    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que el Pleno del Ayuntamiento en sesión ordinaria celebrado el 27 de setiembre de 2022 aprobó provisionalmente la ordenanza fiscal, publicándose el anuncio en el BOIB número 128 de día 1 de octubre de 2022, i dado que no se han presentado reclamaciones contra dicho acuerdo durante el plazo de exposición pública, en virtud del artículo 17.4 del Real Decreto legislativo de 5 de marzo, en el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, se publica el texto íntegro de la ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA FISCAL REGULADORA DE LA TASA POR LA PRESTACIÓN DEL SERVICIO DE RECOGIDA Y TRASLADO DE ANIMALES Y SU CUSTODIA. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 1º. Fundamento y Naturaleza.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En uso de las facultades concedidas por los artículos 133.2. y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases del Régimen Local, y de conformidad con lo dispuesto en los artículos 15 a 20 del RDL 2/2004 del texto refundido de la LRHL, este Ayuntamiento establece “ la Tasa por la prestación del servicio de recogida y traslado de animales y su custodia", que se regirá por la presente Ordenanza Fiscal, cuyas normas atienden a lo prevenido en el artículo 57 del citado RDL 2/2004.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 2º. Hecho imponible.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituye el hecho imponible de la Tasa el uso, la realización de actividades y la prestación del servicio de recogida y traslado de animales, vivos o muertos, y su custodia &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 3º. Sujeto pasivo.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Son sujetos pasivos contribuyentes las personas físicas o jurídicas y las entidades a que se refiere el artículo 35.4 de la Ley 58/2003 General Tributaria que soliciten o resulten beneficiadas por la prestación del servicio o la realización de actividades de recogida y traslado de animales, vivos o muertos, y su custodia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 4º.- Responsables.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas o jurídicas a que se refiere el artículo 42 de la Ley 58/2003 General Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general en los supuestos y con el alcance que señala el artículo 43 de la Ley 58/2003 General Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 5º. Cuota tributaria.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La cuota tributaria regulada en esta Ordenanza serán las siguientes tarifas para cada uno de los distintos servicios o actividades:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;a) Recogida de animales, vivos o muertos, hasta un máximo de 8 unidades: 35,70 €/por servicio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Manutención de animales: 2,20 €/unidad y día.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Por traslado de animal a planta incineradora de Son Reus 21,90 €/unidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Servicios de asistencia veterinaria&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Vacunación antirrábica 22,13 €/unidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) Implantación microchip 33,25 €/unidad &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) Pasaporte 9,00 €/unidad &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4) Gastos de gestión por cambios de persona propietaria en el Registro de Identificación de Animales de Compañía de las Islas Baleares 10,00 €/unidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Eutanasia de animales&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Hasta 15 kg. 30,00 €/unidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) Más de 15 kg. 40,00 €/unidad &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Cesión de animales a la perrera municipal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Hasta 15 kg. 47,60 €/unidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) Más de 15 kg. 57,60 €/unidad &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) Camadas (camadas del mismo parto de al menos 40 dias) 61,60 €/unidad &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;g) Adopción de animales. Deberán abonar una tarifa única en concepto de implantación microchip, vacunación antirrábica y pasaporte más los gastos de estancia y administración. 64,38 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 6º. Devengo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se devenga la Tasa y nace la obligación de contribuir desde el momento en que se inicie la prestación del servicio&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo 8º.- Liquidación e ingreso.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta Tasa se liquidará en el momento de prestar el servicio. El INGRESO de las cuantías que se relacionan será SIMULTÁNEO a la solicitud del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El LUGAR DE INGRESO será en la cuenta corriente de la Entidad Bancaria que a continuación se relaciona abierta a nombre del Ayuntamiento de Llucmajor: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#4f81bd"&gt;&lt;span style="color:#000000"&gt;(aquellas entidades que suscriban el convenio cuaderno 60) &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Disposición adicional.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las referencias al articulado de la presente ordenanza, deberán entenderse sin perjuicio de que hayan podido ser modificadas por normativa posterior a su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#365f91"&gt;&lt;span style="color:#000000"&gt;Disposición derogatoria &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La presente ordenanza fiscal deroga la ordenanza fiscal reguladora de la tasa por la prestación del servicio de recogida y traslado de animales y su custòdia publicada en el BOIB numero 139 de 3 de noviembre de 2016.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La presente ordenanza fiscal entrará en vigor el mismo día de su publicación en el Boletín Oficial de las Islas Baleares i permanecerá en vigor hasta su modificación o derogación expresa.&lt;/span&gt;&lt;/p&gt;
