es CAIB 670624 text/html CAIB es 157736 11285 CAIB 11288 2023-03-04 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Mediante el decreto AJT 202303844, de fecha 28/02/2023, se ha acordado lo siguiente:</span></span></p> <p><strong>1.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Modificar el régimen de libranza de los auto taxis para el periodo comprendido entre el 1 y el 31 de marzo de 2022.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Se regirá por dos regímenes de turnos: S1 y S2, observando una jornada diaria de doce horas y media (12,5 h) con franjas horarias comprendidas entre la 1:45 h y las 14:15 h, y otra franja entre las 13:45 h y las 2:15 h del día siguiente, alternativamente según meses con la siguiente distribución:</span></p> <table border="1" cellspacing="0" class="Table" style="border-collapse:collapse; Sin embargo, este horario ampliado no se aplicará a los servicios de auto taxi iniciados en el aeropuerto y el puerto.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em>b)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Entre las 20:00 horas del día 31 de marzo y las 8:00 horas del 1 de abril, los auto taxis están exentos del régimen de turnos, período en el que pueden dar servicio sin restricción. Sin embargo, este horario ampliado no se aplicará a los servicios de auto taxi iniciados en el aeropuerto y el puerto.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em>c)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Entre las 23:00 horas de los viernes y las 6:00 horas de la mañana siguiente, así como entre las 23:00 horas de los sábados y las 6:00 horas de la mañana siguiente, ambas correspondientes al mes de marzo, los auto taxis están exentos del régimen de turnos, período en el que pueden dar servicio sin restricción. Sin embargo, este horario ampliado no se aplicará a los servicios de auto taxi iniciados en el aeropuerto y el puerto.</span></p> <p><strong>2.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Modificar el régimen de libranza de los auto taxis por el período comprendido entre el 1 de abril y el 31 de octubre de 2023, de forma que exista un único turno con jornada diaria de 24h, con límite entre jornadas a las 6:00 h de la mañana. </span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Con aplicación de las siguientes previsiones en materia de libranza y restricción geográfica para el inicio de servicio.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Los taxis afectados observarán las siguientes jornadas de libranza:</span></p> <table border="1" cellspacing="0" class="Table" style="border-collapse:collapse; margin-left:40px; margin-right:0px; margin-top:0px"><em>b)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> En los días que se preste servicio coincidiendo con libranzas voluntarias los taxis afectados tendrán que abstenerse de iniciar el servicio en el puerto, aeropuerto y zonas de Can Pastilla y Playa de Palma, desde la calle Déntol hasta la divisoria del término municipal de Llucmajor.</span></p> <p><strong>3.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Modificar extraordinariamente el régimen de jornada y libranza de los auto taxis adaptados comprendido entre el 1 de marzo y el 31 de octubre de 2023, que le será de aplicación la siguiente distribución, mensualmente configurada, de los días de libranza de los auto taxis incluidos en el Registro de auto taxis que integran la flota de los referidos vehículos adaptados, con previsión de los turnos especiales denominados M1, M2, M3, M4, M5 y M6, determinando que los taxis adaptados tendrán que prestar servicio indistintamente durante cuatro jornadas, observando a continuación cada taxi una jornada de Turno de Guardia y seguidamente, observar una jornada de libranza opcional. En estos días, los taxis adaptados no podrán iniciar la prestación del servicio en el puerto, ni en el aeropuerto, excepto para la realización de un servicio especial que requiera este tipo de vehículos. Satisfacer, con absoluta prioridad y diligencia profesional, las demandas de servicios de usuarios que requieren vehículos adaptados, ya sean recibidas mediante el sistema de radio teléfono municipalmente instalado o mediante cualquier otra modalidad reglamentaria de acceso al servicio, con especial atención a servicios sanitarios.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">ii. Atender las demandas de los usuarios, a efectos de obtención de servicios de auto taxi adaptado, con cobertura de las 24 horas de cada jornada, con despliegue y utilización de los medios, instalaciones y modos de actuación previstos en el Decreto núm. 11078, de 14 de septiembre de 2001 (BOIB núm. 154, de 25 de diciembre de 2001).