&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En el&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="background-color:white; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="color:black"&gt;BOIB núm. 1, de 3 de enero de 2023, se publicó la Resolución del Presidente de la AETIB, de 27 de diciembre,&lt;/span&gt;&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;por la cual se aprueban los pliegos de las condiciones generales que tienen que regir la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios singulares con entidades privadas para eventos singulares que generen repercusión mediática para las marcas de las Islas Baleares y la Agencia de Estrategia Turística de las Islas Baleares (AETIB), durante el año 2023 en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea, Next Generation EU.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:115%"&gt;De una primera lectura de la convocatoria se ha detectado errores materiales en&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:115%"&gt;la Resolución del Presidente de la AETIB de fecha de 27 de diciembre de 2022 y el Anexo A de los Pliegos de las condiciones generales que han de regir la convocatoria pública para la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios singulares con entidades privadas para eventos singulares que generen repercusión mediática para las marcas de las Islas Baleares y la Agencia de Estrategia Turística de las Islas Baleares (AETIB), durante el año 2023 en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea, Next Generation EU.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;1.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, establece que “Las Administraciones Públicas podrán, asimismo, rectificar en cualquier momento, de oficio o a instancia de los interesados los errores materiales, de hecho o aritméticos existentes en sus actos”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Comunidad Autónoma de les Illes Balears, dispone que la revocación de los actos de gravamen o desfavorables y la rectificación de los errores materiales, aritméticos y de hecho en actos y disposiciones administrativas corresponde al órgano que ha dictado el acto o la disposición”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, dicto la siguiente,&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; Rectificar los errores observados en la Resolución del Presidente de la AETIB de fecha de 27 de diciembre de 2022 y el Anexo A de los Pliegos de condiciones generales que han de regir la convocatoria pública para la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios singulares con entidades privadas para eventos singulares que generen repercusión mediática para las marcas de las Islas Baleares y la Agencia de Estrategia Turística de las Islas Baleares (AETIB), durante el año 2023 en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea, Next Generation EU. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Concretamente,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;1.- En la Resolución del Presidente de la AETIB, en el apartado “Resuelvo”, de la versión en castellano y catalán:&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Catalan:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;“Aprovar els plecs de condicions generals que han de regir la tramitació dels expedients de contractació que es derivin de les sol·licituds de patrocinis d'esdeveniments singulars amb entitats privades que generin repercussió mediàtica per a les marques de les Illes Balears i l'Agència d'Estratègia Turística de les Illes Balears (AETIB) durant l'any 2023, que s'adjunten com ANNEX A en aquesta resolució.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Castellano:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;“Aprobar los pliegos de las condiciones generales que tienen que regir la tramitación de los expedientes de contratación que se deriven de las solicitudes de patrocinios singulares con entidades privadas para eventos singulares que generen repercusión mediática para las marcas de les Illes Balears y la Agencia de Estrategia Turística de les Illes Balears (AETIB) durante el año 2023 en el marco del Plan de Recuperación, Transformación y Resiliencia financiado por la Unión Europea, Next Generation EU que se adjuntan como Anexo A en esta resolución.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;2.- En la resolución del presidente de la AETIB y en el ANEXO A, de la versión en castellano y catalán&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;En todos los apartados &lt;strong&gt;donde diga:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Anexo A1“&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Anexo 1s”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3.- En el apartado 1.1 del anexo A “Requisitos de los eventos”, en el punto A) de la versión en castellano:&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;“Los que se ajusten a la definición de evento estratégico, con voluntad de&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;continuidad y con una duración inferior a 10 días anuales, a excepción de&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;aquellos con consideración de ciclos culturales o festivales vinculados a la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;cultura.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;“Los que se ajusten a la definición de evento singular.”&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;4.- En el apartado 3 del anexo A “Presupuesto de la convocatoria”, de la versión en castellano&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“El importe del patrocinio solicitado nunca podrá superar el 50% respecto del&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presupuesto de gasto indicado al Anexo A1 (impuestos incluidos) y tampoco podrá&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;superar el máximo establecido por marca. Así mismo, tampoco se podrá superar a la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;fase de justificación con relación al gasto real efectivo.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“El importe del patrocinio solicitado nunca podrá superar el 25% respecto del&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;presupuesto de gasto indicado al Anexo A1 (impuestos incluidos) y tampoco podrá&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;superar el máximo establecido por marca. Así mismo, tampoco se podrá superar a la&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;fase de justificación con relación al gasto real efectivo.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;5.- En el apartado 6.2 “Documentación Administrativa: Documentación relacionada con la entidad solicitante” en el caso de personas físicas y jurídicas españolas, de la versión en castellano&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;Donde dice: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Los datos contenidos en este documento regirán la valoración de la solicitud y&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;prevalecerán encima cualquier otro documento librado y, por lo tanto, no se&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;podrán modificar ni enmendar. En caso de no agasajar todos los datos&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;solicitados en este documento, el patrocinio quedará excluido.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;span style="line-height:105%"&gt;Debe decir:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:105%"&gt;&lt;em&gt;&lt;span style="line-height:105%"&gt;“Los datos contenidos en este documento regirán la valoración de la solicitud y&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;prevalecerán encima cualquier otro documento librado y, por lo tanto, no se&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;podrán modificar ni enmendar. &lt;p&gt;&lt;strong&gt;&lt;span style="line-height:105%"&gt;6.- En el apartado 6.2 del anexo A “Documentación Administrativa: Documentación relacionada con la entidad solicitante” en el caso de personas jurídicas no españolas con actividad en España, de la versión en castellano:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Donde dice:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;“Testigo judicial, certificación administrativa o declaración responsable, de no&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;incurrir en las prohibiciones para contratar con la administración según el&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ordenamiento jurídico español y por analogía con el ordenamiento del Estado a&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;que pertenece&lt;/span&gt;&lt;/em&gt;&lt;span style="line-height:115%"&gt;.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta resolución —que agota la vía administrativa— se puede interponer recurso potestativo de reposición frente al Presidente de la AETIB en el plazo de un mes a contar desde el día siguiente a su publicación en el BOIB, de acuerdo con lo que establecen el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 44, de 3 de abril) y el artículo 123 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común de las administraciones públicas (BOE núm. 236, de 2 de octubre).&lt;/span&gt;&lt;/p&gt;
