    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En fecha 30 de diciembre de 2022, en la reunión ordinaria del Consejo Ejecutivo Insular de Eivissa, se ha aprobado la siguiente propuesta:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;PRIMERO. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Reconocer la obligación y ordenar el pago, la cantidad de novecientos sesenta y nueve mil ciento cuarenta y seis euros con cincuenta y tres céntimos de euro (969.146,53€), a favor del Ayuntamiento de Santa Eulària des Riu con NIF NIF P0705400J con cargo a la partida presupuestaria 2310 46200 de los presupuestos del Consell de Eivissa para el año 2022.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;SEGUNDO. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Notificar el acuerdo que se adopte al Ayuntamiento de Santa Eulària des Riu.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Convenio de colaboración entre el Consell Insular de Eivissa y el Ayuntamiento de Santa Eulària des Riu para la financiación de los servicios sociales comunitarios básicos para los años 2022, 2023 y 2024.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Partes&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Vicent Marí Torres, presidente del Consell Insular de Eivissa, de conformidad con el articulo 20 de la Ley 4/2022, de 28 de junio, de consells insulars y el artículo 52 del Reglamento orgánico del Consell Insular de Eivissa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Maria del Carmen Ferrer Torres, alcaldesa del Ayuntamiento de Santa Eulària des Riu, actuando en nombre y representación de esta institución, de conformidad con lo que dispone el artículo 21.1.b de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Antecedentes&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;1. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;El artículo 9.2 de la Constitución española prevé que corresponde a los poderes públicos promover las condiciones para que la libertad y la igualdad del individuo y de los grupos en que se integra sean reales y efectivas; remover los obstáculos que impidan o dificulten su plenitud y facilitar la participación de toda la ciudadanía en la vida política, económica, cultural y social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;También establece en sus artículos 41, 139 y 149.1.1, que los poderes públicos mantendrán un régimen público de Seguridad Social para aquel, que garantice la asistencia y las prestaciones sociales suficientes ante situaciones de necesidad; así como que todos los españoles tienen los mismos derechos y obligaciones en cualquier parte del territorio del Estado y que el Estado tiene competencia exclusiva sobre la regulación de las condiciones básicas que garanticen la igualdad de todos los españoles en el ejercicio de los derechos y en el cumplimiento de los derechos constitucionales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;2. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Nuestro Estatuto de Autonomía (según redacción dada por la Ley orgánica 1/2007, de 28 de febrero, que lo reformó) establece en el art. 12 los principios rectores de la actividad pública y dispone que las instituciones propias de la comunidad autónoma deben promover, entre otras, la cohesión social y el derecho a la protección social. Así mismo, en su artículo 16.4 dispone que las administraciones públicas, en el marco de sus competencias respectivas, deben promover las condiciones necesarias para que los derechos sociales de la ciudadanía de las Illes Balears y de los grupos y colectivos en que se integran sean objeto de una aplicación real y efectiva.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;3. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;La Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local (después de la reforma operada por la Ley 27/2013, de 27 de diciembre, de racionalización y sostenibilidad de la Administración local) establece en el art. 25.1 que el municipio, para la gestión de sus intereses y en el ámbito de sus competencias, puede promover actividades y prestar los servicios públicos que contribuyen a satisfacer las necesidades y aspiraciones de la comunidad vecinal en los términos que prevé este artículo y en el art. 25.2 prevé que ejerce, en todo caso, como competencias propias, en los términos de la legislación del Estado y de las comunidades autónomas, en las materias siguientes: letra e) Evaluación e información de situaciones de necesidad social y la atención inmediata a personas en situación o riesgo de exclusión social. Por otro lado, el artículo 36 atribuye a los consells insulars la asistencia y cooperación jurídica, económica y técnica en los municipios.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;De lo contrario, el art. 6 del Decreto ley 2/2014, de 21 de noviembre, de medidas urgentes para aplicar a las Illes Balears la Ley 27/2013, de 27 de diciembre, de racionalización y sostenibilidad de la Administración local, dispone que los municipios continuaran ejerciendo las competencias en materia de prestación de servicios sociales y de promoción y reinserción social que se preveían como propias antes de la entrada en vigor de la Ley 27/2013, mientras no hayan estado asumidas por parte de la Comunidad Autónoma de las Illes Balears. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;4.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; El Consell Insular de Eivissa ha asumido únicamente competencias en materia de servicios sociales y asistencia social en virtud de la Ley 12/1993, de 20 de diciembre, de atribución de competencias a los consells insulars en materia de servicios sociales y asistencia social y de la Ley 14/2001, de 29 de octubre, de atribución de competencias a los consells insulars en materia de servicios sociales y seguridad social, en los términos y al alcance que establecen estas leyes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;5.