![CDATA[<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La Ley orgánica 2/2006, de 3 de mayo, de educación, dispone en el apartado 4 del artículo 69 que las administraciones educativas, en el ámbito de sus competencias, organizarán periódicamente pruebas para los mayores de veinte años para obtener directamente el título de Bachiller.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012 por la que se regula la prueba libre para obtener el título de Bachiller dirigida a las personas mayores de veinte años en el ámbito territorial de las Illes Balears, modificada por el Orden de 27 de febrero de 2018, establece en el apartado 1 del artículo 3 que se dictará, cada curso académico, una resolución para convocar la prueba para obtener el título de Bachiller para las personas de más de veinte años. El apartado 2 del artículo 3 determina que la resolución de convocatoria fijará el plazo de inscripción, el calendario de la prueba, los centros educativos donde debe realizarse, el horario y la duración de los ejercicios y cualquier otra cuestión que se considere necesaria para que esta se lleve a cabo. El apartado 3 del artículo 3 determina que la resolución de convocatoria informará de los criterios de calificación de cada una de las materias, así como del material necesario para hacer los ejercicios.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Actualmente, y según lo que dispone el Decreto 21/2019, de 2 de agosto, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2019, de 2 de julio, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, la Dirección General de Planificación, Ordenación y Centros tiene la competencia con respecto a la prueba libre de Bachillerato.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><span style="color:black">El Estatuto de Autonomía de las Illes Balears, aprobado por la Ley Orgánica 1/2007, de 28 de febrero, establece en el artículo 35 la competencia exclusiva de la Comunidad Autónoma de las Illes Balears en cuanto a la enseñanza de la lengua catalana, propia de las Illes Balears, y en el apartado 2 del artículo 36, la competencia en el desarrollo legislativo y la ejecución de la enseñanza en toda su extensión, niveles y grados, modalidades y especialidades.</span></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><span style="color:black">Por todo ello, y en virtud de lo que se establece en el apartado 2 del artículo 36 del Estatuto de Autonomía de las Illes Balears y en la Disposición Final Primera de la Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012, dicto la siguiente</span></span></span></span></p>

<p style="text-align:center"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>Resolución</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><span style="color:black"><strong>Primero</strong></span></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Aprobar la convocatoria y las instrucciones para el año 2023 de la prueba libre dirigida a las personas mayores de veinte años para obtener el título de Bachiller en la Comunidad Autónoma de las Illes Balears y concretar los aspectos organizativos, de acuerdo con el anexo 1 de esta Resolución.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>Segundo</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Aprobar los contenidos, la estructura y los criterios de calificación de los diferentes ejercicios de la prueba e informar del material necesario para llevarlos a cabo, de acuerdo con el anexo 2 de esta Resolución.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>Tercero</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><span style="color:black">Aprobar los modelos de documentos establecidos en los anexos 3, 4 y 5 de esta Resolución.</span></span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>Interposición de recursos</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante el consejero de Educación y Formación Profesional en el plazo de un mes a contar desde el día siguiente al de su publicación en el <em>Boletín Oficial de las Illes Balears</em>, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las administraciones públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Estas instrucciones tienen por objeto convocar y regular, para el año 2023, la prueba libre para que las personas de más de veinte años puedan obtener el título de Bachiller en la Comunidad Autónoma de las Illes Balears y concretar los aspectos organizativos de esta prueba.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>2. Modalidades convocadas</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Se convoca la prueba según las modalidades siguientes:</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>4. Materias de la prueba</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Las materias de Bachillerato correspondientes a esta convocatoria son las especificadas en el anexo 1 de la Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012, modificada por la Orden del consejero de Educación y Universidad de 27 de febrero de 2018.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>5. Requisitos de las personas participantes</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Pueden participar en esta prueba todas las personas que acrediten los requisitos que se especifican en el artículo 5 de la Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012, modificada por la Orden del consejero de Educación y Universidad de 27 de febrero de 2018.