    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El día 17 de diciembre se publicó al BOIB n.º 164 la Resolución del director general del Ente Público de Radiotelevisión de las Islas Baleares por la cual se aprueba la convocatoria del proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal laboral del Ente Público de Radiotelevisión de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. De acuerdo con la base 19.1.1. de la convocatoria el tribunal es el órgano de selección encargado de llevar a cabo este proceso selectivo. Se tiene que constituir un tribunal por cada grupo profesional. Los tribunales se tienen que ajustar, a la composición, a la disposición adicional decimocuarta del Decreto Ley 6/2022, de 13 de junio que prevé que se podrán constituir con un presidente y dos vocales, uno de los cuales tiene que hacer las funciones de secretario, y el mismo número de suplentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. De acuerdo con la base 19.1.3 de la convocatoria la determinación de la composición de los tribunales se tiene que llevar a cabo de acuerdo con las normas siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;a) El presidente será designado libremente por el director del Ente Público de Radiotelevisión de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Los vocales tienen que ser nombrados por sorteo entre el personal laboral fijo en situación de servicio activo en Ente Público de Radiotelevisión de las Islas Baleares que pertenezcan al grupo de que se trate. El sorteo se hará con la participación del Comité de Empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;c) En el supuesto de que no haya personal laboral fijo suficiente para constituir los diferentes tribunales se solicitará a la Conselleria de Presidencia, Función Pública e Igualdad que designe funcionarios de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;d) La secretaría corresponderá a la persona designada por votación del tribunal entre las personas designadas como vocales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. El día 13 de abril de 2023 ha tenido lugar la sesión con el Comité de Empresa en la cual se ha llevado a cabo el sorteo entre el personal laboral fijo del Ente para formar parte del tribunal del proceso extraordinario de estabilización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;5. El día 13 de abril de 2023 ha tenido entrada al Ente Público de Radiotelevisión de las Islas Baleares el oficio del secretario de la Consellería de Presidencia Función Pública e Igualdad por el cual designa funcionarios para formar parte de los tribunales de los grupos A y B.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El Decreto Ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en la ocupación pública de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. La Ley 7/2010, de 21 de julio, del sector público instrumental de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Ley 15/2010, de 22 de diciembre, del Ente Público de Radiotelevisión de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Nombrar a los miembros de los órganos de selección del proceso de estabilización por concurso extraordinario de méritos del Ente Público de Radiotelevisión de las Islas Baleares de acuerdo con el Anexo de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el director del Ente Público de Radiotelevisión de las Islas Baleares en el plazo de un mes contado desde el día siguiente a la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante el Juzgado de lo contencioso-administrativo en el plazo de dos meses contados desde el día siguiente a la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
