&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. En fecha 24 de enero de 2023 la jefa del Servicio de Personas con Discapacidad e Innovación Social, con el visto bueno del Director Insular de Personas con Discapacidad e Innovación Social emitieron informe justificativo relativo a la necesidad de concertar un total de 282 plazas y 42 complementos de alta intensidad, por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; tres anualidades del Servicio de apoyo en la vivienda para personas con discapacidad intelectual y/o trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 26 de enero de 2023 la Presidencia del IMAS ordenó el inicio del expediente para esta concertación social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;En la misma fecha, la presidenta del IMAS dictó Resolución de aprobación de la previsión de los servicios a concertar durante el año 2023 por Dirección Insular de Personas con Discapacidad e Innovación Social. (BOIB núm.16 de 4 de febrero de 2023), servicios entre los cuales se encuentra el que se objeto de esta concertación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Además a la mencionada Resolución se aprobaron la Guía de aplicación al modelo de atención a los servicios sociales para personas con discapacidad de Mallorca para toda la concertación y el Modelo de evaluación de seguimiento de la acción concertada, aplicable a los servicios concertados por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; la Dirección Insular de Personas con Discapacidad e Innovación Social&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; Constan en el expediente &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|Pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas que tienen que regir el concierto y&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;l&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;a propuesta de convocatoria, con los anexos correspondientes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El gasto previsto para&amp;nbsp;este expediente es de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; 14.874.426,54 € &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;y el Servicio de Contabilidad y Presupuestos emitió Informe de autorización&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; al gasto en fecha de 8 de febrero de 2023. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Asimismo, constan al expediente los documentos contables de a cargo de la aplicación presupuestaria 40.23128.26000. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El Servicio Juridicoadministrativo y la Intervención delegada del IMAS han emitido sendos informes favorables a la convocatoria de la concertación objeto de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Fundamentos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[Fundamentos|Cimientos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;En relación a la competencia,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB nº. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB nº. 29, de 28 de febrero de 2008), en concreto el artículo 70.4 relativo a la competencia propia de los consejos insulares en materia de servicios sociales y asistencia social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La Ley 14/2001, de 29 de octubre, de atribución de competencias en los consejos insulares en materia de servicios sociales y seguridad social, establece al artículo 14 la potestad reglamentaria normativa atribuida a los consejos insulares en materia de servicios sociales, dentro del marco de la regulación básica establecida por el Gobierno de las Islas Baleares (BOIB nº. 135, de 10 de noviembre de 2001 y BOE nº. 284, de 27 de noviembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB nº. 89 de 18 de junio de 2009 y BOE &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;nº. 163 de 7 de julio de 2009&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;) prevé al artículo 27 y a la disposición final cuarta, que cada Consejo Insular, en el marco de sus competencias, tiene que definir las prestaciones propias de servicios sociales, complementando la cartera básica de servicios sociales que aprueba el Gobierno de las Islas Baleares, la cual fue aprobada mediante el Decreto 66/2016, de 18 de noviembre, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cual se establecen principios generales para las carteras insulares y locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB nº. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consejo de Mallorca de fecha 11 de abril de 2019, en especial el establecido en el artículo 2 de acuerdo con el cual el Instituto Mallorquín de Asuntos Sociales, como organismo autónomo creado por el Consejo de Mallorca, adscrito al Departamento de Derechos Sociales del Consejo de Mallorca, es el organismo que ejerce las competencias atribuidas por cualquier título en el Consejo de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Decreto de la Presidencia del Consejo de Mallorca, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;de día 8 de julio de 2019, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; el cual se crean los departamentos que tienen que estructurar el gobierno (BOIB nº. 92, de 9 de julio de 2019), entre los cuales se encuentra el Departamento de Derechos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Decreto de la Presidencia del Consejo de Mallorca por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cual se nombran los miembros del Consejo Ejecutivo de día 12 de noviembre de 2021 (BOIB núm 158 de 16 de noviembre de 2021) por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el que se nombrada la Sra. Sofia Alonso Bigler Consejera&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; ejecutiva de Derechos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.3 de los Estatutos del IMAS (BOIB nº. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física o una otro causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;En relación al fondo,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; La Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca aprobada definitivamente en pleno del Consejo de Mallorca de 13 de julio de 2017 (BOIB nº. 97, de 18 de julio de 2017 y corrección d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;e errores materiales publicada BOIB nº. 161, de 30 de diciembre de 2017) y prorrogada su vigencia hasta el 31 de diciembre de 2023 por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; Acuerdo del Pleno en sesiones de 8 de julio de 2021 (BOIB nº. 95, de 17 de julio de 2021) y de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;15 de diciembre d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;e 2022 (BOIB nº. 168, de 27 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;E&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;l R&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;eglamento por el cual se regula el funcionamiento de los servicios sociales para personas con discapacidad incluidos en la Cartera Insular de servicios sociales y se establecen los requisitos de autorización y acreditación, aprobado al &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Pleno &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;del Consejo de Mallorca de fecha 8 de febrero de 2018 (BOIB nº. 21, de 15 de febrero de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; La Directiva 2014/24/UE del Parlamento Europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB nº. 89 de 18 de junio de 2009). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social a la comunidad autónoma de las Islas Baleares (BOIB nº. 146 de 22 de noviembre de 2018), regula en el Capítol I el «Régimen de colaboración privada en la gestión de servicios sociales para las personas mediante la acción concertada» (en adelante Ley 12/2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El Decreto 48/2017, de 27 de octubre, (BOIB número 132 de 28 de octubre de 2017) por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales (en adelante Decreto 48/2017)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La Ley 3/2018, de 29 de mayo, del tercer sector de acción social (BOIB nº. 67, de 31 de mayo de 2018), regula en sus artículos 3 y 4 las entidades que tienen la consideración de entidades del tercer sector de acción social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; Resolución de la Presidencia del IMAS por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; la cual establece los servicios sociales para personas con discapacidad y para personas mayores, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB nº. 36, de 22 de marzo de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; Resolución de la Presidencia del IMAS, nº. 21525 de 2 de diciembre de 2022, de actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;pueden ser objeto de concertación social (BOIB nº. 158, de 6 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Resolución de la presidenta del Instituto Mallorquí de Asuntos Sociales, núm.1324 de 26 de enero de 2023, de aprobación de la previsión de los servicios a concertar durante el año 2023 por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; la Dirección Insular de Personas con Discapacidad e Innovación Social (BOIB nº. 16, de 4 de febrero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;En relación al procedimiento,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;La Ley 12/2018 dispone en el artículo 5 los «Requisitos exigibles a las entidades gestoras de los servicios concertados y al artículo 6 los «Procedimientos de concertación y criterios de preferencia a favor de entidades del tercer sector social».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El Decreto 48/2017 al Título III, establece los «&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Procedimientos de concertación&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;» en todo lo que no contradiga la Ley 12/2018 antes mencionada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;20. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE nº. 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;21.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; El artículo 214 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto refundido de la Ley reguladora de las Haciendas Locales, y visto el acuerdo de aprobación del régimen de fiscalización e intervención limitada previa de requisitos básicos y toma&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[toma|presa]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de razón en ingresos del Consejo Insular de Mallorca y de las entidades de su sector público sujetos a función interventora de fecha 12 de diciembre de 2019, el expediente ha sido sometido a la Intervención delegada del IMAS para la emisión del preceptivo informe de fiscalización previa ( BOE nº. 59 de 9 de marzo de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;En virtud de la competencia atribuida legalmente; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;DECLARAR que de acuerdo con los antecedentes de esta resolución, queda &lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;acreditada la concurrencia de las circunstancias que hacen necesario recurrir&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[recurrir|recorrer]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; en la acción concertada para la prestación del&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;servicio&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;de apoyo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; en la vivienda para personas con discapacidad &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;intelectual y/o trastorno del desarrollo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;CONVOCAR la concertación social de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; 282 plazas y 42 complementos de alta&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; intensidad&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; del&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;servicio&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;de apoyo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; a la vivienda para personas con discapacidad &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;intelectual