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales a las Illes Balears, tiene como finalidad principal conseguir el mayor bienestar social posible para el territorio de las Illes Balears, de forma progresiva y en todos sus aspectos, mediante un sistema de acción social integrado por servicios sociales y medidas de asistencia social que favorezcan el desarrollo pleno de la persona dentro de la sociedad para superar y prevenir las causas determinantes de su marginación y promover la plena integración social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En relación con las responsabilidades públicas, en esta ley se establece, en su artículo 34, que corresponde a la Administración autonómica, en los consells insulars y en los municipios ejercer las competencias en aquesta materia de acuerdo con lo que establece el Estatuto de autonomía, la Ley de servicios sociales y la legislación de régimen local, de manera que se asegure el funcionamiento correcto del sistema público de servicios sociales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El artículo 37.g de la referida norma autonómica, establece que es competencia de los consells insulars dar soporte técnico y profesional a los servicios sociales comunitarios y colaborar en la implantación de las prestaciones básicas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Y en su artículo 38.1.a prevé que serán de competencia de los municipios, entre otros, crear, organizar y gestionar los servicios sociales que consideren necesarios dentro de su municipio, tanto propios como delegados por otras administraciones, de acuerdo con la cartera de servicios sociales y el plan estratégico correspondiente y los planes estratégicos autonómicos y balear. Así como el art. 12 prevé que los servicios sociales comunitarios son el primer nivel del sistema público de servicios sociales. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;6. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Los servicios sociales comunitarios básicos (de ahora en adelante SSCB) son los servicios que se configuran como los servicios que tienen un carácter universal, abierto y polivalente, que constituyen el canal normal de acceso al sistema de servicios sociales y garantizan la universalidad del sistema y su proximidad a las personas usuarias y a los ámbitos familiar y social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;7.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; El artículo 70 de la Ley 4/2009, de 11 de junio, en la redacción dada por la Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la covid-19, modificado por Decreto Ley 8/2020, de 13 de mayo, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la covid-19, señala que la financiación de los SSCB y de los programas que presten es a cargo de la Comunidad Autónoma de las Illes Balears, de los consells insulars y de las entidades locales de las Illes Balears.&lt;strong&gt; &lt;/strong&gt;La aportación de la Administración de la comunidad autónoma de las Illes Balears debe garantizar, en el marco de los principios de estabilidad presupuestaria y sostenibilidad financiera, la financiación a las entidades locales titulares de los SSCB. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El importe y la distribución de los créditos que debe satisfacer la conselleria competente en materia de servicios sociales respecto a la aportación en concepto de cofinanciación de la comunidad autónoma de las Illes Balears a los consells insulars y ayuntamientos en ningún caso no puede ser inferior al 50% del coste de estas, siempre que se cumplan como mínimo las ratios de plantilla establecidas en la normativa que regula estos servicios.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Así mismo, el referido artículo 70 establece que el importe y la distribución de los créditos que debe satisfacer la conselleria competente en materia de servicios sociales, tanto en concepto de cofinanciación como de los fondos que se vayan creando, se deben establecer en el Plan de Financiación de los Servicios Sociales Comunitarios, que se acuerda en la Conferencia Sectorial de Servicios Sociales y se aprueba por acuerdo del Consell de Govern.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;8. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;La Ley 4/2022, de 28 de junio, de consells insulars, prevé en su art.120 que los consells insulars pueden subscribir convenios con sujetos de derecho público y privado, sin que eso implique la cesión de la titularidad de la competencia&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;9.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; En fecha 28/02/2022 en Consell de Govern se aprobó el Plan de financiación de los SSCB de las Illes Balears para los años 2022, 2023 y 2024, el cual estuvo informado favorablemente por la Conferencia Sectorial de Servicios Sociales en la sesión de día 16 de febrero de 2022. Este Plan ha estado modificado en lo que respecta a los fondos 5 por acuerdo del Consell de Govern de data 7 de noviembre de 2022. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El citado Plan de financiación se configura como el documento de articulación de los programas, los fondos y las prestaciones de SSCB, así como del establecimiento de los criterios de su financiación, para los años referidos. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;10. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Decreto 48/2011, de 13 de mayo, por el cual se regulan los principios generales y las directrices de coordinación de los SSCB, establece unas ratios de equipos mínimos de profesionales o unidades de trabajo social (UTS), que se deben garantizar a todo el territorio de las Illes Balears y establece los criterios para determinar los costes de los SSCB, y se debe aplicar al Plan de Financiación de los Servicios Sociales Comunitarios Básicos de las Illes Balears para los años 2022, 2023 y 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;11.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; La cartera de servicios sociales es el instrumento que determina el conjunto de prestaciones del sistema público de servicios sociales e incluye todas las prestaciones técnicas, económicas y tecnológicas. La actividad de los Servicios Sociales comunitarios básicos se debe articular mediante la implantación de las prestaciones que especifica la Cartera de Servicios Sociales. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;12.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; El Plan de Financiación de los Servicios Sociales Comunitarios Básicos de las Illes Balears para los años 2022, 2023 y 2024, regula en su punto punto 2.1 como su objetivo principal: reforzar el primer nivel de atención del Sistema Público de Servicios Sociales mediante el incremento progresivo del numero de profesionales de las Unidades de Trabajo Social (UTS) y la intervención de las UTS dentro del marco de los SSCB.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;13. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Con la aprobación del referido Plan, el Gobierno se compromete a la financiación de los SSCB de la isla de Eivissa para las próximas tres anualidades, siempre y cuando se cumplan con las ratios de profesionales establecidas en el Decreto 48/2011, de 13 de mayo. El plazo de referencia para el cálculo del cumplimiento de ratios es la población del año 2020, según los datos del IBESTAT (Institut d'Estadística de les Illes Balears), en el caso de la población del municipio de Santa Eulària des Riu en el citado plazo era de 39.358 personas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;14. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Durante el plazo comprendido entre el 1 de enero de 2022 y el 31 de diciembre de 2024, tal y como se expone en el punto 1.2.3 del referido Plan «Fijación de ratios para los años 2022, 2023 y 2024», se han de cumplir por parte de los SSCB de los municipios de la isla de Eivissa, las siguientes ratios de profesionales son: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Año 2022&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1 trabajador/a social cada 7.500 habitantes&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1 educador/a social cada 7.500 habitantes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1 Auxiliar cada 10.000 habitantes&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En cumplimiento del punto 2.1. «Estructura y objeto de financiación» del referido plan, se determina que la aportación al Plan de Financiación por parte de la Conselleria d'Afers Socials i Esports del Govern de las Illes Balears queda supeditada al cumplimiento de ratios por parte de los diferentes ayuntamientos. Aquellos que no cumplan la ratio exigida para cada anualidad no podrán beneficiarse de ninguno de los fondos financiados por la administración del Govern de las Illes Balears. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;15.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; El crédito que prevé la Conselleria d'Afers Socials i Esports del Govern de las Illes Balears para la financiación del conjunto de los SSCB de la isla de Eivissa, siempre y cuando, se cumplan las ratios referidas anteriormente es el siguiente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Importe año 2022: 1.381.858,25€ *&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Importe año 2023: 1.646.737,97€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Importe año 2024: 1.646.737,97€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;* En este importe se debe añadir la cantidad de 83.330,00€, aprobado en la modificación del plan el cual se destina al Fondo 5 del mismo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;16.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; En el caso de la isla de Eivissa, el Plan de Financiación prevé que la distribución del importe previsto por parte del Govern de las Illes Balears se distribye en los fondos de financiación del 1 al 5 (este incluido), quedando excluido el fondo 6 y 7 de financiación, concretamente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fondo 1: Financiación de las Unidades de Trabajo Social &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El objeto de la referida financiación es el 50% de los costes salariales de los y las profesionales de las UTS responsables de la atención directa, polivalente y comunitaria dentro del marco de los SSCB, calculando el coste medio de las ratios establecidas por cada año detalladas en el punto anterior. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fondo 2: Mejora de ratios de la UTS.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este fondo financia el adelanto en el esfuerzo de los ayuntamientos que durante el año 2022 estén cumpliendo con la ratio que exige al año siguiente y los que al año 2023 estén cumpliendo con la ratio que el plan exige para el año 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fondo 3: Actuaciones complementarias a la intervención de las UTS dentro del marco de los SSCB&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El objeto de este fondo es financiar las actuaciones derivadas del trabajo de la UTS, sea a nivel individual como comunitario.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fondo 4. Programa VECA &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La finalidad de este Fondo es la financiación de ayudas para el acceso a oferta de ocio en periodos de vacaciones escolares para niños con el objeto de garantizar la asistencia a comedores escolares durante el periodo no lectivo. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Fondo 5. Actuaciones preventivas y de detección de riesgo de los menores.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Fondo 5 tiene por objeto financiar actuaciones preventivas y de detección de riesgo de menores, en lo que respecta a la isla de Eivissa ofrece soporte económico para la creación y/o mantenimiento de equipos de atención a la infancia y familia a los servicios sociales comunitarios, en ejecución de lo previsto en la Ley orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia (LOPIVI). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Esta financiación solo es para la anualidad del año 2022, ya que es el único ejercicio que se tiene la certeza de que hay crédito por parte de la Administración General del Estado (AGE). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El crédito destinado a este fondo aprobó la «Propuesta de distribución territorial de los Créditos para Programas Sociales Consignados en los PGE 2022» en fecha 28 de junio de 2022 por Consell Interterritorial de Servicios Sociales, a la referida propuesta se incorpora una nueva línea de trabajo vinculada al desarrollo de la referida LOPIVI. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La transferencia de este fondo a los ayuntamientos queda condicionada a su aprobación definitiva por parte del Consell de Govern y a la resolución de la transferencia por parte de la Consellera d'Afers Socials i Esports.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;17. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;De conformidad con el Plan de financiación de los servicios sociales, Consell Insular de Eivissa recibirá por parte del Govern de las Illes Balears los importes señalados en el antecedente 15 del presente convenio, los cuales se deben distribuir y transferir a los diferentes ayuntamientos de la isla de Eivissa según la anualidad con los importes que se detallan a continuación, siempre y cuando, se cumplan las ratios de trabajadores establecidos anteriormente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Importe año 2022: 2.954.800€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El importe de las aportaciones para las anualidades 2023 y 2024 se podrá ampliar en función de la disponibilidad de crédito, mediante la formalización de una adenda.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;19&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;. La distribución de la aportación que realiza el Consell Insular de Eivissa en lo que respecta a la financiación de los SSCB de la isla de Eivissa es la siguiente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Distribución año 2022 de los 2.954.800.