    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 24&amp;nbsp;de noviembre&amp;nbsp;de 2022, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.El de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015 (BOIB núm. 185), 22 de junio de 2016 (BOIB núm. 81), 26 de junio de 2018 (BOIB núm. 80), 14 de junio de 2019 (BOIB núm. 80), 2 de marzo de 2020 (BOIB núm. 28), 6 de mayo de 2020 (BOIB núm. 77), 22 de junio de 2020 (BOIB núm. 114), 23 de julio de 2021 (BOIB núm. 101), 19 de noviembre de 2021 (BOIB nº 162), 1 de julio de 2022 (BOIB núm. 87). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.El 4 de febrero de 2022, el vicepresidente del FOGAIBA, dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 23, de 12 de febrero de 2022, en la que figura una solicitud, denegada provisionalmente por falta de presupuesto, a favor de JUAN OLIVER GORNALS, con NIF ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;68&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, con número de expediente INEA 2019_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, por importe de ayuda de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;95&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;363&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;00&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;€, un importe de concesión de 4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.68&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;50&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;€ y un plazo de ejecución de 6&amp;nbsp;meses. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 1 de julio de 2022 se dictó Resolución de la presidenta del FOGAIBA por la que se modifica la Resolución de 10 de julio de 2015 mediante la cual se convocan, para los años 2015 a 2020, subvenciones para inversiones en las explotaciones agrarias. En esta modificación de la Resolución, el apartado noveno, punto 4 permite el incremento de crédito durante el período de 6 meses posteriores a la resolución de la ayuda sin necesidad de convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.El 12 de agosto de 2022, fecha en que finalizó el período de 6 meses para incrementar el crédito. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 12 de septiembre de 2022 se publicó en la página web del FOGAIBA el requerimiento para la aceptación de la subvención INEA2019 según el cual se podía conceder la ayuda a los expedientes, que por orden de puntuación, figuraban en el anexo I, entra otros, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JUAN OLIVER GORNALS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con DNI ***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;68&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;** y con número de expediente INEA 2019_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, por un importe de ayuda de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;95&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;363&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;00&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;€, un importe de concesión de 4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.68&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;50&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;€ y un plazo de ejecución de 6&amp;nbsp;meses. Se concedió un plazo de 10 días hábiles a contar desde el día siguiente de la publicación del requerimiento para que el interesado se opusiera a la concesión de la ayuda y que en caso de no hacerlo se daría por aceptada la propuesta, se dictaría el acto de concesión y se procedería a su notificación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.El 25 de octubre de 2022, con registro de entrada núm. 623058/2022, la persona indicada en el apartado anterior ha presentado una solicitud de cambio de inversiones, en la que indica que el modelo de tractor que solicitó (M125GX-IV-S marca Kubota), con un importe de 64.660,00€, ya no se fabrica y que pasa a ser el M6132 24/24 marca Kubota, con un importe de 91.870,00€. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.El 8 de noviembre de 2022 se emite informe de moderación de costes del tractor M125GX-IV-S marca Kubota donde se informa que el precio máximo elegible es el de la solicitud de ayuda, por tanto el importe elegible del tractor es de 64.660,00€. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.El 7 de noviembre de 2022, con registro de entrada núm. 650333, Juan Oliver Gornals solicita el desistimiento de las inversiones del remolque del cultivador y del chisel; con un importe de inversión de 30.703,00€. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.El importe de la ayuda solicitada era de 95.363,00 € y descontando el importe de 30.703,00 € de los desistimientos solicitados por el beneficiario queda un importe solicitado de 64.660,00 €. Con el 50% de nivel de ayuda queda un importe de ayuda concedida de 32.330,00 €. Por tanto, se deben revocar un total de 15.351,50 €, tal y como se especifica en el anexo de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10.Dado todo esto, se propone aceptar el desistimiento de las inversiones y revocar parcialmente la ayuda concedida al beneficiario como se indica en el anexo adjunto de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa &amp;nbsp;favorablemente del cambio de inversión &lt;/em&gt;&lt;em&gt;y se propone al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Revocar parcialmente la ayuda concedida &lt;/em&gt;&lt;em&gt;&lt;em&gt;al beneficiario detallado en el anexo adjunto, que es un total de 1 expedientes y que comienza y termina por JUAN OLIVER GORNALS &amp;nbsp;y por el importe indicado en el anexo de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.
