El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III)<em> </em>mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB n.º 103, de 6 de agosto de 2022).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los técnicos de la Dirección General de Energía y Cambio Climático examinaron las solicitudes y emitieron un informe desfavorable sobre las solicitudes de subvención descritas en el anexo con la motivación que figura en este anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El 6 de febrero de 2023, se emitió una propuesta de resolución denegatoria del director general de Energía y Cambio Climático (BOIB n.º 19, de 11 de febrero de 2023).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 23 de febrero de 2023, DANIEL DEL VALLE DOMINGUEZ, titular del expediente&nbsp; MOVESIII-2629/2021, presentó alegaciones a la propuesta de resolución de denegación de la ayuda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vez valorada la documentación presentada se emitió un informe DESFAVORABLE a la alegación a la denegación de la solicitud dado que la documentación incumple los puntos 4.2.g) y 11.3.1.f) de la convocatoria pública de referencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la facturada modificada que el interesado aporta en las alegaciones, se aplica un descuento de 1.000€ ficticio, puesto que también se encarece en 1.000€ el precio inicial del vehículo antes de aplicar los impuestos. Tanto en la factura aportada inicialmente como en la modificada el precio final del vehículo después de aplicar los impuestos es el mismo, y por tanto no hay ningún descuento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Se ha agotado el plazo de diez días hábiles que se concedían para presentar alegaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Decreto Legislativo&nbsp;2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto&nbsp;75/2004, de 27 de agosto, por el que se despliegan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB n.º 122, de 2 de septiembre de 2004).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB n.º&nbsp;72, de 24 de mayo de 2008).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Real Decreto&nbsp;266/2021, de 13 de abril, por el que se aprueba la concesión directa de ayudas a las comunidades autónomas y a las ciudades de Ceuta y Melilla para la ejecución de programas de incentivos ligados a la movilidad eléctrica (MOVES&nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOE n.º&nbsp;89, de 14 de abril de 2021).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º&nbsp;88, de 3 de julio de 2021).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática, de 3 de agosto de 2022, por la cual se modifica y amplía el crédito de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática, de 28 de junio de 2021, por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo financiado por la Unión Europea – NextGenerationEU (BOIB n.º 103, de 6 de agosto de 2022).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Denegar la concesión de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el motivo que figura en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos&nbsp;123 y 124 de la Ley&nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&nbsp;57 de la Ley&nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