-€&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-La aportación al Fondo 1 de &lt;strong&gt;financiación de las unidades de Trabajo Social&lt;/strong&gt; para cubrir el 25% de los costes salariales de los y las profesionales de la UTS responsables de la atención social directa, polivalente y comunitaria dentro del marco de los SSCB, es la siguiente: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-El resto de la financiación mediante la aportación del Consell Insular puede ir destinada a los gastos ocasionados por los siguientes conceptos:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Gastos ocasionados por personal técnico de estructura, dedicado a la coordinación entendido como jefe de Departamento, coordinador de UTS siempre y cuando no se imputen al FONDO 1.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Concepto 2: Gastos ocasionados por servicios, prestaciones y actuaciones propias de los Servicios Sociales Comunitarios Básicos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Gastos ocasionados por servicios y prestaciones destinadas dentro del ámbito de actuación de Infancia y familia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Gastos ocasionados por los servicios y prestaciones dirigidos a colectivos de atención específicos como pueden ser la gente mayor, personas inmigrantes entre otras.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este convenio tiene por objeto establecer las condiciones de colaboración entre el Consell Insular de Eivissa y el Ayuntamiento de Santa Eulària des Riu, para la financiación de las prestaciones de los servicios sociales comunitarios básicos de este municipio para los años 2022, 2023 y 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Los servicios sociales comunitarios financiados con este convenio se prestaran con el contenido y con los criterios que se establecen al Plan de financiamiento de los SSCB de las Illes Balears para los años 2022, 2023 y 2024, aprobado por Consell de Govern el 28 de febrero de 2022.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.Estructura y objeto del financiación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Plan de Financiación, 2022, 2023 y 2024 de los servicios sociales comunitarios básicos tiene como objeto principal reforzar el primer nivel de atención del Sistema Público de Servicios Sociales mediante el incremento progresivo del nombre de profesionales de las unidades de Trabajo Social (UTS) y la intervención de las UTS dentro del marco de los servicios sociales comunitarios básicos. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Los ayuntamientos que no cumplen la ratio exigida para cada anualidad no podrán beneficiarse de ninguno de los fondos financiados por la administración del Govern de las Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El acceso al Fondo 1 obra la puerta a la participación del resto de fondos de esta vía. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El fondo 2 financia el adelanto en el esfuerzo de los ayuntamientos que durante el año 2022 estén cumpliendo con la ratio que se exige al año siguiente. y los que al año 2023 estén cumpliendo la ratio que este plan exige para el año 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Por tanto, a medida que mejora la ratio, aumenta la cantidad económica asignada al fondo 1 y disminuye la del fondo 2, hasta que al año 2024, año que la ratio fijada es la mejor prevista al decreto, el fondo 2 desaparece. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El fondo 3 tiene por objete financiar las actuaciones derivadas del trabajo de la UTS, sea a nivel individual como comunitario. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El fondo 4 financia ayudas para el acceso a oferta de ocio en períodos de vacaciones escolares para niños con el objeto de garantizar la asistencia a comedores escolares durante el periodo no lectivo y el Fondos 5 complementa y enriquece este Plan, con esete fondo se considera que el desarrollo de la Ley de Infancia y Familia es básico. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Por otro lado, mediante el presente convenio se regula la financiación que reciben los diferentes ayuntamientos de la isla de Eivissa, por parte del Consell Insular de Eivissa. La referida financiación se distribuye entre el fondo 1, el importe del cual se ha calculado con el mismo porcentaje del importe financiado por parte del Govern por el mismo fondo y por los conceptos 1 y 2 el objeto de los cuales se ha descrito al antecedente 19 del presente convenio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El importe que corresponde a los conceptos 1 y 2 se ha calculado teniendo en cuenta el criterio poblacional (núm. de habitantes) de cada municipio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La aportación del Consell Insular de Eivissa al Plan de Finaciación no se verá afectado en caso de incumplimiento de ratios por parte de los Ayuntamientos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.1. FONDO 1: Financiación de las Unidades de Trabajo Social (UTS)&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Mediante el &lt;strong&gt;FONDO 1&lt;/strong&gt;, se financia el importe correspondiente al coste del equipo mínimo de profesionales establecido para cada estrato de población y según las ratios de profesionales de trabajador/a, educador/a sociales y auxiliar administrativo/a de los artículos 10 y 13 del Decreto 48/2011, de 13 de mayo, por cual se regulen los principios generales y las directrices de coordinación de los servicios sociales comunitarios básicos. La conselleria competente en materia de servicios sociales del Govern de las Illes Balears abonará a cada unidad de financiación el 50% del coste de la UTS y corresponde al Consell Insular de Eivissa y a los ayuntamientos financiar el 50% restante. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Se toma como a referencia el salario medio de los trabajadores/as sociales y educadores/as sociales en 35.000 € y del auxiliar administrativo en 25.000 €. Al importe resultante se le añade un 8% adicional para costes indirectos sobre los costes laborales que incluyen gastos corrientes, de reposición y de pequeñas inversiones.