    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de julio de 2015 por la cual se convocan subvenciones para Inversiones a las explotaciones agrícolas, para los años 2015-2019, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el&amp;nbsp;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/p&gt;

&lt;p&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Común de las Administraciones Públicas.&lt;/p&gt;

&lt;p&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha de 16&amp;nbsp;de noviembre&amp;nbsp;de 2022, dicta lo siguiente:&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1. Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de fecha 17 de diciembre de 2015 (BOIB núm. 185), con fecha 22 de junio de 2016, (BOIB núm. 81) y con fecha 26 de junio de 2018 (BOIB núm. 80, con fecha 2 de marzo de 2020 y con &amp;nbsp;fecha 6 de mayo de 2020. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2. El 4 de febrero de 2022, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 23, de 12 de febrero de 2022, en la que figuraba una concesión a favor de&amp;nbsp;JOAN PERELLO GELABERT, amb NIF ***7082**, con número de expediente INEA2019_1/289, por un importe de ayuda de 164.129,59€, un importe de concesión de 98.477,75€ y un plazo de ejecución de 12 meses.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3. El 7&amp;nbsp;de octubre&amp;nbsp;de 2022, con registro de entrada núm. 574155&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, la persona indicada en el apartado anterior &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ha presentado&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;una solicitud de cambio de inversión,&amp;nbsp;dónde solicita cambiar la&lt;/em&gt;&amp;nbsp;&lt;em&gt;plantación de higueras por una plnatación de algarrobos al polígono 9, parcerla 214 de Llubí y desiste de la plantación de higueras en el polígono 7, parcela 769 de Llubí.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;4. La inversión con el cambio de inversión tiene un importe de ayuda de 161.735,21€ y un importe de concesión de 97.041,13€. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;5. El importe de ayuda concedida inicialmente era de 98.477,75 €, por tanto hay una diferencia de 1.436,62 € que deben revocarse. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;6. Dado todo esto, el día 25 de octubre de 2022 se notifica a la persona interesada, mediante publicación en la web del FOGAIBA, «el Informe/propuesta provisional de de resolución de aceptación de la solicitud de cambio de inversión de las inversiones concedidas y revocación parcial del importe de concesión»; a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones. Una vez transcurridos los 10 días hábiles, la persona interesada no ha presentado ninguna alegación. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;7. Se ha considerado el Informe/Propuesta provisional de resolución de 20 de octubre de 2022, de revocación parcial de la ayuda concedida a Joan Perelló Gelabert, con NIF ***7082**.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Consideraciones jurídicas&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1. Resolución de 10 de julio de 2015&lt;/em&gt;&amp;nbsp;&lt;em&gt;del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) &amp;nbsp;por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias&lt;/em&gt;&amp;nbsp;&lt;em&gt;modificada mediante las resoluciones de 17 de diciembre de 2015, 22 de junio de 2016, 26 de junio de 2018, 2 de marzo de 2020 y 6 de mayo de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;Por todo ello, dicto la siguiente&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;RESOLUCIÓN&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;1. Aceptar la modificación de inversiones propuesta y revocar parcialmente la resolución de ayuda concedida al beneficiario detallado en el anexo adjunto, que es un total de 1 expediente, que comienza y termina por JOAN PERELLÓ GELABERT, NIF ***7082** y por el &amp;nbsp;importe indicado en el anexo de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;2. Notificar esta resolución al beneficiario&amp;nbsp;mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos &lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;
