    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Habiéndose aprobado definitivamente la Ordenanza municipal reguladora de la tasa para la utilización de espacios y materiales municipales del Ayuntamiento de Estellencs, se publica este para su general conocimiento y en cumplimiento de los artículos 70.2 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ORDENANZA FISCAL REGULADORA DE LA TASA PARA LA UTILIZACIÓN De ESPACIOS Y MATERIALES MUNICIPALES DEL AYUNTAMIENTO DE ESTELLENCS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 1. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cimiento y naturaleza. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Al amparo del previsto a los artes. 57 y 20 del RDL 2/2004, de 5 de marzo, este Ayuntamiento establece la tasa por la utilización privativa de espacios municipales. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 2. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Hecho imponible. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de esta tasa la utilización privativa de espacios y materiales municipales. La obligación de pago nace, a todos los efectos, en el momento de la solicitud del material, la equipación y de los servicios que contempla este precio. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 3. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sujeto pasivo. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son sujetos pasivos del precio, en concepto de contribuyentes, las personas físicas y jurídicas, así como las entidades a que se refiere la Ley General Tributaria que soliciten la utilización de los espacios. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 4. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Responsables. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Responden solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas o jurídicas a que se refiere la Ley General Tributaria. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 5. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Beneficios fiscales. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento, los centros educativos, los partidos políticos con representación municipal y las entidades, asociaciones o clubes sin afán de lucro se encuentran exentos del pago de los precios que regula esta ordenanza. Así mismo, siempre se priorizarán las peticiones que procedan de las entidades del municipio de Estellencs o del propio Ayuntamiento de Estellencs, que tienen un cariz público, sobre las de particulares. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento también podrá excepcionar del pago de los precios que regula esta ordenanza a personas físicas o jurídicas que organicen actividades sin afán de lucro de interés público general. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los Servicios Sociales municipales, previa solicitud del interesado, harán un informe por excepcional parcial o totalmente del pago de los precios previstos, que en todo caso aprobará la Alcaldia. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo. 6. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuota tributaria. &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cuota tributaria se determinará por la aplicación de las tarifas que se detallan. Las tarifas de los servicios regulados en esta tasa son las siguientes: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SALÓN SOCIAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actas y actividades puntuales privadas: 50,00€/día. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades regulares: 10€ por cada día en la semana que se realice la actividad. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades por día: 300,00€/día. La fianza será de 100€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades sin lucro: gratuito&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;BIBLIOTECA&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actas y actividades puntuales privadas: 50,00€/día. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades regulares: 10€ por cada día en la semana que se realice la actividad. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades por día: 300,00€/día. La fianza será de 100€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades sin lucro: gratuito&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;COCHERAS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actas y actividades puntuales privadas: 50,00€/día. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades regulares: 10€ por cada día en la semana que se realice la actividad. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades por día: 300,00€/día. La fianza será de 100€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades sin lucro: gratuito&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;GIMNASIO&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades regulares: 10€ por cada día en la semana que se realice la actividad. La fianza será de 50€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuota anual por usuario: 51,00€&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades por día: 300,00€/día. La fianza será de 100€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actividades sin lucro: gratuito&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;BUZONES&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El uso de estos buzones solo se podrá realizar al horario de la oficina municipal (9.00h-14.00h). &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;caso que se produzca la pérdida de la clave del buzón o algún daño del mismo a causa de un mal os por parte del usuario, este tendrá que asumir los costes derivados de los mismos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Cuota anual por buzón: 19,00€&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;MATERIAL MUNICIPAL.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;&amp;nbsp;Sillas: 2€ por silla como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;&amp;nbsp;Mesas: 4€ por mesa como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;Proyector: 300€ como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;Carpa: 300€ como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;Material de sonido (tabla de potencia, ecualizador y otros): 300€ como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;Cadalso (escenario): 300€ como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;−&amp;nbsp;&amp;nbsp;Otro mobiliario: 100€ como fianza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;GASTOS RELACIONADOS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si una actividad produce un gasto extraordinario en el Ayuntamiento de Estellencs, un técnico municipal hará un presupuesto y el solicitante tendrá que abonar el coste en concepto extraordinario de tasa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 7.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Pago.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El precio por la utilización del espacio se tendrá que pagar en el momento de la solicitud de la utilización. En el caso de denegación se reintegrará el importe ingresado.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Artículo 8.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Gestión.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El solicitante se hace responsable del buen uso del espacio y/o el material cedido por el Ayuntamiento. El Ayuntamiento de Estellencs puede actuar de oficio contra el solicitante que haga un mal uso o lo destine a una finalidad diferente a la solicitud&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La fianza se devolverá una vez acabada la actividad o devuelto el material, siempre después de que un trabajador municipal haya comprobado el buen estado. Los desperfectos que se ocasionen tendrán que ser abonados por el solicitante según el presupuesto que haya elaborado un profesional adecuado. Si hay fianza depositada, de la cual se extraería en principio la cantidad a abonar, no fuera suficiente, se practicará liquidación complementaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La autorización del uso del espacio y otras cuestiones (claves, por ejemplo) será recogida por el solicitante a las oficinas municipales en el día y la hora que le sea asignada. Así mismo el retorno del espacio se hará del mismo modo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento se reserva el derecho de denegar alguna petición, especialmente en caso de coincidencia de fechas, o por otras razones de forma motivada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes se tramitarán por riguroso orden de Registro de Entrada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La solicitud de cualquier cesión de espacio municipal para la realización de actividades de carácter lucrativo tendrá que acreditar mediante una declaración responsable que cumple los requisitos legales para desarrollar las actividades, especialmente tendrá que acreditar el alta a la seguridad social de los profesionales que lleven a cabo la actividad. En este sentido se entenderá que una actividad tiene carácter lucrativo si se cobra un precio a los asistentes a la misma, independientemente de si la entidad que solicita el espacio tenga carácter lucrativo o no.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cualquier interpretación de esta Ordenanza, así como los criterios extremos que no estén incorporados en esta Ordenanza, son de la Autoridad Municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presente ordenanza entrará en vigor el día de su publicación en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares y siempre para el curso fiscal posterior a su aprobación, estando en vigor hasta su modificación o derogación exprés.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el presente Acuerdo se podrá interponer recurso contencioso-administrativo, ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia, en el plazo de dos meses a contar desde el día siguiente en la publicación del presente anuncio, en conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;
