923 CAIB 2023-01-12 CAIB 20 780150 ![CDATA[Expediente 1234/2022 de modificación de la Ordenanza reguladora del precio público por el servicio de escuela infantil ]] 668436 CAIB 927 text/html ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Pleno del Ayuntamiento de Esporles en sesión ordinaria celebrada el día 29 de septiembre de 2022, aprobó el expediente 1234/2022 de modificación de la Ordenanza reguladora del precio público por el servicio de escuela infantil y que se la siguiente:</span></span></p> <p style="text-align:center"><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">ORDENANZA REGULADORA DEL PRECIO PÚBLICO POR EL SERVICIO DE&nbsp;ESCUELA INFANTIL</span></strong></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 1.º- Cimiento y objeto</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta Entidad Local, en uso de las facultades contenidas en los artículos 41 a 47 y 127 del Texto Refundido de la Ley Reguladora de las Haciendas Locales aprobado por Real decreto legislativo 2/2004, de 5 de marzo, establece el presente precio público por la prestación del servicio de escuela infantil.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 2.º- Hecho imponible</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constituye el hecho imponible de la presente Ordenanza la utilización de los servicios prestados por la escuela infantil municipal, que incluyen: servicios educativo, de guardería y de comedor.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 3.º- Sujeto pasivo</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Están obligados al pago de la tasa, en concepto de contribuyentes, las personas que soliciten o en el interés de las cuales redunden los servicios que constituyen el hecho imponible de la tasa, entendiéndose por tales los padres, tutores o representantes legales de los menores.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 4.º Responsables</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Responderán de la deuda tributaria los deudores principales junto a otras personas o Entidades. A estos efectos se considerarán deudores principales los obligados tributarios del apartado 2 del artículo 35 de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Excepto precepto legal exprés en contrario, la responsabilidad será siempre subsidiaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a que se refieren los artículos 42 de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En relación con la responsabilidad solidaria y subsidiaria de la deuda tributaria, se estará a aquello que se ha fijado en los artículos 42 y 43, respectivamente, de la Ley 58/2003, de 17 de diciembre, General Tributaria.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 5.- Cuota tributaria</span></span></strong></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Matriculación en el centro: 30 €</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Seguro escolar: 6 € por curso escolar</span></span></li> </ul> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A- Por la prestación de los servicios de septiembre a junio:</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuantía a exigir por la prestación de los servicios se determinará en función de las tarifas siguientes, según los tramos horarios y los servicios que se ofrecen en cada uno de estos tramos:</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; En estas edades no se puede superar el periodo de 4 horas continuadas sin esta comida completa. Esta comida tiene lugar durante el tramo 1 del Servicio de escolarización básica y se ofrecerá a partir de las 12 del mediodía. En caso de hacer uso del servicio de escuela tempranera será necesario que el niño quede a comedor o sea recogido a las 12 h</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- En los casos que un usuario que disponga del servicio mensual de comedor, deje de asistir a la escoleta, a partir del 3.º día se le descontarán 2,66 € por día.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Los bebés (1.º) tienen una bonificación del 25% en el comedor en tanto sus menús sean adaptados.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Los precios de los servicios de guardería y de comedor se irán aumentando por curso escolar, de manera automática de acuerdo con el I.P.C. del año anterior.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante, tal y como señala el artículo 44 del Texto Refundido de la Ley Reguladora de las Haciendas Locales aprobado por Real decreto legislativo 2/2004, de 5 de marzo, se establece que el importe de los precios públicos tendrá que cubrir como mínimo el coste del servicio prestado o de la actividad realizada, por lo cual, estos precios del servicio de comedor podrán variar en función de los precios obtenidos al proceso de contratación de dicho servicio.</span></span></p> <p><strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">B- Por la prestación de los servicios el mes de julio:</span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durante el mes de julio se aplicarán las tarifas de la siguiente forma:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Por las matriculaciones mensuales se aplicará a todos los alumnos (incluidos los alumnos de 3.º) las cuotas por los alumnos de 1.º y 2.º de educación infantil establecidas a todos los tramos y servicios del apartado A.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Se establece la posibilidad de inscribir a los alumnos, de cualquier edad, solo algunas semanas. font-size:12px">C- Otras consideraciones</span></span></strong></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Antes del inicio del curso escolar, las familias tendrán que informar del tramo horario del que harán uso de forma general, que se podrá modificar en cualquier momento durante el curso previa información al equipo educativo.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Dentro de los precios establecidos por el servicio educativo no están incluidos el material necesario para fiestas, salidas y otros gastos que serán aportados directamente por los padres.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 6.