![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos </strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 30 de junio de 2023 termina el ejercicio de la función directiva de determinados directores de centros educativos de las Illes Balears, por lo que es necesario seleccionar en los centros con vacantes, a los directores que deben desarrollar esta tarea a partir del 1 de julio.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el BOIB nº. 30, de 23 de febrero de 2010, se publicó, con corrección de erratas en el BOIB núm. 33, de 27 de febrero, la Orden del consejero de Educación y Cultura de 18 de febrero de 2010 por la que se aprueban las bases para la selección, nombramiento y cese de los órganos de gobierno de los centros docentes públicos universitarios de las Islas Baleares.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Actualmente, estas bases deben ajustarse a lo que dispone la Ley orgánica 2/2006, de 3 de mayo, de educación (LOE), según la redacción fijada por la Ley orgánica 3/2020, de 29 de diciembre, por la que se modifica la Ley orgánica 2/2006, de 3 de mayo, de educación (LOMLOE) . Los puntos setenta y uno a setenta y tres bis del artículo único de la LOMLOE modifican los artículos 134 a 137 de la LOE, que tratan, entre otros aspectos, de los requisitos para ser candidato a director, del proceso de selección y del nombramiento.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Teniendo en cuenta los puntos anteriores, en la presente Resolución se incluyen los cambios introducidos por la LOMLOE en lo que se refiere a los requisitos para ser candidato a director, al procedimiento de selección (en especial, en los aspectos que hacen referencia a la composición de la comisión de selección) y al nombramiento, adecuándose a esta norma el baremo de los méritos de los candidatos. De acuerdo con el artículo 133 de la LOE, los directores deben seleccionarse mediante un concurso de méritos basado en los principios de igualdad, publicidad, mérito y capacidad, proceso en el que deben participar la comunidad educativa y Administración educativa.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. De acuerdo con el Decreto 11/2021, de 15 de febrero, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, corresponden a la Dirección General de Planificación, Ordenación y Centros de la Consejería de Educación y Formación Profesional las competencias en materia de planificación educativa, coordinación, régimen orgánico y funcionamiento de los centros docentes.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. A partir de lo expuesto, es necesario convocar un proceso para seleccionar a los directores de determinados centros docentes públicos no universitarios y aprobar las bases que deben regirlo.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El director general de Planificación, Ordenación y Centros y la directora general de Personal Docente deben llevar a cabo las actuaciones que se prevén en esta Resolución.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Orden del consejero de Educación y Cultura de 18 de febrero de 2010 por la que se aprueban las bases para la selección, nombramiento y cese de los órganos de gobierno de los centros docentes públicos no universitarios de las Illes Balears (BOIB nº 30, de 23 de febrero), con corrección de errores en el BOIB nº. 33, de 27 de febrero.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm. 106, de 4 de mayo), modificada por la Ley orgánica 3/2020 de 29 de diciembre, por la que se modifica la Ley orgánica 2/ 2006, de 3 de mayo, de educación (BOE núm. 340, de 30 de diciembre).</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Real decreto 894/2014, de 17 de octubre, por el que se desarrollan las características del curso de formación sobre el ejercicio de la función directiva establecida en el artículo 134.1. <em>c) </em>de la Ley orgánica 2/2006, de 3 de mayo, de educación, así como de los correspondientes cursos de actualización de competencias directivas (BOE núm. 270, de 7 de noviembre).</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto 11/2021, de 15 de febrero, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 21, de 15 de febrero), modificado por el Decreto 25/2021, de 8 de marzo, de la presidenta de las Illes Balears (BOIB núm. 33, de 9 de marzo) y por el Decreto 1/2022, de 27 de julio , de la presidenta de las Islas Baleares (BOIB núm. 104, de 9 de agosto de 2022).</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La ley 40/2015, de 1 de octubre, de régimen jurídico del sector público por la que se establecen y regulan las bases del régimen jurídico de las administraciones públicas, los principios del sistema de responsabilidad de las administraciones públicas y de la potestad sancionadora, así como la organización y funcionamiento de la Administración General del Estado y de su sector público institucional para el ejercicio de sus actividades.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, en virtud de las competencias que tengo conferidas, y con el acuerdo de la Mesa Sectorial de Educación, dicto la siguiente</span></span></p>
