![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Habiendo transcurrido el plazo de exposición al público del acuerdo de aprobación inicial, por el Pleno que se celebró el pasado 26 de octubre de 2022, de l'Ordenanza reguladora de la tasa para la recojida y tratamiento de residuos sólidos urbanos, contra la que no se ha presentado ninguna alegación, queda elevado a definitivo el acuerdo plenario inicial de aprobación <span style="color:#000000">del</span> texto de la ordenanza que se transcribe íntegramente por el general conocimiento y en cumplimiento de lo dispuesto en el artículo 70.2 de la Ley 7/1985.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Contra esta aprobación definitiva se podrá interponer directamente recurso contencioso-administrativo en el plazo de dos meses a partir del día siguiente de la publicación de este anuncio ante el Juzgado de lo Contencioso Administrativo de Palma de Mallorca, o cualquier otro recurso que se considere pertinente.</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>ORDENANZA REGULADORA DE LA TASA PARA RECOGIDA Y TRATAMIENTO DE RESIDUOS SÓLIDOS URBANOS</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1. Fundamento y naturaleza</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Al amparo de lo previsto en los artículos 57 y 20.3 del texto refundido de la Ley reguladora de las haciendas locales, aprobado por el Real decreto legislativo 2/2004 , de 5 de marzo (en adelante TRLHL), y de conformidad con lo que se dispone en los artículos 15 al 19, este Ayuntamiento establece la tasa para recogida de basura y tratamiento de residuos sólidos urbanos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2. Hecho imponible</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Constituye el hecho imponible de la tasa la prestación de los servicios de recepción obligatoria de recogida de residuos domiciliarios y tratamiento de residuos sólidos urbanos de viviendas, alojamientos y locales o establecimientos donde se ejercen actividades industriales, comerciales, profesionales, artísticas o de servicios.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. A tal efecto, se consideran residuos domiciliarios y residuos sólidos los restos y desechos de alimentación o detritus procedentes de obras, detritus humanos, materias y materiales contaminados, corrosivos, peligrosos o aquellos la recogida o el vertido de los cuales exija la adopción de medidas higiénicas especiales, profilácticas o de seguridad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. No está sujeta a la tasa la prestación, de carácter voluntario y a instancia de parte, de los siguientes servicios:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Recogida de basuras y residuos no calificados domiciliarios y urbanos de industrias, hospitales y laboratorios.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Recogida de desechos y cenizas de calefacciones centrales.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Recogida de escombros y residuos de obras.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 3. Sujetos pasivos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Son sujetos pasivos, en calidad de contribuyentes, las personas físicas y jurídicas, así como las entidades a que se refiere el artículo 35 de la Ley 58/2003, de 17 de enero, General Tributaria (LGT), que resulten beneficiadas o afectadas por los servicios o actividades objeto de esta ordenanza en ocupar o utilizar, por cualquier título (personas propietarias, usufructuarias, arrendatarias, prestatarias, precarias u otros) las viviendas o locales situados en los lugares, plazas, calles o vías públicas en los que se realice el servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Tendrá la consideración de sujeto pasivo sustituto de la persona contribuyente la persona propietaria de las viviendas o locales, que podrá repercutir, en su caso, las cuotas abonadas sobre los las personas usuarias de dichas viviendas o locales, beneficiarias del servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 4. Responsables</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Serán responsables de las deudas tributarias, junto con los deudores principales, las personas o entidades a que se refiere el artículo 41 de la LGT, en los supuestos y con el alcance que allí se señala.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las que se refiere el artículo 42 de la LGT.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Serán responsables subsidiarios las personas o entidades a que se refiere el artículo 43 de la LGT.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 5. Cuota tributaria</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La cuota tributaria consistirá en una cantidad fija, por unidad de local o metro cuadrado, que se determinará en función de la naturaleza y destino de la superficie y lugar donde estén situados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las cuotas señaladas en la tarifa tienen carácter irreducible y corresponden al año natural. En el caso de que el contribuyente realice dos actividades, el gravamen a aplicar será el correspondiente a las dos si se trata de dos actividades susceptibles de generar residuos específicos y sólo una si por su similitud generan el mismo tipo de residuos y en conjunto no se aparta del volumen de residuos generado por la actividad gravada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Si la superficie empleada de los locales correspondientes a los puntos 4, 5, y 6 de los anteriores apartados 2.1. y 2.2. tienen más de 200 m2, en exceso se aplicará un suplemento de 0,28 euros/m2 por basura y 0,14 euros/m2 por tratamiento y eliminación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En los epígrafes 8 y 9 se considerará “superficie empleada” la destinada al servicio de bar o comedor y concretamente, el espacio destinado a bar y comedor (incluyendo el interior de las barras o espacios destinados a camareros), terrazas y los espacios públicos utilizados, pero excluyendo las cocinas cerradas al público, los servicios públicos y los almacenes. Se entenderá que se dedican a terrazas los espacios que, por sus condiciones, no pueden ser utilizados más de 180 días anuales; todos los espacios que estén cerrados en más de un 75% se considerarán como comedores. La superficie de los espacios definidos como terrazas será ponderada con un coeficiente 0,5, por su menor aprovechamiento potencial. Los espacios públicos utilizados serán computados según el uso efectuado durante el año natural anterior y se les aplicará un coeficiente reductor según el número de meses autorizados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Cada predio que se dedique a ganadería o agricultura se considerará como una vivienda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Recogida y tratamiento de basura en suelo rústico:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Los edificios, predios, huertos y viviendas ubicadas en suelo rústico y que pueden tener un uso de vivienda o que generen algún tipo de basura en algún momento, abonarán:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Si están ubicados a menos de 1 km de la ruta habitual del camión de basura, y tienen recogida domiciliaria, tendrán que abonar las tarifas anteriores.