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>6. Tasa y plazo de presentación de las solicitudes de inscripción</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. La inscripción a la prueba de esta convocatoria no está sometida al pago de ninguna tasa.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. El plazo de inscripción es del 13 de febrero al 24 de febrero de 2022, ambos incluidos.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">3. La solicitud de inscripción a la prueba debe realizarse únicamente mediante el modelo oficial que aparece en el anexo 5 de esta Resolución.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">4. La solicitud de inscripción, con la documentación requerida, se puede presentar de forma telemática, de acuerdo con las indicaciones que se publicaran en la página web del Servicio de Ordenación Educativa.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Igualmente, se puede presentar por duplicado, en los lugares siguientes:</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">En este caso, uno de los ejemplares de la solicitud debe permanecer en el lugar donde se hace la inscripción y el otro devolverse a la persona interesada.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">5. La inscripción se realizará por materias, desde un mínimo de una hasta un máximo de siete.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>7. Documentación que debe presentarse en el momento de la inscripción</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. La solicitud de inscripción se acompañará de la siguiente documentación:</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Una declaración responsable de no estar matriculado en enseñanzas oficiales de Bachillerato y de no tener el título de Bachiller (anexo 4 de esta Resolución).</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. Asimismo, en el caso de equivalencias, exenciones y adaptaciones de acceso, se adjuntará, según corresponda, la documentación siguiente:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">a) Un certificado oficial acreditativo de la evaluación positiva de las materias superadas anteriormente, siempre que estas no figuren en el GestIB. En caso de que no se haya solicitado el reconocimiento de materias superadas con anterioridad, se entenderá que la persona inscrita renuncia a la calificación anterior para esta convocatoria.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">b) Un certificado de discapacidad, expedido por el organismo oficial competente.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>8. Publicación de las listas de aspirantes admitidos y excluidos</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. Una vez haya finalizado el plazo de presentación de solicitudes, y dentro de los seis días hábiles siguientes, se publicará en la web del Servicio de Ordenación Educativa la relación provisional de todas las personas que se han inscrito en la prueba, con la indicación de si están admitidas o excluidas. En este ultimo cas, se debe especificar el motivo de exclusión.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La dirección de cada centro donde se realizará la prueba también publicará en el tablón de anuncios la relación provisional de admitidos y excluidos.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. En la relación de personas inscritas se harán constar las materias de las que los aspirantes han manifestado la voluntad de examinarse.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">3. En el caso de las personas que lo hayan solicitado, asimismo se hará constar la siguiente información:</span></span></span></p>
<ol style="list-style-type:lower-alpha">
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Las materias superadas anteriormente. </span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La exención del ejercicio de lengua catalana y literatura II o la solicitud de esta exención.</span></span></span></p>
</li>
</ol>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">4. Las personas solicitantes disponen de un plazo máximo de tres días hábiles, contadores desde el día hábil siguiente al de la publicación de las listas provisionales, para subsanar las deficiencias que hayan motivado la exclusión.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">5. El Servicio de Ordenación Educativa publicará en su página web, i la dirección de cada centro en el tablón de anuncios, la relación definitiva de personas admitidas y excluidas en un plazo máximo de tres días hábiles contadores a partir de la finalización de este plazo de subsanación.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>9. Fechas de la prueba</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La prueba tendrá lugar los días 28, 29 y 30 de marzo de 2022.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>10. Organización horaria</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. Una vez finalizado el plazo de inscripción, la Consejería de Educación y Formación Profesional publicará la distribución horaria de los ejercicios de las diferentes materias en la página web del Servicio de Ordenación Educativa de la Dirección General de Planificación, Ordenación y Centros. Este documento también se hará público en el tablón de anuncios de los centros donde se realizará la prueba.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. Cada ejercicio tiene una duración de 90 minutos. Habrá un descanso de 30 minutos entre los ejercicios. Los ejercicios se desarrollarán entre las 15.00 y las 21.30 horas.