    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con lo que dispone el artículo 5 del Reglamento 3/1995, de 7 de junio, de los Jueces de Paz, y en virtud de lo dispuesto mediante Decreto de Alcaldía de 15/11/22, se anuncia la convocatoria pública para la provisión del cargo de JUEZ/A DE PAZ SUSTITUTO/A de este municipio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los requisitos para optar a la elección de este cargo son los siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ser español, mayor de edad.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No estar incurso en ninguna causa de incapacidad o incompatibilidad tipificadas en la Ley Orgánica del Poder Judicial que le sean de aplicación.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Gozar del pleno ejercicio de los derechos civiles.&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Residir en el término municipal de Calvià.&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas interesadas que reúnan los mencionados requisitos, podrán presentar sus solicitudes en el Registro General del Ajuntament de Calvià durante el plazo de VEINTE (20) DÍAS hábiles contados a partir del siguiente al de la publicación de este anuncio en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; (BOIB).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El modelo de instancia que se adjunta como documento anexo estará a disposición de las personas interesadas en el tablón de anuncios de la sede electrónica de este Ayuntamiento (https://seuelectronica.calvia.com). Junto con su solicitud, las personas candidatas tendrán que adjuntar un &lt;em&gt;“currículum vitae” &lt;/em&gt;donde consignarán los detalles más significativos de su perfil personal, académico y profesional.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes se presentarán en el Registro de entrada de este Ayuntamiento o bien mediante el registro electrónico de acuerdo con el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de no presentarse solicitudes, el Pleno de la Corporación elegirá libremente, de acuerdo con lo que se prevé en el artículo 101.2 de la Ley Orgánica 6/1985, de 1 de julio, del Poder Judicial y el artículo 4 y 6 del Reglamento 3/1995, de 7 de junio, de los Jueces de Paz.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1&lt;strong&gt;. &lt;/strong&gt;Que he tenido conocimiento del anuncio publicado en el Boletín Oficial de les Illes Balears sobre la apertura del plazo de presentación de instancias para la elección del juez/a de paz sustituto/a de Calvià.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Que reúno los requisitos de capacidad establecidos en el Reglamento número 3/1995, de 7 de junio, de los Jueces de Paz, artículo 1.2 del Título I y artículo 13 del Título II.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Que cumplo todos los requisitos que prevé la LO 6/1985, de 1 de julio, del Poder Judicial, y en concreto los siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;a) Ser español.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Ser mayor de edad&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) No estar incurso en ninguna de las causas de incapacidad establecidas en el artículo 303 de la citada LO 6/1985 que dispone que están incapacitados para ingresar en la Carrera Judicial los disminuidos física o psíquicamente para la función judicial; los condenados por delitos dolosos mientras no hayan obtenido la rehabilitación; los procesados ​​o inculpados por delito doloso en tanto no sean absueltos o se dicte auto de sobreseimiento y aquellos que no se encuentren en el pleno ejercicio de sus derechos civiles.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Que no incurro en ninguna de las incompatibilidades y prohibiciones reguladas en los artículos 389 a 397 de la Ley Orgánica del Poder Judicial en lo que le sea aplicable:&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Con cualquier cargo de elección popular o designación política del Estado, Comunidades Autónomas, Provincias y demás entidades locales y organismos dependientes de cualquiera de ellos.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;b) Con las ocupaciones o cargos dotados o retribuidos por la Administración del Estado, las Cortes Generales, la Casa Real, Comunidades Autónomas, Provincias, Municipios y&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;cualquier entidad, organismo o empresa dependiente de unos y otros.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Con el ejercicio de la abogacía y de la procuraduría y con todo tipo de asesoramiento jurídico, sea o no retribuido.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) No podrán los/las jueces/as pertenecer a partidos políticos o sindicatos o tener empleo al servicio de los mismos. Tampoco podrán tomar parte en las elecciones legislativas o locales más que la de emitir su voto personal. Sin embargo ejercerán las funciones y cumplimentarán los deberes inherentes a sus cargos.&lt;/span&gt;&lt;/p&gt;
