&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En fecha 22 de julio de 2022, el presidente del Instituto de Industrias Culturales de las Illes Balears (ICIB) dictó la Resolución por la que se aprueba la convocatoria pública de subvenciones para apoyar las salas de exhibición cinematográfica de las Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia (finandiado por la Unión Europea – Next&amp;nbsp;Generation&amp;nbsp;EU) (BOIB n.º 98, de 28 de julio de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Durante el plazo de presentación de solicitudes para optar a las subvenciones mencionadas, el ICIB recibió siete solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Comisión Evaluadora prevista en el apartado 12 de la convocatoria se reunió el día 20 de diciembre de 2022 para examinar las solicitudes presentadas y para emitir el informe que sirvió de base para la Propuesta de resolución de la directora del ICIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 23 de enero de 2023 se publicó en la Sede Electrónica de la CAIB la Propuesta de resolución de la convocatoria, a fin de que las personas interesadas pudieran formular alegaciones. Se recibieron dos alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En el plazo establecido, se presentaron las alegaciones siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1. Alegación en relación con el expediente SALESCINE 1/2022, en que se solicita que se modifique el importe concedido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2. Alegación en relación con el expediente SALESCINE 3/2022, en que se expone que presentaron la documentación solicitada y, por lo tanto, solicitan ser admitidos y que se emita una nueva resolución de concesión a favor de Cinesa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En lo relativo a las alegaciones a la Propuesta de resolución de la convocatoria, se determina:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1. Estimar la alegación presentada en relación con el expediente SALESCINE&amp;nbsp;1/2022: se rectifica el importe concedido.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.2. Desestimar la alegación en relación con el expediente SALESCINE 3/2022, teniendo en cuenta que, con la documentación presentada durante el periodo de presentación de solicitudes y posteriormente, como respuesta al requerimiento realizado por parte del ICIB, se confirma que el solicitante no cumple los requisitos que estipulan las bases de la convocatoria en el apartado 4.2 y que, tal como se indica en el apartado 4.5, «deberán cumplirse desde el momento de presentación de la solicitud y deberán mantenerse hasta la finalización y la justificación de la actividad objeto de subvención». Además, se debe tener en consideración que no procede aceptar la aportación de la nueva documentación presentada junto con el escrito de alegaciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El personal del ICIB ha comprobado que las entidades beneficiarias cumplen los requisitos que la normativa establece para poder recibir subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Orden HFP/1030/2021, de 29 de septiembre, por la que se configura el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Orden HFP/1031/2021, de 29 de septiembre, por la que se establece el procedimiento y el formato de la información a proporcionar por las Entidades del Sector Público Estatal, Autonómico y Local para el seguimiento del cumplimiento de hitos y objetivos y de ejecución presupuestaria y contable de las medidas de los componentes del Plan de Recuperación, Transformación y Resiliencia.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB n.º 100, de 11 de julio de 2009).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Decreto 50/2018, de 21 de diciembre, por el que se aprueban los Estatutos del Instituto de Industrias Culturales de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Resolución del presidente del ICIB de 22 de julio de 2022 por la que se convoca la concesión de subvenciones para apoyar las salas de exhibición cinematográfica de las Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia (financiado por la Unión Europea - Next&amp;nbsp;Generation&amp;nbsp;EU) (BOIB n.º 98, de 28 de julio de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar la concesión de subvenciones por el importe total de 172.200,00&amp;nbsp;euros a favor de los beneficiarios y de acuerdo con el concepto y el importe que constan en el Anexo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer el gasto indicado para cada uno de los beneficiarios con cargo al capítulo 7 del presupuesto del ICIB para el año 2022 y proveniente del Plan de Recuperación, Transformación y Resiliencia (financiado por la Unión Europea - Next&amp;nbsp;Generation&amp;nbsp;EU), con los importes que se detallan en el Anexo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Excluir de la concesión de subvenciones las solicitudes que se indican en el Anexo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Establecer que los beneficiarios están obligados a cumplir lo dispuesto en el apartado 21 de la Resolución del presidente del ICIB de 22 de julio de 2022&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Informar a los beneficiarios de que la subvención se justificará y pagará de acuerdo con lo dispuesto en los apartados 18 y 19 de la Resolución del presidente del ICIB de 22 de julio de 2022 por la que se convoca la concesión de subvenciones para apoyar las salas de exhibición cinematográfica de las Illes Balears, en el marco del Plan de Recuperación, Transformación y Resiliencia (financiado por la Unión Europea - Next&amp;nbsp;Generation&amp;nbsp;EU) (BOIB n.º 98, de 28 de julio de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Publicar esta Resolución en el&lt;em&gt; B&lt;/em&gt;&lt;em&gt;oletín&lt;/em&gt;&lt;em&gt; Oficial de l&lt;/em&gt;&lt;em&gt;a&lt;/em&gt;&lt;em&gt;s Illes Balears&lt;/em&gt; (BOIB).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que no agota la vía administrativa, podrá interponerse un recurso de alzada ante el presidente del ICIB, en el plazo de un mes a contar a partir del día siguiente de su publicación, de acuerdo con el artículo 122 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;
