1630 2022-12-29 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Antecedentes</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">1. El 21 de octubre de 2022, la presidenta del Instituto Mallorquín de Asuntos Sociales (IMAS) dictó la resolución para la aprobación de convocatoria pública de ayudas económicas a a entidades que llevan a cabo actividades de apoyo<span style="display:none">&lt;A[apoyo|soporte]&gt;</span> a los servicios sociales de atención primaria y actividades de apoyo<span style="display:none">&lt;A[apoyo|soporte]&gt;</span> para personas en situación de exclusión social con problemas añadidos de salud para el año 2022, y actividades y /o acciones formativas destinadas a dar apoyo a entidades que trabajan con personas en riesgo de exclusión social.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Esta resolución se publicó en el BOIB núm. 139 de 27 de octubre de 2022.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">3. Una vez revisadas las solicitudes admitidas y enmendadas,<span style="color:#000000"> </span>valorados los proyectos y de conformidad con los puntos establecidos en las bases, se ha calculado el importe correspondiente a cada entidad, dado que existe crédito adecuado y suficiente para hacer frente a los gastos que genera esta convocatoria con cargo en la partida 30.23152.48000 y 30.23152.48001 el importe máximo que se destina es de seis cientos cincuenta mil euros (650.000,00€).</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">4. La</span> <span style="color:#000000">Comisión Evaluadora se reunió el 25 de noviembre y 2 de diciembre de 2022, acordando los otorgamientos y denegaciones en función del</span> <span style="color:#000000">informe técnico de valoración de los proyectos presentados, que cumplan los requisitos y han obtenido una valoración igual o superior a 25 puntos.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">5. Visto eso, el 20 de diciembre de 2022, entró en el Servicio Jurídico-administrativo del IMAS (vía SEGEX) el informe propuesta de otorgamiento y denegaciones de estas ayudas emitido de la jefa de Sección de Inserción Social del IMAS con el visto bueno del Director insular de Inclusión Social del IMAS,</span><span style="color:#000000"> por</span><span style="color:#000000"><span style="display:none">&lt;A[por|para]&gt;</span></span><span style="color:#000000"> </span><span style="color:#000000">el que solicitaba de acuerdo con el informe técnico de valoración de 20-12-22 y adjuntando el acta de la comisión evaluadora, que se proceda al otorgamiento y a la denegación de las ayudas correspondientes.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">6. Igualmente, en este informe se propone DENEGAR la ayuda a la entidad </span><span style="color:#000000"><em>Asociación Española contra el cánce</em></span><span style="color:#000000">r, para no cu</span><span style="color:#000000">mplir con el establecido en el punto 10.2 de las bases de la convocatoria de las ayudas. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Consideraciones jurídicas</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">1. <span style="color:#000000"><strong> </strong></span>El Pleno del Consejo de Mallorca, por acuerdo de día 11 de abril de 2019, aprobó los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67 de 18 de mayo de 2019). El artículo 2.1 de los Estatutos dispone que el IMAS, tiene por objeto fundamental el ejercicio, en forma directa y descentralizada, de las competencias atribuidas para<span style="display:none">&lt;A[para|por]&gt;</span> cualquier título en el Consejo de Mallorca en materia de servicios sociales y protección de menores.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. De acuerdo con el artículo 70.4 del Estatuto de Autonomía, son competencias propias de los consejos los servicios sociales y la asistencia social y la política de protección y atención a personas dependientes. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. De acuerdo con el artículo 3 de los Estatutos del IMAS, este organismo tiene personalidad jurídica propia y la capacidad de obrar necesaria para cumplir sus fines. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. De acuerdo con el arte. 8 de la Ley 38/2003, general de subvenciones, con carácter previo al otorgamiento de las subvenciones, se tienen que aprobar las normas que establezcan las bases reguladoras de concesión en los términos que prevé la Ley.