<p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>RESOLUCIÓN</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Convocar un concurso de méritos para seleccionar a los directores de los centros públicos que figuran en el anexo 2, de conformidad con el calendario establecido en el anexo 3 y de acuerdo con el baremo de méritos previsto en el anexo 4 y los criterios de valoración del proyecto de dirección previsto en el anexo 5 de esta Resolución.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Aprobar las bases que deben regir esta convocatoria, que figuran en el anexo 1 de esta Resolución.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Aprobar el modelo de solicitud, que figura en el anexo 6, los modelos para complementar la solicitud que figuran en los anexos 7 y 8, así como el modelo de relación de miembros propuestos por el centro para formar parte de la comisión de selección, que figura en el Anexo 9.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta Resolución en el <em>Boletín Oficial de las Islas Baleares</em>.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Formación Profesional en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primero<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Requisitos de los candidatos</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Los requisitos que deben cumplir los candidatos para poder participar en el concurso de méritos son los siguientes:</span></span></p>
<ol class="lower-alpha" start="1">
<li style="list-style-type:none"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tener una antigüedad mínima de cinco años como funcionarios de carrera en la función pública docente al finalizar el plazo de presentación de candidaturas.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Haber ejercido, al finalizar el plazo de presentación de candidaturas, funciones docentes como funcionarios de carrera durante un período mínimo de cinco años en alguna de las enseñanzas que ofrece el centro al que se opta.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Prestar servicios, al publicarse la convocatoria, en un centro público de las Islas Baleares en alguna de las enseñanzas que ofrece el centro al que se opta.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tener las titulaciones o los certificados que acrediten el dominio de la lengua catalana exigible de conformidad con la Orden del consejero de Educación y Universidad de 8 de marzo de 2018 por la que se fijan las titulaciones que hay que tener para dar clases de y en lengua catalana, propia de las Islas Baleares, en la enseñanza reglada no universitaria, se establecen las equivalencias, se define el Plan de Formación Lingüística y Cultural (FOLC), se regulan las condiciones de la exención de la evaluación de la lengua catalana y literatura en enseñanzas no universitarias y se determinan las funciones y la composición de la Comisión Técnica de Asesoramiento para la Enseñanza de y en Lengua Catalana (BOIB núm. 38, de 27 de marzo) , modificada por la Orden del consejero de Educación y Formación Profesional de 9 de julio de 2021 de modificación de la Orden del consejero de Educación y Universidad de 8 de marzo de 2018 por la que se fijan las titulaciones que hay que tener para dar clases de y en lengua catalana , propia de las Islas Baleares, en la enseñanza reglada no universitaria, se establecen las equivalencias, se define el Plan de Formación Lingüística y Cultural (FOLC), se regulan las condiciones de la exención de la evaluación de la lengua catalana y literatura en enseñanzas no universitarias y se determinan las funciones y la composición de la Comisión Técnica de Asesoramiento para la Enseñanza de y en Lengua Catalana (BOIB núm. 95, de 17 de julio).</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Presentar un proyecto de dirección que incluya, entre otros aspectos, los objetivos, líneas de actuación y evaluación de este proyecto.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En los centros específicos de educación infantil de segundo ciclo; en los centros incompletos de educación infantil y primaria; en los centros de educación secundaria con menos de ocho unidades; en los centros en los que se imparten únicamente enseñanzas artísticas, enseñanzas deportivas o enseñanzas de idiomas o en los centros de educación de personas adultas, con menos de ocho profesores, los candidatos están eximidos de cumplir los requisitos expresados en las letras <em>a ) </em>y b <em>) </em>del apartado 1 del punto primero de las bases.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Presentación de las solicitudes</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El plazo para presentar las solicitudes y la documentación acreditativa del cumplimiento de los requisitos y méritos alegados es hasta el 15 de febrero de 2023.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La solicitud se realizará exclusivamente por medios electrónicos a través del trámite telemático habilitado al efecto que se encuentra en la página web de la Dirección General de Planificación, Ordenación y Centros y en la sede electrónica de la CAIB. La solicitud debe cumplimentarse siguiendo las instrucciones de la aplicación y para poder cumplimentarla y tramitarla se requerirá la autenticación previa de la identidad del solicitante mediante uno de los siguientes sistemas:</span></span></p>
