    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que en el marco de la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público, las administraciones tienen por objetivo la estabilización de las plazas estructurales que han sido ocupadas de forma ininterrumpida desde las fechas establecidas por esta normativa. En este sentido, el Instituto Menorquín de Estudios mediante Decreto de Presidencia núm. 07/2022, de fecha 17/05/2022 aprueba la oferta pública por la estabilización extraordinaria, que se ha ratificado por el Consejo Rector el 27 de octubre de 2022, y publicada la Oferta Pública en el BOIB núm. 67 de fecha 24 de mayo de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que de este mandato legislativo, y con el objetivo de fijar los criterios comunes y facilitar la coordinación de estos procesos, desde la Comunidad Autónoma de las Islas Baleares se impulsó la creación de la Mesa de Negociación de las administraciones públicas, mediante el Decreto Ley 2/2022, de 7 de febrero, por el que se establecen medidas urgentes para la reducción de la temporalidad en el empleo público en las Islas Baleares. En la Mesa de Negociación formó parte el Consejo Insular de Menorca en su nombre y de sus entes dependientes, como lo es el Instituto Menorquín de Estudios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que el Gobierno Balear mediante el Decreto Ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en la ocupación de las Islas Baleares, publicado en el BOIB núm. 78 de fecha 16 de junio de 2022, aprueba las bases generales con los criterios generales que deben regir los procesos selectivos de estabilización para el ingreso o el acceso como funcionario de carrera o personal laboral fijo de las administraciones insulares y locales de las Islas Baleares. En concreto en el art. 1.4 de este Decreto Ley incluye dentro de su ámbito de aplicación a la Administración autonómica, las administraciones insulares y locales de las Islas Baleares y en las entidades que integran el sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que en fecha 11 de noviembre de 2021 mediante Decreto de Presidencia núm. 20/2022, se aprueba la convocatoria de las plazas de la Oferta Pública para estabilización extraordinaria, publicado en el BOIB núm. 149 de fecha 18/11/2022, donde se han detectado unos errores materiales en relación con el nivel de catalán y la titulación requerida de la plaza de Técnico/a investigador/a. De acuerdo con el catálogo aprobado por el Pleno del Consejo Insular de Menorca en sesión ordinaria de 18 de abril de 2016, por el que se aprueba inicialmente la modificación puntual de la plantilla del Instituto Menorquín de Estudios y de su catálogo de puestos de trabajo, y publicada la aprobación definitiva en el BOIB núm. 109 de fecha 27 de agosto de 2016, donde consta que el nivel de catalán del Técnico/a investigador/a &lt;strong&gt;es C1&lt;/strong&gt; y la&lt;strong&gt; titulación requerida es de Titulaciones superiores o de grado equivalente relacionadas con el medio ambiente y/u otras disciplinas científico-técnicas y /o sociales.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Que en aplicación de lo establecido en el art. 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, que dice: «las administraciones públicas pueden rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Visto el acuerdo del Consejo Rector del IME de fecha 18 de junio de 2010 ( BOIB núm. 149, de fecha 16.10.2010), por el cual se delegan en esta presidencia determinadas competencias en materia de personal, entre las que se incluyen expresamente la adopción de las resoluciones que sean necesarias en relación con los procedimientos para la selección de nuevo personal, de acuerdo con las bases aprobadas por el Consejo Rector y demás competencias que corresponden al Consejo Rector en materia de personal que en el ámbito de las corporaciones locales correspondan a la presidencia de las entidades locales y tengan carácter de delegables, conforme a esta normativa y que no sean atribuidas expresamente a otros órganos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Teniendo en cuenta que la normativa básica de régimen local reconoce a los presidentes de las corporaciones la competencia para aprobar las ofertas públicas de empleo con carácter de delegable (artículos 21.1 g, 21.3, 34.1 g y 34..2 de la Ley 7/1985 , de 2 de abril, reguladora de las bases del régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo lo anterior, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