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La vinculación de la financiación a la obligación del cumplimiento de las ratios mínimas tendrá efectos con un umbral máximo de incumplimiento de 0,1 de jornada y la ratio mínima es de 25% de la jornada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La cantidad total que recibirá el Ayuntamiento de Sant Josep de sa Talaia por UTS para los años 2022, 2023 y 2024 será de:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;El FONDO 2&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; financia el adelanto en el esfuerzo de los ayuntamientos que durante el año 2022 estén cumpliendo con la ratio que se exige para el año 2023. Y los años que el año 2023 estén cumpliendo la ratio que este plan exige para el año 2024. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El objeto de financiación de este Fondo es el incentivo financiero del 50% de los costes salariales necesarios para la mejora progresiva de la ratio de los y las profesionales de la UTS responsables de la atención social directa, polivalente y comunitaria dentro del marco de los SSCB.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En cualquier caso, se entenderá como mejora de ratio, el cas que una entidad local haya logrado la ratio del año siguiente en al menos, uno de los dos perfiles profesionales (trabajador/a y educador/a social), si no se acredita el logro de las ratios del año posterior no se podrá percibir el importe establecido por el fondo 2.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

FONDO 3: Actuaciones complementarias a la intervención de las UTS dentro del marco de los SSCB.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El &lt;strong&gt;FONDO 3&lt;/strong&gt; tiene por objeto financiar las actuaciones derivadas del trabajo de la UTS, sea a nvel individual como comunitario, concretamente para: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) Fomentar la polivalencia de los profesionales derivados del Fondo 1 mediante la financiación de las actividades incluidas en sus proyectos de intervención comunitaria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En este caso podrá imputarse un mínimo del 50% del fondo en proyectos comunitarios dirigidos a infancia, juventud, mujer, soledad de las personas mayores o envejecimiento saludable.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) Cofinanciación de prestaciones económicas con carácter de urgencia social (según Decreto ley 10/2020 de 12 de junio, de prestaciones sociales de carácter económico de las Illes Balears). En este caso el gasto imputado en este concepto no podrá ser superior al 50%.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Con la aportación de este Fondo se financiará el coste de la actividad generada por las actuaciones referidas anteriormente, no se podrá imputar como gasto aquellas derivadas de la contratación de personal ni con la contratación de servicios de personal (cap I y II). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La distribución del crédito del fondo 3 se ha hecho un 50% según la población dependiente (menor de 14 y mayor de 85 años), un 20% según el numero de expedientes trabajados el 2020 y un 30% según el numero de personas atendidas por los SSCB según la justificación del plan de financiación 2020.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Las aportaciones del Govern de las Illes Balears para el Ayuntamiento de Santa Eulària des riu a cargo del fondo 3 son las siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Con esta aportación se distribuyen los fondos provenientes del Ministerio del programa para la garantía de los derechos a la alimentación, ocio y cultura de los menores durante las vacaciones escolares y se canaliza mediante ayudas económicas de urgencia social para financiar: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) La cobertura de necesidades básicas como alimentación saludable, equilibrada y apropiada a su edad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) Actividades de ocio, tiempo libre, culturales y educativas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;c) La conciliación de la vida familiar y laboral de familias con hijos e hijas a cargo y en situación de vulnerabilidad social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

FONDO 5: Actuaciones de desarrollo de la Ley 9/2019, de 19 de febrero, de la atención y los derechos de la Infancia y Adolescencia y actuaciones preventivas y de detección de riesgo de los menores. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este fondo tiene dos objetivos: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-El soporte a la financiación de las actuaciones materiales, técnicas y jurídicas para poder ejercer las declaraciones de riesgo previstas en el título IV de la ley 9/2019, de 19 de febrero, de la atención y los derechos de la Infancia y Adolescencia por parte de los servicios sociales municipales. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-El soporte económico para la creación y/o mantenimiento de equipos de atención de infancia y familia a los servicios sociales de atención primaria (servicios sociales comunitarios), en ejecución de lo previsto en la Ley orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia (LOPIVI) y aprobados en el Consell Interterritorial de Servicios Sociales de día 28 de junio de 2022 y distribuidos por acuerdo de la Conferencia sectorial de día 14 de octubre de 2022 y del Consell de servicios sociales de dia 15 de octubre de 2022.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Para el logro de los objetivos expuestos anteriormente, se llevan a cabo dos líneas de actuación: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Línea A:&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; El primer objetivo, vinculado a la Ley balear de Infancia y adolescencia, presenta las siguientes características: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;A medida que los diferentes consells insulars tomen la iniciativa que facilite el ejercicio de las declaraciones de riesgo por parte de los SSCB, este fondo crecerá en su dotación económica.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En el caso de la isla de Eivissa ningún ayuntamiento realiza actuaciones imputables a esta modalidad. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;Línea B: &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;El segundo objetivo, vinculado a la Ley orgánica de protección integral a la infancia y la adolescencia frente a la violencia (LOPIVI), se caracteriza por: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La aprobación de los «Programas para el esfuerzo de equipos de atención a la infancia y la familia en los servicios sociales de atención primaria», provenientes de fondos estatales consignados a los Presupuestos Generales del Estado de 2022, provoca su inclusión al Plan de Financiación. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Esta línea B, pretende ayudar a financiar equipos de infancia y familia, de carácter preventivo a los servicios sociales de primaria. Estos equipos se definen en el art 42 de la LOPIVI: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;«Artículo 42. De los equipos de intervención.