<ol class="lower-alpha" start="1">
<li style="list-style-type:none"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sistema de identidad electrónica para las administraciones: Cl@ve.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">DNI electrónico o certificado digital reconocido.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Se comprobarán de oficio los requisitos y méritos de los candidatos a través del Portal de Servicios al Personal. Los participantes que estén de acuerdo con los datos que constan en este Portal deben indicarlo y realizar el envío telemático. En caso de que el solicitante quiera rectificar algún dato de los que constan en el Portal o quiera aportar algún dato nuevo que no conste, debe adjuntar al trámite telemático la documentación justificativa en formato digital del cumplimiento de los requisitos o de los méritos alegados que desee subsanar o presentar de acuerdo con el anexo 7 de esta Resolución. Si la documentación no se puede justificar en formato digital se puede presentar dentro del plazo establecido en cualquiera de las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La tramitación telemática sólo se completa cuando, utilizando el asistente de tramitación, se envía la solicitud, obteniendo un número de registro.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En caso de haber tramitado más de una solicitud, sólo se considerará válida la última que se haya registrado telemáticamente.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercero<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proyecto de dirección</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El proyecto de dirección de los candidatos debe elaborarse partiendo del análisis del centro educativo y debe fijar los objetivos, las líneas de actuación y la evaluación del propio proyecto, desde la perspectiva de un plan estratégico. El director del centro debe garantizar que todos los aspirantes tengan acceso a los documentos institucionales del centro, así como a los datos estadísticos necesarios para elaborar el proyecto de dirección (SEDEIB). El proyecto educativo del centro (PEC) debe estar disponible en el sitio web del centro y en el GestIB y al alcance de toda la comunidad educativa.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El proyecto de dirección no superará las veinte páginas en cuyo cómputo no se incluyen ni la portada ni el índice. El tipo de letra debe ser Times New Roman, cuerpo 12, escala 100%, interlineado 1,5. Los márgenes superior, inferior, derecho e izquierdo deben ser de 2 cm cada uno. Se pueden utilizar cuadros resumen o gráficos, que deben cumplir los mismos requisitos formales.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El proyecto de dirección debe incluir lo siguiente:</span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Una introducción, en la que debe reflejarse :</span></span></p>
<ul>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El análisis del espacio físico y del entorno social del centro.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El análisis y la valoración del proyecto educativo y de la organización y funcionamiento del centro.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El análisis y la valoración de los datos y resultados de los últimos años.</span></span></li>
</ul>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Un proyecto estratégico, con el siguiente contenido:</span></span></p>
<ul>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ámbitos de intervención o factores críticos de éxito a partir de los que se fijarán los objetivos.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Objetivos que deben haberse alcanzado al final de los cuatro años de mandato como director. Estos objetivos deben ser coherentes con el PEC, deben incidir en la mejora global del servicio educativo que presta el centro y deben estar orientados a alcanzar el éxito escolar de todo el alumnado.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Indicadores que permitan medir y alcanzar los objetivos fijados.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Líneas de actuación, proyectos, planes, procesos, actividades, etc., para alcanzar los objetivos fijados, entre los que deben preverse, entre otros, las acciones encaminadas a dinamizar y sensibilizar a la comunidad educativa en relación con la aplicación del plan de igualdad del centro, elaborado en el marco del Plan de Coeducación de las Islas Baleares y el fomento de la lengua catalana.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Recursos humanos, materiales y económicos.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Estrategias para conseguir la participación de la comunidad educativa y la implicación del claustro y el consejo escolar en el proyecto de dirección.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sistema de evaluación del proyecto.