y/o trastorno del desarrollo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; tres anualidades, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;de acuerdo con los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«Convocatoria de la concertación social del Servicio de Apoyo en la Vivienda para &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;personas con discapacidad intelectual i/trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El objeto de esta convocatoria es fijar el procedimiento, los criterios de preferencia, los requisitos y las condiciones de la concertación del Servicio de Apoyo en la Vivienda para personas con discapacidad intelectual i/trastorno del desarrollo, incluido en la red pública de servicios para personas con discapacidad de Mallorca de acuerdo con los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas. . Se&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; dicta al amparo la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social a la comunidad autónoma de las Islas Baleares, en adelante Ley 12/2018 &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;(BOIB nº. 146, de 22 de noviembre de 2018)&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;; y del Decreto 48/2017 de 27 de octubre, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;(BOIB nº. 132, de 28 de octubre de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Ámbito territorial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El ámbito territorial de esta concertación es la Isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Plazas a concertar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Las plazas a concertar en el marco de esta convocatoria son de 282 &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;(incluye 42 plazas con complemento de alta intensidad) Este número tiene carácter estimativo y se ha establecido en función de las necesidades actuales del Servicio de Personas con Discapacidad e Innovación Social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Vigencia de la concertación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La vigencia de esta concertación será de tres años, desde la formalización o desde la fecha que expresamente se determine al acuerdo de acción concertada suscrito entre el Instituto Mallorquín de Asuntos Sociales (en adelante IMAS) y las entidades que resulten adjudicatarias. El concierto será susceptible de renovación por igual plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Requisitos de las entidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Las entidades que quieran optar a esta concertación social tendrán que cumplir los requisitos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;a) Inscripción al Censo de Organizaciones del Tercer Sector Social de las Islas Baleares, de acuerdo con el establecido a la Ley 3/2018, de 29 de mayo, del tercer sector social (BOIB nº. 67, de 31 de mayo de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;b) Cumplir los requisitos mínimos que se establecen en el título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares, en adelante Ley 4/2009 (BOIB nº. 89, de 18 de junio de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;c)Tener el servicio objeto de esta convocatoria legalmente constituido y acreditado por el IMAS en el momento de la adjudicación, así como tener el servicio inscrito en el Registro Unificado de Servicios Sociales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;d) Acreditar una experiencia mínima de un año en la prestación del servicio y perfil de las personas usuarias objeto de esta concertación. La experiencia tiene que ser acreditada de acuerdo con el punto 7.2 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;e) Acreditar solvencia financiera y técnica para prestar el servicio objeto de la concertación de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;acuerdo con el punto 7.2 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;f) Estar al corriente en el cumplimiento&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de las obligaciones económicas con el Consejo de Mallorca y con el IMAS, así como con las obligaciones tributarias y con la Seguridad Social que vendan impuestas por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;g) Que la entidad no haya sido objeto, respecto del servicio a concertar, de una resolución de expediente sancionador en materia de servicios sociales, causas que constan en los artículos 127 a 129 de la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Ley 4/2009 durante los 24 meses anteriores al concierto, a excepción que, con carácter previo a la presentación de la solicitud, la entidad haya satisfecho el pago íntegro de la totalidad del importe de la sanción y haya acreditado delante del órgano sancionador que se han corregido las causas que motivaron la sanción. Estos hechos se acreditarán necesariamente mediante la verificación y el correspondiente informe por parte del órgano administrativo competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;h) No estar afectadas por ninguna prohibición de contratar con la Administración, de acuerdo con el artículo 71 de la Ley 9/2007, de 8 de noviembre, de contratos del sector público, ni estar incluida en ninguno de los supuestos previstos en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, ni la Ley 58/2003, de 17 de diciembre, general tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;i) No haber sido sancionado en los últimos cuatro años mediante resolución firme por la comisión de infracciones graves o muy graves en materia de relaciones laborales, empleo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[empleo|ocupación]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;, empresas usuarias de empresas de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;j) Acreditar la titularidad del centro, o la disponibilidad del espacio físico necesario para desarrollar el servicio, mediante cualquier título jurídico válido por un periodo no inferior al de la vigencia del concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;7&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.1. Lugar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[Lugar|Sitio]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; y plazo de presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El plazo para presentar las solicitudes es de&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; 10 días h&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;ábiles contadores desde el día siguiente que se haya publicado esta convocatoria en el Boletín Oficial de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;E&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;l &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;modelo de solicitud (MOD-1), tiene que ir firmado por la persona representante legal de la entidad, indicando expresamente el número de plazas que solicita concertar con el IMAS en el marco de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Esta solicitud se tiene que acompañar de los documentos que se &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;detallan a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;a) Una fotocopia del documento nacional de identidad, para acreditar la identidad de la persona que legalmente represente a la entidad, así como la acreditación de su representación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;b) Certificado de la inscripción al Censo Público de Organizaciones del Tercer Sector &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Social de las Islas Baleares, con menos de 6 meses de vigencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;c) Certificado de la inscripción al Registro de Servicios Sociales, con menos de 6 meses de vigencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;d) Copia de la resolución de acreditación vigente del servicio a concertar o copia de la solicitud de la acreditación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;e) Documentación acreditativa de la solvencia técnica. En el caso de que la solvencia técnica se acredite mediante Resolución de servicios previamente contratados o concertada con el IMAS, no es preceptivo presentar la documentación acreditativa. Si bien, en todo caso, se tiene que indicar al MOD-1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;f) Documentación acreditativa relativa a la solvencia financiera señalada en el MOD- 1 de solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;g) &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Justificando de disposición de póliza de seguro de responsabilidad civil que cubra la indemnización por riesgos (profesionales, de atención a las personas o de otros) para&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;todo el periodo de duración del concierto, por un importe igual o superior al exigido en los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas de esta concertación social, en función del número de plazas solicitadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;h) Documentación acreditativa de la titularidad o de disponibilidad del espacio físico en lo que se desarrollará el servicio, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; cualquier título jurídico válido, por un periodo no inferior al de la vigencia &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;del concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;i) En caso de ser interesadas en las plazas de apoyo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[apoyo|apoyo]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; complementario previsto en esta convocatoria, tendrán que presentar una solicitud específica (MOD 2) de complemento por apoyo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[apoyo|apoyo]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; a la vivienda de alta intensidad firmada por el representante legal de la entidad, de acuerdo con el modelo disponible en la sede electrónica del Consejo ), que incorpore, para cada una de las personas usuarias del servicio de apoyo en la vivienda respecto de las cuales se solicita el complemento por apoyo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[apoyo|apoyo]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; a la vivienda de alta intensidad y las solicitudes individuales correspondientes previamente validadas por el equipo técnico del IMAS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;En relación a la documentación referenciada a las letras a), b), c), d) y e) del punto 1, de conformidad en el establecido en el artículo 28 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (en adelante Ley 39/2015), no será necesaria la presentación de aquella documentación que ya haya estado previamente aportada, teniendo que indicarlo la entidad, llenando a este efecto la información contenida, siempre que esté en vigor y no haya sufrido modificaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La presentación de la solicitud implica que la entidad autoriza en el IMAS para el cual pueda consultar o pedir a cualquier administración la documentación, los datos y los informes que consideren necesarios para tramitar el expediente, y que la entidad se obliga a cumplir con el pliego&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegue|pliego]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.3. Enmienda de deficiencias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Si la solicitud no reúne los requisitos legales y los que se derivan de esta convocatoria se tiene que requerir a la entidad solicitante, de acuerdo con lo que establece el artículo 68 de la Ley 39/2015, para que, en un plazo de diez días hábiles, enmiende la falta o acompañe los documentos preceptivos, con la indicación que, si no lo hace, se tendrá por desistida de su petición, previa resolución expresa en los términos que establece el artículo 21 de la Ley mencionada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Instrucción del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.1. Órgano competente para la instrucción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El órgano competente para instruir el procedimiento es la Dirección Insular de Personas con Discapacidad e Innovación Social del IMAS, que tendrá la prerrogativa de interpretarlo y resolver las dudas que surjan durante el cumplimiento&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Los servicios técnicos de la Dirección Insular de Personas con Discapacidad e Innovación Social del IMAS tienen que examinar las solicitudes y si procede&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pega|ocurre]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; tramitar los requerimientos de enmienda que sean necesarios, emitiéndose informe al respect&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;o.