&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 25 de octubre de 2022 los miembros de la Comisión Paritaria del Convenio colectivo del sector de la limpieza de edificios y locales de las Islas Baleares se reunieron para aprobar y acordar la constitución de la Comisión Paritaria del Convenio colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 25 de octubre de 2022, Jose Maria Muñoz Juarez, en representación de la Comisión Paritaria del Convenio colectivo, solicitó el registro, el depósito y la publicación de la citada Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El artículo 90.3 del Texto Refundido de la Ley del Estatuto de los Trabajadores, aprobado por el Real Decreto Legislativo 1/1995, de 24 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Real Decreto 713/2010, de 28 de mayo, sobre registro y depósito de convenios y acuerdos colectivos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El artículo 45 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Inscribir y depositar el acta de constitución de la Comisión Paritaria del Convenio colectivo del sector de la limpieza de edificios y locales de las Islas Baleares de 25 de octubre de 2022 en el Registro de Convenios Colectivos de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Publicar el Convenio en el &lt;/span&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Hacer constar que la versión castellana del texto es la original firmada por los miembros de la Comisión Negociadora y que la versión catalana es su traducción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Notificar esta Resolución a la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;ACTA DE CONSTITUCION DE COMISION PARITARIA DE INTERPRETACION DEL CONVENIO COLECTIVO DE LIMPIEZA DE EDIFICIOS Y LOCALES DE LES ILLES BALEARS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;En la ciudad de Palma de Mallorca, siendo las 10,00 horas del día 25 de octubre de 2022, en la sala de juntas del TRIBUNAL DE ARBITRAJE y MEDIACION DE LES ILLES BALEARS (TAMIB) se reúnen las personas abajo relacionadas, que comparecen en representación de las organizaciones empresariales y sindical que asimismo se citan, al objeto de proceder a constituir la Comisión paritaria designada en del Convenio colectivo arriba reseñado, y nombrar a las personas que compondrán la misma para esta constitución, Convenio colectivo que consta debidamente registrado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;El artículo 68 del Convenio, establece que la Comisión se constituirá inevitablemente dentro de los tres meses siguientes a la publicación del Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;En dicha constitución se designarán los miembros de la misma, y se determinarán los procedimientos de su funcionamiento nombrándose un secretario para que levante acta, pudiendo ser un miembro o un asesor de la misma y se fijarán las reglas de moderación de la sesión. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:#ffffff; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El domicilio de esta comisión y la sede de sus reuniones queda fijada en los locales del Tribunal d'Arbitratge i Mediació de les Illes Balears (TAMIB) situada en Avinguda de Comte de Sallent nº 11, 2ª planta, 07003 de Palma de Mallorca, igualmente se designa dicho domicilio para&lt;/span&gt;&lt;span style="background-color:#ffffff; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; dirigirse las solicitudes de convocatorias y demás trámites a realizar ante la Comisión. Los acuerdos de la Comisión deberán adoptarse mediante el voto favorable de, al menos, 8 miembros de la misma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Se acuerda que levante el Acta de la reunión de hoy D. Jose María Muñoz Juárez, que además moderará la sesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Los puntos del orden del día son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;1º.- CONSTITUCIÓN DE LAS PERSONAS QUE COMPONDRÁN LA COMISIÓN PARITARIA DEL CONVENIO COLECTIVO Y DETERMINACIÓN DE LOS PROCEDIMIENTOS DE SU FUNCIONAMIENTO.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;2º.- RUEGOS, COMUNICACIONES Y PREGUNTAS&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Se aprueba el Orden del día y se procede a debatir y resolver los asuntos planteados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;Punto 1. CONSTITUCIÓN DE LAS PERSONAS QUE COMPONDRÁN LA COMISIÓN PARITARIA DEL CONVENIO COLECTIVO Y DETERMINACIÓN DE LOS PROCEDIMIENTOS DE SU FUNCIONAMIENTO &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Así, de acuerdo a lo establecido en el Convenio colectivo, se procede a la constitución formal de la Comisión paritaria del mismo, que tendrá su domicilio en los locales del Tribunal d'Arbitratge i Mediació de les Illes Balears (TAMIB) situada en Avinguda de Comte de Sallent nº 11, 2ª planta, 07003 de Palma de Mallorca &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Acto seguido se acuerda que formarán la Comisión paritaria 4 representantes por parte de la representación sindical y 4 representantes por la representación empresarial que serán 2 de ASPEL y 2 de ABENET. Pudiendo aportar hasta dos asesores por cada patronal o sindicato signatarios del Convenio colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Por la representación sindical de SITEIB los miembros de la Comisión que firman el Acta de Constitución: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;La Comisión paritaria, según establece el texto del Convenio, tiene atribuidas las funciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;a) Aclarar e interpretar los preceptos del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;b) La vigilancia del cumplimiento de lo pactado en el presente Convenio Colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;c) Ejercer el control del cumplimiento por parte de las empresas del porcentaje de empleo estable acordado en el artículo 13 del Convenio Colectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;En caso de constatar la existencia de situación en las que concurran indicios fundados de inobservancia del porcentaje o de obstrucción en el ejercicio del control de tal incumplimiento o no facilitación de la información y/o documentación que pueda solicitarse, promoverá la oportuna denuncia ante la Autoridad Laboral competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;d) Asumir cuestiones relativas a competencia desleal, vigilando específicamente funciones sobre las siguientes cuestiones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;1. Cumplimiento de obligaciones básicas en materia laboral, Seguridad Social, etc., de aquellas empresas que por su habitual actuación puedan existir fundados motivos para creer que existe incumplimiento sistemático de tales obligaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;2. Análisis de las adjudicaciones del servicio de limpieza realizadas por el sector público con el fin de determinar que los costes aplicados por la empresa adjudicataria, en el caso de bajas temerarias, respetan el cumplimiento de los derechos del personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;3. Formulación de denuncias a la autoridad competente y tribunales de defensa de la competencia y elaboración de informes y comunicados para su pública difusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;a) Promover el establecimiento de informe previo y preceptivo de la Comisión Paritaria en la adjudicación del servicio de limpieza que lleve a cabo el sector público de esta Comunidad Autónoma y, caso de establecer tal informe, ejercer tal competencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;b) Servir de instrumento de conciliación y arbitraje de conflictos colectivos de trabajo, a cuya observancia y resolución se someten las partes, siendo su intervención de obligado cumplimiento como requisito previo a cualquier vía o procedimiento judicial que pudiera corresponder.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;c) Intervención en gestión y desarrollo en los planes de formación continua que se establezcan por las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;d) Todas aquellas cuestiones que de mutuo acuerdo le sean conferidas por las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;Punto 2. RUEGOS, COMUNICACIONES Y PREGUNTAS.- &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;Se acuerda en la presente nombrar a D.