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Nombre de las personas que se proponen para formar parte del equipo directivo, con indicación de la formación y experiencia en gestión de centros que tienen. El número de miembros que deben configurar el equipo directivo debe adecuarse a lo que dispone la Resolución del consejero de Educación y Universidad de 15 de noviembre de 2017 por la que se establecen los criterios para determinar la tipología de los centros docentes públicos no universitarios y la asignación de equipos directivos (BOIB núm. 152, de 14 de diciembre).</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si la persona propuesta como miembro del equipo directivo es un funcionario interino que no tenga el próximo curso destino en el centro, el nombramiento se hará en fecha 1 de septiembre, siempre que a partir de esa fecha ocupe en el centro una plaza vacante de todo el curso escolar a jornada completa. En cualquier caso, el hecho de que determinados profesores del centro ejerzan funciones directivas no supondrá en ningún caso un aumento de la cuota del profesorado del centro respecto a los criterios establecidos.</span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los candidatos deben presentar el proyecto de dirección, en el lugar y en la forma que establece el apartado C del punto quinto de las bases y de acuerdo con el calendario establecido en el anexo 3<strong> </strong>de esta Resolución.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cuarto<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Comisión de selección</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. En cada uno de los centros docentes en los que se debe seleccionar un director debe constituirse una comisión de selección.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Cada comisión de selección debe estar formada por dos representantes de la Administración educativa y cuatro representantes del centro, dos de los cuales deben ser miembros del claustro de profesores y los otros dos, del consejo escolar. Los representantes del consejo escolar deben ser elegidos por los miembros que no son docentes, entre ellos mismos. Ambos representantes no pueden provenir simultáneamente de un mismo sector de la comunidad educativa. El representante de los alumnos en el consejo escolar no puede ser elegido por esta comisión si cursa un nivel inferior a tercero de ESO.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las comisiones deben estar formadas por los siguientes miembros:</span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Representantes de la Administración educativa: dos representantes designados por el director general de Planificación, Ordenación y Centros, uno de los cuales debe ser un inspector de educación, propuesto por la jefa del Departamento de Inspección Educativa, que debe actuar como presidente, y el otro, un director en ejercicio del mismo tipo de centro docente para el que se realiza el proceso de selección, o parcialmente similar.</span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Representantes del centro:</span></span></p>
<ul>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dos miembros del claustro de profesores del centro, elegidos en una sesión extraordinaria del claustro convocada al efecto. De éstos, el de menor edad actuará como secretario de la comisión. Los candidatos a director del centro no podrán ser elegidos como miembros de la comisión.</span></span></li>
<li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dos miembros del consejo escolar del centro, elegidos en una sesión extraordinaria del consejo escolar convocada al efecto. No se puede elegir a un miembro que también lo sea del claustro de profesores ni un representante de los alumnos que curse un nivel inferior a tercero de ESO.</span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. En caso de que el director del centro docente se presente como candidato a director o forme parte de una propuesta de equipo directivo, no puede presidir las sesiones extraordinarias del claustro de profesores ni del consejo escolar mencionadas en el apartado 3. <em>b) </em>del punto cuarto de las bases<em> </em>y debe ser sustituido por el jefe de estudios. En caso de que el jefe de estudios también se presente como candidato a director o forme parte de una propuesta de equipo directivo, debe presidir el claustro el profesor con más antigüedad en el centro y debe presidir el consejo escolar el profesor miembro de este órgano que tenga mayor antigüedad en el centro. Excepcionalmente, el director del centro, el resto de miembros del equipo directivo y los profesores representantes del claustro en el consejo escolar tendrán voz, pero no voto, en la sesión extraordinaria del consejo escolar mencionada en el apartado 3. <em>b) </em>del punto cuarto de las bases.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El claustro de profesores y el consejo escolar deben elegir a sus representantes por votación secreta y según los siguientes criterios:</span></span></p>
<ol class="lower-alpha" start="1">
