&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por la presente, y en ejercicio de la competencia propia de desarrollo económico local que tiene encomendado del Ayuntamiento de Deià, de acuerdo con lo establecido por el articulo 29.2 t de la Ley 20/2006,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;convocar las Ayudas del Ayuntamiento de Deià destinadas a autónomos y PYMES para promover la desestacionalización y la diversificación económica, además de la promoción de su digitalización, con su publicación en el Boletín Oficial de las Islas Baleares, además del tablón de anuncios, la página web i las redes sociales del Ayuntamiento de Deià. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Deià, el día de la firma electrónica &lt;em&gt;(6 de febrero de 2023)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;BASES DEL AYUNTAMIENTO DE DEIÀ QUE DEBEN REGIR LA CONCESIÓN DE AYUDAS DESTINADAS A AUTÓNOMOS Y PYMES PARA PROMOVER LA DESESTACIONALIZACIÓN Y LA DIVERSIFICACIÓN ECONÓMICA, ADEMÁS DE LA PROMOCIÓN DE SU DIGITALIZACIÓN.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Convocatoria de 2023&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PRIMERA. - OBJECTO DE LA SUBVENCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Con esta subvención se pretende conceder ayudas a las empresas y autónomos de Deià para promover la desestacionalización y la diversificación económica, además de la promoción de su digitalización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;S&lt;span style="color:black"&gt;EGUNDA. - RÉGIMEN JURÍDICO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento de Deià tiene, como competencia propia, la del desarrollo económico, de acuerdo con lo dispuesto en el artículo 29.2 t de la Ley 20/2006.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La concesión de la presente subvención está sometido a lo dispuesto en el Reglamento municipal regulador de subvenciones, adoptado en sesión plenaria del día 10 de noviembre de 2017.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Así mismo, será aplicable la Ley 38/2003, de 17 de noviembre, General de Subvenciones; el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, los arts. 25 y 72 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y el Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones de la CAIB. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;TERCERA. - CRÉDITOS PRESUPUESTARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta convocatoria de subvenciones cuenta con el presupuesto máximo siguiente:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;&lt;strong&gt;8.000 euros.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las obligaciones económicas derivadas de la concesión de subvenciones de esta convocatoria van a cargo de la aplicación presupuestaria 479.00/430 &lt;em&gt;Ayudas dinamización, desestacionalización y diversificación económicas&lt;/em&gt; del presupuesto de este Ayuntamiento para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;CUARTA. – LÍNEAS DE AYUDAS Y CUANTÍA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;A) AYUDAS A LA DESESTACIONALIZACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Pueden optar aquellos autónomos o empresas que hayan desarrollado o desarrollen su actividad durante los meses de enero, febrero y marzo de 2023 recibirán 150€ por cada uno de estos meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Para considerar que se ha tenido actividad durante estos meses, se deberá demostrar que al menos ha existido actividad durante el 60% de los días laborables (o de su proporción), quedando exceptuados los periodos de baja médica en caso de autónomos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La cantidad máxima a otorgar por esta línea será de 5.000€&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;B) AYUDAS A LA DIVERSIFICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Pueden optar aquellos autónomos o empresas que desarrollen actividades económicas que no tengan que ver con el turismo, el comercio, la construcción, las transacciones inmobiliarias, el transporte, la jardinería o cualquier otra que pueda ser considerada análoga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En este caso, las empresas preexistentes recibirán una ayuda de 300€, y las que se pongan en marcha durante el 2023 de 500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La cantidad máxima a otorgar por esta línea será de 1.500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;C) AYUDAS A LA DIGITALIZACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Pueden optar aquellos autónomos o empresas que creen una página web, una aplicación o cualquier otra herramienta digital para el desarrollo de su actividad. Las empresas que las desarrollen durante el 2023 recibirán 500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La información que salga en estas herramientas digitales tiene que constar, al menos, en catalán.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las empresas que ya tengan una página web, una aplicación o cualquier otra herramienta digital que no esté en catalán y se la traduzcan durante el 2023 recibirán 150€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La cantidad máxima a otorgar por esta línea será de 1.500€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;QUINTA.- EN CASO DE TENER UN NÚMERO DE SOLICITUDES MAYOR O MENOR DE LAS QUE SE PUEDEN ATENDER SEGÚN LA PREVISIÓN DE LA BASE CUARTA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Si las solicitudes válidas con derecho a recibir la subvención superaran la suma total de las ayudas, la Comisión Evaluadora podrá formular, con el objetivo de atender todas las solicitudes presentadas que cumplan los requisitos, una Propuesta de Resolución que incluya el prorrateo proporcional entre todas ellas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;En caso de que hubiera presupuesto suficiente para atender a todas las solicitudes válidas y, además, existiera una cantidad sobrante, la Comisión Evaluadora podrá proponer una Propuesta de Resolución que incluya un aumento proporcional y equitativo de las cantidades a percibir por todas las líneas (priorizando, si hubiera, las deficitarias).