&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El Pleno del Ayuntamiento en sesión de día 13 de febrero de 2023 aprobó definitivamente el precio público por eventos, actividades, espectáculos, actuaciones culturales y similares organizadas y/o programadas por el Ayuntamiento de Manacor; y transcurrido el plazo previsto en el artículo 103 de la Ley 20/2006, de 15 de diciembre, municipal y régimen local, se procede a la publicación del texto íntegro en ese Boletín Oficial, el cual entrará en vigor el día siguiente al de su publicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;«Aprobación precio público por eventos, actividades, espectáculos, actuaciones culturales y similares organizadas y/o programadas por el Ayuntamiento.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El Pleno del Ayuntamiento en sesión de día 14 de noviembre de 2022 acordó aprobar provisionalmente el Precio Público por eventos, actividades, espectáculos, actuaciones culturales y similares organizadas y/o programadas por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. El acuerdo de aprobación provisional se publicó en el tablón de anuncios de la sede electrónica del Ayuntamiento de Manacor en fecha 17 de noviembre de 2022 y en el Boletín Oficial de las Illes Balears núm. 148 de día 17 de noviembre de 2022, quedando expuesto por un plazo de 30 días hábiles a efectos de que los interesados pudieran examinar el expediente y presentar las reclamaciones que estimaran oportunas. Dentro del plazo legalmente establecido, se presentaron las siguientes alegaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;GRUPO MUNICIPAL POPULAR DE MANACOR, día 14 DE DICIEMBRE DE 2022 (RGE 15129)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. En cumplimiento del arte. 102 c) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;local de las Islas Baleares, se procedió a dar audiencia previa durante 30 días hábiles a las asociaciones vecinales y de defensa de las personas consumidoras y usuarias establecidas en el ámbito territorial de Manacor que estén inscritas en el registro municipal y cuyas finalidades guarden relación con el objeto de la disposición aprobada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Transcurrido el plazo otorgado, no se ha presentado ninguna alegación ni reclamación por parte de las asociaciones notificadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. De conformidad con el artículo 5 de la Ley 11/2016, de 28 de julio, de igualdad entre mujeres y hombres, se solicitó al Instituto Balear de la Mujer el correspondiente informe de evaluación de impacto de género, el cual se emitió en fecha 25 de noviembre de 2022, 7 (RGE 21436, de 28 de noviembre de 2022), que concluye que “En la redacción de la normativa no se ha detectado ninguna situación de desigualdad por cuestión de género, y se considera neutro dado que su aplicación no producirá efectos diferenciadores sobre las mujeres y los hombres y no incidirá en la posible situación de desigualdad que se encuentren, puesto que la variable del género no es relevante para su desarrollo y aplicación.“&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Informe jurídico sobre desestimación de las alegaciones presentadas y propuesta de acuerdo, emitido por la TAG de Promoción Económica con la conformidad del secretario general con fecha 30 de enero de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Arte. 4.1.a) de la de la Ley 7/1985, 2 de abril, reguladora de las Bases de Régimen Local, en cuanto a la potestad reglamentaria del Ayuntamiento para dictar disposiciones de carácter general y de rango inferior a ley, sin que , en ningún caso, estas disposiciones puedan contener preceptos contrarios a las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Arte. 49 de la de la Ley 7/1985, 2 de abril, reguladora de las Bases de Régimen Local, en cuanto al procedimiento a seguir para la aprobación de las ordenanzas locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Arte. 70.2 y 65.2 de la de la Ley 7/1985, 2 de abril, reguladora de las Bases de Régimen Local, en cuanto a la publicación y entrada en vigor de las ordenanzas y reglamentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Arte. 3.3 d) 1º del RD 128/2018, de 16 de marzo, por el que se regula el régimen jurídico de los funcionarios de administración local con habilitación de carácter nacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Artes. 85 y 102 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears, en cuanto a la obligatoriedad de los informes previos de adecuación a la legalidad y al procedimiento de elaboración de reglamentos y ordenanzas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Arte. 22.2 de la de la Ley 7/1985, 2 de abril, reguladora de las Bases de Régimen Local en cuanto a la competencia para la aprobación de las ordenanzas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. Arte. 47.1 de la de la Ley 7/1985, 2 de abril, reguladora de las Bases de Régimen Local, en cuanto a que el acuerdo será adoptado por mayoría simple de los miembros presentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8. Artículo 133 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, en cuanto a la participación de los ciudadanos y ciudadanas en el procedimiento de elaboración de normas con rango de ley o reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;9. Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;10. Artes. 6 y 20 de la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;11. Artes. 41 y ss del RDL 2/2004, de 5 de marzo, por el que se aprueba el Texto refundido de la Ley Reguladora de las Haciendas Locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, proposo que, previo dictamen de la Comisión Informativa General, el Pleno del Ayuntamiento adopte lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Desestimar las alegaciones presentadas por el GRUPO MUNICIPAL POPULAR DE MANACOR el día 14 de diciembre de 2022 y RGE 15129 por los motivos expuestos en el informe jurídico de la TAG de Gestión Tributaria con la conformidad del Secretario General.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Aprobar definitivamente el precio público por eventos, actividades, espectáculos, actuaciones culturales y similares organizadas y/o programadas por el Ayuntamiento de Manacor, de acuerdo con el texto que se determinará a continuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Publicar el Acuerdo de aprobación definitiva en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. De acuerdo con lo previsto en el artículo 7 del texto del Precio Público, se delega la competencia para la modificación de este precio público en la Junta de Gobierno Local, de conformidad con el artículo 47 del RDL 2/ 2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, en relación con el artículo 23.2.