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para elegir a los representantes del claustro de profesores, cada miembro puede votar a un representante y se seleccionarán los dos más votados. El resto de profesores votados tendrán la consideración de suplentes y se ordenarán según los votos obtenidos, de mayor a menor. En caso de empate en el número de votos, se seleccionará al profesor con más antigüedad en el centro docente, y, si el empate continúa, el de mayor edad. Si aun así persiste el empate, se seleccionará por sorteo.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para elegir a los representantes del consejo escolar, cada miembro, excepto los que se indican en el apartado 4 del punto cuarto de las bases, puede votar a un representante. Se seleccionarán a los dos más votados. El resto de miembros votados tendrán la consideración de suplentes y se ordenarán según los votos obtenidos, de mayor a menor. En caso de empate en el número de votos, se seleccionará al miembro del consejo escolar de mayor edad, y, si continúa el empate, la elección se decidirá por sorteo.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la Ley 40/215 de régimen jurídico del sector público, los miembros de la comisión de selección no pueden ejercer estas funciones cuando concurra un conflicto de interés, por eso no pueden ser miembros de la comisión de selección las personas que formen parte de la propuesta de equipo directivo del candidato. Tampoco pueden formar parte si se da cualquier otro de los motivos indicados en los artículos 23 y 24 de esta ley.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Las funciones de la comisión de selección son las siguientes:</span></span></p>
<ol class="lower-alpha" start="1">
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Valorar el proyecto de dirección de cada uno de los candidatos, de conformidad con los criterios y orientaciones establecidos en el anexo 5 de esta Resolución.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Valorar y validar los méritos académicos y profesionales de los candidatos, de conformidad con el baremo del Anexo 4 de esta Resolución.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Proponer al director general de Planificación, Ordenación y Centros al candidato seleccionado.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Quinto<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Procedimiento</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>A. Plazos</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">Las fechas máximas para llevar a cabo los diferentes trámites de este </span>procedimiento, que son los que se indican a continuación<span style="background-color:white">, aparecen</span> en el anexo 3<strong> </strong>de esta Resolución.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>B. Listas provisionales y definitivas de precandidatos admitidos y excluidos</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Finalizado el plazo para presentar las solicitudes, la Dirección General de Planificación, Ordenación y Centros hará públicas las listas provisionales de precandidatos admitidos y excluidos, con indicación de los motivos de la exclusión. Estas listas deben publicarse el 22 de febrero de 2023 en la página web de la Dirección General de Planificación, Ordenación y Centros <em>http://dgplacen.caib.es </em>.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los participantes excluidos disponen de un plazo de cinco días naturales a contar a partir del día siguiente de la publicación de las listas provisionales para presentar ante la Dirección General de Planificación, Ordenación y Centros las alegaciones para subsanar los defectos que hayan motivado exclusión a través del trámite telemático habilitado al efecto, que se encuentra en la página web de la Dirección General de Planificación, Ordenación y Centros y en la sede electrónica de la CAIB.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Finalizado el plazo para presentar alegaciones, el director general de Planificación, Ordenación y Centros debe dictar la resolución por la que se aprueban las listas definitivas de precandidatos admitidos y excluidos, que deben publicarse en la página web <em>http: //dgplacen.caib.es </em>. Se consideran precandidatos porque todavía estarán pendientes de la entrega del proyecto de dirección. Con esta publicación se considera realizada la notificación a los interesados.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>C. Presentación del proyecto de dirección</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Los precandidatos deben presentar el proyecto de dirección en formato pdf, con un tamaño máximo de 5 Mb y exclusivamente por medios electrónicos a través del trámite telemático habilitado al efecto, que se encuentra en la página web de la Dirección General de Planificación, Ordenación y Centros y en la sede electrónica de la CAIB. La tramitación telemática sólo se completa cuando, utilizando el asistente de tramitación, se envía el proyecto, obteniéndose un número de registro. En caso de haber colgado más de un proyecto, se considera válido el último que se haya registrado telemáticamente. El trámite telemático de presentación de proyecto estará abierto del 8 al 16 de marzo.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Posteriormente, la Dirección General de Planificación, Ordenación y Centros hará pública la lista provisional de candidatos admitidos y excluidos, que se publicará en la página web <em>http://dgplacen.caib.es </em>. Tienen que figurar como excluidos los candidatos que no hayan presentado el proyecto de dirección o que hayan presentado un proyecto que no se ajusta a los requisitos formales exigidos. Con esta publicación se considera realizada la notificación a los interesados.