&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. El Consejo Ejecutivo del Consejo Insular de Menorca, en la sesión de carácter ordinario de día 16 de mayo de 2022, aprobó el Texto refundido y simultáneamente la convocatoria de las ayudas de minimis para el fomento de las razas autóctonas de Menorca 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Esta convocatoria se rige por las bases aprobadas por el Consejo Ejecutivo del CIM en la sesión de carácter ordinario de día 20 de septiembre de 2021 (BOIB núm. 136 de 5 de octubre de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;2. La dotación presupuestaria de esta convocatoria es de 30.000 € de la partida 5.41240.4890000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;3. El plazo de presentación de solicitudes era del día siguiente a la publicación en el BOIB, que fue día 9 de junio de 2022 y núm de BOIB 75, hasta día 31 de octubre de 2022. En este plazo se presentaron dos solicitudes. Los dos solicitantes cumplen los requisitos de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;4. El objeto de esta convocatoria es apoyar a las actividades que hayan llevado a cabo, entre día 1 de noviembre de 2021 y día 31 de octubre de 2022, las asociaciones de ganaderos de razas autóctonas de Menorca, para compensar el coste de los gastos relacionados con la gestión de los libros genealógicos y la mejora genética, para obtener productos primarios de calidad, y también los gastos derivados de las tareas que realizan las asociaciones para promocionar estos productos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;5. El punto 4 de las bases enumera las actividades subvencionables y el punto 7 indica la documentación que tienen que presentar los solicitantes de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;6. El punto 8 de las bases indica la relación y valoración de las solicitudes. Para la concesión de las subvenciones previstas, se establece que se tendrá en cuenta el siguiente criterio: censo mediano de cada explotación, obtenido de la división entre el número de animales inscritos en el libro genealógico y el número de afiliados a cada asociación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;a)&lt;/em&gt; &amp;lt; 20 cabezas : 4 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b)&lt;/em&gt; 20-40 cabezas: 5 puntos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;c)&lt;/em&gt; &amp;gt; 40 cabezas: 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;Según el resultado en la puntuación corresponderán las cantidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;a)&lt;/em&gt; menos de 5 puntos : 6.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;b)&lt;/em&gt; igual o más de 5 puntos: 12.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;7. El punto 12.1 de las bases prevé la presentación de la justificación de los gastos objeto de subvención junto con la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;8. Día 29 de noviembre de 2022 se reunió la Comisión Evaluadora de las ayudas y emitió su propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;9. Día 12 de diciembre de 2022 interventor emitió informe de fiscalización favorable a la concesión de las ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fundamentos de derecho &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;1. Ley 38/2003, de 17 de noviembre, general de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Reglamento (CE) núm. 1408/2013 de la Comisión, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas de minimis en el sector agrícola, modificado por el Reglamento (UE) 2019/316.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;5. Articulo 33.2 &lt;em&gt;k&lt;/em&gt; de la Ley 4/2022, de 28 de junio, de consejos insulares de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Como titular del Departamento de Economía y Territorio, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares; por el Decreto de Presidencia núm. 275/2022, de 6 de septiembre de 2022, relativo a la delegación de competencias de la Presidencia en los consejeros ejecutivos (BOIB núm. 118 de 8 de septiembre de 2022), y el Acuerdo del Consejo ejecutivo de 5 de septiembre de 2022, relativo a la delegación de competencias del Consejo Ejecutivo en la presidenta y en los consejeros y consejeras ejecutivos (BOIB núm. 118 de 8 de septiembre de 2022), todo lo anterior en relación con el Decreto de Presidencia núm. 421/2019, de 9 de julio, de creación de los departamentos (BOIB núm. 93 ext. de 10 de julio de 2019);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En uso de las atribuciones que me han sido conferidas;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; Conceder y tramitar el pago, por un importe total de 18.000 €, de las ayudas siguientes de la convocatoria de ayudas de minimis del CIM para el fomento de las razas autóctonas de Menorca, para compensar el coste de los gastos relacionados con la gestión de los libros genealógicos y la mejora genética, para obtener productos primarios de calidad, y también por los gastos derivados de las tareas que realizan las asociaciones para promocionar estos productos, llevadas a cabo entre el 1 de noviembre del año 2021 y día 31 de octubre de 2022, con cargo a la partida 5.41240.4890000 del presupuesto del Consejo Insular de Menorca para el año 2022:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;Estas ayudas, en virtud de su naturaleza específica como ayudas de minimis, están sometidas al Reglamento (UE) núm. 1408/2013 de la Comisión, de 18 de diciembre de 2013, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea de las ayudas de minimis en el sector agrícola, modificado por el Reglamento (UE) núm. 2019/316, de 21 de febrero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; Remitir a la BDNS este acuerdo en cumplimiento del art. 20.8 de la LGS y publicarlo en el Boletín Oficial de las Islas Baleares a los efectos de notificación (art. 1&amp;nbsp;b de la LPACAP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt;&lt;strong&gt; &lt;/strong&gt;Comunicar este acuerdo a la Consejería de Agricultura, Pesca y Alimentación del Gobierno de las Islas Baleares para que tenga los efectos que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
