&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“(...)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7. Propuesta del conseller executiu del Departament d'Hisenda, Gestió Econòmica,&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Esports i Joventut, en relación con el encargo de gestión a FECOEV, SAU para la producción y ejecución de la Feria infantil Diverespai 2022/2023. Exp. 2022/00021424L&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Habiéndose presentado una propuesta, del siguiente tenor: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;“El día 27 de noviembre de 2022, el conseller executiu del Departament d'Hisenda, Gestió Econòmica, Esports i Joventut dispuso la incoación del expediente para la programación y ejecución total de la Feria Diverespai 2022/2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El importe a destinar a la programación y ejecución de la Feria Diverespai 2022/2023 asciende a la cantidad máxima de &lt;strong&gt;449.078,74 €&lt;/strong&gt; (cuatrocientos cuarenta y nueve mil setenta y ocho euros con setenta y cuatro céntimos), con cargo al aplicación presupuestaria 3370-2279900. Dicha cantidad se distribuirá entre los presupuestos de 2022 y 2023 de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.000,00 € a cargo de la partida presupuestaria 3370-2279900 del presupuesto del Consell Insular d'Eivissa para el año 2022.· &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;439.078,74 € a cargo de la partida presupuestaria 3370-2279900 del presupuesto del Consell Insular d'Eivissa para el año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa no cuenta con los medios propios, humanos y materiales, suficientes para llevar a cabo la programación y ejecución de la citada feria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consejo Ejecutivo del Consejo Insular de Eivissa, en sesión celebrada el día 13 de mayo de 2013, dictó una instrucción en relación con la aprobación del procedimiento de tramitación y ejecución de los encargos de gestión del Consell Insular de Eivissa en sus medios propios&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Además, el artículo 115 de la Ley 4/2022, de 28 de junio, de consejos insulares (BOIB núm. 88, de 7-07-2022), en referencia a los encargos de gestión, señala lo siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. En el marco de la legislación de régimen jurídico de las administraciones públicas, los consejos insulares y sus entes instrumentales pueden encargar la realización de actividades de carácter material o técnico de su competencia a otras administraciones públicas. Asimismo pueden aceptar los encargos de gestión que les propongan otros entes públicos de acuerdo con los siguientes apartados.&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. El encargo de gestión no puede comportar la atribución a los consejos insulares de facultades de resolución, pero éstos podrán llevar a cabo las actuaciones materiales y de gestión que sean inherentes al objeto del encargo, incluida la facultad de dictar actas de trámite que no sean susceptibles de recurso.&lt;/em&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. El encargo debe formalizarse mediante convenio, de conformidad con la legislación básica de régimen jurídico de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. La efectividad del encargo queda condicionada a la existencia de los medios materiales, personales y económicos necesarios para su ejercicio.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El encargo debe cumplir lo establecido en el Acuerdo de fiscalización limitada previa para la adaptación de los requisitos adicionales previstos en el acuerdo del Consejo de Ministros de 30 de mayo de 2008, modificado el 7 de julio de 2011, y el 20 de julio de 2018, respecto al ejercicio de la función interventora en régimen de requisitos básicos, adoptado por el Pleno del Consell Insular d'Eivissa en sesión de fecha 29-11-2018, en relación a los expedientes de encargos de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que con fecha 2 de noviembre de 2022, expediente núm. 2/2022000006295, se hizo el preceptivo RC del ejercicio en curso y expediente núm. 2/2022000006296, RC a futuros del ejercicio 2023, que dota de crédito el encargo de gestión directa y eventual para llevar a cabo la organización y ejecución de la Feria Diverespai 2022/2023, que se celebrará en las fechas determinadas en la memoria técnica, es decir, entre los días 26 de diciembre de 2022 y 3 de enero de 2023, en el Recinto Ferial d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En fecha 3 de noviembre de 2022 se emitió memoria técnica donde se concretan tanto las características de los trabajos que deben encargarse, como la justificación, los plazos, el presupuesto, las formas de pago, la posibilidad de modificaciones y prórrogas, etc. (CSV: 14157771435311670322). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe técnico favorable, de fecha 7 de noviembre de 2022 sobre los criterios económicos y de eficacia que justifican que se encargue a Ferias, Congresos y Eventos d'Eivissa, SAU (FECOEV) llevar a cabo la prestación del servicio por a la producción técnica y ejecución de la citada feria, que prevé la posibilidad de que el medio propio contrate prestaciones parciales con terceros, que el importe de estas prestaciones no excede del 50% de la cuantía del encargo, con las excepciones previstas en el artículo 32.7 de la Ley 9/2017 de 8 de noviembre, de contratos del sector público. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, visto el informe jurídico favorable de fecha 7 de noviembre de 2022, con el visto bueno del secretario general de la corporación, en relación con el encargo de la gestión directa y eventual del Consell Insular de Eivissa a un medio propio personificado, (Ferias, Congresos y Eventos d'Eivissa, S.A.U. (FECOEV) para llevar a cabo la producción técnica y ejecución de la feria Diverespai 2022/2023 que se celebrará en el Recinto Ferial entre los días 26 de diciembre de 2022 y 3 de enero de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con el apartado tercero c del Decreto de Presidencia núm. 2019000484, de fecha 16 de julio, de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular d'Eivissa (BOIB núm. 98, de 17-07-2019; modificaciones en el BOIB núm. 175, de 31-12-2019, en el BOIB nº 101, de 4-06-2020 y en el BOIB nº 153 de 05-09-2020), por razón del importe, corresponde al Consejo Ejecutivo la aprobación de este encargo de la gestión a un medio propio personificado. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto, que este encargo de gestión a un medio propio personificado (Ferias, Congresos y Eventos d'Eivissa SAU, (FECOEV) por la producción técnica y ejecución de la feria Diverespai 2022/2023 que se celebrará en el Recinto Ferial entre los días 26 de diciembre de 2022 y 3 de enero de 2023 se realizará de conformidad con la legislación vigente que sea de aplicación, y en todo caso, observando las prescripciones contenidas en los artículos, 11 y 86 Ley 40/2015, de 1 de octubre, del Régimen Jurídico del Sector Público y en los artículos 6 y 32 de la Ley 9/2017, de 8 de noviembre, de contratos del Sector Público. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Concretamente, en relación con el artículo 32.7 b) de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, y conociendo los recursos con los que cuenta FECOEV y la posible necesidad de recurrir a la contratación de terceros por la ejecución parcial del encargo, se ha previsto que en caso, estos contratos no superarán en ningún momento el 50% de la cuantía del encargo, puesto que de los 449.078,74 € que se estima como importe total del encargo, si fuera necesario se llegaría a contratar con terceros un máximo de 217.448,32 €. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;Visto el informe propuesta favorable emitido por el gerente del Campamento de sa Cala des Jondal en fecha 8 de noviembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;En virtud de todo lo anterior y de lo que establece el artículo 72.d) del reglamento orgánico del Consejo Insular de Eivissa (BOIB núm. 136 de 18-09-2010, corrección en BOIB núm. 148, de 14-10 - 2010, modificación en BOIB nº 48, de 16-04-2016), el consejero que suscribe, en virtud de las atribuciones que tengo conferidas por los Decretos de Presidencia núm. 2019000471, de 10 de julio de 2019, de estructura del Gobierno del Consejo Insular d'Eivissa y creación de departamentos (BOIB núm. 95, de 11-07-2019; modificaciones en el BOIB núm. 175, de 31-12-2019 , en el BOIB nº 153 de 05-09-2020 y en el BOIB nº 119, de 2-09-2021), núm. 2019000472, de nombramiento de las personas miembros del Consejo Ejecutivo de 10 de julio de 2019 (BOIB núm. 95 de 11-07-2019), núm. 2019000484, de 16 de julio de 2019 de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular de Eivissa (BOIB núm. 98, de 17-07-2019; modificaciones en el BOIB núm. 175, de 31-12-2019, en el BOIB nº 101, de 4-06-2020 y en el BOIB nº 153 de 05-09-2020), y con carácter previo a la emisión del correspondiente informe de fiscalización previo, preceptivo y necesario, de la Intervención de la corporación, y para el caso de que dicho informe sea favorable y de conformidad, elevo al Consejo Ejecutivo del Consell Insular d'Eivissa, si lo estima adecuado, la siguiente&lt;/span&gt; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PROPUESTA DE ACUERDO:&lt;/strong&gt; &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero. APROBAR &lt;/strong&gt;el encargo de la gestión directa y eventual del Consell Insular d'Eivissa a un medio propio personificado (Ferias, Congresos y Eventos de Eivissa SAU, FECOEV), con NIF A07837602, para la prestación del servicio para la producción técnica y ejecución de la Feria Diverespai 2022/2023 que se celebrará en el Recinto Ferial entre los días 26 de diciembre de 2022 y 3 de enero de 2023 en los términos establecidos en la Memoria técnica que obra en el expediente (CSV: 141577714353116702 se publica como ANEXO. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo.- APROBAR &lt;/strong&gt;la autorización y compromiso de gasto de la cantidad de este encargo de gestión, con un importe máximo de 449.078,74 € (cuatrocientos cuarenta y nueve mil setenta y ocho euros con setenta y cuatro céntimos), tal y como se detalla en el punto 5 de la Memoria técnica, con la siguiente distribución: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.000,00 €&lt;/strong&gt; a cargo de la partida presupuestaria &lt;strong&gt;3370-2279900 &lt;/strong&gt;del presupuesto del Consell Insular d'Eivissa para el&lt;strong&gt; año 2022&lt;/strong&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;439.078,74 € &lt;/strong&gt;a cargo de la partida presupuestaria &lt;strong&gt;3370-2279900 &lt;/strong&gt;del presupuesto del Consell Insular d'Eivissa para el &lt;strong&gt;año 2023.&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.- NOMBRAR &lt;/strong&gt;a Francesc Xavier Costa Garcia, gerent del Campament de sa Cala des Jondal, como encargado de verificar la ejecución del encargo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto: NOTIFICAR &lt;/strong&gt;el acuerdo que se adopte a la entidad interesada: FECOEV, S.A.U. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinto.- PUBLICAR &lt;/strong&gt;este acuerdo y la Memoria técnica del encargo en la Plataforma de Contratación y en el Boletín Oficial de las Islas Baleares, de conformidad al artículo 32.6 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, añadiendo esta publicidad a la establecida para el perfil del contratante de la Plataforma de contratación del sector público, de acuerdo con los artículos 63.6 y 347 de la citada Ley 9/2017 y en la prevista en el artículo 11.3. a de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público y en el artículo 8.1.b de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;strong&gt;Objeto&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Departament d'Hisenda, Gestió Econòmica, Esports i Joventut del Consell Insular d'Eivissa, dentro del marco de sus competencias y como parte de su programación de fomento de ocio y ocio para niños durante el año 2022, tiene previsto llevar a cabo durante las fiestas de Navidad la realización de la Feria Diverespai 2022/2023 , con el siguiente calendario:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Día de inicio: 26 de diciembre de 2022, 10:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Día de finalización: 3 de enero de 2023, 20:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La feria se desarrollará durante dos sesiones diarias de mañana y de tarde con el siguiente horario:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Sesión de mañana: de 10:30 horas hasta 14.00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Sesión de tarde: de 17:00 horas hasta 20:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No habrá sesión de tarde el día 31 de diciembre de 2022 ni sesión de mañana el día 1 de enero de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En total habrá 8 sesiones de mañana y 8 sesiones de tarde.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El lugar de desarrollo de la feria será el edificio del recinto de Ferias, Congresos y Eventos de Eivissa y una carpa anexa montada por el evento. La dirección es ctra. Ibiza - San Antonio, km 1. 