    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El 9 de febrero de 2023 el Pleno del Consejo de Mallorca adoptó el acuerdo de resolución de los recursos de alzada presentados contra el Acuerdo de la presidenta de 12 de diciembre de 2022&lt;strong&gt; &lt;/strong&gt;de aprobación definitiva del Proyecto Básico y proyectos complementarios y estudio de costes de la planta de compostaje para fracción FORM recogida selectivamente ubicada en el TM de Llucmajor, en los términos que transcribo literalmente a continuación:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;1.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Estimar parcialmente el recurso de alzada presentado por el Grup Balear d'Ornitologia i Defensa de la Natura GOB y evaluar las alegaciones presentadas en fecha 21 de noviembre de 2022 (RE del CiM núm. 62433/2022) por el Grup Balear d'Ornitologia i Defensa de la Natura (GOB) presentadas en la información pública del proyecto básico de la Planta de Compostaje de Llucmajor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Desestimar el contenido material de las alegaciones presentadas por el Grup Balear&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d'Ornitologia i Defensa de la Natura (GOB), de acuerdo con la motivación contenida en el informe del ingeniero industrial de la DIR de 24 de enero de 2023 (SEFYCU 3079863 y CSV K7AARWDYLEQATTV7NW4H) y aprobar definitivamente el Proyecto Básico de la Planta de Compostaje para fracción FORM recogida selectivamente, planta de Llucmajor, y proyectos complementarios de la planta fotovoltaica i de la línea de media tensión conformado por los siguientes archivos firmados electrónicamente por el autor del proyecto (con código SEFYCU y CSV individual para cada un de ellos) con presupuesto para el conocimiento de la Administración que asciende a 29.912.083,62€:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Estimar parcialmente el recuro de alzada presentado por TIRME,SA de acuerdo con la motivación contenida en el informe del ingeniero industrial de la DIR de 24 de enero de 2023 (SEFYCU 3080696 i CSV K7AARWM3LVU924YLKR9E) y aprobar definitivamente el estudio de costes de explotación de la Planta de Compostaje de FORM de Llucmajor de acuerdo con lo que prevé el documento Estudio de costes de explotación de la planta de compostaje de biorresiduos de Llucmajor (SEFYCU 3081613; CSV: K7AA RWWD 9WQU QY4L HZER), firmado electrónicamente en fecha 26 de enero de 2023 por el autor del proyecto, que servirà de base para el reconocimiento tarifario de la empresa concesionaria del servicio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;4.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Aprobar definitivamente unos costes fijos de explotación por valor de 1.252.524,75 €/año y costes variables de explotación unitarios por valor de 119,94 €/t FORM (descompuestos en CV generales por valor de 75,62 €/t FORM, CV combustibles por valor de 3,88 €/t FORM i CV energía por valor de 40,44 €/t FORM), revisables anualmente de acuerdo con la fórmula de revisión tarifaria que se determinará en la modificación del contrato suscrito con TIRME,SA relativo a la gestión de residuos urbanos de la isla de Mallorca (modificación núm. 5).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;5.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Advertir de que el proyecto constructivo de la planta de compostaje para fracción FORM&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;recogida selectivamente de Llucmajor no se podrá ejecutar hasta que el Consejo Ejecutivo del Consejo Insular de Mallorca apruebe la modificación del contrato suscrito con TIRME, SA relativo a la gestión de residuos urbanos de la isla de Mallorca (modificación núm. 5), previo informe de fiscalización favorable por parte de la Intervención General del Consejo de Mallorca, con el fin de incorporar el presupuesto del proyecto en el precio del contrato, además del resto de modificaciones necesarias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;6.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Publicar este Acuerdo en el BOIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;7.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Notificar a TIRME SA y al GRUP BALEAR D'ORNITOLOGIA I DEFENSA DE LA NATURALESA,&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;del contenido del presente Acuerdo y de los informes y estudios que lo fundamentan”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra este acto, que pone fin a la vía administrativa, se puede interponer directamente el recurso contencioso administrativo ante el Juzgado contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la recepción de la presente notificación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;No obstante lo anterior, se podrá interponer, si procede, cualquier otro recurso que se considere oportuno. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;
