    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El Pleno del Consejo de Mallorca, en sesión ordinaria de día 10 de noviembre de 2022, ha adoptado el Acuerdo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 31 de diciembre de 1998 se publicó en el BOCAIB núm. 167 ext. la ordenanza reguladora del precio público por prestación de servicios y realización de actividades en las instalaciones deportivas y culturales del Consejo. Esta ordenanza se ha modificado en varias ocasiones, que se han publicado en el BOIB nº. 156 de 29 de diciembre de 2001, en el BOIB núm. 49 ext. de 9 de abril de 2003, en el BOIB núm. 97 de 11 de julio de 2006, en el BOIB núm105 de 18 de agosto de 2016, en el BOIB núm. 80 de 1 de julio de 2017 y finalmente en el BOIB núm. 55 de 27 de abril de 2021.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En fecha 27 de septiembre de 2022 el consejero ejecutivo de Hacienda y Función Pública adjudicó el contrato de obra para la construcción de cuatro pistas de pádel en el polideportivo de Sant Ferran con un plazo de ejecución de dos meses.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El técnico de deportes ha informado sobre la necesidad de modificar la ordenanza reguladora de los precios públicos por prestación de servicios y realización de actividades en las instalaciones deportivas del Consejo de Mallorca, dado que se ha aprobado una reestructuración de la instalación deportiva consistente en la ejecución de cuatro pistas de pádel en el sitio donde se ubican las pistas polideportivas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En fecha 19 de septiembre de 2022, el consejero ejecutivo de Transición, Turismo y Deportes dictó resolución por la que se iniciaba el expediente para modificar la ordenanza reguladora de los precios públicos por prestación de servicios y realización de actividades en las instalaciones deportivas del Consejo de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El expediente cuenta con la memoria económica por la inclusión de los precios públicos nuevos por el alquiler de las pistas de pádel, elaborada por el técnico de Deportes en septiembre de 2022, así como con la memoria abreviada de impacto normativo, elaborada por la jefa de Sección Jurídica de la Dirección Insular de Deportes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Visto el informe jurídico de la jefa de Sección Jurídica de la Dirección Insular de Deportes con la nota de conformidad de la Secretaría General del Consejo de Mallorca de fecha 11 de octubre de 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Estatuto de Autonomía de las Islas Baleares en la redacción dada por la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares, atribuye como competencias propias de los consejos insulares la materia del deporte y ocio así como el fomento y la promoción de las actividades deportivas y de ocio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El artículo 10 del Decreto de Organización del Consejo de Mallorca vigente adscribe al Departamento de Transición, Turismo y Deportes la instalación del Polideportivo de Sant Ferran.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. De acuerdo con el artículo 148 del Real decreto legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley reguladora de las haciendas locales (TRLHL), los Consejos Insulares pueden establecer y exigir precios públicos por la prestación de servicios o la realización de actividades de su competencia, según las normas incluidas en el capítulo VI del título I del citado texto refundido (artículos 41 a 47 (TRLRHL).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Los artículos 49 y 108 de la Ley 7/85, de 2 de abril, reguladora de las bases de régimen local (LRBRL).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Artículos 101 a 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Visto el artículo 17.1 m) de la Ley 4/2022, de 28 de junio, de Consejos Insulares, corresponde al Pleno de la institución el establecimiento de precios públicos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Vista la instrucción sobre la elaboración y tramitación de disposiciones generales de carácter no tributario, aprobada por el Consejo Ejecutivo de 6 de junio de 2018, modificada por acuerdo del Consejo Ejecutivo de 26 de febrero de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo lo expuesto, el consejero ejecutivo de Transición, Turismo y Deportes eleva al Pleno del Consejo de Mallorca, previo dictamen de la Comisión Informativa General y de Cuentas, el siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;ACUERDO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar inicialmente la modificación de la ordenanza reguladora de los precios públicos por prestación de servicios y realización de actividades en las instalaciones deportivas del Consejo de Mallorca, para incluir los precios públicos del alquiler de las pistas de pádel. Así, la modificación consiste en:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el artículo 4, en los puntos que incluyen el concepto Pista polideportiva:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2. Pista polideportiva:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2.1. Sin luz: 20,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2.2. Con luz: 22,00 €/hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2 Pista polideportiva:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2.1. Sin luz: 6,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2.2. Con luz: 6,60 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2.2. Con luz: 6,60 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se sustituyen por:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2. Pista de pádel:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2.1. Sin luz: 13,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.2.2. Con