    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#1d1b1d; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Plan de Utilización de los Espacios Portuarios del puerto de La Savina, de competencia estatal,&amp;nbsp; delimita la zona de servicio que incluye las superficies de tierra y agua necesarias para la ejecución de sus actividades, las destinadas a tareas complementarias y los espacios de reserva que garanticen la posibilidad de desarrollo de la actividad portuaria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;El citado Plan se aprobó mediante la ORDEN FOM 3152/2003, de 27 de octubre, y lleva implícita la declaración de utilidad pública a efectos expropiatorios de los bienes de propiedad privada incluidos en la zona de servicio del puerto. Así, contemplaba&amp;nbsp; la incorporación a la superficie terrestre, entre otras, de “&lt;em&gt;una parcela de 11.461 metros cuadrados de superficie, situada en la ribera interior del Estany Pudent y que pertenece a la zona de dominio ´público marítimo-terrestre&lt;/em&gt;”. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;Posteriormente, por Resolución de 14 de mayo de 2010, de la Presidencia de Puertos del Estado, se aprobó la modificación no sustancial del mencionado Plan, que no supone una alteración significativa de la delimitación interna en que se divide la zona de servicio del puerto de La Savina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;Dicha modificación supone la corrección o aclaración de las referencias existentes relativas a la condición de dominio público marítimo-terrestre de la mencionada parcela de 11.461 metros cuadrados de superficie. Esta parcela se encuentra afectada por la Sentencia de la Audiencia Nacional de 16 noviembre de 2001, confirmada por el Tribunal Supremo,&amp;nbsp; que la excluye del dominio público marítimo terrestre y que anula el deslinde en el tramo comprendido entre los hitos 1319 y 1320, aprobado por las Órdenes Ministeriales de 21 de noviembre de 1997 y 19 de diciembre de 1997. Por lo tanto, la ocupación de la citada parcela precisa de la expropiación a Salinera Española, SA, como propietaria de la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;La Autoridad Portuaria de Baleares, beneficiaria de la expropiación, ha formulado &amp;nbsp;relación de los bienes y derechos que, por el momento, considera de necesaria expropiación, sobre la cual esta Delegación del Gobierno, de acuerdo con los artículos 18 y 19 de la Ley de Expropiación Forzosa abre un periodo de información pública por un plazo de quince (15) días &lt;/span&gt;a partir de la última de las siguientes publicaciones:&amp;nbsp; BOE, BOIB, anuncio en el Diario de Ibiza y en el tablón de anuncios del Consell Insular de Formentera, al objeto de que&lt;span style="color:#1d1b1d"&gt; cualquier persona pueda aportar por escrito los datos oportunos para rectificar posibles errores de la relación publicada u oponerse por razones de fondo o de forma a la necesidad de ocupación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;Los escritos de alegaciones deberán presentarse por los interesados o sus representantes legales ante el Registro General de la Dirección Insular de la Administración General del Estado en Ibiza-Formentera, sita en el Paseo Marítimo Juan Carlos I, 11 (Casa del Mar - 2.ª planta), 07800, de Eivissa, o bien ser remitidos a la dirección indicada en los términos previstos por el artículo 16 de la Ley 39/2015 de Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#1d1b1d"&gt;El expediente puede ser consultado en las oficinas de la Autoridad Portuaria de Baleares en La Savina, sitas en calle de Calp, s/n.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