</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">iii. Al objeto de preservar la especial prestación del servicio a los usuarios con movilidad reducida, durante las jornadas de guardia, los auto taxis afectados se abstendrán de atender servicios generales asignados mediante las emisoras que operan en el ámbito de servicio municipal de auto taxi, limitándose, como norma general, a quienes estén expresamente demandados por usuarios con movilidad reducida, con la única excepción de aquellos servicios que, prestados en momentos marginales de la jornada, no interfieran significativamente en la obligación principal y preferente de prestar servicio a usuarios destinatarios de la adaptación de vehículos. Con el fin de preservar esta obligación principal, se instalarán los dispositivos técnicos que permitan atender, de forma preferente, las demandas de estos usuarios, sin interferencia funcional alguna con la transmisión de las emisoras que operan con carácter general en el servicio municipal de auto taxi.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">iv. Estos dispositivos pueden ser de tipo portátil de transmisión-recepción, dispositivo de manos libres, o de la modalidad técnica que garantice satisfacer su finalidad.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#202124">v. Los incumplimientos en la prestación del servicio, relacionados con las determinaciones de la presente regulación, serán objeto de los oportunos procedimientos sancionadores, en aplicación de la tipificación prevista por los artículos 79.16 y 80.2 del Reglamento municipal regulador del servicio, en concepto de falta muy grave o grave, por negar injustificadamente la prestación del servicio o no concurrencia al mismo, respectivamente.</span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">vi. Las jornadas de libranza y de guardia, de acuerdo con la vigente normativa general en materia de turnos de auto taxi, se iniciarán a las 6:00 horas del día resultante de la presente regulación, con reincorporación al servicio, después de cada libranza, a las 6:00 horas del día siguiente.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">vii. Los distintivos especiales para vehículos adaptados resultarán de exhibición obligatoria, en los términos del artículo 35 <em>g)</em> del Reglamento municipal regulador del servicio, debiendo estar complementados por el símbolo internacional de accesibilidad.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">viii. Las libranzas especiales, resultantes de la presente regulación, serán compatibles con la prestación de servicios interurbanos previa y específicamente demandados por usuarios destinatarios de la adaptación incorporada por los vehículos, en concordancia con las normas reguladoras del régimen específico de recogida de viajeros fuera del término municipal, en trayectos previamente concertados acogidos a régimen de reciprocidad, hacia el puerto y el aeropuerto, según lo establecido en la Orden del consejero de Obras Públicas, Vivienda y Transportes, de 7 de noviembre de 2000 (BOIB núm. 140, de 16 de noviembre de 2000). Exclusión que incluso afecta a los servicios previamente concertados, con origen en el puerto y el aeropuerto y con destino a cualquier otro municipio.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#202124">ix. Sin embargo, a aquellos taxis incluidos en el registro municipal de vehículos accesibles, cuando por razón de avería incorporen temporalmente un vehículo sin adaptación, les será asignado el turno de prestaciones mensual alterna del tipo S1 o S2, durante la temporada baja, según su número de licencia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.-</strong> Por razones de homogeneidad en la técnica de control de las tarifas, la modalidad turística Taxi Tour, implantada mediante Acuerdo plenario de 30 de junio de 2005, será objeto de inclusión en el funcionamiento del taxímetro, así como de señalización exterior en el indicador luminoso de tarifas. Reflejando el valor 'cero' en la cuantía del taxímetro y en el indicador luminoso homologado de tarifas múltiples.</span></p> <p><strong>5.-</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> Sin perjuicio de lo establecido en la presente resolución, sobre integración de los servicios interurbanos en el cómputo efectuado por el sistema de control horario automatizado, los servicios interurbanos previamente concertados acogidos al citado régimen de reciprocidad, hacia el puerto y el aeropuerto, así como los servicios previamente concertados que tengan origen en el puerto y el aeropuerto, con destino a cualquier otro municipio, quedan excluidos del presente régimen de turnos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#333333">6.-</span></strong><span style="color:#333333"> El sistema de turnos establecido se rige por el número de licencia. No será obligatoria la exhibición del distintivo de turnos de trabajo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#202124">7.-</span></strong><span style="color:#202124"> Mediante Decreto de Alcaldía podrán ampliarse las determinaciones que desplieguen o complementen el régimen de turnos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#202124">8.-</span></strong><span style="color:#202124"> Dejar sin efecto las resoluciones reguladoras de los turnos de trabajo de auto taxi que resulten contrarias al presente decreto.