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5<span style="color:#000000">. </span><span style="color:#000000">Vista la Ordenanza General de Subvenciones del Consejo de Mallorca (OGS) aprobada en sesión de 23 de diciembre de 2016 (BOIB núm. 21, de 18 de febrero de 2017), y modificada por Acuerdo del Pleno del Consejo de Mallorca de fecha 14 de junio de 2018 (BOIB núm. 96, de 4 de agosto de 2018), en especial referencia a lo establecido en su artículo 1 que determina que tiene por objeto regular el régimen jurídico general de las subvenciones otorgadas por el Consejo Insular de Mallorca, los organismos autónomos que dependen y las entidades de derecho público con personalidad jurídica propia vinculadas o dependientes de que otorguen subvenciones dentro del ejercicio de potestades administrativas. Así como, visto que esta OGS da cumplimiento<span style="display:none">&lt;A[cumplimiento|cumplido]&gt;</span> al previsto en el Decreto legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones adecuando, de acuerdo con la Disposición adicional segunda de este Decreto legislativo, la actividad de concesión de subvenciones del Consejo en el establecido a la misma Ley.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. De acuerdo con la Ordenanza General de Subvenciones y con la convocatoria, el procedimiento de selección de las entidades beneficiarias se tiene que hacer mediante concurrencia competitiva, en los términos que prevé el artículo 21 de la Ordenanza mencionada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. La Comisión Evaluadora constituida para esta convocatoria ha estudiado y comprobado todas las solicitudes presentadas, haciendo los requerimientos de enmiendas que correspondieron, y posteriormente emitió el informe que sirve de base al órgano instructor para elaborar la propuesta de resolución correspondiente.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. En virtud del punto 11.1 de esta convocatoria de ayudas económicas, las resoluciones de concesión o de denegación de las ayudas se notificará a las entidades interesadas y se publicará en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 45.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (LPAC).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">9. El órgano competente para aprobar las bases específicas y resolver los procedimientos de ayudas, prestaciones y subvenciones relativas a las competencias atribuidas al IMAS, es la Presidencia del IMAS, en virtud del artículo 7.2.7 de los Estatutos del IMAS y atendido el Decreto de la Presidencia del Consejo Insular de Mallorca por<span style="display:none">&lt;A[por|para]&gt;</span> el cual se nombra el consejero<span style="display:none">&lt;A[consejero|conseller]&gt;</span> ejecutivo de Derechos Sociales (BOIB núm. 92 de 9 de julio de 2019), el cual, de acuerdo con el artículo 7.1 de los Estatutos del IMAS, ejercerá también el cargo de presidente del IMAS.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">10. La Resolución de la presidenta<span style="color:#000000"> </span>del</span><span style="color:#000000"> </span><span style="color:#000000">Instituto</span><span style="color:#000000"> </span><span style="color:#000000">Mallorquín</span><span style="color:#000000"> </span><span style="color:#000000">d</span><span style="color:#000000">e As</span><span style="color:#000000">untos</span><span style="color:#000000"> </span><span style="color:#000000">Sociales</span><span style="color:#000000"> </span><span style="color:#000000">(IMAS)</span><span style="color:#000000"> que </span><span style="color:#000000">aprobó</span><span style="color:#000000"> la</span><span style="color:#000000"> convocatoria pública de ayudas económicas a a entidades que llevan a cabo actividades de apoyo</span><span style="color:#000000"><span style="display:none">&lt;A[apoyo|soporte]&gt;</span></span><span style="color:#000000"> a los servicios sociales de atención primaria y actividades de apoyo<span style="display:none">&lt;A[apoyo|soporte]&gt;</span> para personas en situación de exclusión social con problemas añadidos de salud para el año 2022, y actividades y /o acciones formativas destinadas a dar apoyo a entidades que trabajan con personas en riesgo de exclusión social (BOIB núm. 139 de 27 de octubre de 2022).</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">11. Constatado que se ha cumplido con el establecido a la Ordenanza general de subvenciones y a la convocatoria, que existe crédito adecuado y suficiente en el presupuesto de 2022 para la concesión de estas ayudas, y asimismo, que consta al expediente la documentación contable, y que no existen deudas pendientes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Existiendo informe del órgano instructor en el cual conste que de la información que obra en su poder se desprende que los beneficiarios cumplen todos los requisitos necesarios para acceder a las mismas, y la documentación como mientras no tiene deudas y por lo tanto, cumplen con los requisitos para ser personas beneficiarias. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">12.
