    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, dictada por delegación del Consejo Ejecutivo, según acuerdo de 28 de septiembre de 2022, BOIB núm. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;“Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.Mediante el acuerdo del Consejo Ejecutivo del Consejo Insular de Mallorca de 18 de mayo de 2022 (BOIB núm. 66, de 21 de mayo de 2022), rectificado por el acuerdo del Consejo Ejecutivo del Consejo Insular de Mallorca de 24 d agosto de 2022 (BOIB núm. 113, de 27 de agosto de 2022), y que también ha resultado modificado por el Acuerdo de la Comisión de Gobierno de 28 de julio de 2022, de resolución de recurso de alzada (BOIB nº 107, de 13 de agosto de 2022), se aprobó la oferta de empleo público del Consejo Insular de Mallorca y de la Agencia de Defensa del Territorio derivada de la tasa adicional para la estabilización de la ocupación temporal del artículo 2 y las disposiciones adicionales sexta y octava de la Ley 20/2021 de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público. Se incorporan a esta oferta de empleo público las plazas correspondientes a la tasa adicional para la estabilización de la ocupación temporal incluidas en las ofertas de empleo público del Consejo Insular de Mallorca y de la Agencia de Defensa del Territorio de los años 2017 y 2019 aprobadas por los acuerdos del Consejo Ejecutivo de 29 de noviembre de 2017 y de 18 de diciembre de 2019, que no han sido objeto de convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Mediante la Resolución del consejero ejecutivo de Hacienda y Función Pública, de 28 de noviembre de 2022, se aprobó la convocatoria del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de las escalas, subescalas , clases y categorías (o especialidades) de administración general y especial de los subgrupos C1, C2 y grupo E/AP derivada de la oferta de empleo público extraordinario del Consejo de Mallorca y de la Agencia de Defensa del Territorio para el año 2022 y acumuladas de 2017 y de 2019 (BOIB núm. 157, de 3 de diciembre de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. De acuerdo con la Base 6, Órganos de selección, del Anexo II, Bases específicas, de la convocatoria, el consejero ejecutivo de Hacienda y Función Pública debe nombrar a los tribunales encargados de la selección, los cuales tienen la consideración de órganos dependientes de su autoridad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Con arreglo a la mencionada Base 6, se designará un tribunal calificador para las plazas de cada subgrupo o grupo de titulación de administración general y un tribunal calificador para las plazas de cada subgrupo o grupo de titulación de administración especial , de acuerdo con los siguientes criterios:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;-Deben estar constituidos, como mínimo, por cinco miembros titulares, y el mismo número de suplentes. En caso de que resulte imposible la constitución de los tribunales calificadores con cinco miembros titulares y cinco suplentes por la falta de funcionarios de carrera, se podrán constituir con un presidente y dos vocales, uno de los cuales tiene que hacer las funciones de secretario, y el mismo número de suplentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;-El presidente o presidenta, y los vocales, uno de los cuales actuará como secretario o secretaria, deben ser nombrados por el consejero ejecutivo de Hacienda y Función Pública entre el personal funcionario de carrera del Consejo de Mallorca o de sus organismos autónomos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;-La composición debe ajustarse, salvo razones fundadas y objetivas, debidamente motivadas, al criterio de paridad entre hombres y mujeres, con capacitación, competencia y preparación adecuadas. Se considera que existe una representación equilibrada cuando en los órganos de más de cuatro miembros cada sexo está representado al menos en un 40%; en el resto, cuando ambos sexos estén representados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;-Todos los miembros de los tribunales deben poseer una titulación académica de igual o superior nivel que el exigido a los aspirantes para el ingreso. Para los tribunales calificadores de administración especial al menos uno de los miembros debe poseer una titulación correspondiente a alguna de las áreas de conocimiento de las especialidades que se convoquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De conformidad con el apartado 1 del artículo 13 del Decreto 27/1994, el nombramiento de los miembros de los tribunales debe publicarse en el Boletín Oficial de las Illes Balears y en la Sede Electrónica del Consejo de Mallorca una vez finalizado el plazo de presentación de instancias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Nombrar a los Tribunales Calificadores del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de las escalas, subescalas , clases y categorías (o especialidades) de administración general y especial de los subgrupos C1, C2 y grupo E/AP derivada de la oferta de empleo público extraordinario del Consejo de Mallorca y de la Agencia de Defensa del Territorio para el año 2022 y acumuladas de 2017 y de 2019, los cuales están constituidos por los miembros que figuran en el anexo de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.&amp;nbsp;Publicar esta Resolución en el Boletín Oficial de las Illes Balears , en la Sede Electrónica y en el tablón de edictos electrónico del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Notificar esta Resolución a las personas nombradas, haciéndoles saber que la condición de miembro del Tribunal Calificador y la consiguiente obligación de asistencia a las sesiones constituye un deber del personal funcionario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra este acto de trámite, no cabe recurso administrativo alguno, aunque la persona interesada puede alegar su oposición para su consideración en la resolución que ponga fin al procedimiento. No obstante, si se estima que concurre alguna de las circunstancias señaladas en el artículo 112.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, cabe interponer el recurso administrativo que proceda , fundamentado en cualquiera de los motivos de nulidad o anulabilidad previstos legalmente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
