    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por Acuerdo del Pleno de fecha 25 de octubre de 2022, se aprobó inicialmente la modificación de la Ordenanza reguladora del régimen de uso de los Huertos Urbanos del municipio de Marratxí que sigue con el procedimiento que establece la tramitación del artículo 102 de la Ley 20/2006, de 15 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El 8 de noviembre de 2022, se publicó en el BOIB núm. 144 la aprobación inicial y exposición pública durante un periodo de treinta días, periodo que finalizó el 09/12/2022 y durante el cual no se han presentado ningún tipo de alegación ni sugerimiento, por lo que el Acuerdo se entiende aprobado definitivamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Los Huertos Urbanos son una iniciativa del Área de Servicios Sociales del Ayuntamiento de Marratxí que tiene por objetivo fomentar la red social, la educación ambiental y la agricultura tradicional y ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Los huertos urbanos del Área de Servicios Sociales del Ayuntamiento de Marratxí se configuran como áreas de cultivo de hortalizas y plantas aromáticas que, ubicadas en un entorno urbano y gestionado según los principios de la agricultura ecológica, además de producir alimentos por el consumo propio tienen una finalidad social, integradora, educativa, de ocio, ambiental y participativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento de Marratxí pretende fomentar todas aquellas acciones que repercutan en beneficio a las personas residentes, atendiendo a la ocupación del tiempo libre por parte de éstas. Con la disposición de los huertos de ocio se pretende que la población adopte una actitud activa y positiva en su tiempo libre y de ocio, con el objeto de que, a la vez que se potencien los valores saludables y ambientales, se ofrece una distracción saludable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Mediante esta Ordenanza se pretende establecer el régimen aplicable a la utilización de estos espacios hortícolas para establecer el procedimiento a seguir por la adjudicación de los huertos, los criterios generales de selección aplicables a la demanda existente, los derechos y obligaciones que incumben a las personas beneficiarias, y, en general, la regulación del uso y funcionamiento de la red de huertos urbanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2. OBJETO DE LA ORDENANZA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Esta Ordenanza tiene por objeto definir el procedimiento de adjudicación de parcelas de cultivo de los huertos urbanos del municipio de Marratxí, así como determinar las condiciones de uso de estas parcelas y las obligaciones de las personas adjudicatarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El huerto urbano de Sa Cabana dispone de 3 mesas de cultivo (equivalente a una plaza del huerto) adaptadas por aquellas personas que se desplazan en silla de ruedas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La actividad de cultivo dentro de las parcelas se prestará de acuerdo con lo descrito en esta ordenanza y correrá a cargo de las personas adjudicatarias, en concreto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) Las siembras, mantenimiento, orden y limpieza de la parcela asignada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) El seguimiento de los principios de la agricultura ecológica y las recomendaciones que pueda establecer el Área de los Servicios Sociales del Ayuntamiento de Marratxí al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Correrá a cargo del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) Los gastos de agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) La supervisión por parte de las personas profesionales agrarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;c) El seguimiento de la persona técnica del Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;d) Equipo básico de herramientas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;e) Abonos y compuestos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;f) Mantenimiento de las áreas comunes y el sistema de riego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;3. FUNDAMENTO LEGAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En esta ordenanza se dicta de conformidad con lo dispuesto en los artículos 4.1, 25.2 b)y l) y 49 de la Ley de Bases de Régimen Local; y los artículos 29.2.b),h) y k) y el artículo 100 y siguientes de la Ley 20/2006 Municipal y de Régimen Local de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4. NATURALEZA JURÍDICA DE LA ADJUDICACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La adjudicación del uso privativo de dominio público sobre las parcelas de cultivo y de los espacios comunes del huerto urbano de titularidad municipal no supone la transmisión del dominio de la parcela o el espacio de cultivo cedidos, que siguen siendo propiedad del Ayuntamiento de Marratxí, respecto tanto del terreno como de todas las instalaciones existentes en el momento de la adjudicación y de las que las diferentes personas usuarias puedan realizar con la autorización previa y expresa del Ayuntamiento , las cuales quedarán unidas de forma permanente a la parcela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La persona adjudicataria tan sólo tiene la posesión precaria de la parcela de cultivo que se le asigne, según libre decisión y a criterio municipal; todo ello en los términos previstos en esta Ordenanza y la licencia de uso privativo de dominio público que finalmente se otorgue de acuerdo con la legislación vigente: la Constitución Española; el Código civil; la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares; la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local; el Real decreto legislativo 781/1986, de 18 de abril, del texto refundido de las disposiciones vigentes en materia de régimen local; el Real