    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en la ocupación pública, publicada en el BOE n.º 312 de 29 de diciembre de 2021, establece para todas las administraciones la estabilización de las plazas estructurales que, dotadas presupuestariamente, han sido ocupadas de forma ininterrumpida desde las fechas establecidas en la normativa de aplicación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que en aplicación de este mandato el Consejo Ejecutivo y todos los ayuntamientos de Menorca, en sesión de carácter ordinario de 23 de mayo de 2022, aprobaron sus ofertas públicas de ocupación para la estabilización extraordinaria del personal de sus plantillas antes del 1 de junio de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Que de acuerdo con el art. 121 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, la Oferta pública de empleo del Consejo se presentó conjuntamente con el personal del Consorcio Socio-sanitario de Menorca, el Consorcio de Residuos y Energía, y el Consorcio para la Protección de la Legalidad Urbanística en Suelo Rústico de la Isla de Menorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Que el Decreto Ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en la ocupación de las Islas Baleares, publicado en el BOIB n.º 78 de fecha 16 de junio de 2022, validado por el Pleno del Parlamento de las Islas Baleares en sesión de 28 de junio de 2022, aprobó las bases generales con los criterios generales que tienen que regir los procesos selectivos de estabilización para el ingreso o el acceso como funcionario de carrera o personal laboral fijo de las administraciones de las Islas Baleares. Este Decreto Ley fue modificado por el Decreto Ley 7/2022 de 11 de julio, de prestaciones sociales de carácter económico de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que la Disposición adicional primera de la Ley 20/2021, establece que los municipios, podrán encomendar la gestión material de la selección del personal a los consejos insulares. De acuerdo con esta normativa, el Consejo Insular de Menorca firmó con todos los ayuntamientos de Menorca un convenio de encargo de la gestión material del proceso extraordinario de la oferta pública de empleo de estabilización de las ofertas públicas municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que con fecha de 18 de noviembre de 2022, el BOIB nº 149, publicó las mismas bases específicas para todas y cada una de las administraciones locales de Menorca. Este mismo boletín publicó las convocatorias de las ofertas públicas del Consejo Insular de Menorca, la de todos los ayuntamientos y la del Instituto Menorquín de Estudios, a la cual hay que sumar las convocatorias del Ayuntamiento de Ciutadella publicadas en el BOIB nº 150 de 19 de noviembre de 2022 y la del Instituto Menorquín de Estudios. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que atendida la coincidencia de la publicación de convocatorias, el proceso de solicitud finalizó de forma genérica día 20 de diciembre de 2022, a pesar de que las modificaciones de algunas convocatorias hayan alargado los plazos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Que de acuerdo con el informe de la jefa del Servicio de Gestión de Personas SGP 4/2022, de 12 de enero de 2022, relativo a la constitución y funcionamiento de los tribunales de valoración de la Oferta pública de empleo extraordinaria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que en fecha 16 de enero de 2023 mediante Resolución nº 2023/36, de la consejera ejecutiva del Departamento de Servicios Generales se nombran &lt;span style="color:#222222"&gt;los tribunales de las convocatorias de las ofertas públicas de empleo extraordinaria para estabilización del Consejo Insular de Menorca y entes dependientes, de todos los ayuntamientos de Menorca y del Instituto Menorquín de Estudios, publicada en el BOIB núm. 9 de fecha 19/01/2023. Estos nombramientos se han modificado mediante Resolución nº. 2023/59 de fecha 26 de enero de 2023 de la consejera ejecutiva del Departamento de Servicios Generales, publicada en el BOIB nº 14 de fecha 31 de enero de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#222222"&gt;Que algunos miembros de los tribunales han presentado la abstención, de acuerdo con el arte. 23 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, mediante las siguientes instancias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#222222"&gt;- ROSSELLO VILLALONGA, JAVIER con reg. de entrada nº GE/002295/2023 de fecha 25/01/2023, por manifestar ser delegado sindical.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#222222"&gt;- COLL HELLYER, VICTORIA ISABEL con reg. de entrada nº GE/002705/2023 de fecha 30/01/2023, para manifestar tener vínculo familiar de cuarto grado en las convocatorias del grupo A2 de la plaza de Trabajadora social de las plazas del Consejo Insular de Menorca, del Ayuntamiento de Maó y el Ayuntamiento de Es Migjorn.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Como titular del Departamento de Servicios Generales, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, por el Decreto de presidencia n.º 275/2022, de 6 de septiembre de 2022, relativo a la delegación de competencias de la Presidencia en los consejeros ejecutivos (BOIB nº 118 de 8 de septiembre de 2022), el acuerdo del Consejo ejecutivo de 5 de septiembre de 2022, relativo a la delegación de competencias del Consejo Ejecutivo en la presidenta y en los consejeros y consejeras ejecutivas (BOIB nº 118 de 8 de septiembre de 2022), todo lo anterior en relación con el Decreto de presidencia nº 421/2019 de 9 de julio, de creación de los departamentos (BOIB nº 93 ext. de 10 de julio de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Los nuevos miembros nombrados designados designados formaran parte de los tribunales de acuerdo con los siguientes grupos o subgrupos a calificar: subgrupo A1 y el grupo B, subgrupo C2 de administración especial, grupo C1+C2 de administración general y grupo AP, de acuerdo con el cuadro que consta a en el anexo I de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGUNDO. &lt;/strong&gt;Establecer la dedicación exclusiva del personal que forma parte de los tribunales durante las jornadas de su actuación trabajando &lt;span style="color:#000000"&gt;en jornadas completas y consecutivas de les 8 a las 14 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los miembros de los tribunales trabajarán de forma rotativa evitando que dejen sus puestos de trabajo por un período superior a los diez días. En cualquier caso se debe garantizar que todos los candidatos de una misma convocatoria sean valorados por los mismos miembros de un tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCERO.&lt;/strong&gt; Los miembros del Tribunal calificador se abstendrán de intervenir y los aspirantes podrán recusarlos, en la o las convocatorias afectadas por los motivos establecidos en los artículos 23 y 24 de la Ley 40/2015,de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CUARTO.&lt;/strong&gt;&lt;span style="color:#000000"&gt; Los miembros de los tribunales tendrán, en todo caso, derecho a indemnización por su participación de acuerdo con el Real Decreto 462/2002, de 24 de mayo, sobre indemnizaciones por razón del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;QUINTO.&lt;/strong&gt; Aceptar las abstenciones manifestadas por los siguientes miembros de los tribunales en las convocatorias de las plazas que han indicado y por la administración afectada, quedando en el resto de convocatorias de plazas y administraciones como miembro del Tribunal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
