font-size:12px">Los expedientes&nbsp;han sido&nbsp;tramitados&nbsp;por el Fondo&nbsp;de Garantía Agraria&nbsp;y Pesquera de&nbsp;las&nbsp;Islas Baleares&nbsp;(FOGAIBA) en cumplimiento de lo&nbsp;dispuesto en el artículo&nbsp;43&nbsp;de&nbsp;la Ley&nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&nbsp;administraciones públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>1. Con fecha 17 de noviembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambient y clima, correspondientes a</em>&nbsp;</em><em><em>l</em></em><em><em>os</em></em><em><em>&nbsp;año</em></em><em><em>s</em></em><em><em>&nbsp;2015&nbsp;a&nbsp;2019.</em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>2. De conformidad con el apartado sexto de la Resolución mencionada, el plazo para presentar las solicitudes finalizó el día 30 de junio de 2017, y tuvieron entrada en el Registro del Fondo de Garantia Agraria y Pesquera de las Illes Balears un total de 688 solicitudes de ayuda. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>3. Analizada total la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de las correspondientes resoluciones con los datos y los importes que figuran en el citado anexo. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>4. Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliables dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>5. Con fecha 10/12/2009, dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago junto con un escrito que solicita el cambio de titular del expediente a favor de Guelnor Sl. El solicitante en persona nos explica que quiere realizar este cambio, ya que la mayor parte de los polígonos y parcelas solicitadas los ha traspasado al RIA del solicitante pues es el propietario de las fincas. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>6. Después de las comprobaciones oportunas, el gestor comprueba que el nuevo solicitante, dentro de la misma convocatoria, ya tiene un expediente concedido y cobrado. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>7. Con fecha 03/11/2020, el solicitante presenta un nuevo escrito indicando que renuncia el cambio de titular a favor de Guelnor SL y solicita el pago sólo de la inversión del marge que es propiedad de M. Catherine Vicens. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>8. Analizada la documentación y el escrito presentado, los gestores comprueban que la inversión propiedad de la solicitante supone menos del 50% de la inversión total concedida. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>9. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece la obligación de la Administración a dictar resolución expresa ya notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y las normas aplicables”. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>10. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>11. Dado todo esto, se propone hacer la revocación total debido al incumplimiento de la obligaciones para poder ser beneficiarios; y por no cumplir el compromiso de ejecutar la inversión mínima. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>12. En relación a las fechas del Anexo I se notifica, mediante la publicación en la página web http://www.caib.es, la mencionada propuesta a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>13. A día de hoy, y una vez finalizado el plazo, los interesados relacionados en el Anexo I adjunto no han presentado alegaciones.</em></em></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>Fundamentos de derecho</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>1. Con fecha 17 de noviembre de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 169, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan subvenciones para las inversiones no productivas vinculadas a la realización de compromisos de agroambiente y clima, correspondientes al año 2015 en 2019. </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 . </em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. </em></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em><strong><em>-&nbsp;</em></strong></em></strong><em><em>Dado el apartado 3.1, establece los requisitos que deben cumplirse para ser beneficiarios de la ayuda. </em></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em><strong><em>-&nbsp;</em></strong></em></strong><em><em>Dado el apartado 10.1, son obligaciones del beneficiario, entre otros “Mantener los requisitos y condiciones exigibles respecto a la explotación ya la persona beneficiaría, a los que hace referencia el apartado tercero de esta Resolución”. </em></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em><strong><em>-&nbsp;</em></strong></em></strong><em><em>En virtud del apartado 12.1 “El plazo para notificar y justificar la realización de las inversiones propuestas en la Resolución es de seis meses, a contar desde el día siguiente a la fecha de notificación de la resolución de concesión de la ayuda . </em></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em><strong><em>-&nbsp;</em></strong></em></strong><em><em>El apartado 12.6 establece que debe justificarse más del 50% de la cantidad total de inversión aprobada en la resolución de concesión inicial. </em></em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em><strong><em>-&nbsp;</em></strong></em></strong><em><em>En virtud del ANEXO III, Reducciones y Exclusiones, y su apartado 2.3 reducciones por incumplimiento de compromisos, y por incumplimiento de un compromiso básico de realizar más del 50% de la ayuda. </em></em></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>Conclusión </em></em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>Por todo lo expuesto anteriormente, el incumplimiento de los apartados 3.1, 10.1, 12.1, 12.6 y/o el incumplimiento de los compromisos básicos del ANEXO III, implica la posibilidad de revocar la ayuda otorgada a los interesados mediante las resoluciones de concesión detalladas en el Anexo I.</em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>Informe - Propuesta de resolución de revocación&nbsp;total</em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>Se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos.</em></em></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>1.