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1. Las administraciones públicas competentes dotarán a los servicios sociales de atención primaria y especializada de profesionales y equipos de intervención familiar y con la infancia y la adolescencia, especialmente entrenados en la detección precoz, valoración e intervención frente a la violencia ejercida sobre las personas menores de edad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2. Los equipos de intervención de los servicios sociales que trabajen en el ámbito de la violencia sobre las personas menores de edad, deberán estar constituidos, preferentemente, por profesionales de la educación social, de la psicología y del trabajo social, y cuando sea necesario de la abogacía, especializados en casos de violencia sobre la infancia y la adolescencia»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Santa Eulària des Riu presentó un «Programa de Habilidades Parentales» que recibirá la financiación de &lt;strong&gt;43.330,99€&lt;/strong&gt; para la línea B del fondo 5, para el año 2022. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.6 . Aportaciones a cargo del presupuesto del Consell Insular de Eivissa&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) Concepto 1 «Gastos ocasionados por personal técnico de estructura».&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Su objeto es financiar los gastos ocasionados por personal propio de los Servicios Sociales Comunitarios Básicos que se dediquen a tareas de coordinación, supervisión y dirección de las UTS, que no se dediquen a la atención directa de casos y que no están imputados al FONDO 1. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) Concepto 2 « Gastos ocasionados por Servicios, prestaciones y actuaciones propias de los Servicios Sociales Comunitarios Básicos».&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El objeto de financiación de este Fondo es financiar gastos ocasionados por servicios y prestaciones propias de los SSCB, los cuales están definidos en el punto 15.b) de los antecedentes de este convenio, ya sean gastos de personal, siempre que no estén imputadas al Fondo 1, como gastos derivados de la ejecución de los citados servicios y prestaciones. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La financiación de los conceptos 1 y 2 solo es para el año 2022, ya que está sujeto a disponibilidad de crédito por parte del Consell Insular de Eivissa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Santa Eulària des Riu, recibirá a cargo de estos dos conceptos un importe de 527.376,75€.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;3. Obligacions de l'Ajuntament de Santa Eulària des Riu.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El Ayuntamiento de Santa Eulària des Riu, se compromete a:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a.Desarrollar y ejecutar, dentro de su ámbito territorial y de acuerdo con las condiciones establecidas en el presente convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b.Acreditar, ante el Consell Insular de Eivissa, la realización de estas actuaciones objeto del convenio y presentar la documentación justificativa correspondiente de acuerdo con las condiciones que se detallan en el presente convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;c.Colaborar con los técnicos del Consell Insular de Eivissa con la finalidad de lograr un mejor desarrollo de las actuaciones previstas en el marco del presente convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;d.Librar al Consell de Eivissa toda la información que le sea requerida en relación con la ejecución del convenio y en concreto en lo que respecta a la gestión de los expedientes, según la estructura del anexo “Variables del sistema informativo” del Decreto 48/2011, a efectos estadísticos de planificación de actuaciones y los/las profesionales de alta en el sistema, a efectos de seguimiento periódico del acuerdo de cumplimientos de ratios de las UTS.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;e.Destinar la financiación recibida por los diferentes Fondos de financiación al objete que corresponde en cada fondo, atendido que esta obligación está vinculada a la financiación que recibirán por parte de la Conselleria d'Afers Socials i Esports i del Consell Insular de Eivissa, en concepto de financiación de acciones complementarias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;4. Obligaciones del Consell Insular de Eivissa&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Aportar al Ayuntamiento de Santa Eulària des Riu, para los años 2022, 2023 y 2024, la cantidad máxima de dos millones quinientos noventa y cuatro mil ocho euros con veintiséis céntimos de euro (2.594.008,26€) en concepto de financiación de los servicios sociales comunitarios básicos años, 2022, 2023 y 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Dar soporte, asistencia técnica a los profesionales de los equipos municipales para contribuir a un óptimo despliegue de las actuaciones objeto del presente convenio. En esta línea el Consell de Eivissa podrá convocar reuniones de seguimiento y coordinación y organizar acciones formativas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;5. Fase de presentación y seguimiento&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Entre el 1 de marzo y el 15 de marzo y entre el 1 de septiembre y el 15 de septiembre de los años 2023 y 2024, el Ayuntamiento debe presentar los siguientes documentos de los cuales se facilitaran modelos:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) Anexo 1 de solicitud de la financiación para el año correspondiente. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) Anexo 2 que incluye:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.1 anexo 2 - ficha 1 - identificativa de los centros de servicios sociales municipales y puntos de atención&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.2 anexo 2 - ficha 2 – ficha identificativa de los profesionales de los centros de servicios sociales. (marcando la casilla fase presentación y relacionando todas las contrataciones llevadas a cabo o vigentes de 01 de enero a la fecha de presentación de la documentación)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La presentación de la citada documentación es necesaria para que quede justificado el cumplimiento de las ratios acordadas y el Consell pueda emitir a la Conselleria d'Afers Sociales el certificado donde se detalle el cumplimiento de la ratio prevista para cada anualidad de cada municipio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La documentación citada anteriormente y la acreditación del cumplimiento de ratios por parte del Ayuntamiento es condición necesaria para recibir la aportación del Govern de las Illes Balears para los ejercicios 2023 y 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Con respecto al año 2022, a petición del Consell Insular, los ayuntamientos ya han presentado, previamente a la formalización del presente acuerdo, la documentación relacionada anteriormente, acreditando el cumplimiento de las ratios resto de condiciones para recibir la financiación objeto del convenio para el año en curso.