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.2. Criterios de tramitación &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- Si el cómputo total de plazas que ofrecen las entidades que cumplan con los requisitos establecidos en el punto 6 de esta convocatoria no supera el número total de plazas&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; a concertar,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el informe propondrá que se adjudiquen directamente a las entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- Si el cómputo total de plazas que ofrecen las entidades que cumplan con los requisitos establecidos en el punto 6 de esta convocatoria supera el número total de plazas a concertar, se actuará según los criterios de preferencia establecidos en el punto 8.4 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- A &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;petición del órgano instructor, e&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;n caso que haya dificultados en la interpretación de las ofertas presentadas o dudas en el procedimiento de adjudicación, o así lo considere el órgano instructor se convocará una comisión evaluadora, con la composición y funciones que se establecen en el punto 8.3 de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.3. De la Comisión Evaluadora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;La Comisión Evaluadora actuará de conformidad con el artículo 15 relativo al «Comité técnico de asesoramiento» del &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Decreto 48/2017 y, consecuentemente tendrá los mismos efectos que el mencionado &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Comité Técnico de Asesoramiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Composición&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La comisión evaluadora estará integrada por los miembros siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- Presidente: El director insular de Personas con Discapacidad e Innovación Social o persona que lo sustituya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- Vocales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;- Secretaria (con voz y sin voto): La jefa de servicio juridicoadministrativo del IMAS, o persona que la sustituya.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;ii. Régimen de funcionamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Esta comisión tiene que analizar e interpretar las incidencias o dificultades detectadas y tiene que emitir informe el cual se tiene que tener en cuenta por&lt;/span&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; el órgano instructor al mismo tiempo de elaborar la propuesta de resolución. Sólo será convocado por el órgano instructor en caso que, para existir dificultades o dudas este órgano lo considere necesario. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;La Comisión Evaluadora queda válidamente constituida con la asistencia, como mínimo, de los miembros siguientes: la presidencia o persona suplente, la secretaria o persona suplente y dos vocales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.4. Criterios de preferencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 6 de la Ley 12/2018, los criterios para resolver la concertación social objeto de esta convocatoria son: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;a) El arraigo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[arraigo|enraizamiento]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de la persona en el entorno de atención y las condiciones de atención que requiere la persona. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;b) La implantación de la entidad en la localidad donde se tenga que prestar el servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;c) La libre elección y&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; la lista de espera pública de acceso a los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.5. Continuación del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Una vez comprobados todos los requisitos, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;el órgano instructor &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;emitirá informe propuesta de adjudicación de las plazas a concertar del servicio objeto de esta convocatoria, que incluirá la designación de un responsable del seguimiento del concierto y si es el caso, la exclusión motivada de las entidades que no cumplan con los requisitos establecidos, así como cualquier otra información que resulte necesaria para la resolución del expediente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución y notificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.1. Órgano competente para la resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB nº. 67, de 18 de mayo de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.2. Plazo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para dictar y notificar la resolución de esta concertación es de tres meses contadores del día siguiente que acabe el plazo de presentación de solicitudes. Se tienen que considerar desestimadas las solicitudes no resueltas en el plazo indicado anteriormente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.3. Notificación y publicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La resolución de la concertación social objeto de esta convocatoria, se tiene que notificar individualmente a las entidades interesadas, de acuerdo con el previsto en el artículo 42 de la Ley 39/2015, tienen que ser expresas, motivadas y tienen que fijar la cuantía individual del concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Además, esta resolución se publicar&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;á en el BOIB y en el DOUE, as&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;í como en el Tablón de Anuncios del IMAS (&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000080"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;https://imas.sedipualba.es/tablondeanuncios/&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;) y en la Sede electrónica del Consejo de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.4. Modificación resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Cualquier alteración de las condiciones exigidas para conceder el concierto, puede dar lugar a la modificación de la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.5. De los Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Contra las resoluciones que adopta la Presidencia del IMAS se puede interponer recurso de alzada ante el Consejo Ejecutivo del Consejo de Mallorca en el plazo y con los efectos del artículo 112 de la Ley 39/2015, del 1 de octubre, de procedimiento común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Formalización de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La concertación social que se establece al amparo de esta convocatoria se tiene que formalizar mediante un documento administrativo denominado «acuerdo de acción concertada», cuyo modelo se tendrá que aprobar por resolución de la Presidencia del IMAS. En este acuerdo de acción concertada se tienen que hacer constar los contenidos mínimos previstos en el artículo 8 de la Ley 12/2018 así como&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[como|cómo]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;, según el establecido en el artículo 7 del Decreto 48/2017, los derechos y las obligaciones recíprocos, las características concretas del servicio, otras circunstancias derivadas de la Ley 4/2009 y de los decretos de desarrollo, y del pliego de condiciones técnicas de esta concertación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Cesión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el previsto en el artículo 7.4 de la Ley 12/2018 queda prohibida la cesión, total o parcial, del servicio objeto del acuerdo de acción concertada. No obstante, cuando la entidad concertada sea declarada en concurso de acreedores, la administración pública competente podrá autorizar la cesión con la adopción de las medidas necesarias para garantizar la continuidad y la calidad del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Condiciones técnicas de ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Las condiciones técnicas de ejecución se tienen que ajustar al Decreto 10/2013, de 28 de febrero, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cual se fijan los principios generales del Registro Unificado de Servicios Sociales de las Islas Baleares y de los procedimientos para la autorización y la acreditación de servicios sociales, y se regulan la sección suprainsular del Registro y los procedimientos para autorizar y acreditar servicios sociales de ámbito suprainsular, y los reglamentos de desarrollo vigentes en su ámbito territorial de actuación, así como también se tienen que ajustar a la Ley 12/2018 y al Decreto 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[Por|Para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; otro parte, la ejecución del concierto social objeto de esta convocatoria se ha regir por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el contenido del pliego&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegue|pliego]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas aplicables en esta concertación y que se aprueban conjuntamente con la convocatoria. Concretamente, los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;, de conformidad con el previsto en el artículo 8 del Decreto 48/2017 detalla: el objeto, la definición del servicio, el calendario y horario, los servicios que se tienen que prestar, los requisitos de los servicios a concertar, el modelo de atención, los criterios de intervención con las personas usuarias, el régimen de utilización de plazas y el régimen económico, los seguros, el número de plazas, los medios materiales y humanos que tiene que aportar la entidad concertada, las obligaciones de la entidad concertada, la financiación del concierto, la justificación, la coordinación, control y supervisión, la protección de datos de carácter personal y la regulación de los incumplimientos por parte de las entidades y las penalidades, así como el plazo del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Al respecto, el artículo 9.3 del Decreto 48/2017, de 27 &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;de octubre establece las obligaciones de las entidades y determina que mediante el concierto social, la entidad titular del servicio se obliga a cumplir los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; técnicos, así como las normas establecidas en el título VII de la Ley 4/2009 y en los correspondientes decretos de desarrollo y de aplicación de esta Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Seguimiento y criterios de acceso de las personas usuarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Desde la Dirección Insular de Personas con Discapacidad e Innovación Social se hará el seguimiento técnico del servicio concertado objeto de esta convocatoria, de conformidad con el mencionado en el artículo 10 de la Ley 12/2018 y al artículo 27 del Decreto 48/2017 y con los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; técnicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La entidad concertada tiene que facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección Insular de Personas con Discapacidad e Innovación Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El IMAS, a través del Servicio de Personas con Discapacidad e Innovación Social, tiene que gestionar directamente el acceso a los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Penalidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las condiciones previstas para la prestación del servicio se tiene que penalizar, de acuerdo con el Pliego de prescripciones técnicas de este concierto social, y con la normativa de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Causas de extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Los acuerdos de acción concertada se extinguen, de acuerdo con el previsto en el artículo 9 de la Ley 12/2018, por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; el cumplimiento&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; y vencimiento del plazo, siempre que no se hayan renovado, o por resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Son causas de resolución de los acuerdos de acción concertada las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;a) Acuerdo mutuo de las partes, manifestado con la antelación de dos meses.