decreto 1372/1986, del reglamento de bienes de las corporaciones locales; la Ley 33/2003, de 3 de noviembre, del patrimonio de las administraciones públicas; el Decreto de 17 de junio de 1955, de reglamento de servicios de las corporaciones locales, y demás normativa concordante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Dicho uso privativo tiene carácter personal y en ningún caso las personas titulares podrán ceder, enajenar, grabar o disponer, a título oneroso o gratuito, los derechos que se deriven de la autorización de uso, ni pueden transmitirlo a terceras personas, sin perjuicio del posible apoyo de lo establecido en esta Ordenanza, en lo que respecta a la cesión del uso de las parcelas de cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;5. DERECHOS DE LAS PERSONAS ADJUDICATARIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Constituyen derechos de las personas o entidades adjudicatarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) Cultivar dentro de la parcela de cultivo o mesas de cultivo adjudicadas cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) Emplear la caseta común para depositar las herramientas, semillas y otros elementos que puedan aportar destinados al cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;c) Disponer del asesoramiento, tanto de la persona técnica de los Servicios Sociales como de la persona técnica agraria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;d) Los demás que se deriven del contenido de esta ordenanza y de las bases de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;6. PROHIBICIONES A LAS PERSONAS ADJUDICATARIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;No se permite a las personas adjudicatarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) Cultivar ninguna especie que no sea para el consumo humano, con la única excepción del cultivo de flores y plantas aromáticas. No se permite, pues, plantar árboles de ningún tipo, céspedes o plantas ornamentales que requieran un elevado consumo de agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) Cultivar plantas degradantes del suelo y plantas psicotrópicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;c) Cultivar una única especie por temporada (monocultivo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;d) Aplicar productos fitosanitarios de síntesis para el control de plagas o enfermedades. Sólo se autorizan los productos empleados en producción ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;e) Aplicar abonos de síntesis. Sólo se autorizan los productos empleados en producción ecológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;f) La sustracción o daño a productos o plantas obtenidos en el cultivo por parte de las personas adjudicatarias de otras parcelas ajenas a la adjudicada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;g) Comercializar, en la forma que sea, los productos obtenidos en el cultivo de la parcela o mesa de cultivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;h) Hacer ninguna clase de obra, lo que incluye la prohibición de realizar ningún tipo de nueva valla o separación (mediante muros, cañas, maderas, plásticos, uralitas, etc.), barbacoas, invernaderos, pozos, mesas fijas o bancos, así como la modificación interior o exterior de la caseta, si la hubiere, o la construcción o instalación de nuevos elementos o modificación de los existentes; todo ello salvo autorización del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;i) Tener/criar/acceder con cualquier tipo de animal o ganado y construir casetas o jaulas destinadas a éstos, salvo autorización del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;j) Cazar, talar árboles o cualquier otra actividad que pueda causar daño a la fauna y flora que pueda haber o surgir en el huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;k) Acumular o abandonar cualquier material o desecho, dentro o fuera del huerto, y aportar cualquier tipo de objeto ajeno a la función del huerto susceptible de alterar la estética del lugar; utilizar la parcela como depósito o almacén de materiales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;l) Alterar los caminos y conducciones de riego del huerto adjudicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;m) Mover los mojones y vallas que se delimiten la parcela municipal. La persona adjudicataria se obliga a ejecutar su trabajo dentro de los límites de la parcela o mesa adjudicada, sin llevar a cabo su actividad más allá de los límites fijados ni regar con aspersores o con cualquier otro utensilio que pueda invadir o regar otros parcelas o mesas vecinas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;n) Realizar un cultivo que pueda invadir fincas o parcelas colindantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;o) Dejar el huerto sin trabajar. En caso de imposibilidad temporal, que no podrá alargarse más de tres meses, la persona adjudicataria deberá comunicar de forma motivada esta circunstancia a la técnica de Servicios Sociales ya la persona técnica agraria responsables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;p) Circular por el interior del huerto con vehículos a motor, salvo cuando se utilicen herramientas agrícolas, previa autorización del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;q) Estacionar automóviles en el interior del huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;r) Instalar mangueras de uso individual o sistemas de riego por goteo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;s) Cualquier otro uso no previsto anteriormente y que produzca molestias o malos olores, limite el uso y disfrute del resto de parcelas o afecte al entorno del lugar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;t) No respetar las normas básicas de convivencia ni estética del huerto, mantener una conducta insolidaria, realizar un gasto excesivo de agua o utilizar