CAIB es 10381 2023-03-02 10382 152193 90 2023-03-02 text/html ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Mediante el Acuerdo del Consejo de la Sindicatura de 21 de junio de 2022 (BOIB n.º 86, de 2 de julio de 2022) se aprobaron la convocatoria, las bases, los ejercicios, el baremo de méritos y el temario, y se designó el Tribunal Calificador de las pruebas selectivas para el ingreso, por el turno libre, en el cuerpo de auditores de la Sindicatura de Cuentas de las Illes Balears.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Una vez finalizadas las fases de concurso y de oposición de dichas pruebas selectivas, el 17 de febrero de 2023, el Tribunal Calificador elevó al síndico mayor la relación de aspirantes que habían superado el concurso oposición.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La base 9.4 de dichas pruebas selectivas dispone que el síndico mayor, a la vista de la relación definitiva de aspirantes que han superado el concurso oposición, dictará la resolución que ordene su publicación en el Boletín Oficial de las Illes Balears.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La base 10.1 de las pruebas selectivas mencionadas establece que en el plazo de veinte días naturales, a contar desde el día siguiente de su publicación en el BOIB, los aspirantes seleccionados han de presentar varios documentos.&nbsp;</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello,</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESUELVE</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Ordenar la publicación en el Boletín Oficial de las Illes Balears de la relación definitiva de aspirantes que han superado el concurso oposición de las pruebas selectivas para el ingreso en el cuerpo de auditores de la SCIB, que se adjunta como anexo de esta Resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Establecer que, en el plazo de veinte días naturales, a contar a partir del día siguiente de la publicación en el Boletín Oficial de las Illes Balears de esta Resolución, los aspirantes seleccionados han de presentar en el Registro General de la SCIB los siguientes documentos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Declaración jurada o promesa de no haber estado separados mediante un expediente disciplinario del servicio de ninguna administración pública, o de los órganos constitucionales o estatutarios de las comunidades autónomas, ni encontrarse inhabilitados de forma absoluta o especial para empleos o cargos públicos por una resolución judicial, según el modelo del anexo VII del Acuerdo del Consejo de la Sindicatura de 21 de junio de 2022.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Certificado médico, en modelo oficial, expedido en los tres meses anteriores a su presentación, acreditativo de tener las capacidades y las aptitudes necesarias para el ejercicio de las funciones del cuerpo de auditores.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si no se presenta la documentación en el plazo fijado, salvo casos de fuerza mayor, que han de ser debidamente constatados y, si procede, apreciados por la Administración mediante una resolución motivada, o si al examinarla se deduce que faltan algunos de los requisitos exigidos, la persona interesada no puede ser nombrada funcionaria en prácticas y quedan anuladas sus actuaciones, sin perjuicio de la responsabilidad en que haya incurrido por falsedad en la solicitud inicial.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que no agota la vía administrativa, puede interponer un recurso de alzada ante el Consejo de la Sindicatura en el plazo de un mes, a contar desde el día siguiente de su publicación, de acuerdo con el art. 121 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; el art. 58 de la Ley 3/2003, de 26 de marzo, del régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y la disposición adicional primera de la Ley 4/2004, de 2 de abril, de la Sindicatura de Cuentas de las Illes Balears.&nbsp;</span></span></p> <p style="text-align:center"><em><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