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;SEXTA.- BENEFICIARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Podrán ser beneficiarios de estas ayudas, en los términos y requisitos que establecen estas bases:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Los trabajadores autónomos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Las sociedades de responsabilidad limitada, las sociedades anónimas, las sociedades comanditarias, las sociedades colectivas, las sociedades laborales y las sociedades cooperativas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Todos ellos tendrán que cumplir con los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- No superar los 25 trabajadores (en la totalidad de su actividad, no únicamente en la que desarrollen en el municipio de Deià).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Desarrollar su actividad en el municipio de Deià mediante establecimiento físico y/o tener su domicilio social y fiscal en Deià.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Encontrarse al corriente de sus obligaciones tributarias y con la Seguridad Social, incluidas las de la Hacienda Local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- No encontrarse incurso en ninguna de las prohibiciones previstas en los apartados 2 y 3 del Art.13 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;SÉPTIMA. - PLAZOS DE LA CONVOCATORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El plazo de presentación de las solicitudes será el que se indica a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La presentación de la solicitud, junto con la documentación exigida, será a partir del día siguiente a la publicación de estas bases en el BOIB y hasta el 10 de marzo de 2023 para la LÍNEA A y hasta el 15 de noviembre de 2023 para las LÍNEA B y LÍNEA C. En caso de que el último día sea inhábil, el plazo se prorrogará hasta el siguiente día hábil. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La presentación de la solicitud de subvención fuera del plazo establecido y la falta de presentación de la documentación exigida en estas bases, será causa de inadmisión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;OCTAVA. - COMISIÓN EVALUADORA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La Comisión Evaluadora estará formada por la Alcaldía y la secretaría-intervención del Ayuntamiento de Deià. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;NOVENA. - PROCEDIMIENTO Y RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La subvención se concederá a las solicitudes que reúnan todos los requisitos establecidos en las presentes bases que rigen la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Una vez finalizado el plazo de presentación, la Comisión Evaluadora comprobará las solicitudes y requerirá las enmiendas o la resolución de cualquiera de las dudas que les surjan respecto de las solicitudes presentadas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Si del examen de la solicitud por la Comisión Evaluadora se comprueba que no reúne los requisitos establecidos en el artículo 66 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y/o que no aporta la totalidad de la documentación requerida en esta Convocatoria, se requerirá, en base al art. 23.5 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, a la Entidad solicitante, o si procede a la designada como responsable, para que enmiende la falta o aportación de los documentos preceptivos, en un &lt;strong&gt;plazo de diez días hábiles&lt;/strong&gt; contados a partir del día siguiente al requerimiento, con la indicación que, si así no lo hiciera, se le tendrá por desistida en su petición, previa Resolución que tendrá que ser dictada en los términos previstos en el artículo 21 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Además, se realizarán de oficio cuántas actuaciones se estimen necesarias y convenientes para la determinación, conocimiento y comprobación de los datos que figuran en las solicitudes en virtud de las cuales se tendrán que valorar las mismas para la resolución del expediente de concesión de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Transcurrido el plazo de los diez días hábiles para enmendar o aportar nueva documentación, la Comisión Evaluadora, una vez comprobada qué solicitudes reúnen los requisitos establecidos en la presente convocatoria, elevará informe al órgano competente para su resolución y que corresponde al Alcalde.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El plazo máximo para resolver y notificar el acuerdo será de dos meses desde la finalización del plazo de presentación de las solicitudes. Este acuerdo pondrá fin a la vía administrativa y se podrá interponer contra dicha resolución recurso potestativo de reposición en el plazo de un mes, ante el mismo órgano que haya dictado la resolución, o bien recurrir directamente ante la jurisdicción contenciosa-administrativa en la forma y plazos establecidos en la Ley reguladora de la jurisdicción contenciosa-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;DÉCIMA. - DOCUMENTACIÓN NECESARIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Deià podrá requerir en cualquier momento de la tramitación de las solicitudes, los documentos que considere necesarios para garantizar la correcta adjudicación de la ayuda, según los criterios de evaluación establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;No se encuentra sometida en ninguna de las causas de prohibición de la obtención de la consideración de beneficiario señaladas en el artículo 13 puntos 2 y 3 de la Ley 38/2003.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