productos tóxicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Se entenderán, entre otras, normas básicas de convivencia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No faltar el respeto al otro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No insultar y/o adoptar actitudes violentas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No realizar agresiones verbales y/o físicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No crear conflictos personales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No acudir al huerto en condiciones no deseables (consumo de alcohol o de otras drogas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Realizar un consumo responsable de la luz y agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de estas normas podrá suponer la revocación de la licencia de uso privativo o de la condición de persona de soporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;7. OBLIGACIONES DE LAS PERSONAS O ASOCIACIONES ADJUDICATARIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las personas adjudicatarias están obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) Cultivar cualquier variedad de hortalizas, flores y plantas aromáticas en los términos contenidos en las bases y siempre que no sean especies prohibidas por alguna disposición. Plantar al menos 3 especies diferentes simultáneamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) Aportar las semillas, abonos y otros elementos que utilicen para el cultivo, y asumir los gastos de su adquisición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;c) Asumir los gastos generados por la conservación y el mantenimiento ordinarios de la tierra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;d) Avisar inmediatamente al ayuntamiento si detectan cualquier daño o desperfecto en la parcela, espacio, mesa, caseta o en sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) Las obras y reparaciones de renovación o reposición en la parte exterior de la parcela, espacio, mesa o caseta o en sus elementos, debidas al envejecimiento u otras causas en las cuales no se dé daño o negligencia por parte de la persona adjudicataria o de la persona ayudante o acompañante, serán a cargo del Ayuntamiento de Marratxí. En caso contrario irán&amp;nbsp; a cargo de la persona adjudicataria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f) Mantener limpias y en perfecto estado de conservación las herramientas y útiles necesarios&lt;/span&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt; para el cultivo que sean propiedad del Ayuntamiento y que éste pueda poner a su disposición si lo considera adecuado. El Ayuntamiento podrá requerirles que compensen su desperfecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;g) Permitir las visitas a su parcela o espacio de niños de las escuelas o de otros colectivos autorizados por el Área de Servicios Sociales con el fin de conocer así o mediante un taller, y de forma práctica, lo que han aprendido en los libros de ciencias naturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;h) Mantener el entorno de sus parcelas y espacios con mesas de cultivo en perfecto estado, limpio y libre de todo tipo de hierbas y plantas espontáneas. También se tendrán que hacer cargo de gestionar adecuadamente los desechos que se produzcan, separando los de origen orgánico del resto y depositando cada tipo de residuo en el contenedor específico. El Ayuntamiento se reserva la potestad de gestionar el funcionamiento de la compostera común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;i) Cumplir las ordenanzas municipales y demás normativa local, autonómica o estatal que les pueda afectar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Responder de los daños de todo tipo, robos o actos vandálicos que puedan afectar al interior de las parcelas, espacios o caseta de herramientas, y de cualquier responsabilidad en caso de que se haya realizado de manera intencionada tanto por la persona adjudicataria como por su ayudante o acompañante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;k) Hacerse cargo de las indemnizaciones económicas y las reparaciones que se generen derivadas de los daños causados ​​en el huerto municipal y en sus instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;l) Comunicar al Ayuntamiento los datos de la persona de apoyo en los términos señalados en las bases, en su punto 3 y responder solidariamente con él ante el Ayuntamiento por sus actos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;m) Tratar de resolver los conflictos personales fuera del espacio del huerto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;n) Comunicar a la persona técnica de servicios sociales de las situaciones de mala convivencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;o) Asistir a las reuniones convocadas por el Ayuntamiento así como a las actividades formativas. La ausencia injustificada podrá suponer la inmediata revocación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;8. HORARIO Y ACCESO&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Se podrá acceder a las parcelas y mesas de cultivo de lunes a domingo, dentro del siguiente horario según la época del año; de mayo a octubre de 7:00 a 21:30 hy de noviembre a abril de 8:00 a 20:00 h.