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>11. Normas de ejecución</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La prueba se llevará a cabo de acuerdo con las siguientes indicaciones:</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. Los participantes acreditarán su identidad mediante el Documento Nacional de Identidad, el NIE o el pasaporte.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. Los presidentes de los tribunales tomarán las decisiones oportunas para asegurar el desarrollo adecuado de la prueba y resolver cualquier incidencia. Se contará con el apoyo de la Consejería de Educación y Formación Profesional.</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>12. Tribunales</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La constitución, la composición y el nombramiento de los tribunales se regirán por el artículo 9 de la Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012, modificada por la Orden del consejero de Educación y Universidad de 27 de febrero de 2018.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>13. Estructura de la prueba y contenidos</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">1. La prueba debe organizarse de forma diferenciada según las modalidades de Bachillerato.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">2. La prueba consta de un ejercicio para cada una de las materias a las que hace referencia el anexo 1 de la Orden del consejero de Educación, Cultura y Universidades de 29 de noviembre de 2012, modificada por la Orden del consejero de Educación y Universidad de 27 de febrero de 2018.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>14. Materias superadas anteriormente</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Pueden tener la consideración de materias superadas anteriormente: </span></span></span></p>
<ol style="list-style-type:lower-alpha">
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Únicamente las materias superadas mediante la prueba libre realizada en las Illes Balears en convocatorias anteriores.</span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Las materias superadas en estudios anteriores que sean equivalentes, según la normativa vigente, a materias del segundo curso del Bachillerato actual.</span></span></span></p>
</li>
</ol>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>15. Reclamaciones</strong></span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Los participantes pueden presentar una reclamación si consideran incorrecta la aplicación de los criterios de evaluación y de calificación. Las reclamaciones, dirigidas al tribunal, deben presentarse por correo electrónico al Servicio de Ordenación Educativa (ordenacio@dgplacen.caib.es) dentro de los tres días hábiles posteriores a la publicación de las calificaciones, y deben argumentarse las razones que motivan la reclamación. A este efecto, se utilizará el modelo que figura en el anexo 3 de esta Resolución.</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Los tribunales, en los dos días hábiles siguientes a la recepción de las reclamaciones, realizarán una sesión de evaluación extraordinaria para resolver las reclamaciones presentadas. En caso necesario, se puede contar con asesores especialistas que no formen parte del tribunal. La decisión tomada por el tribunal se comunicará a la persona interesada en un plazo máximo de tres días hábiles. Si las decisiones modifican las calificaciones, estas modificaciones deben trasladarse al acta definitiva, que se publicará dentro del mismo plazo en la página web del Servicio de Ordenación Educativa i en el tablón de anuncios de los centros donde se ha realizado la prueba.</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Contra las resoluciones de los tribunales, se puede interponer un recurso de alzada ante el Director General de Planificación, Ordenación y Centros en el plazo de un mes contador desde la comunicación de la resolución de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></span></span></p>

<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>16. Certificaciones</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Los secretarios de los centros donde se ha desarrollado la prueba expedirán, si así lo solicita el aspirante, un certificado de acuerdo con el acta de evaluación de la prueba libre. En este certificado constará una relación de todas las materias, superadas y no superadas.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Si los aspirantes no superan todas las materias, pero aprueban alguna, mantienen las calificaciones para convocatorias posteriores.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>17. Propuesta de título</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">Los aspirantes que tengan todas las materias de la prueba superadas cumplen las condiciones para obtener el título de Bachiller y lo pueden solicitar en la secretaría del centro donde se ha hecho la prueba. Estos centros son los encargados de enviar las propuestas de titulación a la Dirección General de Planificación, Ordenación y Centros.</span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal"><strong>18. Información para los centros donde se organiza la prueba</strong></span></span></span></p>
<p><span style="font-size:12px"><span style="font-family:Times New Roman,Times,serif"><span style="line-height:normal">La Consejería de Educación y Formación Profesional debe elaborar un calendario de actuaciones para que los centros educativos puedan hacer la prueba de conformidad con esta Resolución, que se enviará directamente a los centros implicados.</span></span></span></p>
