&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fina Santiago Rodríguez, consejera de Asuntos Sociales y Deportes del Gobierno de las Illes Balears en virtud del Decreto 10/2019, de 2 de julio, de la presidenta de las I&lt;/span&gt;&lt;span style="color:#000000"&gt;lle&lt;/span&gt;&lt;span style="color:#000000"&gt;s Balears, por el que se dispone el nombramiento de los miembros del Gobierno de las I&lt;/span&gt;&lt;span style="color:#000000"&gt;lles&lt;/span&gt;&lt;span style="color:#000000"&gt; Balears (BOIB núm. 88, de 3 de julio), en representación de la Administración de la Comunidad Autónoma de las I&lt;/span&gt;&lt;span style="color:#000000"&gt;lle&lt;/span&gt;&lt;span style="color:#000000"&gt;s Balears, con NIF S0711001H, en el ejercicio de las facultades que le atribuye la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Antoni Gomila Benejam, con DNI 41734148G, director gerente, en representación de Fundación Tutelar Demà, con sede social en la calle Sor Clara Andreu, 15, 07010 , y con NIF G57676124.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El artículo 30.15 del Estatuto de Autonomía de las Illes Balears, en la redacción dada por la Ley orgánica 1/2007, de 28 de febrero, establece como competencias exclusivas de la Comunidad Autónoma de las Illes Balears, entre otros, la acción y el bienestar social; las políticas de protección y apoyo a las personas con discapacidades físicas, psíquicas y sensoriales; y las políticas de atención a las personas dependientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En el desarrollo de su actuación como entidad prestadora de servicios sociales, la entidad Fundación Tutelar Demà presta el servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Al amparo de la Resolución de la consejera de Asuntos Sociales y Deportes de 4 de &lt;/span&gt;&lt;span style="color:#000000"&gt;octubre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2022 por la que se convoca la acción&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;concertada&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave en Mallorca y en&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Ibiza&lt;/span&gt;&lt;span style="color:#000000"&gt;, p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara los&lt;/span&gt;&lt;span style="color:#000000"&gt; a&lt;/span&gt;&lt;span style="color:#000000"&gt;ños&lt;/span&gt;&lt;span style="color:#000000"&gt; 2022-2025 (BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;131, de 8 d&lt;/span&gt;&lt;span style="color:#000000"&gt;e &lt;/span&gt;&lt;span style="color:#000000"&gt;octubre&lt;/span&gt;&lt;span style="color:#000000"&gt;)&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;se ha instruido el correspondiente expediente administrativo y se ha acreditado que la entidad Fundación Tutelar Demà es titular del servicio llamado «Servicio de apoyo en el domicilio», que cumple los requisitos para suscribir este concierto.&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. El concierto se imputa a la partida económica 17301.313B01.26104.00 (o el equivalente que la sustituya) de los Presupuestos de la Comunidad Autónoma para los años 2022, 2023, 2024 y 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Ambas partes nos reconocemos mutuamente la capacidad legal necesaria para formalizar este Acuerdo de acción concertada, de acuerdo con las siguientes&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cláusulas &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Objeto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El objeto de este Acuerdo es la concertación de un número máximo de 10 plazas de servicio de &lt;/span&gt;&lt;span style="color:#000000"&gt;apoyo en el domicilio&lt;/span&gt;&lt;span style="color:#000000"&gt; para personas con diagnóstico de salud mental grave, para los años 2022-2025 en el ámbito territorial de Mallorca &lt;/span&gt;&lt;span style="color:#000000"&gt;y Menorca&lt;/span&gt;&lt;span style="color:#000000"&gt;, con la entidad Fundación Tutelar Demà, durante los meses de vigencia del concierto. De las &lt;/span&gt;&lt;span style="color:#000000"&gt;10&lt;/span&gt;&lt;span style="color:#000000"&gt; plazas estimadas p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; concertar, &lt;/span&gt;&lt;span style="color:#000000"&gt;3 son de baja intensidad y 7 son de alta intensidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Cuantía y partida presupuestaria&lt;/strong&gt;&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Los precios máximos de una plaza concertada del servicio de apoyo a la vivienda para personas con diagnóstico de salud mental grave son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Estos precios pueden ser objeto de revisión, de acuerdo con lo que dispone el artículo 24 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. El importe máximo del concierto es de &lt;span style="color:#000000"&gt;620.354,87 &lt;/span&gt;€ (exento del IVA), correspondientes a los mes&lt;span style="background-color:#ffffff"&gt;es de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;noviembre&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; de 2022&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; a octu&lt;/span&gt;bre de 2025, con cargo a las partidas y anualidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- 2022, 16.140,60 € correspondientes al me&lt;span style="background-color:#ffffff"&gt;s de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;noviembre&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#ce181e"&gt; &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de 