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento podrá modificar el citado horario en los casos concretos en que resulta necesario según criterio municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las personas adjudicatarias, o las autorizadas por imposibilidad justificada de la persona adjudicataria, pueden introducir en el recinto hasta un máximo de cuatro personas acompañantes simultáneamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En caso de las personas jurídicas, asociación o entidades autorizadas no deberá regirse por este número máximo de personas acompañantes simultáneamente, sino que podrá ser mayor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;9. DURACIÓN DE LA LICENCIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La adjudicación del uso privativo de las parcelas de cultivo de los huertos se otorga por un período de un año, a contar a partir del día siguiente de la recepción de la notificación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La licencia se prorrogará de oficio por un período de un año hasta llegar a un máximo total de 3 años, salvo que antes de este plazo tenga lugar la renuncia o la revocación de la licencia. Esta prórroga automática requerirá informe favorable del Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Agotado este plazo, se puede optar de nuevo a la adjudicación de una licencia, mediante la presentación de una solicitud, conforme a lo que se regula en esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En caso de que la persona adjudicataria deje la parcela sin trabajar más de 3 meses sin que haya una comunicación expresa y motivada al Ayuntamiento de Marratxí, esta parcela queda libre y puede ser adjudicada nuevamente, una vez resuelta o declarada caducada la licencia, según prevé esta Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En caso de imposibilidad temporal y justificada de la persona adjudicataria para llevar a cabo las tareas de cuidado y mantenimiento del huerto, esta persona puede autorizar otra el tiempo imprescindible hasta que se resuelva la imposibilidad de realizar las tareas la persona adjudicataria por sí misma. El Ayuntamiento debe emitir una autorización provisional de acceso a la persona designada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las causas justificadas de imposibilidad temporal son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Estar en período de embarazo, de maternidad o de paternidad, de adopción o de acogimiento permanente o pre adoptivo, incluyendo el período en que sea procedente la licencia de excedencia para cuidado de hijos e hijas por cualquiera de los casos anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Sufrir enfermedad o incapacidad temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Encontrarse en fase inminente de realización de un viaje de larga o media duración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;10. CADUCIDAD Y RENOVACIÓN DE LA LICENCIA. EFECTO DE LA EXTINCIÓN DE LA AUTORIZACIÓN.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;A. La licencia de uso privativo se extinguirá por los siguientes motivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por vencimiento del plazo final.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por renuncia del titular de la licencia antes de su vencimiento del plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por muerte o incapacidad sobrevenida de la persona adjudicataria antes del vencimiento de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por voluntad unilateral del Ayuntamiento de no prorrogar la licencia por motivos justificados o incumplimiento de las normas establecidas en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;B. La licencia de uso privativo se podrá revocar por el Ayuntamiento en los siguientes supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por pérdida o constatación de la carencia de la concurrencia en el adjudicatario de los requisitos de acceso a la licencia de uso privativo objeto de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por haber cesado en el cultivo de la parcela adjudicada durante más de tres meses sin que exista una comunicación expresa y motivada al Ayuntamiento de Marratxí y éste lo acepte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por la necesidad de disponer de las parcelas para obras, servicios o instalaciones de la Administración o para el desarrollo de las actuaciones previstas en el planteamiento urbanístico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por incumplir reiteradamente las instrucciones dadas por el Ayuntamiento, las cláusulas contenidas en esta ordenanza y otra normativa de aplicación, aunque no se haya sancionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por la constatación de que no se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias y de la Seguridad Social; todo esto a nivel estatal, autonómico y local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Por cualquier otra circunstancia de interés público debidamente justificada por el Área de Servicios Sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Y, en general, por todos los supuestos previstos en el bloque normativo de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;C. A efectos de la extinción de la licencia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento de Marratxí debe iniciar un expediente contradictorio con audiencia pública de la persona titular de la licencia de uso privativo, previamente a la aprobación de la caducidad o la revocación de la licencia. Este expediente debe contener un acta de comprobación del estado de la parcela asignada, realizado por el órgano competente que debe hacer la propuesta de resolución y extinción de la licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Dentro de los 15 días hábiles siguientes a la fecha de recepción de la notificación del citado acuerdo, la persona usuaria debe dejar el huerto municipal vacío ya plena disposición del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las obras y plantaciones que tengan el concepto de mejora efectuada por la persona usuaria y que no puedan ser retiradas sin daño al terreno municipal, quedan en propiedad del Ayuntamiento sin que esto genere un derecho a indemnización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Respecto a las cosechas, al extinguirse la licencia de uso privativo quedan a disposición de los Servicios Sociales municipales si la persona adjudicataria o personas familiares autorizadas