es text/html 2022-11-26 CAIB 667076 48793 700039 2022-11-25 es CAIB 110 CAIB 48791 ![CDATA[<p><span style="line-height:1"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Visto que el Pleno del Ayuntamiento en sesión ordinaria celebrado el 27 de setiembre de 2022 aprobó provisionalmente la ordenanza fiscal, publicándose el anuncio en el BOIB número 128 de día 1 de octubre de 2022, i dado que no se han presentado reclamaciones contra dicho acuerdo durante el plazo de exposición pública, en virtud del artículo 17.4 del Real Decreto legislativo de 5 de marzo, en el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, se publica el texto íntegro de la ordenanza.</span></span></p> <p style="text-align:center"><span style="line-height:1"><strong>ORDENANZA FISCAL REGULADORA DE LA TASA POR EXPEDICIÓN DE DOCUMENTOS ADMINISTRATIVOS</strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 1º. Fundamento y Naturaleza.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y de conformidad con lo dispuesto en los artículos 15 a 20 del RDL 2/2004 del texto refundido de la LRHL, este Ayuntamiento establece la Tasa por expedición de documentos administrativos, que se regirá por la presente Ordenanza Fiscal, cuyas normas atienden a lo prevenido en el artículo 57 del citado RDL 2/2004.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 2º. Hecho imponible.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Constituye el hecho imponible de la Tasa la realización de la actividad administrativa de competencia local desarrollada con motivo de la tramitación, a instancia de parte, de toda clase de documentos que expida y de expedientes de que entienda la Administración o las Autoridades Municipales.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. A estos efectos, se entenderá tramitada a instancia de parte cualquier documentación administrativa que haya sido provocada por el particular o redunde en su beneficio aunque no haya mediado solicitud expresa del interesado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. No estará sujeta a esta Tasa la tramitación de documentos y expedientes necesarios para el cumplimiento de obligaciones fiscales, así como las consultas tributarias, los expedientes de devolución de ingresos indebidos, los recursos administrativos contra resoluciones municipales de cualquier índole y los relativos a la prestación de servicios o realización de actividades de competencia municipal y a la utilización privativa o el aprovechamiento especial de bienes del dominio público municipal, que estén gravados por otra Tasa Municipal o por los que se exija un precio público por este Ayuntamiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 3º. Sujeto pasivo.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Son sujetos pasivos contribuyentes las personas físicas y jurídicas y las entidades a que se refiere el artículo 35.4 de la Ley 58/2003 General Tributaria que soliciten o resulten beneficiados o afectados por los servicios o actividades que preste o realice esta Entidad Local.</span></span></p> <p><strong>Artículo 4º. Responsables.</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a que se refiere el artículo 42 de la Ley 58/2003 General Tributaria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con el alcance que señala el artículo 43 de la Ley 58/2003 General Tributaria.</span></span></p> <p><strong>Artículo 5º. Cuota tributaria.</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La cuota tributaria se determinará por una cantidad fija señalada según la naturaleza de los documentos o expedientes a tramitar, de acuerdo con la Tarifa que contiene el artículo siguiente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La cuota de Tarifa corresponde a la tramitación completa, en cada instancia, del documento o expediente de que se trate, desde su iniciación hasta su resolución final, incluido la certificación y notificación al interesado del acuerdo recaído.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las cuotas resultantes por aplicación de las anteriores tarifas se incrementarán en un 50 por 100 cuando los interesados solicitasen con carácter de urgencia la tramitación de los expedientes que motivasen el devengo.</span></span></p> <p><strong>Artículo 6º. Tarifa.</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Tarifa a que se refiere el artículo anterior se estructura en los siguientes epígrafes:</span></span></p> <p style="margin-bottom:0px; El INGRESO de las cuantías devengadas será SIMULTÁNEO a la solicitud del servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El LUGAR DE INGRESO será en la Tesorería Municipal o bien en la cuenta corriente de la Entidad Bancaria que a continuación se relaciona abierta a nombre del Ayuntamiento de Llucmajor: </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">(aquellas entidades que suscriban el convenio cuaderno 60) </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Los escritos recibidos por los conductos a que hace referencia el artículo 38 de la Ley de Régimen Jurídico de las Administraciones Públicas y del procedimiento administrativo común, que no venga debidamente reintegrados, serán admitidos provisionalmente, pero no podrán dárseles curso sin que se subsane la deficiencia, a cuyo fin se requerirá al interesado para que, en el plazo de diez días abone las cuotas correspondientes con el apercibimiento de que, transcurrido dicho plazo sin efectuarlo, se tendrán los escritos por no presentados y será archivada la solicitud.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las certificaciones o documentos que expida la Administración Municipal en virtud de oficio de Juzgados o Tribunales para toda clase de pleitos, no se entregarán ni remitirán sin que previamente se haya satisfecho la correspondiente cuota tributaria.</span></span></p> <p><strong>Artículo 9º.