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La entrada en vigor queda prevista para el día de la publicación del texto íntegro en el BOIB, una vez comunicado el acuerdo de aprobación definitiva del precio público, con el envío de una copia del texto en el Gobierno de las Islas Baleares y en la Delegación del Gobierno en efectos previstos en el artículo 113 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local, y transcurrido el plazo de 15 días hábiles desde que estos organismos reciben la copia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;PRECIO PÚBLICO 07.POD POR EVENTOS, ACTIVIDADES, ESPECTÁCULOS Y ACTUACIONES CULTURALES Y SIMILARES ORGANIZADAS Y/O PROGRAMADAS POR EL AYUNTAMIENTO DE MANACOR&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;FUNDAMENTO LEGAL Y OBJETO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Ejercitando la facultad reconocida en el artículo 106 de la Ley 7/1985, de 2 de abril, y de acuerdo con lo que prevé el artículo 41 del Real decreto legislativo 2/2004 Texto refundido de la Ley reguladora de las haciendas locales, este Ayuntamiento establece precio público por eventos, actividades espectáculos y actuaciones culturales y similares organizadas y/programadas por el Ayuntamiento de Manacor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;HECHO IMPONIBLE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Constituye el hecho imponible de este precio público la asistencia o participación en todo tipo de eventos, actividades, espectáculos y actuaciones culturales o similares organizadas o programadas por el Ayuntamiento de Manacor, con excepción de aquellas que se ofrezcan con carácter gratuito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;SUJETOS PASIVOS OBLIGADOS AL PAGO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 3&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Están obligados al pago de este precio público las personas participantes o beneficiarias de las actividades que constituyen su objeto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;CUANTÍA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 4&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El importe de los precios públicos deberá cubrir como mínimo el coste del servicio prestado o de la actividad realizada y vendrá determinado por el aforo previsto para el evento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La cuantía del precio público se determinará aplicando el siguiente cuadro de TARIFAS:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Cuando existan razones sociales, benéficas, culturales o de interés público que así lo aconsejen, el Ayuntamiento, mediante acuerdo de la Junta de Gobierno Local podrá fijar precios públicos por debajo del límite previsto en el apartado anterior, previo informe justificativo del técnico del área correspondiente y a propuesta del concejal o concejala.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Asimismo, en aquellos espectáculos benéfico-sociales, así como los desarrollados durante las fiestas locales o regionales o cualquier otro en los que pudiera considerarse adecuado, dada la finalidad del mismo y su repercusión social, el Ayuntamiento podrá establecer su reducción o la gratuidad, mediante acuerdo de la Junta de Gobierno Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En estos casos deberán consignarse en los presupuestos de la entidad las dotaciones oportunas para la cobertura de la diferencia resultante si la hubiere.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Los precios públicos establecidos corresponden a precios antes de los impuestos que sean de aplicación en su momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ACREDITACIÓN Y DEVENGO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 5.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se devenga el precio público y nace la obligación de pago, cuando se preste el servicio o se lleve a cabo la actividad, actuación, evento o espectáculo, si bien el Ayuntamiento podrá exigir el depósito previo en el momento que se solicite licite el servicio, cuando se considere adecuado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;NORMAS DE GESTIÓN&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Se exigirá el precio público conforme a la expedición de la entrada o reserva en el espectáculo o evento solicitado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La obligación de pago del precio público nace desde el momento en que se inicie la prestación del servicio o la realización de la actividad, si bien podrá exigirse el depósito previo en el momento en que se solicite el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Devengado el precio público y consignado el depósito previo, se extenderá por parte del personal municipal o al que se delegue, una entrada justificante del ingreso del precio público, que tendrá consideración de carta de pago del ingreso efectuado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. El Ayuntamiento podrá habilitar sistemas de pago online, mediante la web www.enviumanacor.cat u otros, para aquellos eventos que así se determine.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. En los casos que se considere adecuado, se podrá establecer un sistema de entrada nominal, de modo que el título o ticket de entrada estaría vinculado a una persona determinada, para facilitar su control de acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Cuando por causas no imputables al obligado al pago, el servicio o la actividad no se preste o se desarrolle, procederá la devolución del importe correspondiente, previa solicitud de la persona interesada. También podrá tramitarse la devolución de oficio, en base a un informe del técnico o técnica del área correspondiente, a través del procedimiento de gestión tributaria previsto a estos efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;MODIFICACIONES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;ARTÍCULO 7&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De conformidad con lo que prevé el artículo 47 del RDL 2/2004, de 5 de marzo, que aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, la modificación de este precio público corresponderá a la Junta de Gobierno Local, por delegación del Pleno conforme al artículo 23.2.b) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La entrada en vigor queda prevista para el día de la publicación del texto íntegro en el BOIB, una vez comunicado el acuerdo de aprobación definitiva del precio público, con el envío de una copia del texto en el Gobierno de las Islas Baleares y en la Delegación del Gobierno en efectos previstos en el artículo 113 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local, y transcurrido el plazo de 15 días hábiles desde que estos organismos reciben la copia»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra este acuerdo que pone fin a la vía administrativa, se puede interponer recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el siguiente al de la publicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