º- Mejoras socioeconómicas de la cuota.</span></span></strong></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Exenciones.</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La renta per cápita de la unidad familiar será el resultado de dividir la suma de todas las Bases Liquidables (regular e irregular o be de la casilla que se adapte a este concepto) de todos los miembros de la unidad familiar entre el número resultante de la suma del número de miembros de la unidad familiar y otras personas con deducción.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para calcular el porcentaje de la cuota general a aplicar, se cogerá como referencia la declaración de renta del año anterior al inicio del curso y el salario mínimo correspondiendo al año del inicio del curso.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el momento de formalizar la matrícula se presentará un certificado de la Agencia Tributaría de la/las declaraciones de la renta de la unidad familiar. Aquellas familias que no justifiquen los ingresos correspondientes al ejercicio económico que sirve de criterio por la aplicación de los precios se los podrá aplicar la cuota máxima.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el supuesto de que la unidad familiar no hubiera estado sujeto a la obligación de declarar, presentará un certificado negativo de la renta de cada uno de los miembros, expedido por la Agencia Tributaría.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Solo podrán disfrutar de estas exenciones y bonificaciones las personas empadronadas y residentes en Esporles.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 7.- Devengo</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La tasa se reportará y la obligación de contribuir nacerá cuando se inicie la prestación del servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por su naturaleza material, el periodo impositivo se ajustará al curso académico.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El servicio educativo se abonará mensualmente, a partir del mes de septiembre.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuota del mes de septiembre se calculará a partir del día de inicio del calendario escolar fijado por la Consellería de Educación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La cuota del mes de julio es calculará en función de los días de asistencia del niño.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 8.- Normas de gestión</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El alumno que por cualquier motivo desee causar baja a lo largo del curso, está obligado a solicitar esta a la Administración entre los días 1 y 10 de cada mes. En caso contrario, la baja será efectiva en el mes siguiente a la solicitud.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La existencia de deuda pendiente con la Escoleta de Esporles al finalizar el curso hará decaer en su derecho de «Reserva de Plaza» del alumno para el curso siguiente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El servicio de comedor podrá ser contratado mensualmente o por días puntales, avisando previamente en el Centro.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conforme al artículo 26.3 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, en el supuesto que por causas no imputables al sujeto pasivo, el servicio público no se pudiera prestar o desarrollar, procederá la devolución del importe correspondiente.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 9.- Modificación</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La modificación de los precios públicos fijados en el presente Acuerdo corresponderá al Pleno de la Corporación, en virtud el artículo 47.1 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 10.- Infracciones y sanciones</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo el en lo referente a infracciones y sanciones tributarias, será de aplicación la Ley 58/2003, de 17 de diciembre, General Tributaria, en concreto los artículos 181 y siguientes, así como sus disposiciones de desarrollo, según lo dispuesto en el artículo 11 del Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el Real decreto legislativo 2/2004, de 5 de marzo.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Artículo 11.- Legislación aplicable</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En todo el no previsto en el presente Acuerdo se estará al que se dispone en el Texto Refundido de la Ley Reguladora de las Haciendas Locales, aprobado por Real Decreto 2/2004, de 5 de marzo, la Ley 8/1989, de 13 de abril, de Tasas y Precios Públicos, así como en la Ordenanza General aprobada por este Ayuntamiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN DEROGATORIA</strong>.- Queda derogada íntegramente la ordenanza publicada en el *BOIB n.º 76, de 22/05/2010 y posteriores modificaciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓN FINAL.-</strong> La presente ordenanza entrará en vigor el día de su publicación en el Boletín Oficial de la Comunidad Autónoma de las Islas Baleares, estando en vigor hasta su modificación o derogación exprés.</span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Y habiendo transcurrido el plazo de exposición al público de treinta (30) días de duración a contar desde el mencionado anuncio sin que se haya presentado ninguna reclamación o sugerència, se entiende en conformidad con el que dispone el arte. 17 del RDL 2/2004 de 5 de marzo por el que se aprueba el texto Refundido de la Ley Reguladora de las Haciendas Locales, definitivamente aprobada.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Lo cual se hace pública para general conocimiento y a los efectos pertinentes de acuerdo con el arte. 17 del mencionado texto legal</span></p> <p> </p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp; <em>(Firmado&nbsp;electrónicamente: 21 de diciembre de 2022</em></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>La alcaldesa</strong></em><em><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span>Maria Ramon Salas)</em></span></span></p> ]] 2023-01-12 es es 2022-12-22
