&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 14 de julio de 2021 (BOIB núm. 101 de 29 de julio de 2021; corrección de errores en el BOIB núm. 152 de 4 de noviembre de 2021 y BOIB núm. 170 de 11 de diciembre de 2021), se convocó un concurso-oposición para cubrir plazas vacantes de la categoría técnico medio sanitario/técnica media sanitaria en cuidados auxiliares de enfermería del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 23 de enero de 2023 (Publicación en el portal web www.ibsalut.es y en la sede electrónica del Gobierno de las Islas Baleares) se aprobó la lista de personas candidatas que habían superado el proceso selectivo y se dio un plazo de veinte días hábiles para que presentaran la documentación que se relacionaba.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Por medio de la resolución del director general del Servicio de Salud de las Islas Baleares de 23 de marzo de 2023 (BOIB núm. 40, de 30 de marzo de 2023) se nombró personal estatutario fijo y se adjudicaron las plazas ofertadas a las personas que aportaron la documentación indicada en las bases de la &lt;span style="color:black"&gt;convocatoria y se acreditó mediante certificado del Servicio de Prevención la capacidad funcional para el puesto de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Las personas indicadas en el anexo 1 de esta resolución solicitaron aplazamiento de su nombramiento como personal estatutario fijo acogiéndose al punto 14.3 de la Resolución del director general del Servicio de Salud de las Islas Baleares de 14 de julio de 2021, por imposibilidad debidamente acreditada para incorporarse a su puesto de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Las personas interesadas han sido dadas de alta y declaradas aptas por el Servicio de Prevención de Riesgos Laborales del Servicio de Salud. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 55/2003, de 16 de diciembre, del estatuto marco del personal estatutario de los servicios de salud.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Texto refundido de la Ley del estatuto básico del empleado público, aprobado por el Real decreto legislativo 5/2015, de 30 de octubre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Real decreto ley 1/1999, de 8 de enero, sobre selección de personal estatutario y provisión de plazas a las instituciones sanitarias de la Seguridad Social —vigente con rango reglamentario y sin carácter básico en virtud de la disposición transitoria sexta de la Ley 55/2003.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.&amp;nbsp;&amp;nbsp; El Decreto 8/2018, de 23 de marzo, por el que se regula la capacitación lingüística del personal estatutario del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.&amp;nbsp;&amp;nbsp; La Resolución del director general del Servicio de Salud de las Islas Baleares de 14 de julio de 2021 por la que se convoca el concurso-oposición para cubrir plazas vacantes de la categoría de técnico medio sanitario/técnica media sanitaria en cuidado auxiliares de enfermería dependientes del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.&amp;nbsp;&amp;nbsp; El artículo 72.1 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, dispone que “de acuerdo con el principio de simplificación administrativa, se acordarán en un solo acto todos los trámites que, por su naturaleza, admitan un impulso simultáneo y no sea obligado su cumplimiento sucesivo”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Nombrar personal estatutario fijo de la categoría de técnico medio sanitario/técnica media sanitaria en cuidados auxiliares de enfermería dependientes del Servicio de Salud de las Islas Baleares a&amp;nbsp; las personas que figuran en el anexo 1 de esta resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Adjudicar los puestos de trabajo, de acuerdo con lo que se indica en el anexo 2, a las personas candidatas que han superado las pruebas selectivas para el ingreso por el turno libre, en la categoría técnico medio sanitario/técnica media sanitaria en cuidados auxiliares de enfermería del Servicio de Salut de las Islas Baleares, después de haber presentado la documentación pertinente, de acuerdo con la petición efectuada por los candidatos y la puntuación obtenida en el proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Determinar que la toma de posesión debe efectuarse en el plazo de un mes a contar desde el día siguiente a la fecha de publicación de esta resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares &lt;/em&gt;y recordar que perderán el derecho a tomar posesión de la plaza las personas que no se incorporen a su destino en dicho plazo, excepto en los casos de imposibilidad acreditada y apreciada por el órgano convocante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Establecer que, antes de tomar posesión de la plaza, cada adjudicatario ha de hacer constar que no ocupa ningún puesto de trabajo en el sector público&amp;nbsp; ni&amp;nbsp; lleva a cabo ninguna actividad&amp;nbsp; de las que comprende el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. Si lleva a cabo alguna actividad privada —incluidas las de carácter profesional— tiene la obligación&amp;nbsp; que declararlo en el plazo de diez días hábiles a contar desde el día siguiente a la fecha de la toma de posesión a fin de que el órgano competente acuerde la declaración de compatibilidad o de incompatibilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Recordar que, de acuerdo con la base 14.6 de la convocatoria el personal que haya obtenido un destino definitivo no puede participar en los concursos de provisión de plazas durante un plazo mínimo de un año a contar desde el día en que se tome posesión de la plaza básica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Publicar esta resolución en &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución –que agota la vía administrativa- se puede interponer un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contenciosa-Administrativo, en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con el artículo&amp;nbsp; 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, sin perjuicio de cualquier otro recurso que se considere oportuno interponer.&lt;/span&gt;&lt;/p&gt;
