&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Declaración de incumplimiento por de la promotora de la obligación de completar la urbanización del Carreró de can Manyoles; confiscación de garantía; requerimiento de ampliación de garantía; y ejecución subsidiaria de las obras para completar la urbanización, por resolución de alcaldía nº 570-2022, de 10 de mayo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Adjudicación del contrato menor de obras “Adecuación y soterramiento de la red eléctrica en la C/ de can Manyoles, 43-47”, a EDISTRIBUCIÓN REDES DIGITALES SL UNIPERSONAL, NIF. B82846817, por el precio de 21.214,25 euros (base imponible, 17.532,44 euros; + 21% IVA, 3.681,81 euros).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La factura por la realización de las obras fue aprobada por acuerdo de la junta de gobierno local de 16 de noviembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aprobación inicial de la modificación del proyecto de dotación de servicios para completar la urbanización del Carreró de can Manyoles, por acuerdo de la junta de gobierno local, de 23 de septiembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Información pública del proyecto durante el plazo de un mes a partir de la publicación del anuncio, publicado en el BOIB nº 128 de 01.10.2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Audiencia a Promociones can Bosch, S.L. (registre 2022-S-RE-1479) y a la entidad financiera avaladora (registros 2022-S-RE-1478 i 1570). No han presentado alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Audiencia a personas empadronadas en la C/ de can Manyoles 43-45. No se han presentado alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Audiencia a las personas titulares catastrales de las propiedades confrontantes con el callejón. Ha presentado alegaciones el señor GFF (registros 2022-E-RE-1348 i 1349, de 27.10.2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Informe técnico de Soluciones Corporativas IP SL (ConectaBalear) de 07.10.2022 (registro 2022-E-RE-1235) según el cual “el proyecto se adapta favorablemente y cumple con la normativa interna de despliegues de red de telecomunicaciones”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Escrito de Edistribucion Redes Digitales SLU, de 21.10.2022, (registro 2022-E-RE-1315) según el cual “para poder pronunciarse sobre las características de las instalaciones eléctricas existentes deberían disponer de la previsión de potencias a instalar”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Escrito de Telefónica de España SAU, de 27.10.2022 (registro nº 2022-E-RC-3713) en el que se informa que las nuevas necesidades de la su red dependen de la demanda que se genere en el municipio, de manera que no es posible hacer una previsión con antelación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Informe del ingeniero de caminos, canales y puertos RGE, de 02.11.2022, relativo a las obras ejecutadas por E-Distribucion Redes Digitales para soterrar las líneas de baja tensión entre los números 41 y 49 del C/ de can Manyoles. El técnico concluye que las obras se han ejecutado según lo solicitado, en tiempo y forma i adecuados a la normativa vigente y al presupuesto aceptado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Informe jurídico de secretaría, de 10.11.2022, sobre la alegación presentada por GFF a la aprobación inicial de la modificación del proyecto de dotación de servicio. De acuerdo con el informe, procede la desestimación por el siguiente motivo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“Por resolución de alcaldía nº 570, de 10.05.2022, se declaró, entre otros, el incumplimiento de las obligaciones de la promotora Promociones Can Bosch SL de completar la dotación de servicios, y la ejecución subsidiaria de les obras pendientes a costa de la obligada, (artículo 322 del Reglamento de la ley general d ordenación y uso del suelo, para la isla de Mallorca, de 16 de abril de 2015; y artículo 102 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas). El deber del ayuntamiento como ejecutor subsidiario es completar la dotación de servicios y no alcanza otras obligaciones de carácter privado o civil que esa promotora hubiere podido contraer con anterioridad.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Segunda petición de informe a Edistribución Redes Digitales, SLU, con concreción de las aclaraciones solicitadas, (registro 2022-S-RE-1850). La notificación se entiende efectuada el 10.12.2022, después de transcurrir el plazo para acceder a la notificación electrónica sin haberlo hecho. No han emitido informe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ley autonómica 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears; en especial, artículos 71 y 149.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Reglamento general de la Ley 2/2014, de 25 de marzo, de ordenación y uso del suelo, para la isla de Mallorca; en especial, artículos 197 a 201.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Normas subsidiarias de Alaró, de 17 de octubre de 2003.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ordenanza de buen gobierno, convivencia ciudadana y espacios públicos (BOIB nº 72 de 03.06.2021)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ordenanza municipal reguladora de la gestión de los residuos de construcción y demolición (BOIB nº 37, de 14.03.2006)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La junta de gobierno local, en ejercicio de la atribución delegada por resolución de la alcaldía nº 2019-0755, de 25 de junio (BOIB nº 101, de 23.07.2019), en sesión celebrada el día 25 de enero de 2023, acordó:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Aprobar de forma definitiva el proyecto técnico de la Modificación del proyecto de dotación de servicios, para completar la urbanización del Carreró de can Manyoles, promovido por este ayuntamiento (como ejecutor subsidiario de les obligaciones de Promociones Can Bosch SL), redactado por los ingenieros de camino JCS i RGE (visado colegial nº 2022/03/272/01, de 21.09.2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(En atención a su deber de abstención, por tener enemistad manifiesta con persona interesada en el asunto, la concejal Catalina Cifre Rosselló se ha abstenido en la deliberación y votación de la propuesta, (artículo 23,2,c de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Lo que se hace público para general conocimiento.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Directamente el recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de dos meses, contados a partir del día siguiente al de su publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) El recurso de reposición potestativo ante la junta de gobierno local, en el plazo de un mes, contado a partir del día siguiente de la publicación de la presente resolución. Contra la desestimación por silencio del recurso de reposición, que se producirá por el transcurso de un mes desde su presentación sin que se haya resuelto expresamente ni se haya notificado, podrá interponerse el recurso contencioso administrativo, ante el Juzgado de lo Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante lo anterior, se puede ejercitar, si procede, cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