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;6. Pago y justificación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;6.a. Previsión de ordenes de pago&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) La primera orden de pago&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;, por un importe de novecientos sesenta y nueve mil ciento cuarenta y seis euros con cincuenta y tres céntimos de euro (969.146,53€), equivalente al 100% de la aportación del Govern de las Illes Balears (398.923,20€) y del 75% de la aportación del Consell Insular (570.223,33€), de la cantidad correspondiente al ejercicio 2022, se ordenará a la firma del convenio, visto que el ayuntamiento ya ha presentado la documentación de presentación y de seguimiento, detallada en el anterior punto 5, acreditando debidamente, hasta septiembre del 2022, el cumplimiento de ratios especificadas en el punto 12 de los antecedentes del presente convenio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) La segunda orden de pago&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; por un importe de novecientos siete mil cuatrocientos sesenta y ocho euros con nueve céntimos de euro (907.468,09 €), equivalente al 25% de la aportación del Consell Insular correspondiente al ejercicio 2022 (190.074,44€) y el 100% de las aportaciones del Govern delas Illes Balears y del Consell Insular (717.393,65€) de la cantidad correspondiente a la anualidad 2023, se tramitará una vez justificados los gastos técnicos y económicos del primer pago. El Ayuntamiento deberá presentar, como máximo el 15 de febrero de 2023, la documentación que es detalla en el punto 6.b) del presente convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;c) La tercera orden de pago,&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="color:black"&gt; por un importe de setecientos diecisiete mil trescientos noventa y tres euros con sesenta y cuatro céntimos de euro (717.393,64€) equivalente al 100% de las aportaciones la cantidad correspondiente al ejercicio 2024, se tramitará una vez justificado el segundo pago y que el Ayuntamiento presente como máximo el 15 de febrero de 2024, la documentación que se detalla en el punto 6.b) del presente convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;6.b. Fase de justificación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Con efectos de la justificación final y para que el Consell pueda emitir los certificados correspondientes en los plazos establecidos en el plan de financiación, los ayuntamientos presentaran antes del día 15 de febrero de cada uno de los años 2023 y 2024 y 2025, debidamente firmados y actualizados a 31 de diciembre del año anterior los siguientes documentos de los cuales se facilitaran modelos para su cumplimentación: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;1.Memoria técnica y económica del Plan de Financiación de los SSCB, con la presentación de las siguientes fichas: (modelos de los cuales serán facilitados por parte de Conselleria d'Afers Socials i Esports).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a.Ficha 1: Memoria técnico - económica : «Personal del centro de Servicos Sociales»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b.Ficha 2: Memoria técnica: «Personas usuarias para prestaciones y Proyectos de Intervención Comunitaria».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Ficha 2.2: Memoria técnica: «Proyectos de intervención comunitaria»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;c.Ficha 3: Memoria económica: «Balance de ingresos y gastos»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;2.Certificado de la persona responsable de Recursos humanos del Ayuntamiento donde se detalle el cumplimiento de la ratio prevista arar a cada anualidad y el logro de la ratio de mejora, si es el caso.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;3.Certificado del interventor/a o secretario/a del Ayuntamiento que acredite que el importe del convenio correspondiente a cada ejercicio se ha aplicado correctamente a la finalidad prevista, con expresión detallada del gasto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;4.Información estadística correspondiente a cada ejercicio procedente de los municipios y en soporte informático, resultante del sistema de información Historia Social Integrada (HSI), sobre las personas usuarias de los servicios sociales comunitarios básicos y de los profesionales de alta en el sistema.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;5.&lt;strong&gt; &lt;/strong&gt;En cuanto a la justificación de la aportación recibida por parte del Fondo 5, el Ayuntamiento debe justificar el 100% de la financiación recibida, se debe presentar certificación del secretario del Ayuntamiento que justifique el destino del crédito otorgado y hasta los importes asignados acompañando a la referida certificación una memoria técnica , descriptiva de los equipos , territorios y proyectos de prevención. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Si, una vez revisada la documentación justificativa del periodo justificado, se comprueba que los gastos justificados por el Ayuntamiento son inferiores a las derivadas de la ejecución del ejercicio correspondiente, se reducirá proporcionalmente la cantidad pendiente de abonar derivada de esta diferencia en el siguiente pago. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Si en las aportaciones que provienen del Govern hay ha remanentes derivados del no cumplimiento de los requisitos de los fondos 1 y 2 (cumplimiento de ratios) se podrán distribuir a aquellos ayuntamientos que sí cumplan para ampliar la cantidad prevista en el Plan de Financiación de los fondos 3 y 4. Si se da el caso, esa nueva distribución quedará reflejada en la resolución en la cual se aprobará la justificación presentada y se reconocerá y se ordenará la siguiente orden de pago.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Todos los documentos se deben presentar en el Registro Electrónico del Consell Insular y también se deberán de enviar en formato de archivo de hoja de cálculo, al correo electrónico que sea facilitado para tal fin.