no las han recolectado en el plazo de 15 días hábiles antes mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las personas usuarias no tienen derecho a ningún tipo de indemnización por pérdida de cosechas, por mejoras de la parcela o por otras incidencias que se deriven de la extinción o resolución de la licencia de uso privativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;11. PRERROGATIVAS MUNICIPALES&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El Área de Servicios Sociales del Ayuntamiento de Marratxí, sin generar ningún derecho de indemnización a favor de la persona interesada o adjudicataria, puede concretar y modificar las condiciones generales de uso de las parcelas o espacios y otros elementos que se puedan asignar, y modificar sus límites, los trazados de los caminos, las instalaciones de riego y otros servicios de la zona. A raíz de las citadas actuaciones, que se le deben comunicar, la persona adjudicataria puede solicitar que se revoque la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Corresponde también al Área de Servicios Sociales interpretar el contenido de esta Ordenanza y resolver sus dudas o lagunas, sin perjuicio del resto de prerrogativas amparadas por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;12. PROCEDIMIENTO PARA LA CONCESIÓN DE LAS LICENCIAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La Alcaldía dictará Decreto que aprobará las Bases donde se concretarán los requisitos, plazos y condiciones de la convocatoria. En todo caso se destinará un lote de parcelas para las personas físicas, y otro para las asociaciones o entidades sociales que tengan su sede o domicilio social en el municipio de Marratxí (las parcelas vacantes de este último lote se pueden acumular en el anterior, pero no al revés).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las Bases se publicarán en el Boletín Oficial de las Islas Baleares, en la página web municipal y en el tablón de anuncios municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Una vez publicadas, las personas interesadas tendrán que presentar las correspondientes solicitudes en el plazo que se fije en la convocatoria. Concluido este plazo, el área que tramite la convocatoria evaluará provisionalmente las solicitudes presentadas y convocará a una comisión municipal de la que formarán parte representantes del Área de Servicios Sociales y de los Servicios Jurídicos Municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Esta comisión realizará una propuesta de adjudicación que será publicada en la página web municipal, con la apertura de un plazo de cinco días para la presentación de alegaciones. En caso de que no se presenten alegaciones, la propuesta será elevada para su aprobación de la adjudicación por Decreto de Alcaldía. En el caso de presentación de alegaciones, éstas serán informadas por la comisión antes de dictar resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La resolución del procedimiento se realizará en el plazo máximo de 3 meses a contar desde la finalización del plazo de presentación de solicitudes. Esta resolución se publicará en la página web municipal y en el tablón de anuncios municipal y expresará la lista de personas beneficiarias y las que quedarán en lista de espera, así como la lista de excluidos con indicación de la causa de exclusión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;13. REQUISITO PARA ACCEDER A LA ADJUDICACIÓN DE LOS HUERTOS URBANOS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Para participar en la convocatoria, las personas interesadas deben cumplir, en la fecha de finalización del plazo de presentación de solicitudes, los siguientes requisitos, en posesión de los cuales deben estar durante todo el proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;a) PERSONAS FÍSICAS con los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Tener al menos 18 años cumplidos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Estar empadronado o empadronada y residir en el municipio de Marratxí y tener las capacidades y aptitudes, tanto físicas como psíquicas, que sean necesarias para desempeñar las funciones atribuidas al huerto urbano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No haber sido privado del uso privativo por el cultivo de los huertos urbanos en el municipio de Marratxí u otras localidades, mediante expediente con resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No disponer del uso de otro huerto municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No estar empadronado con alguien a quien ya se le ha adjudicado el uso de un huerto urbano en el término municipal de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No haber sido persona adjudicataria en la convocatoria anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Formular declaración expresa, en el escrito de formalización de la licencia, que se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;b) ASOCIACIONES O ENTIDADES destinadas a asociaciones o entidades sin ánimo de lucro y que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- El objeto social debe incluir actividades de tipo social, divulgativas, formativas o de sensibilización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Tener domicilio social o sede social en el municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Estar registrada en el Registro Municipal de entidades del municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- No haber sido privada del uso privativo por parte de un huerto urbano, del municipio o de otro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;- Formular declaración expresa, en el escrito de formalización de la licencia, que se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;14. CRITERIOS DE VALORACIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Los criterios de valoración se regularán en las bases de la convocatoria de adjudicación, según