2&lt;/span&gt;022, con cargo a la partida 17301.313B01.26104.00 de los Presupuestos de la Comunidad Autónoma para el año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- 2023, 202.072,00 € correspondientes a los meses de diciembre de 2022 a noviembre de 2023, con cargo a la partida 17301.313B01.26104.00 (o el equivalente que la sustituya) de los Presupuestos de la Comunidad Autónoma para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- 2024, 209.674,72 € correspondientes a los meses de diciembre de 2023 a noviembre de 2024, con cargo a la partida 17301.313B01.26104.00 (o el equivalente que la sustituya) de los Presupuestos de la Comunidad Autónoma para el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;- 2025, 192.467,55 € correspondientes a los meses de diciembre de 2024 a octubre de 2025, con cargo a la partida 17301.313B01.26104.00 (o el equivalente que la sustituya) de los Presupuestos de la Comunidad Autónoma para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. Si durante la vigencia de este Acuerdo las necesidades reales de plazas son superiores a las estimadas inicialmente y, siempre que exista disponibilidad presupuestaria, se podrá ampliar el concierto, mediante un ajuste contable, sin necesidad de modificar el Acuerdo de acción concertada.&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;3. Personas usuarias del servicio&lt;/strong&gt;&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Pueden ser personas usuarias del servicio las personas mayores de 18 años con discapacidad asociada a un diagnóstico de salud mental por trastorno mental grave y necesidades de apoyo extenso, limitado o intermitente, y con un grado de discapacidad igual o superior al 33&amp;nbsp;%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. La designación de las personas usuarias, la solicitud de plaza, el acceso al servicio y la gestión de la lista de espera de las plazas de este servicio deben hacerse de acuerdo con el Decreto 7/2016, de 12 de febrero, por el que se regulan el acceso al servicio ocupacional para personas con discapacidad por trastorno mental grave y la gestión de la lista de espera de las plazas de este servicio.&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;4. Régimen de ocupación de plazas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. Se entiende por plaza ocupada la asignada a una persona usuaria y ocupada por ella o varias personas según el nivel de intensidad y atención profesional que requieran. En función de los planes individuales de atención y de las necesidades de apoyo concretas de cada persona, y por tanto en función de los objetivos y actuaciones consensuados con la persona y/o su familia, se pueden establecer dos niveles de intensidad: &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;strong&gt;5. Facturación del servicio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;1. La entidad concertada debe presentar una factura en la que ha de constar el importe de la liquidación de las plazas ocupadas correspondiente al mes anterior. A esta factura debe adjuntarse, debidamente firmada por el representante legal de la entidad concertada, una relación detallada de las personas usuarias, en soporte papel y también mediante archivo informático, según el modelo facilitado por la Consejería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;2. La justificación debe contener los siguientes conceptos: DNI/NIE, nombre de la persona usuaria, nivel de intensidad, grado de discapacidad, fecha de ingreso, fecha de baja (en su caso), días de ocupación mensual , y precio/plaza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;3. Las facturas deben ser conformadas por la jefa del Servicio de Atención a la Discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Pago&lt;/strong&gt;&lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;El pago de las cantidades justificadas mensualmente se efectuará de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La Consejería de Asuntos Sociales y Deportes, mediante la Dirección General de Atención a la Dependencia, tramitará mensualmente la propuesta de pago en concepto de coste del servicio concertado. El pago de la cantidad que corresponda se llevará a cabo en la cuenta corriente que indique la entidad concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La entidad concertada no podrá cobrar cantidad suplementaria alguna por persona usuaria o por cualquier otro servicio o prestación que deba atenderse en virtud del concierto suscrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La percepción indebida de cantidades por parte de la entidad concertada supone la obligación de reintegrarlas, previa tramitación del procedimiento que corresponda, con la audiencia de la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Sin perjuicio de lo dispuesto en el apartado anterior, los servicios concertados quedan sujetos al control de carácter financiero y a las funciones inspectoras y sancionadoras de las administraciones competentes en la materia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Auditorías&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;La entidad se obliga a presentar, dentro del tercer trimestre de cada año siguiente durante la vigencia del concierto, las auditorías previstas en el artículo 27.2 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Duración del concierto&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;El régimen de concierto se iniciará el 1 de &lt;/span&gt;&lt;span style="color:#000000"&gt;noviembre&lt;span style="color:#000000"&gt; &lt;/span&gt;de 2022, o en la fecha en que se