    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado&amp;nbsp;8.4. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 27&amp;nbsp;de febrero de 2015&amp;nbsp;por la&amp;nbsp;que se aprueba la convocatoria&amp;nbsp;para el Fomento de la Producción Integrada, para el año 2015 (Prórroga 2021),&amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 14&amp;nbsp;de diciembre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 08 de junio de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2015 se registró la solicitud de ayuda a nombre de MARGARITA &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;GIMBERT QUINTANA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con NIF núm ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3996&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, al amparo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 27&amp;nbsp;de febrero de 2015 por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al fomento de producción integrada y sus posteriores modificaciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El día 14&amp;nbsp;de julio de 2017 el vicepresidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) aprobó la ayuda correspondiente al expediente núm. PI &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;83&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2015 de la línea de ayuda&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;para el Fomento de la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;P&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;roducción &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ntegrada, a favor de MARGARITA &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;GIMBERNAT QUINTANA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con NIF núm.***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3996&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;** un importe máximo de 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;255&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0€ repartidos en cinco anualidades de 3.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;51,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;18&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;€, correspondientes a una superficie comprometida de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;FRUTOS SECOS de 22&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,11 ha&amp;nbsp;(BOIB 89, 22/07/2017). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 19/06/2019 y núm. 17228 se registró un escrito de subrogación por defunción a nombre de CAS CAPALLERS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con NIF núm. E16560914, del expediente PI 83/2015.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha del 14 de julio de 2020 se registró un escrito de autorización por subrogación/cesión de compromisos PDR, por cambio de titularidad de CAS CAPALLERS, C&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a favor de CAS CAPALLERS; S&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;C.&amp;nbsp;con NIF/CIF J42747774 &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Los servicios gestores han comprobado la información necesaria para efectuar la evaluación del cumplimiento de los requisitos por parte del nuevo titular para ser beneficiario de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.El nuevo titular y la explotación agraria indicadas en la solicitud cumplen los requisitos indicados en la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 27 de febrero de 2015 por la que se aprueba la convocatoria para el 2015 de las ayudas destinadas al fomento de la producción integrada y sus posteriores prórrogas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;20.Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;21.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Publicar la resolución en el BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Las personas beneficiarias se comprometen y obligan durante un período de 5 años a: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Mantener sin disminuir la superficie comprometida a nivel de grupo de cultivo, independientemente de que pueda variar la ubicación del cultivo dentro de las parcelas que integran la explotación agraria o de los cambios de las parcelas donde se ubica el cultivo. Este compromiso se considera cumplido con una tolerancia máxima de disminución de la superficie comprometida de 0,1 ha en grupos de cultivo que tengan hasta 0,5 ha de superficie comprometida y un 10% en aquellos de más de 0,5 ha de superficie comprometida. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Cumplir en las parcelas lo que establecen las normas genéricas y específicas sobreproducción integrada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Mantener y actualizar el cuaderno de explotación específico para la producción integrada donde se inscribirán operaciones de cultivo y actuaciones realizadas (abono, fitosanitarios, cultivo, etc) cada una de las parcelas ( o grupo de parcelas en caso de ser el mismo cultivo), con indicación de la fecha de realización y las incidencias, si las hubiere. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Participar, durante el período de compromiso, en actividades de formación relacionadas con la producción integrada. Por eso, deberá justificar la asistencia a algún curso o actividad de formación técnica, relacionados con la materia, de un mínimo de 25 horas. Esta formación la recibirá la persona que tiene a cargo la dirección de la explotación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-En los tratamientos en los que se vayan a aplicar productos químicos, sólo se podrán utilizar las materias activas actualizadas para cada cultivo, seleccionadas en la norma técnica de la producción integrada correspondiente. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Someterse a las actuaciones de comprobación y de control que procedan de la Administración autonómica, estatal y comunitaria, la Sindicatura de cuentas u otros órganos de control externo, necesarios para comprobar la correcta concesión de la ayuda y el posterior mantenimiento de los compromisos . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Cumplir, en su explotación, los requisitos legales de gestión, así como las buenas condiciones agrarias y medioambientales establecidas en los artículos 91, 92, 93, 94 y 95 del Reglamento (UE) núm 1306/2013 del Parlamento Europeo y del Consejo , de 17 de diciembre de 2013. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;-Cumplir los compromisos adquiridos para la concesión de la ayuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