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los participantes excluidos disponen de un<strong> </strong>plazo de cinco días naturales a contar a partir del día siguiente de la publicación de las listas provisionales para presentar ante la Dirección General de Planificación, Ordenación y Centros las alegaciones para subsanar los defectos que hayan motivado la exclusión a través del trámite telemático habilitado al efecto, que se encuentra en la página web de la Dirección General de Planificación, Ordenación y Centros y en la sede electrónica de la CAIB.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Finalizado el plazo para presentar alegaciones, el director general de Planificación, Ordenación y Centros debe dictar la resolución por la que se aprueban las listas definitivas de candidatos admitidos y excluidos, que deben publicarse en la página web <em>http: //dgplacen.caib.es .</em> </span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>D. Formación de las comisiones de selección</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Publicadas las listas definitivas de precandidatos admitidos y excluidos (7 de marzo de 2023), la Dirección General de Planificación, Ordenación y Centros debe comunicar, mediante el correo interno del GESTIB, la existencia de precandidatos admitidos al director de cada centro docente afectado por esta convocatoria.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Una vez efectuada esta comunicación, deben llevarse a cabo las siguientes actuaciones:</span></span></p>
<ol class="lower-alpha" start="1">
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El director general de Planificación, Ordenación y Centros debe nombrar a los representantes de la Administración educativa en cada comisión de selección: un inspector de educación a propuesta de la jefa del Departamento de Inspección Educativa, que debe actuar de presidente , y un director en ejercicio del mismo tipo de centro docente para el que se realiza el proceso de selección, o parcialmente similar.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los directores de los centros deben convocar las sesiones extraordinarias del claustro de profesores y del consejo escolar en las que deben elegirse los representantes del centro en la comisión de selección. La convocatoria debe incluir una relación de los candidatos a director.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Una vez elegidos los representantes del centro en la comisión de selección, el director del centro o la persona en quien delegue comunicará a la Dirección General de Planificación, Ordenación y Centros los nombres a través del trámite telemático habilitado al efecto, que se encuentra en la página web de la Dirección General de Planificación, Ordenación y Centros y en la sede electrónica de la CAIB. El modelo debe cumplimentarse siguiendo las instrucciones de la aplicación (anexo 9) y para poder cumplimentar y tramitar la comunicación se requerirá la autenticación previa mediante uno de los siguientes sistemas:</span></span></p>
<ol class="lower-alpha" start="1">
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sistema de identidad electrónica para las administraciones: Cl@ve.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">DNI electrónico o certificado digital reconocido.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. También debe asegurarse de que se haya publicado en la web del centro y en el GestIB una copia del PEC, si todavía no figura o si se ha actualizado.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El director general de Planificación, Ordenación y Centros dictará resolución para nombrar a los miembros de cada una de las comisiones de selección. Con el fin de asegurar la cohesión entre todas las comisiones de selección y la objetividad del proceso, debe incluir el procedimiento de actuación. Esta resolución debe publicarse en la página web <em>http://dgplacen.caib.es </em>.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Una vez se haya publicado el nombramiento de los miembros de la comisión de selección, la Dirección General de Planificación, Ordenación y Centros publicará en el GestiB, en el apartado de proyectos institucionales, los proyectos de dirección de los candidatos para que estén en el alcance de la comunidad educativa.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>E. Valoración de los méritos y del proyecto de dirección de los candidatos y propuesta de selección</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Corresponde al secretario de la comisión, por orden del presidente, convocar la sesión de constitución y las de funcionamiento, necesarias para realizar las funciones que la comisión de selección tiene encomendadas. Para que las comisiones de selección se puedan constituir y puedan funcionar válidamente, a efectos de llevar a cabo las sesiones y las deliberaciones y tomar acuerdos, se requiere la presencia, como mínimo, de tres miembros y es imprescindible que uno de ellos sea el presidente, puesto que el cargo es indelegable. Si el Secretario no estuviera presente, actuará como tal el otro representante del claustro.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Dirección General de Planificación, Ordenación y Centros debe enviar a los presidentes de las comisiones de selección las puntuaciones provisionales de los méritos de cada uno de los candidatos, de acuerdo con lo que se prevé en el anexo 4 de esta Resolución, y debe publicar en el GestIB los proyectos de dirección que se hayan presentado.</span></span></p>
