabilidades penales o civiles en que se pueda incurrir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;23. Regimen de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;23.1. La resolución del consejero ejecutivo del Departamento de Gestión Ambiental, dictada por delegación del Consejo Ejecutivo y que se tiene que considerar dictada por el órgano delegando, no agota la vía administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;23.2. Contra la mencionada resolución se podrá interponer ante el Pleno del Consejo Insular de Ibiza el recurso de alzada previsto en los artículos 112.1, 121 y 122 de la Ley 39/2015, de 1 de octubre, de la LPAC, en el plazo de un mes desde el día siguiente a su notificación, todo esto en virtud del que dispone el artículo 66.2 de la Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El recurso tendrá que resolverse y notificarse en el plazo de tres meses, transcurridos los cuales sin que se haya dictado resolución exprés se entenderá desestimado y quedará abierta la vía contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;24. Publicidad de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;24.1. Les bases de la present convocatòria de subvencions es publicaran al &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB) i una vegada publicades, en compliment del que disposen els articles 17.3, 18 i 20.8 de la LGS, s'enviaran la convocatòria i un extracte d'aquesta a la Base de Dades Nacional de Subvencions (BDNS), que donarà trasllat de l'extracte al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, les convocatòries de subvencions es publicaran a la seu electrònica del Consell Insular d'Eivissa &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;24.1. Las bases de la presente convocatoria de subvenciones se publicarán al Boletín Oficial de las Islas Baleares (BOIB) y una vez publicadas, en cumplimiento del que disponen los artículos 17.3, 18 y 20.8 de la LGS, se enviarán la convocatoria y un extracto de esta a la Base de datos Nacional de Subvenciones (BDNS), que dará traslado del extracto al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Así mismo, las convocatorias de subvenciones se publicarán en la sede electrónica del Consejo Insular de Ibiza (https://seu.conselldeivissa.es), en la cual se incluirá la información extractada de la subvención, su enlace, la resolución del procedimiento, los impresos de solicitudes, así como los anexos normalizados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La eficacia de la convocatoria queda supeditada en la publicación del extracto en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones se publicará a la BDNS y contenderá información de la identificación las entidades beneficiarias y el importe de las subvenciones finalmente otorgadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto al abono de las subvenciones, se tendrá que informar la BDNS de las cuantías efectivamente percibidas, así como de los acuerdos, los decretos o las resoluciones de reintegro de subvenciones y sanciones impuestas, si fuera el caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;Así mismo, las subvenciones concedidas por el Consejo Insular de Ibiza, con indicación del importe finalmente otorgado, objeto, finalidad y entidad beneficiaria, se publicarán en el Portal de Transparencia del Consejo Insular de Ibiza (http://transparencia.conselldeivissa.info), en el cual se recogerá la información sobre subvenciones y ayudas prevista a la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno, con los límites previstos en la ley mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;24.2. Difusión, por parte de la persona beneficiaria, de la subvención concedida&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El beneficiario o beneficiaria tendrá que adoptar las adecuadas medidas de difusión, haciendo constar expresamente y de forma visible, en cualquiera de los medios y materiales que se utilicen para difundir, que las actividades subvencionadas se realizan con la financiación del Consell Insular de Eivissa .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A tal efecto, la entidad beneficiaria podrá difundir la ayuda en carteles, materiales impresos o mediante menciones en las páginas webs, redes sociales, medios audiovisuales o en otros medios de comunicación ordinarios (prensa, comunicados, etc.) y todos aquellos otros que resulten adecuados al objeto subvencionado y de eficacia equivalente a los citados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todos los soportes comunicativos impresos o digitales deberá incluirse el logotipo del Consejo Insular de Eivissa, que se puede consultar en la página web www.conselldeivissa.es.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;25. Confidencialidad y protección de datos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;25.1. El tratamiento de los datos de carácter personal que realice el órgano gestor deberá cumplir lo que establecen la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos y garantía de los derechos digitales, el Reglamento (UE) 2016/679 del Parlamento y del Consejo, de 27 de abril de 2016, antes mencionado, y demás legislación vigente en materia de protección de datos personales que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;25.2. En la publicación de datos de carácter personal que se realicen en boletines y diarios oficiales, en sitios webs institucionales y en otros medios electrónicos de las resoluciones de los procedimientos de subvenciones, la identificación de la persona interesada se realizará en los términos previstos en la disposición adicional séptima de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