luz: 16,00 €/hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2.1. Sin luz: 8,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.2.2. Con luz: 11,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2 Pista pádel:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2.1. Sin luz: 3,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.2.2. Con luz: 6,00 €/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El texto de la Ordenanza con la modificación, se adjunta a este Acuerdo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Someter el expediente a información pública mediante la inserción de los anuncios correspondientes en el tablón de anuncios del Consejo de Mallorca, y en el Boletín Oficial de las Illes Balears, con el fin de que todas las personas que estén interesadas puedan examinarlo y presentar las reclamaciones que consideren pertinentes, dentro del plazo de treinta días hábiles, a contar desde la inserción del anuncio correspondiente en el boletín.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ordenar que se lleven a cabo el resto de los trámites correspondientes por la aprobación definitiva de la Ordenanza, incluida la solicitud de los dictámenes preceptivos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se puede consultar el expediente y el texto de la Ordenanza reguladora del precio público por prestación de servicios y realización de actividades en las instalaciones deportivas y culturales del Consejo de Mallorca en la sede electrónica del Consejo de Mallorca (https:/ /seu.conselldemallorca.net)&lt;/span&gt;&lt;/p&gt;

En caso de que no se presenten reclamaciones, el acuerdo inicialmente adoptado se entenderá definitivamente aprobado sin necesidad de nuevo acuerdo plenario y se publicará el texto íntegro de la Ordenanza en el Boletín Oficial de las Illes Balears.”&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Artículo 1&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;De acuerdo con lo previsto en el artículo 41 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, el Consejo de Mallorca establece los precios públicos por prestación de servicios y realización de actividades –especificando en las tarifas contenidas en el artículo cuarto– en instalaciones deportivas del Consejo, que se rige por esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Hecho imponible&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El hecho imponible de los precios públicos es la prestación de servicios y realización de actividades en las instalaciones deportivas del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Sujeto pasivo&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El sujeto pasivo son las personas que se beneficien de los servicios o actividades realizadas o prestadas por el Consejo Insular de Mallorca a que se refiere el apartado anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Devengo y pago&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El precio público se devenga en el momento en que se solicita la utilización de la instalación o en el momento de la inscripción en las actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El pago del precio público debe realizarse mediante ingreso, transferencia bancaria o mediante tarjeta de crédito, de acuerdo con los documentos de ingreso facilitados por el Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El pago debe realizarse antes de utilizar la instalación o en el momento de la inscripción a las actividades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Pago de forma mensual a mes vencido&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El pago del precio público por la utilización de instalaciones del polideportivo por centros de enseñanza de primaria o secundaria para la realización de clases de educación física de forma regular correspondientes a la enseñanza formal, se realizará de forma mensual en mes vencido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, las personas físicas o jurídicas, públicas o privadas que utilicen las instalaciones del polideportivo de forma regular abonarán el precio público de forma mensual a mes vencido.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se entiende por personas usuarias regulares las personas físicas o jurídicas, públicas o privadas, que tienen reservada una instalación determinada del polideportivo de forma continuada, en horarios y días fijos, durante un período de al menos dos meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Devolución de ingresos indebidos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se producirá la devolución de ingresos efectuados por las personas usuarias de las instalaciones y/o servicios del Polideportivo Sant Ferran cuando una vez abonado el precio público correspondiente las personas interesadas no puedan disfrutar del uso de las instalaciones o del servicio por el que se ha abonado el precio público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Asimismo debe tramitarse la devolución de ingresos efectuados por personas usuarias cuando por error estos abonan por duplicado un pago o bien cuando se hace por error un pago superior al precio a abonar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El expediente de devolución de ingresos se iniciará de oficio o a instancia de las personas interesadas y debe contener al menos la documentación que acredite los siguientes aspectos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Documentación acreditativa del pago o pagos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;• Identificación de la persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;• Informe del departamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Artículo 3 &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Procedimiento de solicitud de las instalaciones&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El uso continuado durante la temporada escolar se regulará siguiendo esta temporalización:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Del 2 de mayo al 15 de mayo. Presentación de solicitud de renovación anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Del 1 de junio al 15 de junio. Presentación de nuevas solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cualquier momento del año se admitirán solicitudes de reserva de instalaciones de uso puntual, de uso no continuado (por una duración inferior al mes) y de uso continuado (por una duración superior al mes).