las líneas generales que a continuación se indican. Las bases también establecerán la documentación adecuada para acreditar los extremos que se aleguen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;14.1 Personas físicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Se tendrán en cuenta, en todo caso, los siguientes criterios y dentro de los márgenes de puntuación que se contemplan:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;1. Renta de la unidad familiar (máximo de 10 puntos). El Decreto de la convocatoria podrá optar por tener en cuenta sólo los niveles de renta en valor absoluto, o establecer una escala según los miembros de la unidad familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2. Situaciones especiales de renta (1 a 5 puntos por ítem). En los siguientes casos se sumará una puntuación adicional:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2.1. Ser beneficiario de la renta mínima de inserción&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2.2. Estar desempleado sin prestación por desempleo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2.3. Estar parado con prestación por desempleo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2.4. Ser mayor de 65 años o pensionista&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;3. Diversidad funcional (1 a 3 puntos por miembro de la unidad familiar, con un máximo de 6 puntos). Por diversidad funcional física, psíquica o sensorial en la unidad familiar con calificación de discapacidad igual o superior a un 33%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4. Situaciones familiares (1 a 3 puntos por ítem).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4.1. Ser familia numerosa (se podrán otorgar subpuntuaciones según número de hijos)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4.2. Partes múltiples&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4.3. Familia monoparental (un solo progenitor, viudedad o separación y dependen económicamente de un progenitor)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;4.4. Situación de violencia de género&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La adjudicación de las mesas de cultivo a las personas con diversidad funcional, por el contrario, se realizará por riguroso orden de registro de entrada de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;14.2 Asociaciones o entidades sociales sin ánimo de lucro&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La adjudicación de estas parcelas se llevará a cabo por riguroso orden de registro de entrada de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;15. TASAS Y GARANTÍAS&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La autorización para la utilización privativa de los huertos urbanos será gratuita, al no llevar aparejada una utilidad económica para la persona autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Tampoco será necesario presentar o constituir ninguna garantía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;16. LISTAS DE ESPERA Y SU VIGENCIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las personas admitidas que no sean adjudicatarias de ningún huerto permanecerán en una lista de personas suplentes, de acuerdo a la puntuación obtenida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Cuando haya una parcela vacante, debe ofrecerse de acuerdo con el orden estricto de prelación de la lista de espera correspondiente. La notificación debe realizarse por correo electrónico o por vía telefónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Si la persona solicitante a quien se ofrece el cultivo de un huerto no manifiesta en el plazo de tres días la conformidad con la propuesta, se entiende que renuncia al cultivo del huerto urbano y se le excluye del adjudicación, aunque puede continuar en la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En caso de que quede vacía alguna parcela quedará abierto, durante todo el período de licencia, el procedimiento de adjudicación. En este caso, sólo se tendrán que cumplir los requisitos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;17. RÉGIMEN DE RESPONSABILIDAD&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento de Marratxí no se hace responsable de los robos o actos vandálicos que puedan afectar a las personas usuarias, pero se responsabilizará de las reparaciones ocasionadas por tal de mantener el huerto en condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Igualmente, queda exento de cualquier responsabilidad en caso de accidente de la persona adjudicataria o de las personas acompañantes en el desarrollo de las labores de cultivo y en la estancia en el recinto. Correrá a cargo de la persona adjudicataria cualquier responsabilidad por estos conceptos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;DISPOSICIÓN TRANSITORIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Las licencias otorgadas con anterioridad a la entrada en vigor de la presente ordenanza se continuarán regulando por la normativa en vigor en el momento de su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;DISPOSICIÓN DEROGATORIA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Quedan derogadas cuantas disposiciones de igual o inferior rango se opongan, contradigan o resulten incompatibles con lo dispuesto en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;En especial, queda modificado el Reglamento regulador del régimen de uso de huertos urbanos del municipio de Marratxí (BOIB núm. 80, 15/06/2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;DISPOSICIÓN FINAL&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Esta ordenanza entrará en vigor al día siguiente de su publicación y siempre que haya transcurrido el plazo de 15 días a los que se hace mención en los artículos 103 y 113 de la Ley 20/2006 Municipal y de Régimen Local de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
