En fecha 13 de mayo de 2022, la presidenta del Instituto Mallorquín de Asuntos Sociales (en lo sucesivo IMAS), dictó la Resolución por la cual se aprobó la oferta de ocupación pública de personal laboral de la Residencia Oms/San Miquel y de los centros de día Can Clar y Son Bru del Instituto Mallorquín de Asuntos Sociales derivada del proceso de estabilización de la ocupación temporal regulado a la Ley 20/2021en la oferta de ocupación pública de la IMAS para el año 2022 (BOIB n.º 66, de 21 de mayo).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Mediante la Resolución del Vicepresidente del Instituto Mallorquín de Asuntos Sociales, de fecha 30 de noviembre, se aprobaron la convocatoria, las bases y el baremo de méritos del proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral de las categorías adscritas a los grupos C, D y E de las plazas de la oferta pública extraordinaria de la Residencia Oms/Sant Miquel y de los centros de día de Can Clar y Son Bru del IMAS para el año 2022 (BOIB núm. 157, de 3 de diciembre)&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El plazo de presentación de instancias para participar en el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral de las categorías adscritas a los grupos C, D y E de la Residencia Oms/Sant Miquel y de los centros de día de Can Clar y Son Bru del IMAS finalizó el día 31 de enero de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:inline-block"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;F&lt;span style="color:#000000"&gt;undamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;o&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.- &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;De acuerdo con la base 5, Órganos de selección, del Anexo II: Bases específicas de la convocatoria aprobada por la Resolución del Vicepresidente&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt;l Instituto Mallor&lt;/span&gt;&lt;span style="color:#000000"&gt;q&lt;/span&gt;&lt;span style="color:#000000"&gt;uí&lt;/span&gt;&lt;span style="color:#000000"&gt;n de Asuntos Sociales, de fecha 30 de noviembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2022, &lt;/span&gt;&lt;span style="color:#000000"&gt;debe designarse&lt;/span&gt;&lt;span style="color:#000000"&gt; un tribunal &lt;/span&gt;&lt;span style="color:#000000"&gt;para las plazas de las categorías&lt;/span&gt;&lt;span style="color:#000000"&gt; adscritas al &lt;/span&gt;&lt;span style="color:#000000"&gt;grupo C, un tribunal para las plazas d&lt;/span&gt;&lt;span style="color:#000000"&gt;e las categorías&lt;/span&gt;&lt;span style="color:#000000"&gt; adscritas &lt;/span&gt;&lt;span style="color:#000000"&gt;al&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;grupo D y un tribunal para las categorías adscritas al grupo E, los miembros de los cuales deben ser personal laboral fijo, o, supletoriamente, funcionario de carrera, nombrado&lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt; por la Presidencia del IMAS, de acuerdo con los siguientes criterios: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Debe estar constituido, como mínimo, por cinco miembros titulares, y el mismo número de suplentes. En caso de que resulte imposible la constitución de los tribunales calificadores con cinco miembros titulares y cinco suplentes por la falta de laboral fijo, o, supletoriamente, funcionario de carrera, se podrán constituir con un presidente y dos vocales, uno de los cuales tiene que hacer las funciones de secretario, e igual número de suplentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-El presidente o presidenta y los vocales, uno de los cuales actuará como secretario o secretaria, deben ser nombrados por la Presidencia del IMAS, entre el personal laboral fijo o, supletoriamente, personal funcionario de carrera del IMAS, del Conse&lt;/span&gt;&lt;span style="color:#000000"&gt;ll &lt;/span&gt;&lt;span style="color:#000000"&gt;de Mallorca o de sus organismos autónomos. Para cada persona miembro del tribunal, se nombrará una persona titular y una suplente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;-La composición debe ajustarse, salvo razones fundadas y objetivas, debidamente motivadas, al criterio de paridad entre hombres y mujeres, con capacitación, competencia y preparación adecuadas. Se considera que existe una representación equilibrada cuando en los órganos de más de cuatro miembros cada sexo está representado al menos en un 40%; en el resto, cuando ambos sexos estén representados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;-Todos los miembros de los tribunales deben poseer una titulación académica de igual o superior nivel que el exigido a las personas aspirantes para el ingreso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Asimismo, según la base 5.2 de la citada convocatoria, no pueden formar parte de los tribunales los cargos de naturaleza política y el personal eventual de la Administración, tanto si están en activo como si hace menos de cuatro años del cese.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Tampoco pueden formar parte de los tribunales aquellas personas que hayan realizado las tareas de preparación de aspirantes a pruebas selectivas para la escala, subescala, clase, categoría o especialidad de que se trate en los tres años anteriores a la publicación de la convocatoria correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A tal efecto, la Administración, con carácter previo al nombramiento como miembro del tribunal, solicitará a los seleccionados la declaración correspondiente de no haber preparado a aspirantes en el período de tiempo señalado antes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Asimismo, tampoco pueden formar parte los representantes de las empleadas y empleados públicos, sin perjuicio de las funciones de vigilancia y vela del buen desarrollo del procedimiento selectivo. A estos efectos, las personas representantes designadas deben comunicar esta designación a la Administración con la antelación suficiente para garantizar que no se interfiere en el adecuado funcionamiento del procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;De acuerdo con la base 5.3, las personas que son miembros del tribunal deben abstenerse de formar parte de la misma si concurren los motivos de abstención que se prevén en el artículo 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Las personas aspirantes pueden promover la recusación de algún miembro del tribunal calificador en cualquier momento de la tramitación del procedimiento, mediante escrito, en el que debe expresarse la causa o causas en que se fundamenta, de acuerdo con el que se prevé en el artículo 24 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;La abstención y recusación de los miembros de los tribunales calificadores se sustanciarán de acuerdo con lo dispuesto en los artículos 23 y 24 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Publicar esta Resolución en el Boletín Oficial de las Islas Baleares, en la Sede Electrónica del Consell de Mallorca y en el tablón de edictos electrónico del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3. Notificar esta resolución a las personas nombradas, haciéndoles saber que la condición de miembro del Tribunal Calificador y la consiguiente obligación de asistencia constituye un deber del personal funcionario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta resolución no pone fin a la vía administrativa y contra ella puede interponerse, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consell Ejecutivo del Consell Insular de Mallorca, dentro del plazo de un mes, a contar a partir del día siguiente de su publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimación expresa del recurso de alzada, podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, a contar a partir del día siguiente al de la notificación de la desestimación de dicho recurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimación por silencio del recurso de alzada, podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente de la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