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Tanto las reservas para usos no continuados como por uso continuado se formalizan una vez recibido el ingreso del 10% de la totalidad de la reserva, hasta un máximo de 250 € como garantía, que debe abonarse en un plazo no superior a 5 días a partir de la confirmación de la reserva por parte del Consejo de Mallorca. La falta de pago de esta garantía en el plazo fijado puede suponer perder la reserva de espacio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Las federaciones deportivas de las Illes Balears, las asociaciones sin ánimo de lucro, los clubes deportivos inscritos en el Registro de asociaciones deportivas del Gobierno de las Illes Balears, los centros de educación especial así como los centros de enseñanza públicos, privados y concertados de primaria o secundaria para la realización de actividades fuera del horario escolar abonarán los precios públicos, que se detallan a continuación por el alquiler de los espacios deportivos:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Precios públicos para las actividades deportivas organizadas por el Consejo de Mallorca para personas con discapacidad, con graves dificultades económicas, familias numerosas y monoparentales y personas de 65 años o más.&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1 Familias monoparentales&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se entiende por familia monoparental la constituida por un solo progenitor con el que conviven los hijos e hijas nacidos o adoptados, que constituyen su único sostén. Este aspecto se acreditará por la persona interesada en el momento de abonar el correspondiente precio público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se aplicarán los precios públicos relacionados en este artículo al progenitor o progenitora y a los hijos e hijas menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2 Familias numerosas&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sólo se aplicarán estos precios a los progenitores ya los hijos menores de 18 años. Este extremo acreditará por el interesado aportando el carnet de familia numerosa en el momento de inscripción en la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.3 Personas con discapacidad&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La acreditación de la discapacidad se realizará mediante la presentación de certificado o carné emitido por el órgano competente en el momento de inscripción en la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.4 Personas con graves dificultades económicas&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Se consideran personas con graves dificultades económicas las que forman parte de una unidad familiar en la que la suma de los ingresos de todos sus miembros dividido por el número de miembros, es igual o inferior al importe del IPREM fijado para el año que se trate.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Este extremo acreditará por el interesado aportando la documentación relativa a la última declaración de IRPF de que se disponga en el momento de inscripción en la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.5. Natación&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.1. Natación persona adulta (tres días/semana) (a partir de 16 años): 19,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.2. Natación persona adulta (dos días/semana) (a partir de 16 años) 14,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.3. Natación infantil (tres días/semana) (de 3 a 16 años): 19,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.4. Natación infantil (dos días/semana) (de 3 a 16 años): 14,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.5. Natación bebés (tres días/semana) (hasta 3 años): 21,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.5.6. Natación bebés (dos días/semana) (hasta 3 años): 20,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.6 Acondicionamiento físico por persona adulta (mayores de 16 años) dos días/semana: 10,00 €/mes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5.7 Estancias deportivas de verano&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5.7.1. 34,50 €/semana&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5.8 Estancia deportiva de pascua/navidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;5.8.1. 35,50 €/semana&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Utilización de instalaciones del polideportivo por centros de enseñanza públicos, privados y concertados de primaria o secundaria para la realización de clases de educación física de forma periódica correspondientes a la enseñanza formal&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Precio público: 0,50 euros/alumno/hora&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. En caso de que, de acuerdo con lo establecido en esta ordenanza se puedan derivar varios precios públicos, se aplicará el que sea más beneficioso para el usuario.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Disposición Final&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta Ordenanza entrará en vigor quince días hábiles después de su publicación en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