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;b) Renuncia de la entidad concertada, manifestada con una antelación mínima de dos meses para garantizar la continuidad del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;c) Incumplimiento de las normas de carácter obligatorio a que se tienen que someter el servicio objeto de la presente concertación y de las obligaciones en materia de seguridad e instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;d) Incumplimiento de los objetivos cualitativos y cuantitativos establecidos, siempre que el incumplimiento sea imputable a la entidad concertada, así como de las estipulaciones esenciales del acuerdo y de los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;e) Prestación defectuosa de las obligaciones acordadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;f) La negación a atender a las personas usuarias derivadas por el IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;g) Infracción con carácter grave de la legislación fiscal, laboral, de la Seguridad Social, de integración social de personas con discapacidad y de prevención de riesgo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;h) Pérdida sobrevenida de los requisitos de participación a esta convocatoria o de las condiciones técnicas, económicas y financieras que hayan habilitado el acuerdo de acción concertada, así como la revocación o la caducidad de la autorización de apertura&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[apertura|abertura]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; y funcionamiento y/o de la acreditación del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;i) Muerto de la persona física titular del servicio o la extinción de la persona jurídica a la cual corresponde la titularidad, excepto lo que prevé el artículo 29 del Decreto 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;j) Declaración de concurso de acreedores de la entidad titular del servicio, a excepción del previsto en el artículo 7.4 de la Ley 12/2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;k) Modificación de las condiciones técnicas o de las condiciones económicas por parte de la Administración, siempre que la entidad de iniciativa privada no haya dado la conformidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;l) No disponibilidad sobrevenida del título jurídico que acredita la titularidad del servicio durante la vigencia del acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;m) Las cláusulas de revocación previstas en los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; técnicos objeto de este servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Modificación y/o ampliación del acuerdo de acción concertada&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;El procedimiento de ampliación de plazas concertadas del servicio objeto de esta convocatoria, así como de modificación del mencionado concierto, se llevarán a cabo de conformidad con el establecido en los pliegos&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[pliegos|pliegos]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; de prescripciones técnicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;La jurisdicción contenciosa administrativa es la competente para resolver las cuestiones litigiosas relativas a la formalización de este concierto y también las surgidas entre las partes sobre la interpretación, la modificación, el cumplimiento&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="display:none"&gt;&lt;span style="background-color:null"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;, los efectos y la extinción.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; APROBAR los Pliego&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;s&amp;lt;A[pliegos|Pliegos]&amp;gt; de prescripciones técnicas para la concertación del mencionado servicio (Código de verificación K9AA R24H Y4LU WYVV 42PQ), así como el modelo Solicitud (MOD-1) y el modelo de Solicitud de modalidad de Alta Intensidad (MOD-2) que constan anexos a esta res&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;olución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;PUBLICAR esta Resolución en el &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Islas Baleares,&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt; en el &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Diario Oficial de la Unión Europea, &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;así como al Tablón de Anuncios del IMAS y a la Sede electrónica del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;. COMUNICAR esta resolución a la Dirección Insular de Personas con Discapacidad e Innovación Social, al servicio de Gestión Económica, al servicio de Contabilidad y Presupuestos y a la Intervención Delegada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consejo de Mallorca de 11 de abril de 2019 (BOIB nº. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, dentro del plazo de un mes, contador a partir del día siguiente en el de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente en el de la notificación de la desestimación del mencionado recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#111111"&gt;&lt;span style="background-color:null"&gt;No obstante el anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente. Todo eso de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