<div style="page-break-after:always"><span style="display:none"> </span></div>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los proyectos deben valorarse de la siguiente manera:</span></span> </p>
<ul>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El secretario de la comisión de selección convocará a los candidatos a director para que puedan defender su proyecto de dirección ante la comisión. Al final de cada exposición, los miembros de la comisión pueden realizar preguntas al candidato para resolver dudas sobre el proyecto presentado.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La comisión de selección debe valorar, con un máximo de diez puntos, el proyecto de dirección de cada candidato, teniendo en cuenta la defensa efectuada, en caso de que acuerde una entrevista con la persona candidata, y el grado de adecuación del proyecto a lo que dispone el punto tercero de estas bases y de acuerdo con los criterios y las orientaciones del anexo 5 de esta Resolución.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cada miembro de la comisión de selección puntuará cada proyecto de dirección. La puntuación máxima será de diez puntos. La puntuación de la comisión será la media aritmética de las puntuaciones otorgadas por los miembros asistentes, excluidas las que difieran de tres o más puntos entre sí.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La media aritmética debe calcularse con un mínimo de tres puntuaciones. Dichas exclusiones sólo pueden afectar a la puntuación máxima (sólo una, si hay coincidencia) ya la puntuación mínima (sólo una, si existe coincidencia).</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las medias aritméticas antes mencionadas deben calcularse con una aproximación de tres decimales.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los candidatos que no obtengan un mínimo de cinco puntos en la valoración de su proyecto, no podrán ser seleccionados. En consecuencia, no deben tenerse en cuenta los méritos.</span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Finalizada la valoración de los proyectos, la comisión de selección debe valorar y validar los méritos de los candidatos a partir de la documentación enviada por la Dirección General de Planificación, Ordenación y Centros.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Con los resultados de la valoración del proyecto y de los méritos de los candidatos, la comisión de selección debe proponer un director, de acuerdo con el siguiente procedimiento:</span></span></p>
<ol class="lower-alpha" start="1">
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La comisión debe proponer al candidato que haya obtenido la puntuación más alta una vez sumadas la puntuación obtenida por la valoración del proyecto y la puntuación obtenida por la valoración de los méritos.</span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de empate, debe seleccionarse el candidato que haya obtenido la puntuación más alta en la valoración del proyecto de dirección. Si se mantiene el empate, tiene prioridad el candidato que desarrolle o haya desarrollado la tarea docente o directiva en el centro al que se opta y, después, el que haya obtenido la puntuación más alta en los apartados <em>a) </em>, <em>b) </em>y <em>c ) </em>del baremo del anexo 4 de esta Resolución, en este orden. Si aún así se mantiene el empate, se realizará un sorteo público entre los candidatos empatados.</span></span></li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. La comisión de selección debe aprobar el acta final con el nombre del candidato propuesto como director. En el acta aparecerán las puntuaciones globales otorgadas por cada uno de los miembros de la comisión a cada candidato, las medias de cada uno de los apartados especificados en el anexo 5, la puntuación desglosada de los apartados del baremo de méritos recogido en el anexo 4 y la puntuación final global.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. La comisión de selección publicará las puntuaciones definitivas, incluyendo la valoración y calificación del proyecto de dirección y la valoración y validación de los méritos académicos y profesionales, en la página web y en el tablón de anuncios del centro. Con esta publicación se entiende que se ha notificado las puntuaciones a los candidatos. Si los interesados no están conformes, pueden presentar un escrito de alegaciones dirigido al presidente de la comisión de selección en un plazo de cinco días naturales a contar a partir del día siguiente de la publicación. La comisión debe comunicar a los interesados la respuesta a sus alegaciones en un plazo de tres días hábiles.