&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sobre PROCESO CONTENCIOSO-ADMINISTRATIVO&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De D/ña. UTE, GIREF&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En este órgano judicial se tramita PROCEDIMIENTO ORDINARIO 0000323 /2019 seguido a instancias de UTE, GIREF contra COMISION MEDIO AMBIENTE DE LAS ISLAS BALEARES, CONSELL INSULAR DE FORMENTERA, por resolución de fecha 09/11/2022 y conforme al art. 107 de la LJCA se ha acordado remitir a Vd. e&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;l presente por el cual se interesa disponga lo necesario a fin de que se publique en ese EL FALLO DE LA SENTENCIA Nº477/2022 de fecha 21/07/2022, debiendo comunicar a este órgano judicial la fecha y número del ejemplar donde quede publicado. Todo ello de conformidad con el art. 107 LJCA.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se adjunta fallo de la Sentencia y resolución que acuerda su publicación:&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;FALLAMOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; Estimamos parcialmente el recurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;SEGUNDO.- &lt;/strong&gt;Declaramos no ser conformes a derecho y nulos los acuerdos recurridos en los particulares que (i) su contenido es imposible por no incluir un régimen provisional o transitorio de admisión de residuos mientras se ejecuten las obras de las plantas de triaje y compostaje de la fracción orgánica de los residuos urbanos, y (ii) debe incorporarse el acuerdo de 07/07/2016, por el que la CMAIB aprobó una modificación no sustancial de la AAI de Ca Na Putxa, con el fin de establecer un régimen de admisión transitoria de residuos, hasta la construcción y entrada en funcionamiento de la planta de tratamiento previo, prevista para el 15 de setiembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERECERO.- &lt;/strong&gt;Desestimamos la tercera de las pretensiones de la demanda&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CUARTO.-&lt;/strong&gt; Sin costas.&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
