CAIB 52302 2974 2023-01-19 2976 es es ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Reglamento (UE) 2019/1022 del Parlamento Europeo y del Consejo, de 20 de junio de 2019, por el cual se establece un plan plurianual para las especies demersales en el Mediterráneo occidental y por el cual se modifica el Reglamento (UE) núm. 508/2014, establece un régimen de gestión de esfuerzo pesquero para el arrastre en el Mediterráneo. En este sentido, el mismo Reglamento comunitario indica en el artículo 9.2 que cada estado miembro decidirá un método de asignación del esfuerzo pesquero máximo admisible a barcos o grupos de barcos que enarbolen su pabellón.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Reglamento (UE) 2022/110 del Consejo, de 27 de enero de 2022, por el cual se fijan, para 2022, las posibilidades de pesca aplicables a determinadas poblaciones y grupos de poblaciones de pesces en el mar Mediterráneo y en el mar Negro, establece en el anexo III el esfuerzo pesquero máximo admisible en días de pesca asignado en España para su flota de arrastre en el Mediterráneo el 2022, por tramos de eslora y para dos pesquerías, costera y profunda, aplicable desde el 1 de enero de 2022.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Resolución de 25 de febrero de 2022 de la Secretaría General de Pesca por la cual se publica el listado de días máximos subvencionables por reducción de esfuerzo pesquero para el año 2022, asignados por barco de arrastre de fondo del Mediterráneo en el marco de la Orden APA/423/2020 de 18 de mayo por la cual se establece un plan de gestión para la conservación de los recursos pesqueros demersales en el mar Mediterráneo, establece los días máximos subvencionables por reducción de esfuerzo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Real decreto 1173/2015, de 29 de diciembre, de desarrollo del Fondo Europeo Marítimo y de Pesca en cuanto a las ayudas a la paralización definitiva y temporal de la actividad pesquera, modificado por el Real decreto 528/2022, de 5 de julio, establece en el artículo 14.14 lo siguiente:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aplicación del párrafo anterior:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Las cofradías de pescadores, organizaciones de productores pesqueros y otras entidades representativas del sector pesquero, reconocidas al amparo de la Ley 3/2001, de 26 de marzo, que realicen la gestión conjunta de los días de pesca asignados a sus respectivos buques asociados con carácter anual, comunicarán previamente a las autoridades competentes de las comunidades autónomas, los periodos de días subvencionables en los que cada buque realizará la reducción de esfuerzo pesquero.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los buques no integrados en la gestión conjunta comunicarán previamente a las autoridades competentes de las comunidades autónomas los periodos de días subvencionables en los que realizarán la reducción de esfuerzo pesquero.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las autoridades competentes de las comunidades autónomas, conforme las comunicaciones recibidas, establecerán el calendario definitivo sobre los periodos en los que cada buque realizará la reducción de esfuerzo pesquero. Dicho calendario será comunicado al sector y a la Subdirección General de Vigilancia Pesquera y Lucha contra la Pesca Ilegal de la Secretaría General de Pesca.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Las empresas armadoras de las embarcaciones de arrastre de las Illes Balears, en cumplimiento de la normativa de referencia mencionada, han comunicado a la Dirección General de Pesca y Medio Marino o al FOGAIBA los días de reducción de esfuerzo pesquero. Esta comunicación ha sido puesta en conocimiento de los trabajadores previamente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 9.2 del Reglamento (UE) 2019/1022 del Parlamento Europeo y del Consejo, de 20 de junio de 2019, por el cual se establece un plan plurianual para las especies demersales en el Mediterráneo occidental y por el cual se modifica el Reglamento (UE) núm. 508/2014.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El anexo III del Reglamento (UE) 2022/110 del Consejo, de 27 de enero de 2022, por el cual se fijan, para 2022, las posibilidades de pesca aplicables a determinadas poblaciones y grupos de poblaciones de peces en el mar Mediterráneo y en el mar Negro.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