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El presidente de la comisión debe remitir a la Dirección General de Planificación, Ordenación y Centros la puntuación final y la propuesta del candidato seleccionado, junto con la documentación de todo el proceso.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>F. Propuesta de equipo directivo</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Recibida la propuesta de la comisión de selección, la Dirección General de Planificación, Ordenación y Centros debe comunicar al candidato seleccionado que ha sido propuesto como director del centro y que debe introducir en el GESTIB («Centro» > «Propuestas de personal») la propuesta de equipo directivo que figura en el proyecto de dirección hasta el 2 de junio de 2023.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>G. Nombramiento del director propuesto</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El director general de Planificación, Ordenación y Centros debe proponer a la directora general de Personal Docente que nombre directores a los candidatos seleccionados que estén exentos de la realización del programa de formación sobre competencias para el desarrollo de la función directiva, <strong>con efectos del 1 de julio de 2023 y por un período de cuatro años </strong>.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los candidatos que deban realizar total o parcialmente el programa de formación inicial sobre competencias para el desarrollo de la función directiva, el primer año serán nombrados directores en prácticas y, mientras tanto, lo realizarán.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Servicio de Normalización Lingüística y Formación enviará a la Dirección General de Planificación, Ordenación y Centros el listado de los directores en prácticas que han participado en la formación, con la puntuación obtenida.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. A partir del listado de los directores en prácticas que han superado la formación, el director general de Planificación, Ordenación y Centros propondrá a la directora general de Personal Docente que estos directores sean nombrados por un período de tres años más.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En caso de no superar la formación, el centro deberá aparecer como vacante en el siguiente proceso de selección.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Los nombramientos serán publicados en el BOIB, mediante resolución de la directora general de Personal Docente.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>H. Formación inicial</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El programa de formación inicial sobre competencias para el desarrollo de la función directiva que aparece en el artículo 135.6 de la LOE, según la redacción fijada por la LOMLOE, debe desarrollarse durante el curso escolar por el que han sido nombrados directores en prácticas los candidatos seleccionados.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los candidatos seleccionados deben realizar un programa de formación sobre el desarrollo de la función directiva impartido por el Ministerio de Educación y Formación Profesional o por la Dirección General de Primera Infancia, Innovación y Comunidad Educativa, a través del Servicio de Normalización Lingüística y Formación.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>I. Exenciones y convalidaciones del programa de formación inicial</strong></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Están exentos de participar en el programa de formación inicial los candidatos que acrediten experiencia en el ejercicio de la función directiva con al menos una evaluación positiva de su labor.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Están exentos de participar en el programa de formación inicial los candidatos que tengan certificada, en fecha posterior al 1 de julio de 2013, la formación sobre el desarrollo de la función directiva docente impartida por el Ministerio de Educación y Formación Profesional administraciones educativas de las comunidades autónomas.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los candidatos pueden solicitar al Servicio de Normalización Lingüística y Formación la convalidación parcial o total del programa de formación inicial, siempre que hayan realizado cursos de formación permanente impartidos por el Ministerio de Educación y Formación Profesional o por las administraciones educativas de las comunidades autónomas o cursos de postgrado universitario sobre el desarrollo de la función directiva docente.</span></span></p>

En caso de que no haya ningún candidato, o cuando la comisión de selección correspondiente no haya seleccionado ninguna, la Dirección General de Planificación, Ordenación y Centros, previo informe del Departamento de Inspección Educativa, consultado el consejo escolar del centro, debe proponer a la Dirección General de Personal Docente el nombramiento de directores con carácter extraordinario, por un período de dos años y con efectos del 1 de julio de 2023.</span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Corresponde a la directora general de Personal Docente dictar y publicar en el BOIB la resolución de nombramiento.</span></span></p>
