    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de setiembre de 2015 por la cual se convocan subvenciones para la Creación de empresas de Jóvenes agricultores, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha de 6&amp;nbsp;de febrero de 2023, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor del interesado que figura en el anexo de la Resolución con los datos e importes correspondientes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 27 de junio de 2019, en el BOIB núm. 85, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, R8 de 6 de junio de 2019, en la que se incluye JORDI LLINAS POCOVI (núm. Exp. CEJA2018_1/112), con un importe prima de 45.000, 00 € y anualidad 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El 10 de diciembre de 2019 (con registro de entrada 24702) presenta la solicitud del primer y del segundo pago. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.El 27 de enero de 2023 (con registro de entrada 75673), el beneficiario presenta la solicitud de desistimiento del complemento de 5.000,00 € por explotación en producción integrada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por ello, implica realizar una revocación parcial de 5.000,00 euros, por tanto, el importe de concesión asciende a 40.000,00 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Revocar parcialmente las&amp;nbsp;r&lt;/em&gt;&lt;em&gt;esoluci&lt;/em&gt;&lt;em&gt;o&lt;/em&gt;&lt;em&gt;n&lt;/em&gt;&lt;em&gt;es&lt;/em&gt;&lt;em&gt;&amp;nbsp;de ayuda concedida&lt;/em&gt;&lt;em&gt;s&lt;/em&gt;&lt;em&gt;&amp;nbsp;a&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;as personas&lt;/em&gt;&lt;em&gt;&amp;nbsp;beneficiari&lt;/em&gt;&lt;em&gt;as&lt;/em&gt;&lt;em&gt;, por el importe y con los &lt;/em&gt;&lt;em&gt;plaz&lt;/em&gt;&lt;em&gt;os detallados en el anexo de esta Resolución, que es un total de 1 expediente y que empieza y termina por &lt;/em&gt;&lt;em&gt;&lt;em&gt;JORDI LLINAS POCOVI&lt;/em&gt;&lt;/em&gt;&lt;em&gt;, que suma un total de &lt;/em&gt;&lt;em&gt;5&lt;/em&gt;&lt;em&gt;.000,00 &lt;/em&gt;&lt;em&gt;euros&lt;/em&gt;&lt;em&gt;, relativa a la línea de ayuda &lt;/em&gt;&lt;em&gt;“Creación de empresas de jóvenes agricultores”.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, y los&amp;nbsp;artículos&amp;nbsp;121 y 122&amp;nbsp;de la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las Administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