07800 Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para la programación y ejecución de Diverespai 2022/2023, Ferias, Congresos y Eventos d'Eivissa S.A.U. (FECOEV) deberá atenerse a lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Llevar a cabo las actuaciones que son objeto del encargo de gestión para la programación y ejecución de la Feria Diverespai 2022/2023: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Aportar personal y equipos de iluminación, personal y equipos de sonido, personal de carga y descarga de material, transporte de personal y material, producción técnica de las actuaciones, adecuar espacios para talleres, aportar los requerimientos técnicos para el montaje de los hinchables, las infraestructuras necesarias para cumplir con rigor el Plan de autoprotección correspondiente, las infraestructuras necesarias para cubrir las necesidades de los monitores y demás personal técnico y, en definitiva, cualquier equipamiento y/o requerimiento solicitado por personal encargado de desarrollar las actividades así como las que vienen definidas en el presupuesto. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Contratar i firmar los contratos con las empresas correspondientes según el calendario de desarrollo de la feria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. Los pagos a las empresas correspondientes se realizará en los términos y plazos establecidos en el contrato firmado entre FECOEV y las empresas en cuestión. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. La realización de toda la publicidad en prensa escrita, prensa digital, radio, impresión y distribución de toda la cartelería y cualquier otro material publicitario. El escudo del Consell Insular de Eivissa deberá estar presiente de forma destacada en todos los soportes publicitarios que se editen para promocionar la feria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dicha publicidad será en lengua catalana. Antes de imprimir, editar o publicar cualquier material publicitario debe contar con el visto bueno del Departamento de Hacienda, Gestión Económica, Deportes y Juventud y debe haber sido revisado por el Servicio de Normalización Lingüística de este departamento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda prohibida cualquier forma de promoción o publicidad tanto en la cartelería como en el recinto que incite a las personas menores de edad, de forma directa a indirecta, al consumo de bebidas alcohólicas o de tabaco. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. Implantación del plan de emergencia con todas las necesidades que comporte:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Vigilancia&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Ambulancias&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Limpieza&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Servicio de enfermería&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Control aforo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Control del acceso del público a las instalaciones los días de los espectáculos &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e. Adaptar en la medida de lo posible los diferentes recintos a persones con movilidad reducida. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f. Hacerse cargo del control estricto del aforo que nunca podrá superar, a la vez, los 1.000 usuarios (los adultos y acompañantes no cuentan). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g. Realizar todos los trámites administrativos y técnicos para conseguir la correspondiente autorización administrativa, en su caso, para el desarrollo de la feria en cuestión. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;h. Contratar y mantener en vigor durante la ejecución de la actividad los seguros que correspondan. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Cumplir lo establecido, a la Ley 9/2017, de 8 de noviembre, de contratos del sector público, para la cual se transponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014. Igualmente, para la realización de la feria, estará obligada al cumplimiento de la Ley 7/2014, de 26 de noviembre, de régimen jurídico de instalación, acceso y ejercicio de actividades de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Cumplir lo que dispone la Ley 31/1995 de 8 de noviembre, de prevención de riesgos laborales, todo su desarrollo normativo y disposiciones relacionadas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Poner a disposición de las personas usuarias, en la recepción del recinto, hojas de reclamación y quejas. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. FECOEV, SAU, a la hora de contratar personal, monitores, empresas suministradoras de hinchables y otras atracciones, talleres, etc., cumplirá escrupulosamente en las especificaciones de carácter técnico que se señalan en el apartado 8 de este documento&lt;span style="color:black"&gt;. &lt;/span&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa se hará cargo únicamente de la venta de entradas. El precio de las entradas viene fijado por la ordenanza reguladora del precio público de Diverespai, publicada en el BOIB núm. 184, de 8 de diciembre de 2011, modificada en el BOIB núm. 5, de 10 de enero de 2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa quedará excluido de cualquier riesgo empresarial derivado de las acciones previstas al objeto de este encargo. FECOEV, SAU inhibirá al Consell Insular de Eivissa de toda responsabilidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;strong&gt;Medio propio destinatario del encargo&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ferias, Congresos y Eventos d'Eivissa, SAU (FECOEV) es una sociedad mercantil de capital íntegramente público del Consejo Insular de Eivissa (que ha suscrito el 100% de capital), creada al amparo del artículo 103 de Real Decreto Legislativo 781/1986, de 18 de abril, por que se aprueba el texto refundido de las Disposiciones Legales vigentes en materia de régimen local y artículos 89 y ss. del Reglamento de Servicios de las Corporaciones Locales, que adopta la forma de sociedad anónima (el artículo 1 de sus Estatutos vigentes publicados en el BOIB núm. 76, de 21-05-2015, corrección de errores en BOIB núm. 174, de 26 -11-2015;modificación en BOIB nº 30, de 08-03-2018), que tiene entre su objeto social, la realización de las actividades precisas para planificar, proyectar, coordinar y gestionar con las administraciones públicas las actividades inherentes a un centro integrado de servicios relacionados con la promoción económica, social y cultural mediante la gestión integral de eventos relacionados con la promoción económica, turística, social, deportiva y cultural, así como al uso, gestión, explotación y administración de las instalaciones y de los bienes del recinto del edificio llamado Recinto Ferial de Eivissa y del Hipódromo de Sant Rafel, así como otros que por acuerdo del Pleno del Consell Insular d'Eivissa se puedan adscribir en la sociedad, en alguna de las formas de gestión directa o indirecta previstas en la normativa (art. 2.2, letras a y c, de sus Estatutos). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso contrario, la empresa pública FECOEV a tenor de lo establecido en el apartado tercero del artículo 1 bis de sus Estatutos, &lt;strong&gt;tendrá la condición de medio propio del Consell Insular d'Eivissa&lt;/strong&gt; siempre que se cumplan las requisitos legales para poder ser considerada como parte integrante del sector público. Más concretamente, tendrá la consideración de medio propio personalizado, respecto del Consell Insular si cumple lo establecido en el artículo 86 de la Ley 40/2015, de 1 de octubre, del régimen jurídico del sector público, y en el artículo 32 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, por la que se transponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el mismo sentido, de conformidad con la instrucción de Secretaría del Consell Insular, aprobada por el Consell Executiu en fecha 13/05/2013, el Consell Insular puede encargar a FECOEV directamente la realización de actividades de su competencia por razones de eficacia. Asimismo, el presente encargo cumple lo establecido en el Acuerdo de fiscalización limitada previa para la adaptación de los requisitos adicionales previstos en el Acuerdo del Consejo de Ministros de 30 de mayo de 2008, modificado el 7 de julio de 2011, y el 20 de julio de 2018, respecto al ejercicio de la función interventora en régimen de requisitos básicos, adoptado por el Pleno del Consell Insular de Eivissa en sesión de fecha 29/11/2018, en relación a los expedientes de encargos de gestión. Además, FECOEV es la entidad que ha realizado en otras ocasiones los trabajos de programación y ejecución de la Feria Diverespai, junto con el Consell Insular, por lo que, su personal es conocedor de las acciones necesarias para llevarlo a término.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que la citada empresa pública dispone de medios para poder ejecutar estas acciones de programación y ejecución de Diverespai 2022/2023 y, teniendo en cuenta que el Departamento de Hacienda, Gestión Económica, Deportes y Juventud no cuenta con los medios técnicos y humanos idóneos para llevarlo a cabo, así como del espacio para la realización de la feria objeto del encargo, es por eso que el Consell Insular d'Eivissa, mediante el Departamento de Hacienda, Gestión Económica, Deportes y Joventut ha propuesto que el mencionado Consell Insular d'Eivissa encargue a FECOEV la realización de las acciones previstas y necesarias para llevar a cabo la programación y ejecución de la Feria Diverespai 2022/2023. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. &lt;strong&gt;Justificación y necesidad&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;De conformidad con el artículo 70.9 y 16 de la EAIB, el Consell Insular d'Eivissa tiene competencias propias en materia de deporte, ocio, juventud, diseño y aplicación de políticas, planes y programas destinados a la juventud, que ejerce desde que fue transferida la competencia mediante Ley 21/2006, de 15 de diciembre, de atribución de competencias a los consejos de Menorca y de Eivissa y Formentera en materia de juventud y ocio, que establece la transferencia a los consejos de Menorca y de Eivissa y Formentera de las funciones reglamentaria, ejecutiva y de gestión en materia de juventud y ocio (BOIB núm. 184, de 23-12-2006).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;La mencionada Ley 21/2006, de 15 de diciembre, de atribución de competencias a los consejos insulares de Menorca y de Eivissa y Formentera en materia de juventud y ocio, en su artículo 4, establece que el Consejo Insular de Eivissa y Formentera (desde el año 2007, Consell Insular d'Eivissa) ejercerá, dentro de su ámbito territorial y con sujeción al ordenamiento sectorial vigente, las funciones relativas a las actividades de ocio con niños y jóvenes, entre las que se encuentran : «b) Programación y ejecución de actividades de tiempo libre infantil y juvenil».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;El apartado tercero 8, letra g, del Decreto de Presidencia núm. 2020000768, de modificación del Decreto de Presidencia núm. 2019000471, de fecha 10-7-2019, de estructura del gobierno del Consell Insular de Eivissa y creación de departamentos, y del Decreto de Presidencia núm. 2019000484, de fecha 16-7-2019, de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular de Eivissa (BOIB núm. 153, de 5-9-2020, modificación en el BOIB núm. 119, de 2-9- 2021), establece que el Departamento de Hacienda, Gestión Económica, Deportes y Juventud comprende, entre otros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;g) La actividad competencial propia del Consell Insular en relación con las materias de fomento y promoción de las actividades deportivas, actividades recreativas, de ocio y tiempo libre, juventud y equipamientos juveniles y ordenación de estas actividades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;i) Este Departamento también gestionará los servicios propios de su ámbito de actuación prestados en los distintos centros propiedad del Consell Insular.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por eso, es voluntad del Consell Insular d'Eivissa, a través del departamento mencionado, fomentar todas aquellas iniciativas que en la isla supongan una promoción de actividades de ocio y tiempo libre, dirigidas a niños de la isla, y que favorezcan la promoción del ocio y el tiempo libre en sus diversos ámbitos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Feria infantil Diverespai es un espacio de ocio que se desarrolla durante las vacaciones escolares de Navidad. Es un lugar de socialización para los más pequeños, donde las atracciones y actividades de tiempo libre y educativas se interrelacionan para conseguir un proceso de educación no formal dirigido a niños y niñas d'Eivissa. Se organiza desde hace más de 20 años, constituyendo un evento ya tradicional para los niños y niñas de la isla durante las vacaciones navideñas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los dos últimos años, debido al control de aforo y las exigencias impuestas por las autoridades sanitarias debido a la pandemia de la COVID-19, no se pudo celebrar y, por eso, el Departamento de Hacienda, Gestión Económica, Deportes y Juventud, una vez recuperada la normalidad, dentro del marco de sus competencias y como parte de la programación de fomento de ocio y tiempo libre para niños durante el año 2022, tiene previsto llevar a cabo la feria Diverespai 2022/2023. Ésta se desarrollará entre los días 26 de diciembre de 2022 y 3 de enero de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Consell Insular d'Eivissa no cuenta con los medios propios suficientes para llevar a cabo la programación y ejecución de la mencionada feria. No obstante el artículo 11.1. de la Ley 40/2015 de 1 de octubre de régimen jurídico del sector público establece que &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;la realización de actividades de carácter material o técnico de la competencia de los órganos administrativos o de las entidades de derecho público se puede encargar a otros órganos u comunidades de derecho público de la propia Administración o de otra, siempre que entre sus competencias estén estas actividades, por razones de eficacia o cuando no se posean los medios técnicos idóneos para ejercerlas (...). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otra parte, FECOEV, SAU es una sociedad mercantil de capital público del Consell Insular d'Eivissa, de acuerdo con el artículo 1 bis de sus Estatutos que “tendrá la condición de medio propio del Consell Insular d'Eivissa”. ..)”. Asimismo, el apartado 2 de este artículo establece que “El Consell Insular d'Eivissa podrá encargar a la sociedad la ejecución de cualquier actuación material relacionada con el objeto social mencionado en el artículo 2 de los Estatutos sin que, por otro lado, la sociedad pueda participar en ninguna licitación de contratación pública convocada por la administración insular o sus entes instrumentales&lt;em&gt;. (...)”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 2 de los mencionados Estatutos dispone que &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Constituye el objeto de la sociedad:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. &lt;em&gt;La realización de las actividades precisas para planificar, proyectar, coordinar y gestionar con las administraciones públicas, empresas y particulares las siguientes áreas de trabajo:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;Coordinación, impulso y dirección técnica y facultativa de los procesos de reconversión y ordenación de actividades para impulsar la inversión y fomentar la actividad económica pública y privada.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;Coordinación, orientación y evaluación de programas y servicios de ordenación y de reconversión turística.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;em&gt;Las actividades inherentes a un centre integrado de servicios relacionados con la promoción económica, social y cultural de la isla d'Eivissa mediante:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;em&gt;La gestión integral de eventos relacionados con la promoción económica, turística, social, deportiva y cultural, tanto de carácter público como privado.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;em&gt;El servicio de mantenimiento de instalaciones y ajardinamiento público propiedad del Consell Insular d'Eivissa, siempre que éste lo requiera por la vía de encomienda de gestión o acuerdo de Pleno.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;em&gt;El uso, la gestión, la explotación y la administración de las instalaciones y de los bienes del recinto del edificio llamado Recinto Ferial d'Eivissa y del Hipódromo de Sant Rafel, así como otras que por acuerdo de Pleno del Consell Insular d'Eivissa se puedan adscribir a la sociedad, en alguna de las formas de gestión directa o indirecta previstas en la normativa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Asimismo, FECOEV, SAU dispone de las instalaciones necesarias y adecuadas para acoger la Feria infantil Diverespai 2022/2023, con una estimación de participación de niños superior a los 10.500 usuarios durante los 9 días de duración de dicha feria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. &lt;strong&gt;Plazo de duración &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La duración de las actuaciones a encargar será desde el día 26 de diciembre de 2022 hasta el 3 de enero de 2023, según el calendario establecido en el objeto de esta memoria técnica. No obstante, este encargo desarrollará sus efectos desde el momento de la notificación a la entidad encargada, lo que supondrá el orden de inicio de las actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La vigencia será hasta el día que hayan quedado justificados todos los gastos ante el órgano gestor que realizará el seguimiento del encargo que, en cualquier caso, no podrá superar la fecha de &lt;strong&gt;28 de febrero de 2023&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Consell Insular d'Eivissa destinará a la programación y ejecución de la Feria Diverespai 2022/2023 que tendrá lugar durante las fiestas de Navidad, la cantidad de 449.078,74 euros por el encargo de gestión directa y eventual a FECOEV, en los mismos términos que se han detallado antes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta cantidad irá con cargo a la aplicación presupuestaria 3370-2279900 y tendrá el carácter de aportación máxima a los gastos que realice, en ejecución de las acciones objeto de este encargo. No obstante, dado que el Diverespai se inicia el día 26 de diciembre de 2022 y finaliza el día 3 de enero de 2023, dicha cantidad se distribuirá entre los presupuestos de 2022 y 2023 de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En relación con el artículo 32.7 b) de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, y conociendo los recursos con los que cuenta FECOEV y la posible necesidad de recurrir a la contratación de terceros por el ejecución parcial del encargo, se ha previsto que en caso de tener que contratar con terceros cualquier prestación parcial, éstas no superarán en ningún momento el 50% de la cuantía del encargo. Consta en el presupuesto que no está previsto subcontratar con terceros más del 50% del coste total del encargo. En este sentido, la columna “5% PROVEEDORES EXTERNOS” corresponde al margen que cobra FECOEV en concepto de “Subcontractación de servicios externos”, cuando la subcontratación asciende a más de 100.000,00 €, tal y como consta en el Decreto de Presidencia núm. 2020000268, de fecha 20 de marzo de 2020, por el que se aprueban las tarifas la entidad mercantil Ferias, Congresos y Eventos de Eivissa, SAU (FECOEV), y por tanto, no se contabiliza como subcontratación externa.