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La presentación incorrecta de la documentación deberá de ser enmendada de acuerdo a las indicaciones y los plazos del Consell Insular, en cumplimiento de la normativa vigente en aquesta materia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;De conformidad con lo previsto en el artículo 52 de la Ley 40/2015, de 1 de octubre, del Régimen Jurídico del Sector Público, si a la liquidación del convenio, hubiera un remanente porque los gastos justificados por el Ayuntamiento han sido inferiores a la cantidad percibida al adelanto, la diferencia de debe devolver al Consell Insular de Eivissa. El Ayuntamiento debe tramitar la devolución en el plazo máximo de un mes desde la notificación de la reclamación de las cantidades no justificadas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En cualquier caso los gastos justificados se deben haber efectuado entre el 1 de enero y el 31 de diciembre de cada uno de los ejercicios objeto de la financiación del presente convenio y se debe comunicar cualquier modificación que se produzca en las mismas.&lt;/span&gt; &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;7. Información y divulgación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;En entrada de las instalaciones de los servicios sociales municipales a que hace referencia este Convenio debe haber una placa identificativa donde figure la cofinanciación de la Conselleria d'Afers Socials i Esports, del Consell Insular y del Ayuntamiento de Santa Eulària des Riu.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;(Escudo institucional del Govern de les Illes Balears)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Govern de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Conselleria de Serveis Socials i Esports&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Ayuntamiento de Santa Eulària des Riu&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Consell Insular de Eivissa&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Sistema Público de Servicios Sociales&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Servicos Sociales Comunitariops Básicos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;La corporación local tiene la obligación de aportar una imagen digital de la placa identificativa que haya utilizado en que conste la cofinanciación de la Conselleria d'Afers Socials i Esports, cuando presenten la justificación del convenio, juntamente con la memoria técnica y la memoria económica.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Comunicar a la Conselleria d'Afers Socials i Esports y al Consell Insular de Eivissa y convocarlos a través de sus gabinetes de prensa a cualquier acto de difusión en medios de comunicación que realice la corporación local, en relación a les actuaciones previstas en este convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;8. Seguimiento y evaluación&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;El seguimiento y la evaluación del despliegue de este convenio, se realizará mediante una Comissión Mixta de Seguimiento, formada por dos miembros del Consell Insular de Eivissa y dos miembros del Ayuntamiento de Santa Eulària des Riu. Se deben reunir cuando ambas partes lo acuerden. La Comisión puede solicitar la participación de terceras personas para tratar sobre aspectos específicos del Convenio, las cuales tienen voz, pero no voto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;9. Modificación del Convenio&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Cualquier modificación que altere lo que establece este Convenio se debe pactar por acuerdo escrito de las partes. En cualquier caso, el documento en que se formalice la modificación se debe adjuntar a este Convenio como a adenda.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;10. Período de vigencia del Convenio&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este Convenio es vigente desde el momento de la firma hasta al 15 de marzo de 2025 y abarca todas las actuaciones descritas en la clausula segunda que sean objeto de las aportaciones correspondientes y que es realicen o se hayan realizado con efectos retroactivos desde el 1 de enero de 2022 hasta el 31 de diciembre de 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;11. Extinción &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este convenio se extingue por expiración del tiempo convenido de acuerdo con lo que establece la clausula anterior o por alguna de las causes de resolución siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-El acuerdo mutuo de las partes, que se ha de formalizar por escrito.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-La imposibilidad sobrevenida, legal o material, de cumplir las obligaciones que se deriven del objeto del convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-La denuncia previa por escrito de alguna de las partes, con una antelación mínima de tres meses desde la finalización de la vigencia del convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-El incumplimiento grave y manifiesto, para cualquiera de las partes, de las clausules pactadas, con la denuncia previa de una de las partes. En este caso, se pueden exigir las responsabilidades que se deriven de incumplirlas. En caso de incumplimiento del Ayuntamiento de Santa Eulària des Riu, debe reintegrar el dinero que le hayan pagado y de los cuales no haya efectuado el gasto, de acuerdo con lo que dispone este convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;-La decisión judicial declaratoria de la nulidad del convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;12. Normativa aplicable.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Son aplicables a este la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Este convenio queda excluido del ámbito de aplicación de la Ley 9/2017, de 8 de noviembre, de contratos del sector público.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;13. Resolución de conflictos&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Las partes nos comprometemos a resolver, mediante la Comisión Mixta de Seguimiento prevista en la clausula octava, los problemas de interpretación, de cumplimiento o cualquier otro que se pueda plantear respecto de este Convenio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Las cuestiones litigiosas que se puedan derivar, vista la naturaleza jurídico administrativa del Convenio, se deben someter a la jurisdicción contenciosa administrativa, según la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Como prueba de conformidad, firmamos este Convenio en dos ejemplares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
