    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;El Consejo Ejecutivo del Consell Insular de Mallorca, reunido en sesión ordinaria de día 2 de marzo de 2023, ha adoptado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;"Por acuerdo del Consejo Ejecutivo de día 16 de noviembre de 2022 (BOIB núm.&amp;nbsp;153, de 24 de noviembre de 2022) se delegaron en los consejeros ejecutivos y las consejeras ejecutivas las atribuciones del Consejo Ejecutivo como órgano de contratación y de encargos de gestión a medios propios personificados, la aprobación de determinados proyectos de obra, la aprobación de las convocatorias de ayudas y subvenciones de cuantía inferior a doscientos cincuenta mil euros y la incoación y resolución de expedientes disciplinarios por la comisión de faltas leves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;El acuerdo de delegación preveía la necesidad de obtener la autorización previa por parte del Consejo Ejecutivo en determinados contratos y convocatorias de ayudas y subvenciones.&amp;nbsp;La aplicación práctica de este acuerdo ha supuesto que sea necesaria su modificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Por todo ello, propongo al Consejo Ejecutivo que adopte el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Primero.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes por razón de la materia, las competencias de órgano de contratación en todo tipo de contratos siempre que su valor estimado sea inferior a veinte millones de euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Los contratos en que su valor estimado sea igual o superior a cincuenta mil euros requerirán la autorización previa del Consejo Ejecutivo antes de aprobar el expediente de contratación;&amp;nbsp;a efectos de obtener esta autorización será necesario incorporar al expediente los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;a)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Justificación sobre la necesidad e idoneidad del contrato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;b)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Certificado de existencia de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;c)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Pliego de cláusulas administrativas particulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;d)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Informe del servicio jurídico en el pliego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Los contratos mencionados requerirán también la autorización previa del Consejo Ejecutivo para aprobar las modificaciones no previstas que representen un porcentaje que aislada o conjuntamente supere el 10% del precio inicial del contrato, IVA excluido,&amp;nbsp;siempre que el importe de esta modificación sea igual o superior a&lt;em&gt;&amp;nbsp;&lt;/em&gt;cincuenta mil euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Segundo.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes por razón de la materia, la aprobación de los proyectos de obra con un presupuesto base de licitación inferior cincuenta mil euros, excepto que comporten la expropiación forzosa de bienes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Tercero.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes por razón de la materia, los encargos de gestión a medios propios personificados.&amp;nbsp;Cuando el importe del gasto de los encargos sea igual o superior a cincuenta mil euros requerirán la autorización previa del Consejo Ejecutivo antes de aprobarse el expediente;&amp;nbsp;a efectos de obtener la autorización del Consejo Ejecutivo será necesario incorporar al expediente los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;a)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Justificación sobre la necesidad e idoneidad del contrato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;b)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Certificado de existencia de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Cuarto.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes por razón de la materia, la aprobación de las convocatorias de ayudas y subvenciones y aportaciones de cuantía inferior a doscientos cincuenta mil euros.&amp;nbsp;En todo caso, requerirán de autorización previa del Consejo Ejecutivo para la aprobación del gasto de las convocatorias de cuantía superior a cincuenta mil euros;&amp;nbsp;a efectos de obtener la autorización del Consejo Ejecutivo con respecto a la convocatoria de ayudas y subvenciones será necesario incorporar al expediente los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;a)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#fdfdfc"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Memoria justificativa donde deberá constar la siguiente información:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;-&lt;/span&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Si se regula por la Ordenanza General de Subvenciones o por sus bases específicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;-&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Tipo de convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;-&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Finalidades y objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;-&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Previsión al Plan Estratégico de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;-&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Si es ampliable o no el crédito presupuestario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;b)&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#fdfdfc"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Certificado de existencia de crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Quinto.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Delegar en los consejeros ejecutivos y las consejeras ejecutivas, competentes por razón de la materia, la incoación y resolución de los expedientes disciplinarios por la comisión de faltas leves respecto al personal adscrito a su departamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Sexto.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Disponer que los actos administrativos y resoluciones que se dicten en el ejercicio de estas delegaciones, deben señalar expresamente esta circunstancia y se considerarán actos del Consejo Ejecutivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Séptimo.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Dejar sin efectos el acuerdo del Consejo Ejecutivo de día 16 de noviembre de 2022 (BOIB núm. 153, de 24 de noviembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Octavo.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&amp;nbsp;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Publicar este acuerdo en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las Islas Baleares,&amp;nbsp;&lt;/em&gt;que entrará en vigor el mismo día en que se publique."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