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. &lt;strong&gt;Forma de pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El abono de las cantidades relativas a los gastos objeto de este encargo se realizará a medida que se vayan presentando las correspondientes facturas justificativas de los gastos realizados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstante, el Consell Insular podrá requerir en cualquier momento la documentación que estime oportuna justificativa de los gastos facturados en caso de que no quede suficientemente detallado en la factura presentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cualquier caso, deberá estar en el plazo máximo de justificación previsto en el apartado 4 de este encargo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta modificación supondrá la tramitación del correspondiente expediente administrativo que requerirá de los mismos actos que el expediente inicial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cuanto a la posibilidad de prórroga del encargo deberá quedar acreditado que es necesaria y justificada y podrá realizarse en los mismos términos establecidos para la modificación de la misma, siempre y cuando se ejercite antes de finalizar el encargo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.1. CONSIDERACIONES GENERALES &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La programación, en general, debe contener un conjunto de actividades, atracciones y talleres de ocio que tengan en cuenta las diferentes edades de los participantes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se divide la feria en dos espacios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El conjunto de talleres y actividades tendrá que ser de entre 40 y 45. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;8.&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. PERSONAL, FUNCIONES Y TITULACIONES &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Diverespai debe disponer durante el transcurso de toda la feria de, como mínimo, el siguiente personal:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;strong&gt;1 Director&lt;/strong&gt;: Siempre presiente y que debe tener una experiencia mínima como organizador de, como mínimo, 3 eventos de similares características en una feria infantil.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sus funciones son dirigir y coordinar el equipo de monitores, distribuir adecuadamente los espacios y las atracciones dentro del recinto, atender las reclamaciones de los usuarios y supervisar que las actividades se desarrollen con las medidas de seguridad adecuadas para garantizar la integridad de los participantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debe estar en posesión de alguna de las siguientes titulaciones: · &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Director/a de actividades de tiempo libre infantil o juvenil.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación sociocultural.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación de actividades físicas y deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Licenciatura en educación física o en ciencias de la actividad física y el deporte, o equivalente. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;strong&gt;1 Coordinador de actividades&lt;/strong&gt;: Encargado de mantener la coordinación y la comunicación entre las empresas o entidades participantes, el Consell Insular d'Eivissa y FECOEV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debe estar en posesión de alguna de las siguientes titulaciones: · &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Director/a de actividades de tiempo libre infantil o juvenil.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación sociocultural.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación de actividades físicas y deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Licenciatura en educación física o en ciencias de la actividad física y el deporte, o equivalente. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;strong&gt;1 Coordinador de la zona de espectáculos (Can Nadal)&lt;/strong&gt;: Encargado de programar, coordinar y supervisar las actuaciones y espectáculos que se desarrollan a diario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debe estar en posesión de alguna de las siguientes titulaciones: &amp;nbsp;· &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Director/a de actividades de tiempo libre infantil o juvenil.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación sociocultural.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Técnico/a superior en animación de actividades físicas y deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Licenciatura en educación física o en ciencias de la actividad física i el deporte, o equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Diploma de monitor/a de actividades de tiempo libre infantil y juvenil. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· &lt;strong&gt;Monitores suficientes&lt;/strong&gt; para atender todas las atracciones y talleres y que en cualquier caso sumaran &lt;strong&gt;un mínimo de 40&lt;/strong&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Debe estar en posesión de alguna de las siguientes titulaciones: · &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Diploma de monitor/a de actividades de tiempo libre infantil y juvenil.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para actividades deportivas en general, como mínimo, el título de técnico/a superior en animación de actividades físicas y deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para modalidades deportivas específicas, los títulos federativos correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente, el director/a y coordinadores/as, así como todos los monitores/as que trabajen en el Diverespai tendrán que acreditar un nivel mínimo de catalán de B2 o equivalente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;8.&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. TALLERES&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Al menos debe haber 11 talleres. Los talleres se desarrollarán en lengua catalana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Obligatoriamente debe haber los siguientes: · &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de maquillare (“pinta-caras”).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de decoración del árbol de Navidad.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de decoración de pesebres navideños.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de manualidades de temática navideña.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de creación de imanes de frigorífico.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de elaboración de galletas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de cocina y pastelería.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de Fisher Tips.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de chapas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Taller de cartas a los Reyes Magos. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Todos los talleres deben tener una decoración personalizada y material para dar servicio como mínimo a 5.000 usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Si se prevé que un taller tendrá mucha participación se duplicarán de forma que haya más de un espacio disponible. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;8.&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. ATRACCIONS I ACTIVITATS &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Las atracciones y actividades deben dar respuesta a la demanda, edades (Entre 1 y 17 años) y características de los usuarios potenciales, pero como mínimo debe haber: · &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1 Caballitos, cochecitos o similar (atracción mecánica).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1 bebeteca infantil que cubra la demanda de los niños y niñas de entre 1 y 3 años.· &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5 atracciones hinchables de como mínimo 100 m cuadrados.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2 atracciones hinchables de como mínimo 70 m cuadrados.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4 atracciones hinchables de como mínimo 40 m cuadrados.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1 atracción hinchable de como mínimo 25 m cuadrados.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2 atracciones hinchables en reserva por si se produce alguna avería.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1 actividad con 2 camas elásticas como mínimo.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2 ludotecas infantiles. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Todas las atracciones, hinchables, toboganes, etc., deben cumplir los estándares de seguridad exigidos por la Comunidad Económica Europea, y por tanto deben tener el certificado de homologación correspondiente y deben disponer del certificado inspección periódica de atracciones inflables en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Los motores de las atracciones hinchables deben estar situados en zonas de poco tráfico y protegidos por vallas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· En cada una de las atracciones habrá un cartel informativo en catalán referente a la edad mínima de los usuarios que pueden participar, altura mínima, capacidad máxima de la atracción y cualquier otra información que crea conveniente el adjudicatario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· La memoria técnica debe contar con una detallada descripción de las diferentes atracciones con los tamaños, detalles técnicos, etc., acompañadas de fotografías de las mismas. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;8.&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. ACTUACIONES &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Se programará, como mínimo, cuatro actuaciones diarias (2 de mañana y 2 de tarde) en una zona habilitada de la Zona B (Can Nadal). Las actuaciones deben ser variadas (musicales, danza, circo, cuentacuentos, etc.) y dirigidas a las diferentes franjas de edad y, como mínimo, un 50% de las mismas debe ser en lengua catalana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Tanto en los carteles como en los dípticos anunciadores de las referidas actuaciones debe figurar el escudo del Consell de forma destacada y separado del resto de patrocinadores privados, si los hubiere. Los carteles tendrán que ser en catalán y antes de la impresión definitiva se debe obtener el visto bueno del Departament d'Hisenda, Gestió Econòmica, Esports i Joventut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En los distintos talleres y espectáculos pueden participar otras asociaciones, clubes, federaciones, etc. La participación de las mismas y en qué condiciones debe ir reflejada en la memoria técnica.. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.6. CONTENIDOS ESPECÍFICOS. ZONA B. CAN NADAL &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Can Nadal consiste en un espacio con destacada decoración navideña, donde se ofrecen actuaciones, comparsas, juegos y actividades juveniles (scape rooms, realidad virtual, etc.), espectáculos de danza, música, magia, etc., relacionados con los personajes típicos de las fiestas de Navidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tiene que haber un espacio con escenario, sillas y mesas para las actuaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En este espacio se desarrollarán la mayor parte de los conciertos y espectáculos. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. &lt;strong&gt;Decoración&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como mínimo debe haber lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· 2 pancartas verticales, con una medida mínima de 0,75 x 10 m con el lema “DIVERESPAI” situadas en la fachada exterior, mirando a la carretera de la segunda circunvalación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· 2 pancartas para situar en los puentes de la carretera de circunvalación de la ciudad d'Eivissa con una medida mínima de 5 x 1,5 m, con el lema “DIVERESPAI. FECHAS, LUGAR Y ESCUDO DEL CONSELL”. Para colocar las citadas pancartas se debe solicitar el permiso pertinente en el departamento de carreteras del Consell Insular d'Eivissa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Al ser Navidad, debe haber una destacada decoración navideña en todos los talleres, recepción, espacios deportivos, etc., sobre todo en la zona B (Can Nadal). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. &lt;strong&gt;Control e incidencias&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La empresa o entidad adjudicataria tendrá que llevar un libro de control que estará a disposición del responsable nombrado por el Consell Insular de Eivissa, y donde se reflejarán detalladamente las entradas vendidas y las incidencias que se puedan producir. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. &lt;strong&gt;Publicidad y patrocinadores&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Se imprimirán la cantidad mínima de 200 carteles en color que deben ser repartidos por total la isla de Eivissa. el motivo del cartel será el ganador del concurso que el Consell de Eivissa organizará a tal efecto entre todos los escolares de la isla. Las dimensiones del cartel serán de un mínimo de 30 x 45 cm. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Igualmente se imprimirán un mínimo de 7.000 dípticos de mano en color con la información general del Diverespai: días, horarios, actividades, actuaciones, etc. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· La publicidad tendrá que ser en catalán y antes de imprimir los carteles y dípticos tendrán que tener el visto bueno del Departament d'Hisenda, Gestió Econòmica, Esports i Joventut. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. &lt;strong&gt;Servicio de limpieza&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se prestará, como mínimo, el siguiente servicio de limpieza:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Previo a la inauguración (2 días) del Diverespai: 2 personas a jornada de 8 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Durante la celebración de la feria: mínimo una persona de 9:30 a 14:00 horas y de 16:00 a 21:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Previo&amp;nbsp; a cada sesión: 2 personas (de 8:00 a 10:30 y de 14:00 a 17:00).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· El día siguiente del cierre de la feria: 2 personas a jornada de 8 horas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. &lt;strong&gt;Servicio sanitario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se establecerá una enfermería de, como mínimo, 4 x 4 m, en lugar de que se considere más adecuado, dada, como mínimo, por un auxiliar de clínica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14. &lt;strong&gt;Bar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La explotación del bar irá a cargo de la empresa FECOEV, SAU. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15. &lt;strong&gt;Seguros&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como se indica en el punto 1.3. FECOEV, SAU se compromete a contratar los seguros que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Entre las diferentes pólizas deben haber, como mínimo, las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Póliza de seguro de asistencia y accidentes para los participantes y personal que cubra, como mínimo, los gastos de cuidados y traslados hasta 900,00 € por víctima y un capital mínimo de 3.000,00 € en caso de muerte y 6.000,00 € en caso de invalidez. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Póliza de responsabilidad civil para hacer frente a los daños personales y/o materiales que las actividades puedan ocasionar, con una cobertura mínima de 150.000,00 € por víctima y 600.000,00 € por siniestro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dichas pólizas deben mantenerse en vigor durante todo el tiempo de duración del Diverespai. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;16. &lt;strong&gt;Equipamiento, utillaje, material fungible&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· FECOEV, SAU aportará la totalidad de máquinas y utensilios para la realización de las diferentes actividades, espectáculos, talleres, así como todos los materiales y productos fungibles necesarios para el correcto desarrollo del contrato. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Una relación completa de estos equipos con expresión de su potencia, tensión de funcionamiento y demás características se entregará al representante del Consell d'Eivissa antes del comienzo de los trabajos del servicio, el cual podrá poner las objeciones que considere oportunas en cuanto a la capacidad para llevar a cabo el trabajo en cuestión. Las objeciones que se produzcan serán reparadas por la empresa adjudicataria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Serán rechazados aquellos productos y materiales con fecha de caducidad sobrepasada o aquellos para los que existan sospechas fundamentadas de toxicidad o cualquier otra circunstancia de riesgo potencial para las personas, mobiliario o elementos decorativos y/o de recubrimiento. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Los materiales se guardarán al final de cada jornada en el local designado, correctamente tapados y cerrados de forma que se evite el riesgo de derrame o concentración de olores. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· No se podrán utilizar sustancias químicas catalogadas como peligrosas para las personas o el medio ambiente. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· Los materiales no supondrán un riesgo ni para los trabajadores de la empresa adjudicataria, ni para los usuarios de los servicios, ni para las instalaciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· En caso de anomalías en las instalaciones debidas a la utilización o suministro de materiales o maquinaria que no reúnan las características anteriores, la empresa adjudicataria estará obligada a asumir el coste de la reparación. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;· En todo casa se garantizara el suministro permanente de todo el material necesario. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;17. &lt;strong&gt;Guarda-ropa&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se instalará una zona de guarda-ropa en el lugar que se considere más oportuno, para dar servicio, al menos, a 100 personas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;18. &lt;strong&gt;Director del encargo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como director de verificar la ejecución del encargo se propone el nombramiento del técnico del Departament d'Hisenda, Gestió Econòmica, Esports i Joventut Sr. Francesc Xavier Costa Garcia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;19. &lt;strong&gt;Régimen jurídico aplicable&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este encargo de gestión a un medio propio personificado (Ferias, Congresos y Eventos de Eivissa S.A.U. (FECOEV) para llevar a cabo la prestación del servicio de la producción y ejecución de la Feria Diverespai 2022/2023, que se celebrará entre los días 26 de diciembre de 2022 y 6 de enero de 2023 en el Recinto Ferial d'Eivissa, se realizará de conformidad con la legislación vigente que sea de aplicación, Y en todo caso, observando las prescripciones contenidas en los artículos, 11 y 86 Ley 40/ 2015, de 1 de octubre, del Régimen Jurídico del Sector Público y en los artículos 6 y 32 de la Ley 9/2017, de 8 de noviembre, de contratos del Sector Público. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con el artículo 11.2 de la Ley 40/2015, de 1 de octubre, del Régimen Jurídico del Sector Público, el órgano encomendado tiene la condición de encargado del tratamiento de los datos de carácter personal a los que pueda tener acceso en ejecución del encargo de gestión, de conformidad con lo establecido en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de derechos digitales, en el Reglamento (UE) 2016/679 del Parlamento y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que se refiere al tratamiento de datos personales ya la libre circulación de estos datos (DOUE 4.5.2016), y al resto de legislación vigente en materia de protección de datos personales, que le sea de aplicación.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