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Si no tienen recogida domiciliaria de basura o están ubicados en 1 km o más de la ruta habitual del camión de basura, tendrán que abonar el 50% de la tarifa de basura y la tarifa normal de tratamiento.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Los bares, restaurantes, hoteles rurales, agroturismos y empresas situadas en zonas rústicas se les aplicará las tarifas anteriores con las dos condiciones del apartado 7 a).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 6. Bonificaciones</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Disfrutarán de una bonificación subjetiva del 50% aquellas personas contribuyentes que hayan sido declaradas jubiladas, sean mayores de 65 años o se encuentren inscritas en las oficinas de ocupación en situación legal de paro, siempre que no obtengan ingresos o rentas superiores al salario mínimo interprofesional, y que, en el mismo domicilio, no habiten familiares o personas que obtengan rentas superiores al susodicho salario, y con el visto bueno de los servicios sociales del Ayuntamiento, los cuales pedirán la documentación justificativa que crean conveniente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los grandes generadores de residuos que acrediten mediante certificaciones emitidas por entidades acreditadas y con el visto bueno del técnico municipal que destinan medios en medidas de reciclaje para mejorar la gestión de los residuos de cartón, vidrio, plástico, donde hay que valorar en especial el almacenamiento de cartón dentro de jaulas metálicas aptas para la recogida singular, se les bonificará el 6% de la tasa de tratamiento, el cual el Ayuntamiento abonará a petición del interesado al año siguiente, y después de que hubiera presentado las certificaciones mencionadas más arriba</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 7. Devengo</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Se devenga la tasa y nace la obligación de contribuir desde el momento en el cual se inicie la prestación del servicio, que se entiende iniciada, atendida su naturaleza de la recepción obligatoria, cuando esté establecido y funcione el servicio municipal de recogida domiciliaria de basura en las calles o lugares donde figuren las viviendas o locales utilizados por las personas contribuyentes sujetos a la tasa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Una vez se haya establecido y funcione el mencionado servicio, las cuotas se acreditarán el uno de enero de cada año natural y el periodo impositivo comprenderá el año natural, salvo cuando el inicio o la finalización del uso del servicio se produzca con posterioridad, en los casos que establece esta ordenanza.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Se entenderá que el inicio del uso del servicio se produce con posterioridad al uno de enero únicamente en el supuesto de que la vivienda o local se empiece a utilizar después del día 1 de enero, con independencia que dispongan o no de la licencia de final de obra o de apertura. En cualquier caso, se presumirá que han empezado a ocupar las viviendas o locales que hayan obtenido el final de obra o la licencia de apertura.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 8. Declaración e ingreso</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Dentro de los treinta días hábiles siguientes a la fecha en la cual se devengue por primera vez la tasa, los sujetos pasivos tienen que formalizar su inscripción en matrícula, presentando, al efecto, la correspondiente declaración de alta e ingresando simultáneamente la cuota correspondiente en el primer año natural. Únicamente se prorrateará la cuota de los locales comerciales, que se liquidará por los trimestres naturales; el alta de un solo día ya supone la liquidación del trimestre.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La baja o modificación de cualquier dato del padrón, tanto de la titularidad como del tipo de actividad realizada, tendrá que ser solicitada por el sujeto pasivo, presentando la oportuna declaración, la cual tiene que ser autorizada por resolución de Alcaldía, previo informe de intervención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Si la Administración tiene conocimiento de la existencia de una vivienda o local nuevo o que haya experimentado cambios en relación al padrón, procederá a alterar el padrón y lo notificará al sujeto pasivo, con independencia del expediente sancionador que se pueda tramitar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Las bajas y modificaciones del padrón tendrán efectos a partir del periodo de cobro siguiente al de la fecha en la cual se haya realizado la declaración, excepto en el caso de actividades económicas, que se pueden prorratear por trimestres naturales, a solicitud de sujeto pasivo, si en el mismo local se realiza otra actividad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El cobro de las cuotas se realizará anualmente mediante un recibo derivado de la matrícula en el periodo comprendido entre el día 1 de junio y el 15 de agosto.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 9. Infracciones y sanciones</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Todo cuánto sea relativo a la calificación de infracciones tributarias y a las sanciones que les correspondan en cada caso, se regirá por lo establecido en la Ley general tributaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición Adicional</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Los contribuyentes podrán solicitar el aplazamiento o el fraccionamiento de la cuota tributaria de este impuesto sin intereses.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La solicitud sólo se podrá realizar dentro del periodo voluntario del pago del impuesto y no se podrá alargar más allá del 20 de diciembre del año natural. El importe mínimo del aplazamiento o de cada uno de los fraccionamientos no puede ser inferior a 100 € y su pago se tiene que realizar mediante orden de domiciliación en cuenta. La persona solicitante no puede tener deudas tributarias con el Ayuntamiento en periodo ejecutivo, excepto si han sido fraccionadas o aplazadas. En caso contrario, se aplicarán intereses de demora en los términos establecidos en la Ley General Tributaria y el Reglamento General de Recaudación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La solicitud tendrá que identificar claramente la persona contribuyente, la cuota tributaria que se quiere aplazar o fraccionar y los plazos en que quiere pagar, los cuales tienen que coincidir con los días 5 o 20 de cada mes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.
