![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Antecedentes</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. El 23 de enero de 2023, la Comisión Paritaria del Convenio colectivo del sector de la construcción de las Illes Balears acordó el calendario laboral para el año 2023.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. El 25 de enero de 2023, Francisca Alba Ramon, en representación de la Comisión Paritaria del Convenio colectivo, solicitó el registro, el depósito y la publicación de la citada Acta.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fundamentos de derecho</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. El artículo 90.3 del texto refundido de la Ley del Estatuto de los Trabajadores, aprobado por Real Decreto Legislativo 2/2015, de 23 de octubre.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios y acuerdos colectivos de trabajo.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. El artículo 45 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Por todo ello, dicto la siguiente</span></span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Resolución</strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. Inscribir y depositar el Acta de aprobación del calendario laboral para el año 2023 del Convenio colectivo del sector de la construcción de las Illes Balears en el Registro de Convenios Colectivos de las Illes Balears.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. Publicar el Convenio en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Hacer constar que la versión castellana del texto es la original firmada por los miembros de la Comisión Negociadora y que la versión catalana es su traducción.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4. Notificar esta Resolución a la persona interesada.</span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%">En Palma de Mallorca, a 23 de enero de 2023, se reúne la Comisión Negociadora del Convenio Colectivo del Sector de la Construcción de las Illes Balears, integrada por las personas y representaciones antes relacionadas, adoptando los acuerdos siguientes:</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%"><strong>PRIMERO.-</strong> Las partes acuerdan iniciar la negociación tratando el asunto del calendario laboral de 2023, a cuyos efectos, por la representación sindical de UGT-FICA Baleares se presenta una propuesta que, además de distribuir la jornada anual, contempla periodos laborales a razón de siete horas diarias de trabajo y otros a razón de nueve horas diarias de trabajo.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%">Frente a tal propuesta, tanto la representación sindical de CC.OO. del Hábitat Baleares como la representación empresarial, entienden que actualmente no resulta viable asumir la propuesta de UGT-FICA Baleares por las limitaciones de actividad que contemplan las Ordenanzas municipales.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%">En este orden, por la representación sindical de CC.OO. del Hábitat Balears y por las representaciones empresariales de Asociación de Constructores de Baleares, Asociación Patronal Yeseros-Escayolistas de Baleares, Asociación Maestros Pintores de Baleares y Asociación Empresarial de Promotores Inmobiliarios de Baleares se acuerda firmar el calendario laboral para 2023 que contempla la distribución de la jornada anual en los términos que contiene el anexo de este acta. Para ello, la representación sindical de CC.OO. del Hábitat Baleares interesará de la Autoridad Laboral la certificación correspondiente a su porcentaje de representatividad.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%"><strong>SEGUNDO.- </strong>Las partes acuerdan reanudar las negociaciones en fecha a determinar por las mismas.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%">Y no habiendo más asuntos que tratar, se levanta la presente acta que es firmada por las partes salvo por la representación sindical de UGT-FICA Baleares que, amén de negarse a firmarla, abandona la reunión.</span></span></p>
<p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%">OTROSI ACUERDAN.</span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:108%"><strong>PRIMERO.- </strong>Las partes firmantes del acuerdo descrito anteriormente autorizan al Sr. Andrés Moll Linares para que puedan realizar las gestiones oportunas ante la autoridad laboral para el registro y posterior publicación de dicho acuerdo.</span></span></p>