formalice, y finalizará el 31 de octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Condiciones técnicas de ejecución del servicio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La entidad titular del servicio del que se conciertan las plazas debe cumplir, como mínimo, las condiciones técnicas y de funcionamiento que establece el Pliego general de condiciones técnicas aprobado por la consejera de Asuntos Sociales y Deportes, que se adjunta como anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. El servicio está obligado a aceptar a las personas usuarias designadas por la Consejería y, una vez que se le haya notificado la resolución de adjudicación de servicio, deberá realizar la prestación efectiva del servicio a la persona usuaria, todo ello de acuerdo con la resolución de adjudicación de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Cobertura del servicio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Desde la entrada en vigor de este concierto, la entidad responsable del servicio de apoyo en el domicilio para personas con discapacidad asociada a un diagnóstico de salud mental dispone de las plazas concertadas según el nivel de intensidad que son objeto para asignarlas de forma efectiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Mensualmente, la entidad debe informar a la Dirección General de Atención a la Dependencia de cualquier incidencia en las plazas en el momento que se produzcan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Inspección y control&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En cualquier momento, la Dirección General de Atención a la Dependencia puede inspeccionar el funcionamiento del servicio concertado, para comprobar si se ajusta a lo establecido en este Acuerdo, en todo lo que pueda repercutir, en general, sobre los usuarios del apoyo en el domicilio para personas con diagnóstico de salud mental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Causas de resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Son causas de resolución de este Acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a)&lt;/em&gt; La desaparición de cualquiera de las condiciones administrativas o técnicas que fundamentan su establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) &lt;/em&gt; El incumplimiento de alguna de las estipulaciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)&lt;/em&gt; La negativa u obstrucción a la labor inspectora de la Consejería de Asuntos Sociales y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d) &lt;/em&gt; El resto de causas de resolución que establece el artículo 9.2 de la Ley 12/2018, de 15 de noviembre, de Servicios a las Personas en el Ámbito Social en la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Sistema de penalizaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Garantía de los derechos de la persona usuaria e información a la ciudadanía de sus derechos y deberes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La entidad concertada debe dar información de los derechos y deberes de las personas usuarias y debe garantizar sus derechos, concretamente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Igualdad: debe garantizarse que, en la acción concertada, la atención a las personas usuarias se presta en plena igualdad con las personas usuarias atendidas directamente por la Administración pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Gratuidad: no se puede cobrar cantidad suplementaria alguna a las personas usuarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Calidad asistencial: es el principio que debe inspirar la organización de la acción concertada en todos los aspectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Participación: deben establecerse mecanismos para la implicación efectiva de las personas usuarias en la prestación y la evaluación de los servicios, tener a disposición de las familias de las personas usuarias las hojas de reclamación y dar respuesta escrita a las quejas o sugerencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Asimismo, deben garantizarse el resto de derechos que reconoce el capítulo II («Derechos y deberes») de la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Normativa aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En todo lo que no esté estipulado en este Acuerdo, deben aplicarse el Pliego de prescripciones técnicas; la Resolución de la consejera de Asuntos Sociales y Deportes de 4 de octubre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2022 por la que se convoca la acción concertada del servicio de apoyo en el domicilio para personas con diagnóstico de salud mental grave en Mallorca y en &lt;/span&gt;&lt;span style="color:#000000"&gt;Menorca&lt;/span&gt;&lt;span style="color:#000000"&gt;, para los años 2022-2025, además de toda la normativa relacionada; la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunidad Autónoma de las I&lt;/span&gt;&lt;span style="color:#000000"&gt;lles Balears, y el Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Jurisdicción competente&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las cuestiones litigiosas que pudieran derivarse de la interpretación, ejecución y, en su caso, resolución de este Acuerdo se someterán a la J&lt;/span&gt;&lt;span style="color:#000000"&gt;urisdicción &lt;/span&gt;&lt;span style="color:#000000"&gt;C&lt;/span&gt;&lt;span style="color:#000000"&gt;ontencioso-&lt;/span&gt;&lt;span style="color:#000000"&gt;Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Como muestra de conformidad, firmamos este Acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
